    U daljnjem tekstu zajedno se spominju kao stranke" ilipojedinano kao Korisnik", u sluajuVladeRepublikeHrvatske,odnosnoKomisija",usluajuEuropskekomisije.

    Buduida

    1) je dana 17. srpnja 2006. godine Vijee Europske unije donijelo Uredbu (EZ)br. 1085/2006kojom seuspostavlja Instrumentpretpristupnepomoi(IPA) .

    2) jedana12.lipnja2007.godineKomisijadonijelaUredbu(EZ)br.718/2007kojom seprovodiUredba Vijea (EZ)br. 1085/2006 kojom se uspostavlja Instrumentpretpristupne pomoi(IPA)2,kojomsedetaljnoodreujuprimjenjive odredbeoupravljanju ikontroli.

    3) je dana 29. studenog 2007. godine Komisija donijela Odluku br. C(2007)5734 kojom seodobravaviegodinji operativniprogramZatitaokolia"zapomoZajednice iz InstrumentapretpristupnepomoizakomponentuRegionalnirazvoj"uHrvatskoj.Dana23.listopada2012.godineKomisijaje donijela Odlukubr.C(2012)7401kojom semijenja viegodinji operativni

    programZatitaokolia".

    4) su dana 27.kolovoza 2007. godine Korisnik i Komisija sklopili Okvirni sporazum kojim suutvrena pravila suradnje u vezi s financijskom pomoi Europske unije iz instrumenta

    pretpristupnepomoi(IPA).

    5) sudana10.studenog2008.godineKorisnik iKomisija sklopiliSporazumofinanciranju kojimsu utvrene konkretne odredbe za provedbu viegodinjeg operativnog programa Zatitaokolia".TajjeSporazumofinanciranju stupionasnagu 15.prosinca2008.godine. IzmijenjeniSporazumofinanciranjuje sklopljen 13.prosinca2012.godine,astupiojenasnagu22.oujka2013.godine.

    6) je u skladu slankom 54. Sporazuma o financiranju Operativna struktura 28.prosinca 2012.godinepredalaKomisijiprijavu velikogprojektaPoboljanje vodne infrastrukture u Osijeku",kojapredviadoprinosizInstrumentapretpristupnepomoiuokviruPrioritetneosi2- Zatita

    Prihvatljivi izdaci

    1. Izdacinastaliuprovedbiprojektaprihvatljivi suzasufinanciranje izprogramaIPAako:

    a) su stvarno nastali unutar razdoblja prihvatljivosti utvrenog u lanku 3. ipotkrijepljeni su izdanim fakturama ili raunovodstvenom dokumentacijomistovjetnedokaznevrijednosti;

    b) su ugovori zbog kojih su takvi izdaci nastali u skladu s projektom odobrenim

    OdlukomKomisijebr.C(2013)4058od26.lipnja2013.godine;

    c) sunastaliu skladu snaelimadobrog financijskog upravljanja, aposebno naelom

    ekonominosti iisplativosti;te

    d) su u skladu spravilimaprihvatljivosti propisanima u Poglavlju VI. Sporazuma ofinanciranju.

    1. Nadzor se odnosi na uporabu sustava informacija radi praenja napretka u provedbiprojekta. Unadzoru sekoriste financijski ifizikipokazatelji koji omoguuju usporedbustvarnognapretkapremadovretkuprojekta sIndikativnim rasporedom aktivnosti/PlanomizdatakakojisupredstavljeniuDodatkuovomSporazumu.

    2. Provedbaprojektanadzire seu skladu sodredbamaPoglavlja XIII. (Nadzor i evaluacija)Sporazumaofinanciranju. Toe,izmeuostalog,zahtijevati:

    a) Operativnu strukturu i, gdjejepotrebno, relevantnog Ugovaratelja, koja e voditiaktivnostinadzoraprojekta;

    b) Sektorskinadzorniodborkojipreispitujenapredovanjeprovedbe;

    c) pripremuevidencijaonadzorukojeosiguravaKomisija; teevidencijeonadzoruineglavnidio sektorskog godinjeg izvjea oprovedbi u skladu slancima 84. i85.Sporazumao financiranju;

    d) posebna iliad-hoc izvjea onadzoru, akoOperativna struktura ili slube Komisijetosmatrajununim;

    e) fizike terenskeprovjere.

