The QSD organised a New QS Members Welcoming Party on March 8 to meet with those newly qualified members. The QSD council members took this opportunity to know the new members and introduce them the various QSD sub-committees.

The volunteer building inspection scheme was well received by callers and most of the worries and queries from the public were eased and tackled by our inspectors over the phone. Our volunteers also supplied callers with relevant information like the loan and grant schemes on building safety.

A forum on the “Mandatory Building Inspection Scheme and Mandatory Window Inspection Scheme” was held on March 12 to provide a briefing on the consultation documents and collect members’ views. A representative from the BSD Council attended the Bills Committee on Building (Amendment) Bill 2010 Meeting held on March 20 and expressed our views.

A new Supplement to the Code of Measuring Practice in regard to the stairhood measurement was issued on March 2. The Hong Kong Exchanges and Clearing Limited and Securities and Futures Commission will consult the public on the property valuation requirements for public listing purposes. The GPD Council has set up a panel to handle this matter.

A PDD and GPD Joint Fellowship Dinner was successfully held on March 18 with some 50 members participating to share the warm fellowship spirit. The PDD Council held two CPD events in March; one is on “Revitalizating Industrial Buildings” and the other is on “Adding Value through Design”.

The Home Affairs Department appointed Deloitte Consulting last year to carry out a study and to propose regulatory framework to facilitate professional property management services. The PFMD Council attended a discussion workshop on March 3 and subsequently provided our written comments. The Environmental Bureau of HKSAR published a consultation document on “A New Producer Responsibility Scheme for Waste Electrical and Electronic Equipment”. The PFMD Council will formulate a representative view to the Environmental Bureau by April 30.

The LSD successfully held a half-day conference on Spatial Data Infrastructure (SDI) in Hong Kong on March 18. The conference has fostered collaboration in the industry of geoinformation and drove the development of SDI. In addition, a delegation team from the Geomatic and Land Surveying Division of the Institute of Surveyors, Malaysia visited HKIS on 18 March. There were very good exchanges of ideas between the parties.

The YSG members participated in the Hong Kong Open Indoor Rowing Championships & Charity Rowathon held on Mach 7 and got 26th out of 40 teams. The YSG was also invited to deliver a speech to foundation students from Mainland China studying in City University of Hong Kong. The topic was about general practice surveying and students found it very interesting.

工料測量組於三月八日舉行會員近新派對,大家藉此機會交流認識。

學會的義務樓宇檢查計劃受到市民歡迎,義工透過電話解決了大多來電者的查詢,並向其提供了樓宇安全貸款及資助計劃等資料。強制樓宇及窗戶檢驗計劃論壇於三月十二日舉行,介紹諮詢文件及收集會員意見。建築測量組理事會一位代表於三月二十日參加《2010年建築物(修訂)條例草案》會議,表達學會意見。

香港交易所及證監會將就上市物業估價要求諮詢公眾。產業測量組已成立小組研究有關事宜。針對梯屋的量度,新《量度作業守則補編》於三月二日發出。

規劃及發展組和產業測量組聯合資深專業會員晚宴於三月十八日舉行,出席人數達50人。規劃及發展組三月舉行了兩個CPD活動,計為《活化工廈》及《透過設計增值》。

民政事務處去年委托德勤進行一項研究,就專業物業管理服務建議法規框架;物業設施管理組於三月三日參加一個工作坊,稍後並提出書面意見。環境局公布《廢電器電子產品生產者責任計劃》諮詢文件,組別會於四月三十日前提交代表意見。

土地測量組三月十八日舉行空間資料基建(SDI)半天會議,有助推進地理信息業的合作及SDI的發展。馬來西亞測量師學會地理資訊及土地測量組代表團於三月十八日到訪學會,雙方作了有意義的交流。

青年組會員於三月七日參加了香港公開室內賽艇錦標賽暨慈善接力賽,40隊中取得第26名。該組亦獲城大邀請,就產業測量課題向內地基礎級學生致辭,學生反應理想。

The Land (Compulsory Sale for Redevelopment)

(Specification of Lower Percentage) Notice 2010 takes

effect on 1 April 2010. This Notice lowers the threshold

of applying to the Lands Tribunal for a compulsory sales

order from 90% to 80% for the following classes land lots:

a. a lot with units that each accounts for more than

10% of the undivided shares in the lot;

b. a lot with all buildings aged 50 years or above; and

c. a lot that is not located within an industrial zone

and with all the buildings on its premises being

industrial buildings aged 30 years or above.

It is not my intention to discuss the pros and cons of the

Notice here. Those of you who have followed this event

closely would have formed your own opinion. From day

one, our General Practice Division council members, under

the leadership of our former GPD chairman Dr Lawrence

Poon, have debated and analyzed the implications of the

Notice and have continuously advised the government,

not simply from a professional and technical perspective,

but also from the point of view of the general public. We

believe we have advised the government in a socially

responsible manner. However, our work will not stop

here. While our members may be able to comprehend the

Notice, many small owners of old units affected the Notice

may not fully understand how their interests and rights are

affected under different circumstances.

To help small owners understand the Land (Compulsory

Sa le fo r Redeve lopment ) Ord inance (Cap 545 )

("Ordinance") better, particularly the operation of the

Ordinance and how it protects the interests of small

owners, the General Practice Division of our Institute

is now working together with the Hong Kong Housing

Society (HKHS) to provide free information service to small

owners. While small owners can obtain free information

services at the HKHS’s 10 Property Management Advisory

Centres (PMACs), the HKIS will also organize forums to

provide more advice to small owners.

Working with HKIS

In addition, with a view to providing the said service in

a timely manner, our Institute has been training HKHS

staff to enable them to handle enquiries from the general

public at their PMACs on issues relating to the Ordinance.

