Guiding Principles on Business and Human Rights:
Implementing UN “Protect, Respect and Remedy” Framework
問題意識
企業活動と人権の問題の深刻化の根本原因は ‘ガバナンス・ギャップ’の存在。すなわち多国籍企業などの経済的アクターがもたらす負の側面と、それを適切にコントロールできない国際社会側の能力のギャップ。それをできるだけ少なくし埋めていくことが課題。
I. The state duty to protect human rights (1-10) 人権を保護する国家の義務
II. The corporate responsibility to respect human rights (11-
24) 人権を尊重する企業の責任
III. Access to remedy (25-31)救済へのアクセス

企業は人権を尊重する(=侵害しない)責任を負う
企業の人権尊重を責任を果たすためには・・・
(1)人権尊重をもりこんだ基本方針(トップコミットメント)を表明する
(2)人権に関する影響を特定・予防・軽減・説明するための人権デュー・ディリジェンス をおこなう
①企業活動および関係性(value chainなど)の人権に対する影響の定期的評価の実施
②評価結果の組織への統合
③パフォーマンスの追跡評価
④外部へのコミュニケーション(報告)

責任あるビジネス・責任あるサプライチェーン
企業は自らのオペレーションにどのようにして人権の尊重を組み込むのか(人権リスクを特定しそれを防止し是正するのか)?How should business integrate