    Izmjenaprojekta

    1. Svaka izmjena odobrenog projekta zahtijeva odobrenje Komisije izmjenom odluke ilirazmjenompisamaizmeuKorisnikaislubiKomisije.

    2. Izdacivezaniuzfiziki objektkoji suizmjenom uvedeniuprojektprihvatljivi suoddatumaodobrenja izmjeneodstraneKomisije.

    3. Svaka izmjena projekta predstavljenog u Dodatku koja djeluje na sadraj OperativnogprogramaZatitaokolia"zahtijevatenesamoodlukuKomisijeoizmjenikojaseodnosi

    naprojekt, ve i odluku o izmjeni operativnog programa. Stoga se takvi zahtjevi zaizmjenom projekta prihvaaju samo ako se predaju zajedno s nunim zahtjevom zaizmjenomoperativnogprograma.

    4. Svakavea izmjenaprojekta, opisanoguDodatku,zahtijeva odobrenje Komisije izmjenomodluke. Takve izmjene morajubitipotkrijepljene pravilno motiviranim zahtjevom koji se

    morapredatiprijeistekarazdobljaprihvatljivosti izdatakadefiniranogulanku3.

    Izmjena sesmatraveomkad ukljuuje:

    a) promjenubilokojeg odelemenata opisanihu tokama4.(Opisprojekta) i5. (Ciljevi)Dodatka; ili

    b) svakupromjenu iznosadoprinosaizprogramaIPAdodijeljenogprojektu; ili

    c) promjenuprihvatljivih izdatakaprojekta; ili

    d) znaajnupromjenu fizikihobiljeja ilifunkcionalne svrheprojektakojom se mijenjajunjegovi ciljevi, ukljuujui dodavanje fizike komponente koja nije obuhvaena

    izvornomodlukom;ili

    e) promjenuuuvjetimavlasnitvailiupravljanjaprojektom.

    5. Svaka manja izmjenaprojekta moe se odobriti razmjenom pisama izmeu Korisnika islubiKomisijenatemeljupravilnomotiviranogprijedlogakoji semorapredatiprije istekarazdobljaprihvatljivosti izdatakadefiniranogulanku3.

    Izmjena se smatra manjom u svim sluajevima osim onima navedenima u stavku 4.,posebnokadseodnosina:

    a) produljenje razdobljaprovedbeizvornopredvienoguprijaviprojekta;ili

    b) izmjene i dopune Indikativnog rasporeda aktivnosti/Plana izdataka koje nisu

    obuhvaenegornjim stavkom4.tokac);ili

    c) promjenu fizikih obiljeja ili funkcionalne svrheprojekta koja ne utjee na njegoveopeciljeve.

    6. Sektorskinadzorniodbormorabitiobavijetenoprijedlozimazaveimimanjim izmjenamaprojekta.

    7. Opeje pravilo dabibroj veih izmjena projekta koje zahtijevaju odluke Komisije oizmjenama

    trebalo

    svesti

    na

    najmanju

    moguu

    mjeru.

    8. Svakizahtjev zaizmjenom,bilaonaveailimanja, razmotriteKomisijazasvakipojedinisluaj.

    9. Komisija zadravapravo odbiti zahtjeve za izmjenom projekta kojibi doveli do takvihizmjenaoperativnogprogramakojeonasmatraneprihvatljivima.

    lanak10.Posebniuvjeti

    1. Dobivanje energije iz mulja treba biti ukljueno u natjeaj za ureaj za proiavanjeotpadnihvodaiuidejniprojektureajapostavljanjem kogeneracijskog postrojenja.

    2. Srednjorono i dugorono rjeenje za obradu mulja morabiti uspostavljeno prije istekakratkoronogrjeenja zaskladitenje mulja.

    3. Za vrijeme trajanja projekta potrebnoje poduzeti mjere kojima se ljude potie da seprikljuenasustavodvodnje (npr.promidbenemjereusklopuprojekta,poticaji...).

    HrvatskeaobuhvaagradOsijek inizokolnihnaselja.

    Projekt ukljuuje mjere napolju odvodnje iproiavanja otpadnihvoda kojima e seosiguratiusklaenostsDirektivomoproiavanjukomunalnihotpadnihvoda,temjerenapoljuvodoopskrbekojimaeseosiguratiusklaenostsDirektivomovodizapie.