Questions they may have to answer include:

1) Under what circumstances will a compulsory sale

apply to one's property?

2) How can one object to an application lodged to the

Lands Tribunal by the majority owner?

3) How will the proceeds of a compulsory sale be

distributed amongst the owners?

While we believe urban renewal generally benefits the

community at large, we also believe that this must be

done in a fair and equitable manner; in particular, the

interests and rights of affected small owners must not be

exploited or compromised. We hope our voluntary service

contributes to safeguarding the rights and interests of

small owners.

保障小業主權益《土地(為重新發展而強制售賣)(指明較低百分比)公告》於

四月一日起生效,土地審裁處可就下述三個類別的地段採用

80% 的強拍門檻:

(a) 地段上每個單位各佔該地段不分割份數的 10% 以上;

(b) 地段上所有樓宇的樓齡均達 50 年或以上;以及

(c) 地段並非位於工業地帶,而地段上所有樓宇均屬工業大

廈及樓齡均達 30 年或以上。

本文無意在此對公告的內容作出評論,讀者自有分析。學會

產業測量組執委在該組前主席潘永祥博士的領導下,一開始

已從專業、技術及公眾的不同角度,討論及分析公告的影

響,並與政府保持溝通,克盡社會責任。我們並不滿足於

此,因為很多舊樓小業主未必清楚公告如何影響其權益。

第 545 章

為幫助小業主加深對《土地(為重新發展而強制售賣)條例》

(第 545 章)的認識,尤其是《條例》的運作及為小業主可提

供的保障,學會產業測量組和香港房屋協會合作,為小業主

提供免費資訊服務。小業主可於房協轄下的十個物業管理諮

詢中心獲得免費資訊服務,而學會亦會適時舉辦講座,解答

小業主遇到的問題。

與房協合作

為使小業主能及時得到上述服務,學會現已向房協職員提供

訓練,講解如何回答市民對有關條例的查詢。預計的問題包

括:

1. 在什麼情況下強拍會執行?

2. 如何反對由大多數業主向土地審裁處提出的申請?

3. 強拍所得款項如何分配?

我們相信,市區重建對整體社區有益,然而必須確定是以公

平及對等方式進行,特別是小業主的權益不能受剝削或犠

牲。希望學會的自發服務能幫助保障小業主的權益。

對財政預算案的回應

財政司司長於二月廿四日發表 2010-11 財政預算案,學會對於當中有關土地、房屋及樓宇維修的政策大致上表示歡迎,茲闡述如下。

土地及房屋政策

預算案中提出除維持勾地表外,政府還會指定數幅市區住宅用地作公開拍賣或招標。學會歡迎以上安排,顯示政府積極回應了學會一向建議在出售土地方面作雙軌並行的做法,紓緩土地供應的問題。

就調高 2,000 萬元以上樓宇買賣印花稅稅率方面,學會認為可為庫房帶來進賬,對樓市影響則不大。

在預算案中指定一幅元朗土地作私人住宅用途,可以回應社會對中小型住宅的需求,學會建議政府可多撥二至三塊土地作類似用途,以進一步回應社會所需。至於活化居屋第二市場,效果與復建居屋相類,可以幫助一些市民「上車」。

樓宇維修

學會認同政府協助舊樓業主進行維修,預算案增撥五億元重點協助沒有組織能力或沒有立案法團的舊樓業主維修樓宇,並強調希望早日推行強制驗樓及驗窗計劃,學會表示歡迎。

舊樓失修是涉及公眾安全及高昂社會成本的重大議題。學會十分支持政府準備審議推行的強制驗樓措施,認同是解決舊樓失修問題長遠方案的第一步。但在推行有關措施之餘,如果缺乏專業測量師作中介統籌及提供專業意見給業主,將會大大減低整個措施的效用。本會認為政府可考慮成立特別基金,有條件地向有需要的業主資助僱用專業測量及物業管理服務,只要措施有效,其所帶來的成本效益一定遠高於基金的資助金額。

何鍾泰議員澄清無意冒犯測量專業

在馬頭圍道 45J 號塌樓事件後, 屋宇署派出 40 隊快速巡查小組勘察全港 4,000 座樓齡超過 50 年的樓宇結構安全。一月三十一日《明報》引述何鍾泰議員質疑屋宇署屋宇測量師缺乏專業知識領導快速巡查小組勘察樓宇結構安全,並在同日於港台《城市論壇》節目中作出錯誤引導性發言,令觀眾覺得屋宇測量師不適合帶領快速巡查小組勘察樓宇結構安全。

學會已於二月一日就以上事件發出新聞稿指出其中謬誤。劉秀成議員亦於同日向何鍾泰議員就上述事件發信, 學會於二月三日收到何議員於二月二日的來信, 信中何議員只重申結構工程師於勘察樓宇結構安全所具備的專業知識及他對新聞界報導所導致的錯誤印象表示不幸。由於信中再次證明何議員對建築測量專業認識的不足和缺乏尊重; 學會於二月五月再次去信何議員表示不滿並要求何議員加深對建築界各項專業的暸解,希望不會再發生同類事件。

及後, 劉秀成議員召集其功能組別內各專業團體於二月八日晚上舉行舊樓安全論壇, 並邀得何鍾泰議員出席。其間何議員再次重申一月三十一日的《明報》未有正確引述其對於屋宇署屋宇測量師專業知識的意見, 以致各方誤解。另外, 他再三強調在港台《城市論壇》節目中他本人未有提及「測量師」一詞, 亦提出他對測量專業有近20年的認識, 完全無意對建築測量師不敬, 亦認同建築測量師於勘察樓宇安全的專業水平。他坦言如因其言論引起香港測量師學會各會員、普羅市民、港台城市論壇節目主持人謝志峰、甚至發展局局長的誤會, 他只感到無奈及並不反對由學會代其澄清。

