At 3:20 o’clock in the afternoon, the 63rdRegular Session of the Sangguniang 38
Panlalawigan of Leyte was called to order by Atty. Florante A. Cayunda, Jr., Temporary 39
Presiding Officer. 40
The Honorable Mesias P. Arevalo, Member, gave the Invocation, followed by the 41
singing of the Pambansang Awit ng Pilipinas. 42
After which, the Honorable Niccolo J. Villasin, First Deputy Floor Leader, 43
presented a motion to dispense with the Panunumpa sa Watawat, the Leyte Hymn, the 44
PBMLP Hymn and the PBMLP Creed, and was duly seconded by Honorable Ma. 45
Corazon E. Remandaban, of the 3rdDistrict of Leyte. 46

Mr. Andre S. Sanico, Temporary Secretary to the Sanggunian made the roll call 47
to determine the presence of quorum for the day’s session. The presence of eleven (11) 48
Members was known. 49
He informed the Body that the Secretariat is in receipt of a letter coming from the 50
Office of Board Member Alan Ang informing this August Body that he cannot attend the 51
day’s session as he was an Official Business in the 3RD District of Leyte. Likewise, noted 52
for the Honorable Carlo P. Loreto, Vice-Governor that he was on Official Business in 53
Manila. Hence a quorum was announced. 54

our Internal Rules of Procedures, that during our counting as “physically present “in the 143

attendance because he was not physically present. So I guess we make it a practice in 173
our session that whenever there are signatories in our attendance and are not 174
physically present then automatic e-strike out lang ang pangalan diyan sa attendance 175
nayan, otherwise he or she is on official business. Just an observation Mr. Chair. 176

From the Chair. I have here a copy of the Internal Rules of Procedure. 225
RULE IV SECTION 1, it says here: 226
Upon every roll call the name shall be called by 227 Districts except when two or more have the same 228
Surnames the full name shall be called. 229 230 Second paragraph – 231 232 The calling of the roll of members at the start of 233 the session may be dispensed with upon motion of the 234 Sangguniang Panlalawigan are all present, unquote. 235
Meaning to say, when the Secretariat calls the roll he should state every name of 236
every Member then the member will say “present” or “absent”. 237
Instead of basing by calling the roll in the attendance sheet every member by 238
district and that member should say present. So there’s no need actually to amend the 239
rules. We just follow the rules. 240

To enlighten the thinking of my partner here the Honorable Gina Merilo, I would 272
also like to make it understood that those members who are on official business or 273
official travel are exempted here in this ruling. Because sometimes you know, there is 274
coincidence with certain activity in a barangay and you have to attend. So you write a 275
letter excusing yourself because you are on official business. So, meaning that would 276
not be tantamount of being absent. 277

taken into consideration because you have already a letter. But during you signed the 286
attendance sheet then you go out the session hall that is what Board Member Villasin is 287
saying that you should also be deleted from the list of those who are present. Thank 288

back, it would affect the quorum. Then if someone would question the presence of 298
quorum that time then we can no longer proceed with the other matters. If it would not 299
affect the quorum then it’s okay. 300

Let’s not be too strict on the quorum. Aw deri gad signgon nga strikto. We change the 311
session day to Monday. Today I have a committee hearing a public hearing. I have to 312
go there to take an attendance and to come here informing me nga may session yana 313
and I have to attend. At 4:00 o’clock I have to go back kay may MDC Meeting ha Palo. 314
So, if that is the case Mr. Chair I think we should, you know, be practical. Anyway, we 315
are all responsible hit aton attendance and then waray hihimuon. Bis’ kita nagawas I 316
am sure there are more pressing matters ahead before hiton session. Like for example 317
today. So important ine nga aton session so I just came here. Late ako pero nag-effort 318
ako when my staff texted me. Waray ngane ak hit plano because I’m not in a formal 319
uniform today. Kay waray man ko mag hunahuna nga I will attend the session. So 320
that’s only my point Mr. Chair. Let everybody be responsible hiton attendance. 321

that will work. If that is the case Mr. Chair let’s have originally, let’s go back to our 329
original schedule. Para iton amon nga time hiton Tuesday. Sigurado naako hit kulop na 330
it will be set aside na nga waray naba activities, Mr. Chair. 331

Mr. Chair actually there is no problem if, let’s say, for example there are nine (9) 333
members present and one in the middle of the session leaves because no quorum. But 334
if the members are only eight (8) and then one leaves with no intention of coming back 335
then there might be a question on our quorum. It may, from any member of the council 336
but like for example, in one municipality, where the opposition is really very strong. And 337
they move for approval then they questioned it during the time of the approval of certain 338

ordinance, were only seven (7) present so there was no question. So it might be 339
questioned and would affect the validity of the ordinance. But what if in the middle of 340
the session someone leaves but there’s no sufficient members constituting a quorum to 341
treat any business of the day. But the one who leaves and there’s a question that would 342
affect the quorum of those who are physically present then we have to strike off the 343
name. 344

For clarification, we have two (2) pending motions. First is, we have to approve 347
or adopt the minutes of November 20, 2017. And the second, there is a consolidated 348
motion of Honorable Apostol and Honorable Villasin to be physically present during the 349
session who is listed in the minutes of the regular session. 350

