ombudsmanisinitsfunctioningbythepowerofitsauthorityandininstigatingefficientprotectionofhumanrights.The causes of its popularity and general acceptance intheworldcouldbeasimplifiedandfreelegalproceduremakingcommunicationwith thecitizenseasierandalsoitsroleinlegitimizationanddemocratizationofpoliticalsystem,aswellasimprovementofqualityofpublicadministration.NationalombudsmaninSerbiahasthecharacteristicsofaclassicmodelofombudsman.Itisaformofnonlegalandexternal control of administration and protection of humanfreedomsandrights.BesidestheRepublicOmbudsmaninSerbiantherearealsotheProvincialOmbudsmanforVojvodinaandlocalOmbudsmans.Sofarthepracticehasshownthattheinstitutionofombudsmanhasbeenaccepted by the citizens, gaining good reputation and authoritythatisnecessaryforitsefficientfunctioning.Objectiveof this text is to research institutionalpreconditionsfordevelopmentofthefunctionofombudsmaninSerbia.Qualitativelyspeaking,thesepreconditionsshouldprovideforstrengtheningofombudsmanprerogativesandcreation thebackground for the ruleof lawanddemocracy,andinqualitativesenseitshouldexpandthenetworkoftheProtectorsofCitizens.KeyWords:ombudsman,protectionofhumanrights,controlofadministration,protectorofcitizens,Constitution,democracy,ruleoflaw,independentjurisdiction,divisionofpower,legislativeinitiative,politicalsystem