另一方面,在現存的物業管理條例(第 344 章)的執行上,其實仍有很大的發揮空間,如果能切實執行,對於樓宇失修、非法改建及其他物業管理相關的問題亦能有重大改善, 其中第 40 條的有效運用便是一個好例子。學會就上述問題正草擬一份詳細的計劃書,未來將向政府提供一個長遠、有效及專業的解決方案。

此外,學會亦會積極參與政府向物業管理公司及從業員發牌的可行性諮詢提供專業意見。

Since the formation of the PFM Division within the HKIS in November 2005, the growth in number of members in the division has been phenomenal. This demonstrated the size of the PFM market and the demand for PFM expertise, and the growth of interest on related issues. PFM is to lead changes in the procurement and management of facilities, including infrastructure, buildings, and other special facilities. Surveying and Built Environment invites original contributions to a special issue, planned for publication in September 2011, from a PFM perspective.

The forms of contributions can be in the form of market audits report; research papers; literature reviews; case studies, practice notes, and other publishable materials which will be of interest and importance to our members and affiliates, such as Sustainability Assessment of Projects and Buildings, PFM Performance, PFM Market sectors and future, Organisational and human issues related to PFM, Outsourcing effectiveness, Managing Life Cycle Performance, Sustainable Processes, Design and uses of space, Alternative procurement approaches, Benchmark ing and in te rna t iona l compar isons , Management of special facilities, Regional importance of PFM, PFM of public facilities and housing.

New Supplement to Code of Measuring Practice

Call for articles on professional surveying practices

The HKIS has issued a new Supplement to Code of Measuring Practice which takes effect on 1 March 2010. The purpose of the new Supplement is to clarify that Stairhood shall not form part of the Saleable Area. It should be measured separately and stated under Ancillary Accommodation. The Executive Committee of HKIS has also resolved to set up a Standing Committee on Code of Measuring Practice chaired by Dr Lawrence Poon. The role of the Standing Committee is to help clarify the Code of Measuring Practice and where necessary make recommendation to the Executive Committee on updating the Supplement of Code of Measuring Practice.

Do you have something about professional surveying practice which can be shared with our members? The Editorial Board would welcome such contributions for publication in Surveyors Times.

Articles can be in English or Chinese and should be sub-mitted in Word format and include the title of the paper and author's details. For articles in Chinese, a summary in English will be required. Submissions must not have been published previously. Publication of article will be at the discretion of the Editorial Board whose decision shall be final. Surveying and Built Environment -Call for Papers

Submissions must not have been published previously and all sources of reference must be appropriately acknowledged. All submissions will be screened first by the Chief Editor before they are blind refereed. A definite decision by the Editorial Board will be made within 60 days of submission. Comments of referees and editors will be disclosed to authors if their works are refereed.

Please send contributions or enquiries by email in the first instance to Professor Lawrence Lai at [email protected] or Dr Daniel CW Ho at [email protected]. Deadline for submission is 31 December 2010.

Ir Dr Ho has rightly pointed out a building surveyor is equally competent to assess structural safety problem for buildings as a structural engineer. However, his comment on RTHK TV programme “City Forum” has done damage to the HKIS members. Also, the public might have been misled by statements on Ming Pao and views at “City Forum”.

The letter further stated that we should avoid disharmonies in the society, in particular, the surveying and engineering society. The Institute would trust Ir Dr Ho, as the Legco representative of the engineering profession that building surveyors are professionally competent to provide professional advice and services on structural safety for buildings to the general public. The letter concluded that we look forward to working with the engineering profession jointly in safeguarding the public from the peril of the structural building defects.

Building Surveyor Volunteer TeamUp to March 5, we have received more than 90 calls from the public. After screening and clarifications, more than 20 inspections have been carried out accordingly. The volunteer inspection scheme has been well received by the callers and our effort was appreciated. Most of the worries and queries from the public have been eased and tackled by our inspectors over the phone. For the inspected cases, we managed to inspect common areas and not only the callers’ flats but also some other flats so as to give advice on the overall condition of the buildings. By doing so, we hope to trigger some owners to start coordinating their repair works. In addition to providing professional advices, our volunteers also supplied callers with relevant information like details of loan and grant schemes on Building Safety and services provided by Property Management Advisory Centre under the Hong Kong Housing Society. In this way, they can approach appropriate organisations for further assistance like setting up of Owners Corporation and reference materials on employing consultants for repair works.

Mandatory Building Inspection Scheme and Mandatory Window Inspection SchemeA forum to let members of the Institute express their views was held on March12 with almost 100 members of various divisions attending and the majority were building surveyors. In the forum, our vice-chairman, Mr Vincent Ho, gave a briefing on the consultation documents and led the discussions on topics which were most concerned by surveyors. After obtaining the consensus, Vincent attended the Bills Committee

on Building (Amendment) Bill 2010 Meeting held on March 20 and expressed our views. Subsequently, we have submitted a paper listing our comments to the Bills Committee and copied to Development Bureau. I would like to take this opportunity to thank Mr Kenny Tse who is the convenor of the working group on this matter. Last but not the least, members are reminded that Registered Inspector under MBIS must be a Registered Professional Surveyor. So you should consider becoming a RPS(BS)!

General Specification for Building Maintenance Works in Residential BuildingsI am pleased to inform you that our project for preparation of the above mentioned specification is almost completed. Upon finalisation of cover design, each corporate member of BSD will receive a hard copy and a CD for its soft copy. Moreover, soft copy will be available for downloading through our website. Please wait for our announcement in April/May.