    Mjere na polju odvodnje i proiavanja otpadnih voda ukljuuju proirenje ipoboljanje postojeeg sustava odvodnje i izgradnju ureaja zaproiavanje otpadnihvoda, tobi rezultiralo svoenjem isputanja oneiujuih tvari u rijeku Dravu (slivDunava)nanajmanju moguumjeru.Ovamjera imauinaknaoko135.000ljudi,avezanajeuzMjeru 2.2Operativnogprograma: Izgradnja ureaja zaproiavanje otpadnihvodaizkuanstavaiindustrijanadogradnjakanalizacijskemree.

    Mjere napolju vodoopskrbe ukljuuju rekonstrukciju ipoboljanje vodoopskrbne mree inadogradnjupostrojenja zakondicioniranje vode radiuklanjanja arsena, toedovestidosigurne ipouzdane opskrbe vodom zapie. Ova mjera djeluje na oko 125.000 ljudi, avezanaje uz Mjeru 2.1 Operativnog programa: Uspostava modernih vodoopskrbnihsustavaimrea.

    Trenutno 84% stanovnika u aglomeraciji Osijek imapristup mrei odvodnje. Mreajeduga 370kilometara iukljuuje velikbroj crpnih stanica. Otpadne vodeprikupljaju dvaglavnakolektora. Sveotpadne vode koje seprikupe u aglomeraciji Osijek odvode sedotoke ispusta krajNemetina, na istonom rubu Osijeka. Otpadne vodeprije isputanjaprolazekrozgrubureetku.

    Aglomeracija Bilje/Darda, koja se nalazi sjeverno od Osijeka, bit e spojena naaglomeraciju Osijek u svrhu proiavanja otpadnih voda u centralnom ureaju zaproiavanjeotpadnihvodagradaOsijeka.

    Ukupanteretoneienjakojiproizvedustanovnici (123.000ES)iindustrija (47.000ES)uaglomeracijama Osijek i Bilje/Darda trenutno iznosi oko 170.000 ES. Industrijskooneienje izvedenoje iz trenutno mjerenih iprocijenjenih podataka. Samojedna odindustrija ima ureaj za prethodno proiavanje. Oekuje se da e ukupan teretoneienjakrozitavorazdoblje trajanjaprojektaostativieilimanjekonstantando2020.godine,apotomseblago smanjivati.

    Trenutno se gotovo sva sirova voda zahvaana crpilitu Vinogradi. U sklopu aktivnosti

    vodoopskrbe, glavno je pitanje kvaliteta vode s crpilita Vinogradi. Premda sekondicionira, isporuena vodane ispunjava zahtjeve Direktive ovodi zapie (upogledusadraja arsena- kreeseoko30-40ug/1).Vodoopskrbnamreakojomupravlja VodovodOsijek dugaje oko 470 km i obuhvaa oko 39,590 mjerenih prikljuaka (114.000stanovnika). Distribucijski sustavje zastario s oko 50% mree starije od 30 godina, aizgraenjeodnizamaterijala(HDPE,PVC,lijevanoeljezo i azbestni cement). Mrea trpi

    visoku razinu tehnikih gubitaka (oko 40%), za ijeje rjeavanje predloen dugoroniprogram(izvanpredloenogprojekta).

    Glavnizahvatiusklopuprojektasu: Proirenjekanalizacijskemreeutrinaselja- epin,Brijee iTenja- sukupnooko

    18,000stanovnika,gdjetrenutnopostojitekogranienbrojprikljuaka;

    Izgradnja i rekonstrukcija sjevernog kolektora i izgradnja ureaja zaproiavanjeotpadnih voda (s treim stupnjem proiavanja kapaciteta 170,000 ES) koji bipokrivaoaglomeracijeOsijek iBilje/Darda;

    Proirenje osjekogpostrojenja za kondicioniranje vode, to ukljuuje poboljanosmanjivanje sadraja arsena,kaoimanjemjerezaunapreivanjepouzdanosti iradneuinkovitostimreezadistribucijuvodezapie.

