    What is Disaster?

    A catastrophe, mishap, calamity or graveoccurrence in any area,arising from natural or man- made causes,or by accident or negligence,which results in substantial loss of lifeor human sufferingor damage to, and destruction of property,

    or damage to, or degradation of environment,and is of such a nature or magnitude as to bebeyond the coping capacity of the communityof the affected area. (DM A ct , 2005)

    Supreme Court Judgment - 20 Dec,1986 -Shriram Foods and Fertilisers Industries,Supreme Court has enunciated threeimportant principles :

    i. A hazardous industry owes an absolute and non-delegatable duty to the community to protect itfrom risk;

    ii. Such enterprises are absolutely liable for anyharm that may be caused.

    iii. Any compensation given must have a

    deterrent effect