Welcoming Party for Newly Qualified MembersFollowing our successful welcoming party to newly qualified members in our Annual Dinner last November, the Council decided to hold another welcoming party in the last Friday of April 2010. Newly qualified Members after November 2009 will be invited to attend. Please ensure you will not miss our invitation through email.

Maintenance Cost Information SystemIt comes to our notice that the public is difficult to know or compare the maintenance cost in the market because such maintenance cost data or index for maintenance works, unlike new development projects, are rarely found. The Council has recently formed a working group for setting up a well-recognized maintenance cost information system. With the assistance from Hong Kong Housing Society and the academics, the information could help layman owners and IO to have a rough idea on the cost range for repairing their buildings. The working group has already worked out a template for cost data input of some common building repair items and identified some reliable data sources. Data input and formatting of the maintenance cost information system will be the next step.

Supplement to the Code of Measuring Practice and the Formation of Standing CommitteeA new Supplement to the Code of Measuring Practice in regard to the stairhood measurement was issued on 2 March 2010. With the lapse of time, further clarification on the Code of Measuring Practice may be required. HKIS Executive Committee has formed a Standing Committee to handle all matters in relation to the Code. The Committee, to be chaired by our Immediate Past Chairman, Dr. Lawrence Poon, comprises representatives from related divisions. Mr C K Lau and Mr Leo Choy are nominated as GPD representatives.

Membership Reciprocity with the China Institute of Real Estate Appraisers (CIREA) The Working Group (W/G) has set out a plan for the second examination and made contact with CIREA. Hopefully, there will be a meeting with CIREA in the near future to resolve

outstanding issues. The W/G will inform interested parties of the arrangement in due course.

Consultation on the Property Valuation Requirements under the Listing RulesThe Hong Kong Exchanges and Clearing Limited and the Securities and Futures Commission plan to consult the public on proposed changes on the property valuation requirements for public listing purposes. Meanwhile, they invite GPD to discuss with them on the proposed changes. A panel is set up to handle this matter.

GPD & PDD Joint Fellowship Dinner- 2010For enhancing cohesion and communication, GPD Council and PDD Council jointly organized a fellowship dinner. The event was held on March 18 at World Trade Centre Club, 38/F, World Trade Centre, Causeway Bay. About 50 members participated.

Conference on Spatial Data Infrastructure in Hong KongThe half-day Conference on Spatial Data Infrastructure (SDI) in Hong Kong was held on March 18. The event aimed to promote SDI in Hong Kong. We had the honour to have Ir Dr Hon Samson Tam Wai Ho, member of the Legislative Council (Information Technology), to be the keynote speaker. The Conference was co-organised by the Hong Kong Institute of Surveyors, the Chartered Institution of Civil Engineering Surveyors, the IT Division of the Hong Kong Institution of Engineers and the Department of Land Surveying and Geoinformatics of the Hong Kong Polytechnic University. The conference created a forum to foster collaboration in the industry of geoinformation and its applications. It drove the development of SDI in Hong Kong.

ISM visited the HKISA delegation of 15 members from the Geomatic and Land Surveying Division of the Institute of Surveyors, Malaysia (ISM) visited HKIS on March 18. The delegation consisted of a good fix of Malaysian surveyors from government agencies, academic institutes and private companies. They were warmly received by our Senior Vice President, Vice President, Hon. Secretary, Hon. Treasurer, Chairman and Vice Chairman of the Land Surveying Division. One of the purposes of the visit was to study the situation of utility mapping in Hong Kong. There were very good exchanges of ideas between the parties. After the meeting at the HKIS, we guided the delegation to visit the Hong

Kong Polytechnic University which would organize a new degree course in geomatics with specialism in utility surveying. We also showed the delegation the operation of a private company which specialized in utility survey.

Utility survey is an area for potential growth for our profession. We can make use of our existing strength to serve the users in the utility industry. At the same time, land surveyors should also update our knowledge in detection of underground objects and the operations of the stakeholders involved in the utility industry.

Site Visit for University Students - Infrastructure Works at Anderson Road.The university students who joined the Poster Design Competit ion vis i ted the site of an infrastructure development project on February 27. They witnessed how the land surveyor worked with the engineers to carry out the site formation works. The project team showed the students how the works were carried out and in particular the measures to reduce and monitor the environmental impact caused by the blasting work to the residents living next to the work site. The land surveyor on site demonstrated using laser scanning to measure the rock surface for calculating the accurate amount and location of the explosive to be used in blasting. The students expressed that they enjoyed the visit and gained better understanding of our profession.

PDD/GPD Joint Fellowship Dinner

On March 18, the Planning and Development Division/

General Practice Division Joint Fellowship Dinner was

successfully held at the World Trade Club with some 50

members participating to share the warm fellowship spirit.

On behalf of the Council, I would like to extend our great

gratitude to the event organizers, Ms Karen Chan and Mr

Edwin Tsang.

2010 兩岸四地土地研討會

Our divisional representative, Mr Edwin Tsang will continue

to contribute in the HKIS Organizing Team for the 2010 兩

岸四地土地研討會; which will be held in Hong Kong later

this year. The Organizing Team is now chaired by our

HKIS President.

Assessment of Professional Competence

In the second Council Meeting held on March 18, the

Council appointed an APC Panel of three fellow members

to conduct a Professional Interview for the Division’s first

APC Candidate pending the final vetting process of her

APC Final Report by our BOE representative.

CPD Events

In March 2010, there were two CPD events successfully

held on March 1 and March 11 respectively. On

March 1, we had the CPD Talk on “Revitalizating Industrial

Buildings” by Mr Lauire Lo, Head of Development

Opportunit ies Off ice of the HKSAR Government

Development Bureau. On March 11, we had the CPD talk

on “Adding Value Through Design” by Dr Chan Lai Kiu,

Director of Design and Project of the Hysan Development

Company Limited. Both the aforesaid CPD Talks were

well received by our members with a high turn-out rate.