Yes Mr. Chair. I just would like to ask for clarification because what I know Mr. 353
Chair that when he signs the attendance he should be physically present. Di man liwat 354
kita mag attendance dinhi hin waray la. May point is we may adjourn if someone is not 355
physically present. After a while mayda ka gen lakat then somebody will question your 356
presence then pwede ka absenan. That is my point Mr. Chair. And Mr. Chair since 357
year end naman ine, let’s defer the consideration of the second resolution and that 358
everybody is happy of what we are doing Mr. Chair. Because I’ve been hearing also 359
like myself hiton aton session para diri kita maworok, nag-iiba-iba. And some would like 360
the same we will be strict on our attendance. So I strongly suggest in the spirit of 361
Christmas let’s hold in abeyance the second resolution. And then after our break we can 362
discuss ano gud iton dapat naton buhaton in terms of attendance because everybody is 363
willing to attend. Di kita maaram that will just cause conflict. Absent ka, kuan ka, so I 364
am sure that will affect the relationship hiton nagpipinan ngoan hiton absent hiton usa 365
ka tawo nga that is his, nga iya man ito responsibility, Mr. Chair. That is only my 366

Yes, as I perused the ordinance, I don’t see any conflict with the…I do not know 1005
with the LINA Law considering that this ordinance is anti-squatting, as if they do not 1006
allow illegal settlers in any property. But I think for the LINA Law, they are protecting the 1007
squatter’s nga aada. I do not know if there are free conditions. I am not well-versed of 1008
that law, Mr. Chair, but I think the intention of the Municipality of Javier is to avoid the 1009
squatters in their area. So before entering, they already… kon baga, dere na 1010
ipapasulod. You penalize the Barangay Chairman if they allow squatting without 1011
permission or dere amo it tag-iya, they are being penalized. But for the LINA Law, dere 1012
poyde magpa-eject heton squatters. Anyway, Mr. Chair, if there’s really a conflict of this 1013
ordinance considering that there are separability and repealing clauses, then we will 1014
just look into it na lang. At least Mr. Chair, the municipality has this intention to get rid of 1015
these squatters, kay talaga that’s the problem of the Local Government Units hini nga 1016

municipality of Matalom, Leyte, an ordinance enacting the Ecological Solid Waste 2245
Management Ordinance of Matalom, Leyte. 2246
The Provincial Legal Office Mr. Chair in its second indorsement dated November 2247
17, has recommended for the declaration of this ordinance’ validity. And this is in 2248
consonance with Section 56 (c) of the Local Government Code and Section 447 pa. 5 to 2249
provide for an efficient and effective system of Solid Waste and Garbage Collection and 2250
Disposal. 2251
So the Provincial Legal office has recommended that the same be valid provided 2252
with the community service, as provided for under Section 4 Article 10 of the said 2253
ordinance, the same does not violate the Constitutional prohibition against involuntary 2254
servitude. 2255

Ordinance setting guidelines for the Prevention and Control of Crime in the municipality 2283
of Matalom, Leyte. 2284
The Provincial Legal Office Mr. Chair has recommended for the declaration of 2285
this ordinance valid basing on Section 56 of the Local Government Code, promotion of 2286
the general welfare, a police power as provided under Section 16. However, the 2287
Provincial Legal Office put a caution that although they recommended that the same be 2288
valid, provided that the cash incentive provided under Section 7 of the said ordinance 2289
will not violate the prohibition under Section 335 Chapter 4 of the Local Government 2290
Code that the use of public money or property for private purposes. 2291

Mr. Chair, upon perusing the ordinance, I immediately, noticed that there would 2303
be violations of the constitutional rights of the individuals. Like for example requiring 2304
those who are non-residents to submit police clearance and other documents Mr. Chair. 2305
Otherwise, the penalty in Section 6 thereof they are not allowed to stay or live in the 2306
barangays within the jurisdiction of the municipality. Mr. Chair, to my mind this could be 2307
violative of the right to travel guaranteed by the Constitution. Again, I have several 2308
questions Mr. Chair with respect to because to my mind again, based on my own 2309
interpretation, it would be violative of the equal protection clause even the due process 2310
clause can be violated by the ordinance. The right to travel should not be breached 2311
except for if there are valid grounds, but I don’t think because of their failure wholly to 2312
submit the necessary requirements. Or even the imposition of requiring such 2313
requirements would be violative Mr. Chair of the Bill of Rights. I may be mistaken, Mr. 2314

Another ordinance coming from Matalom, Leyte, Ordinance No. 05 series of 2384
2017, An Ordinance Declaring November 18 of every yeas as the Official Founding 2385
Anniversary of the Municipality of Matalom, Leyte. 2386
The Provincial Legal Office is again Mr. Chair recommended that the same be 2387
declared valid in its 2nd indorsement last November 17. And although they 2388
recommended that the same be declared valid, the Provincial Legal Office emphasized 2389
that the chosen date shall not be considered holiday, because under Section 27 2390
Chapter 7 of 1987 Administrative Code, only the President can proclaim any local or 2391
special day or a particular day or place as a holiday. And under the compendium local 2392
autonomy – all local government cannot proclaim any religion or local holidays only the 2393
President who is vested by law who has the prerogative. And since the ordinance of 2394
Matalom, Leyte only declared November 18 of every year as the official founding 2395
anniversary, the ordinance is silent whether the same is holiday or not. So this 2396
representation would like to recommend that the Municipal Ordinance No. 05 of 2397

period of time and without consideration of the proper due process, without the 2576
observance of due process clause but the penalty of 2 to 3 hours Mr. Chair in my 2577

service, then there is no violation on involuntary servitude. Just like being imprisoned, 2599
nobody wants to be imprisoned. But if there is a court saying that you should be 2600
imprisoned then you should follow the courts. So I think if this penalty will be imposed, 2601
the municipality must observe due process. It cannot just impose without filing of the 2602
cases in court. 2603