In April, we shall have two CPD Talks. On April 9, we

shall have a briefing forum conducted by Rocco Design

Architects Limited regarding the Draft Design and

Management Guidelines on Public Open Space in Private

Developments. It is a joint event of PDD and PFMD.

Another CPD event will be a health talk by Dr Isaac Yip

on April 29 concerning mental health management in

workplace. Details of this CPD talk are to be announced

by the HKIS Secretariat in due course.

Details To minimize the potential risk of damage to life, property and economy during heavy rainstorms in Hong Kong Island, the

Drainage Services Department commissioned a consultant to undertake the design and supervision for Hong Kong West

Drainage Tunnel Project (DSD Contract No. DC/2007/10) in March 2006.

The scope of the Contract comprises the construction of a main drainage tunnel of internal diameter ranging from 6.25m

to 7.25m spanning about 11 km from Tai Hang to Cyberport. 34 intakes will be constructed at Wanchai District, Central and

West District, and Southern District to intercept storm-water at the upper part of Hong Kong Island and discharge it to the

main drainage tunnel via the intakes and adit tunnels. The total length of the adit tunnels is about 8km.

The construction contract commenced on 30 November 2007 and the Contract is due for completion in March 2012. The

Contract Sum is at HK$ 2752 Millions.

Details Waste electrical and electronic equipment (WEEE) contains hazardous substances that are harmful to the environment and human health if not properly treated or disposal of. At present, about 80% of WEEE generated in Hong Kong is recycled and the majority of it is sold through second-hand dealers, usually to developing countries, for re-use and recovery of useful materials. The current exporting strategy is not environmentally sound and is indeed unsustainable. In time, demand for second-hand products in developing countries is expected to decline as the living standard improves and awareness of sustainability develops. Controls on importing WEEE may also be tightened. Various jurisdictions across the globe have put in place specific measures for the management of WEEE.

The mainstream approach has been to bring WEEE under mandatory control through producer responsibility schemes (PRS). On 18 January 2010, the Government published a consultation document to solicit the public's views on introducing similar legislation for the proper management of WEEE. The seminar will introduce the mainstream proposal of the PRS for WEEE including the need, coverage and targets, proper collection and treatment, as well as cost sharing mechanisms.

Proposed Licensing of Property Management Companies and Practitioners

The Home Affairs Department appointed Deloitte

Consulting last year to carry out a study and to propose

regulatory framework to facilitate professional property

management services.

The Council was invited by Deloitte to attend a Discussion

Workshop which was held on March 3 together with other

related professional institutes including HKIH, CIH, HMRB,

HKIFM, HKIREA and HKAPMC. Deloitte briefed attendants

the outline of the consultancy study and its preliminary

recommendations. Dick Kwok, Charles Hung and I

attended the workshop. A brief summary of Deloitte’s

proposal is appended below for members’ reference.

1. Mandatory system is introduced to regulate both

property management companies and practitioners

through a so call “registration” and “licensing” scheme.

2. Minimum requirements proposed for a “registered”

individual will be HKCEE graduate with three years of

experience, whereas for a “licensed” individual will be

Higher Diploma graduates or above with sevens years

of experience. Direct entry will be provided for both

“registered” and “licensed” individuals if candidates

possess professional qualifications such as HKIS,

HKIH, CIH, RPHM, HKIFM, HKIREA and ISCM.

3. No particular entry requirement, except to commit

compliance with a code of conduct, was required for a

“registered” company providing property management

services although they are subject to a threshold

of managing a maximum of 500 units. Whereas for

a “licensed” company, at least one director and

one employee per 2000 units must be a “licensed”

individual, and the company must be in operation for

more than 3 years.

4. Three options were proposed in respect of setting up

the future “Regulatory Body” including an independent

body, government-operated body or body embedded

in existing professional association.

Written comments were sent to Deloitte on March 17

raising the Institute’s concern on some of the key issues.

An abstract of these comments was summarized as

follows:

1. Licensing and registering of property management

companies are generally supported. However, all

service providers including single-owned building

management organizations, incorporated owners,

NGO, etc. must also be included under this new

regulatory framework. Small companies shall also be

“licensed” without exception although they may be

subject to a “registered” grace period as a transitional

arrangement.

2. As professional property managers are already

regulated by their own professional institutes, further

“licensing” of individual appears as a “Bell and Brace”

job. Owing to the nature of property management

which are collaborated from collective effort of various

subcontractor/subordinates, and added to it the wide

spectrum of works and different specialists involved,

“licensing” of an unequivocal responsible individual

appears extremely difficult and impossible.

3. I f the government aims to tackle the exist ing

management problems which mostly are derived

from aging buildings and buildings in disrepair

without proper property management services, a new

regulatory model is definitely not a panacea. Whilst

offering little catalyst for improving the quality, the new

licensing regime will conversely escalate the costs of

providing property management services.

The Council will keep members continuously updated of

any further development of this proposal.

A New Producer Responsibility Scheme for Waste Electrical and Electronic Equipment (WEEE)

The Environmental Bureau of HKSAR recently published a

consultation document on “A New Producer Responsibility

Scheme for Waste Electrical and Electronic Equipment”.

If members are interested, the whole set of consultation

document can be downloaded from the EPD website.

WEEE has become a growing concern internationally

as they contain hazardous components that are harm-

ful to the environment as well as human health. To en-

able our members to fully understand the proposed

scheme, we have pleasure to invite Dr Alain Lam, Principal

Environmental Protection Officer of the Environmental

Protection Department, to offer a seminar which will

be held on April 21. Please look for more details of

the seminar in the CPD section. I would like to appeal

to members to make your best attempt to attend this

seminar as the new scheme may have an impact on

property management professionals. I do hope that you

could also offer your view in the seminar to the Council, so

that we may formulate a more representative view to the

Environmental Bureau by the deadline of April 30.

CPD Updates

Our Fellow Member, Mr James Pong, Chief Prosecution

Officer, and Mr Francis Yeung, Prosecution Officer of the

Central Prosecution Unit of the Environmental Protection

Department delivered a speech on Environmental Law

for Facilities Managers on March 15. They provided an

overview of the environmental laws which related to the air

and noise pollution, and waste and water treatment issues.

Apart from a highlight of the relevant legislations relating to

the said issue that every facility manager should be aware

of and encountered in their daily operation, they have also

set out some case studies. With the permission from the

speakers, the power-point presentation material will be

uploaded to HKIS website. Any members who missed

this useful CPD event can browse the HKIS website and

download the materials for their own reference.

A site visit to the Hong Kong Academy for Performing

Arts was jointly organized with the Hong Kong Institute

of Facility Management on March 20. The Director of

Estate, Mr Bosco Yiu, of HKAPA shared with members

the difficulties of running the project which involved the

construction of a new wide span structural steel portal

for a column-free unobstructed auditorium over a MTR

tunnel and drainage reserve. The auditorium was originally

used as an amphitheatre and HKAPA initiated the change

in order to cater for its future multi-purpose function.

Although the new theatre will be roofed with glass panel

sky-light, it was noted that sophisticated acoustic material

and building services installations were provided to enable

a quiet and comfortable indoor environment while enjoying

arts performance.

On March 8, the QSD organised a New QS Members Welcoming Party, to meet with the newly qualified QS this year. The party was held at the Backstage Live Restaurant in Central.

The young and fresh faces were glad to meet with the QSD council members in this casual and jovial event.? It was also a great opportunity for the QSD council members to get to know the new members as well as introduce them the sub-committees of the QSD. It was also a great honour to have the attendance of our senior Vice President of the Institute, Mr Peter Wong, who gave an impressive speech to the new members. The games brought cheerful atmosphere to the party. They got everybody to blend in and enjoy. Winners were awarded with meaningful prizes.

I would like to take this opportunity to give my special thanks to the welcoming party organising committee, all the newly qualified QS and our council members for their participation and creation of such a spectacular and enjoyable evening. Introduction of QS Profession to Secondary SchoolsThe Promotion Sub-Committee of QSD is organizing a series of promotion activities this year. One of these activities is to introduce the quantity surveying profession to secondary school students. The introduction will be handled by qualified QS members. They will visit their mother secondary schools and will deliver career talks about quantity surveying to young schoolmates. Hopefully, the young secondary school students will have the QS profession in their mind well before they have to choose the subjects in their tertiary education.

This promotion activity is a pilot scheme. The Promotion Sub-committee would like to recruit several qualified members to test the water. The members can decide the timing and the duration of the career talks, and will be supported by the Promotion Sub-committee with a standard promotion package as well as the participation, if necessary, of the QSD council members in the career talks. CPD events - Short Piles - Lessons in Agony

An approximate 100 members attended the subject CPD 短樁事件, Mr Daniel C. Lam, BBS, JP, FRICS, FHKIS, FH-KIArb, FCIArb, AP, RPS put forward his presentation about Yuen Chau Kok incidents which he shared his experience and knowledge with members. This topic brought atten-tion of many members particularly after the Ma Tau Wai collapse accident.

Indoor Rowing Charity Competition and Woman Relay

An exciting but exhausting event our members particularly enjoyed every year was Hong Kong Open Indoor Rowing Championships & Charity Rowathon being held on Mach 7 this year. We formed a strong team from students which studying surveying in different universities and we got 26th out of 40 teams. We also formed a female team and a male team for Professionals & Government Department Team Relay. The female team beat judiciary organization, medical association and CPA for champion and the male team gained 5th out of 9 teams!

Reach Out to the City University of Hong Kong It was our great opportunity to deliver a speech to foundation students from Mainland China studying in City University of Hong Kong. The topic was about working experience of General Practice and students all found it very interesting.

在之前的文章中,我們曾經介紹和比較了兩地最新適用的

標準合同。就香港方面而言,跟隨香港渠務署去年采用

NEC (New Engineering Contract) 合同的先例,我們在2009

年10月的文章中向讀者們介紹了NEC合同系列中的 ECC

(Engineering and Construction Contract) 合同條件的大致

結構,其優勢特點,以及可能存在的不足,以起到抛磚引玉

的作用,希望大家能共同探討 ECC 合同條件的有關問題,

共同瞭解其在香港建築工程界的運用。

在 2009 年 10 月的文章中,我們除了討論 ECC 的優勢特徵

以外,也提及了它的一些不足。之後我們收到其中一位讀者

的一些反饋意見,對我們說道的這些不足進行了回應和解

釋。在這裏,我們跟隨上一篇文章中的“ECC 合同條件的

不足”的序號,就讀者的一些意見進行回答,以作共同探

討。

1. 關於ECC的適用性問題

我們理解 ECC 是想適用於多種工程項目,包括機械和電子

工程。我們在上一篇文章中之所以說其可能不適用於機械和

電子工程項目,是因抛就機械和電子工程項目而言,其他的

標準合同,例如 FIDIC、IChemE 和 MF/1 更為適合。

2. 關於合同文件優先性的問題

與其他一些標準合同相比較,例如,在FIDIC生產設備和設

計施工合同(99年版)條件中第1.5條就規定了構成合同的文件

的優先次序,而 ECC並沒有類似的條款。

不過正如讀者的反饋意見中所說,ECC 的使用手冊中附隨

了一個合約的範本 (sample form of agreement) 供當事人選

用。該合約範本中的第三條說明某些文件是合同文件。然

而,該合約範本並沒有寫明這些合同文件適用的優先順序,

所以不同文件之間出現不一致時,會存在解釋合同的困難。

3. 關於進度管理的問題

需要強調的是,我們並不是旨在闡述只有 ECC 才存在問

題。實際上,在其他標準合同中,也有類似及其他的問題。

4. 關於工作量的問題

我們同意讀者的反饋意見中所說的,ECC 中引入的參加早

期警告會議,修改進度和報價等工作是為了加強進度的控

制。然而,從另一個角度來看,由於業主、承包商及項目經

理需要在進行施工工作的同時,用大量精力處理管理上的工

作,這就增加了他們的工作量。

5. 關於ECC的用語問題

我們理解 ECC 為了想達到具有靈活、簡明的特徵而採用了

不同於其他標準合同的用語,以方便工程人員的理解。然

而,由于 ECC 規定了一些不同的用語,基於上一篇文章所

提出的原因,可能對在解抛工程進行中出現的糾紛造成一定

的困難。

在英國,關於 ECC 的案件糾紛比較少,原因之一應該是,

英國有法定的調解機制 (statutory adjudication),而採用

ECC為不一定代表就沒有糾紛。

我們相信,各個標準合同都有其優勢特點,但事實上不可能

存在一份完美無缺的標準合同。在上一篇文章以及本文中,

我們僅就 ECC 本身的優勢特質和一些可能存在的問題與讀

者共同探討,以共同進步。

Introduction

Nowadays quantity surveyors provide a wide spectrum of professional services throughout the management of a project from its initial inception to final completion typically including cost planning, procurement strategy advice, tender documentation, payment and variation valuation, project management, claims settlement and occasionally giving expert evidence in tribunals. Among which the preparation of bills of quantities remains a vital part of the quantity surveying services. As one of the prime functions of the bills of quantities is to provide an equal basis for the tenderers to submit their tenders, the bills of quantities have to be prepared in accordance with a published standard method of measurement. The “Hong Kong Standard Method of Measurement of Building Works” published by the Hong Kong Institute of Surveyors is the one most commonly used in the Hong Kong construction industry.

Since the release of its first edition in 1962, the HKSMM has been subjected to the first revision in 1966 (i.e. SMM2, the second edition), followed by the third edition issued in 1979 (SMM3). The latest version of SMM is the SMM4 (the fourth edition) published in 2005. As distinct from its precedent versions, the SMM4 has incorporated SMM for Building Services Works which previously were covered by a separate booklet called “Standard Method of Measurement for Building Services Works (First Edition)” published in 1993. The following is a chronological list of the HKSMMs.

In this article, the rationales of the changes of the measurement rules from SMM3 to SMM4 wil l be discussed. A detailed clause-by-clause comparison between the SMM3 and SMM4 can be found in http://www.dlshk.com/smm42010.htm.

Rationale of the changes - Advancement in Engineering Technology and Change in Built Environment

In the old days, most of the buildings were of fairly typical and simple profiles. They were often equipped with simple and unsophisticated facilities/ building services. The standard methods of measurement for Bills of Quantities (BQ) preparation for those narrow verities of building designs were relatively simple.

This is not that case nowadays. The speed of development of bui lding technologies has been breathtaking. Skyscrapers with intricate building fa?ade, giant multi-purposes complexes, green buildings are in the mind of developers and architects. The measurement rules formulated few decades ago are hardly compatible with the latest development of building technologies. The deficiency of the old SMM3 is evidenced by the extensive use of preambles to bridge the gap between the model on which the old SMM3 was drafted and the construction industry in reality.

As an illustration, there are no specific measurement rules under SMM3 for curtain walling. Quantity surveyors can only refer to the general rules under Section XVIII – Glazier in SMM3 for the BQ measurement. It is somehow ambiguous and inconvenient. SMM4 has made a great improvement by incorporating the rules in Section XV sub-section (o) for measuring curtain walling.

As the society is progressing day-by-day, people are well off and the expectation of the living standard and built environment are getting higher and higher. Buildings do

not merely serve as living/ working shelters, they may also be the landmarks displaying the developers’ prestige with unique aesthetical appeal.

SMM4 has taken notice to these and incorporate various new rules for those new building items. Landscaping works is one of the categories which have been newly added as an individual section of the SMM4. On the other hand, obsolete works which were no longer used in Hong Kong e.g. air bricks, slab partition, chimney stacks, etc. are deleted.

Nowadays, buildings are often completed with certain from of greening. Regrettably, there is no specific measurement rule for measuring soft landscaping works under SMM3. As a response to the demand from the industry, measurement rules for landscaping works have been incorporated into the new SMM4 under Section XXII – Landscaping. Indeed, a systemized and standardized set of measurement rules for those missing trades are the long-waited remedies which are now available in the new SMM4.

Wi th the cont inuous and rap id deve lopment of technologies and increasing demand for intelligence and energy efficiency features in building design, building services systems become more and more complicated. The three sections of SMM4, namely Section XVII Mechanical Installations, Section XVIII Electrical Installations and Section XIX Communications / Security / Control Systems provide a systematic method of measurement for the building services works. Section XVII Plumber of the old SMM3 is now incorporated into Section XVII Mechanical Installations of the SMM4 and systems of building services works are classified as shown in Appendix A to Section II General Principles.

Rationalization of measurement method

The very purpose of the Bills of Quantities is to provide a common and systemic way for estimators to price the construction works. In principle, the method of measurement shall follow the same logic on which the estimators are used to price the works. For instance, doors measured in number with size and thickness stated in accordance with Section XIII sub-section (i)(1) of the SMM4 will be a more intuitive approach for the estimators

than the old SMM3 rule that requires the doors to be measured in meter square with the number of doors stated separately.

Another illustration is method of measurement for fire rated doors. Because of the certification issues, fire rated doors together with their frames, ironmongery and glazing are regarded as an integral installation. From the pricing point of view, it makes little sense to breakdown the integral installation. However, the SMM3 made no distinction between fire rated doors and conventional doors thereby requiring the ironmongeries and glazing to be measured separately that created unnecessary hurdles for the estimators. The SMM4 has rationalized the measurement rules and fire rated doors are measured complete with frames, ironmongery and glazing.

A further illustration is the method of measurement for insulation. In SMM4, the measurement rule requires the insulation and protective coverings and finishings to insulation are measured in separate items, whereas in the old SMM for Building Services Works, the method of measurement for insulations and its related protective covering are measured in the same item. As different types of insulation and protective coverings and finishings to insulation are of different prices, measuring the insulation and its protective coverings and finishings under two different items not only facilitate the estimators to price the works but provide the same base for rates comparison during tendering stages. It also helps the quantity surveyors to value the works done and variation.

A Collection of 30-year Experiential Improvement

There is a 30-year (from 1979 to 2005) gap between the publication of SMM3 and SMM4. Because of the reasons discussed above, most QS practices have developed their own standard preambles to supplement and modify the SMM3. The preambles can be viewed as a collection of thoughts intended to strike the balance between ease of measurement and various pricing concerns. However, the preambles do vary from practice to practice. Many of the changes effected in the new SMM4 are indeed inspired by (or a response to) the preambles prevailing in the QS practices. It is hoped that with the new SMM4, the need for customized preambles will be substantially curtailed. It

should be a trend that most estimators will welcome. The presence of a truly standardized method of measurement will help to improve pricing efficiency and accuracy and thereby benefit the industry in general.

Systematical and user-friendly interface

In terms of presentation, the rules in the SMM3 are set out in a rather old-fashioned bullet-point style. It is not user friendly in that the system logic of the rules is not easy to perceive. Below is an abstract from the SMM3 (Figure 1):-

One of the most obvious changes brought about by SMM4 is the tabulated format (Figure 2):-

The general rules in the SMM4 are set out in tables. This new tabulated format for the SMM4 is generally based upon the United Kingdom SMM7. However, the Elemental format used in the United Kingdom SMM7 has not been followed and the Trade Section maintained as being more suitable for the Hong Kong contracting practices.

In the tabulated format of SMM4, each section of the rules comprises information provided, classification table and supplementary rules. There are horizontal lines which divide the classification tables and supplementary rules

into zones to which different rules apply. The table has been mainly divided into four columns (the 1st, 2nd, 3rd and 4th column), with the measurement unit column.

Besides the general rules, there are also supplementary rules, including the measurement rules, definition rules, coverage rules and other supplementary information as detailed below:-

Contains rules governing the

information which shall be given in

addition to the information.

The systemized and tabulated format of SMM4 provides a clearer and user-friendlier interface to both taker-offs and estimators.

Another more far-reaching effect of the revamped format is that it facilitates the compilation of standard phraseology for BQ descriptions which is indispensable for computer-aided bills of quantities production in this IT era.

One-day Seminar on Contract Management 2010Katherine Wong Pui Ching, YSG Committee Member

The One-day Seminar on Contract Management 2010 was successfully held on February 6 with nearly 250 participants filling the Chiang Chen Studio Theatre of The Hon Kong Polytechnic University.

The seminar was jointly organized by the young groups of six professional institutions including The Chartered Institute of Arbitrators (CIArb), The Chartered Institution of Building Services Engineers (CIBSE), The Institution of Civil Engineers (ICE), The Hong Kong Institute of Surveyors (HKIS), The Hong Kong Institution of Engineers (HKIE) and The Law Society of Hong Kong (LawSoc). Through this joint annual event, a committee comprising young surveyors, engineers, solicitors and arbitrators from the professional bodies provides a platform for practitioners to share experiences, address problems and explore new practice in contract management.

Our panel of distinguished guest speakers from various disciplines included Mr Glenn Haley who shared how to manage the way through the Contractual Jungle, Mr James Yeung, Mr Dennis Wong and Mr Edward McMullen who gave us an Overview of Recent Cases and Latest Legal Developments affecting the Construction Industry in Hong Kong. Mr Christopher Tung highlighted the sustainable development in the Policy and Law of a Low Carbon Economy. Mr Mackenzie, J Scott discussed the Alternative Contract Procurement Approach and Mr Kenneth Poon illustrated a New Approach to Cost Management for Construction Works.

Thanks to Mr Peter Berry for delivering a CPD seminar for QSD on February 23. Peter is a qualified Quantity Surveyor for nearly 50 years. He is a Fellow of the Chartered Institute of Arbitrators and a Mediator accredited by the Hong Kong International Arbitration Centre. The topic of

seminar was “Financial claims for more money under the HK Government standard form of Building Contract” and it was successful with around 100 members attending. Mr Sunny Chan, the Honorary Treasurer of QSD, presented a souvenir to the speaker at the end of the seminar.

6th Joint Professional Golf Tournament 2010

Another major event of the year was the 6th Joint Professional Golf Tournament 2010 held in Kau Sai Chau on March 10. There were over 140 golfers from the six professions attending the annual event, again a record high. Despite the unpromising weather forecast of rain and chilly cold, the golfing day turned out to be an exceptional one with sunshine and 20˚C. The winning team this year went to the dentists and the architects with their ever first full team came second. The defending champion, doctors was a little bit sluggish this year and only came third at the end of the day, followed by surveyors, accountants and the lawyers in the fourth, fifth & sixth places.