    Komponenta Al, A2 i A3:Proirenje kanalizacijske mree u tri naselja: epin,Brijee iTenja.KomponentaA4:Izgradnja irekonstrukcijaosjekogSjevernogkolektora;KomponentaE:Izgradnjaureajazaproiavanje otpadnihvoda(UPOV)streimstupnjemproiavanja (osjetljivprijemnikdunavskogsliva)kapaciteta170.000ESza proiavanje svih otpadnih voda proizvedenih u aglomeraciji Osijek i uaglomeraciji Bilje/Darda;

    Vodoopskrba

    Smanjiti nekontrolirano isputanje otpadnih vodaupodzemne vodeu svrhu zatite

    Smanjitiuestalostprelijevanja izkanalizacijskemreeuotvorenavodnatijela Osiguratidostatnekoliinekvalitetnevodezapiezaopskrbu stanovnitva

    Nie navedenipokazatelji mogu se, ako se to smatra nunim, korigirati,posebno nakonzavretka procesa ugovaranja. U tom sluaju, konana vrijednost pokazatelja bit epotvrenarazmjenompisamaizmeuOperativnestruktureislubiKomisije.

    komunalnim drutvima za vodoopskrbu i odvodnju u Bilju i Dardi.Na zadnjoj crpnojstanici,prijeulaskaukanalizacijski sustavOsijeka,mjerit eseprikupljene koliine teeVodovodOsijekfakturiratinaknadezaproiavanje operatorimamreeuBilju/Dardi.

    Vanoje da seradnareformi sektoranastaviu skladu sDugoronimplanomulaganja uvodoopskrbu i odvodnju i proiavanje otpadnih voda, utemeljenim na stratekimciljevima utvrenima u Strategiji upravljanja vodama, kakoje navedenopodB.4.I.,podpodnaslovomDoprinosciljevima Strategijeupravljanja vodama"istratekimoperativnimciljevimaVodovodaOsijek kojiproizlaze izbuduegokrupnjavanja komunalnih drutavazavodoopskrbu iodvodnjuuregionalnokomunalnodrutvozavodoopskrbu iodvodnju.

    Za sve komponente projekta dobivenaje suglasnost zaprovedbu zahvata odobrenjemrelevantnihStudijautjecaja naokoli.Provedene sutriodvojeneprocjeneutjecaja zahvatanaokolitijekom2004.i2005.godine:

    1) Vodoopskrbno podruje Osijeka (ne ukljuujui nadogradnju postrojenja zakondicioniranje vodekojeje obuhvaeno ocjenom opotrebiprocjene utjecaja zahvatanaokoli2011.godine)

    2)SustavodvodnjegradaOsijeka, te

    3)Izgradnja ureaja zaproiavanje otpadnih vodaOsijek (umeuvremenuje kapacitetUPOV-asmanjen s250.000ESna170.000ES).

    JavneraspravezasvetriStudijeutjecaja na okoli bile su oglaene u lokalnim novinama.

    Za vrijeme trajanja javnih rasprava zaprimljena je jedna primjedba vezana uz sustav

    vodoopskrbe, na koju je autor Studije utjecaja na okoli pripremio odgovor, koji je

    Povjerenstvo odobrilo. Za ostale komponente nisu zaprimljena nikakva miljenja,prijedlozi iliprimjedbe.

    U oujku 2011.godine relevantno Ministarstvoje izdalo Rjeenje (na temelju ocjene opotrebiprocjene utjecaja zahvata na okoli) da supostupci vezani uzprocjenu utjecajazahvata na okoliprovedeni u skladu s vaeim zakonodavstvom RH i EU i da daljnjaprocjenanijepotrebna.Ministarstvojezakljuilodautjecaji zahvatanisuznaajni.

    Projekt senalazinamalojpovrini(3ha)uzrubpodrujaekolokemreeNATURA2000.Ministarstvo zatite okolia iprirodeje izdalo miljenje da zahvat nee imati znaajnijiutjecaj na cjelovitost predmetnih podruja. Pojanjeno je da izbjegavanjem ometanjaciljanih vrsta projekt nee imati znaajniji utjecaj na populacije ciljanih vrsta.Poboljanjem stanja okolia smanjit e se trenutnipritisak na kvalitetu vode nizvodno iosigurati bolji ekoloki uvjeti za ciljane vrste. Ministarstvo je stoga zakljuilo da

    predloenizahvatnee imatiznaajniji utjecaj napodrujaouvanjaprirode,testoganijebilopotrebnoizraditiprocjenuuinkauskladuslankom6.stavkom3.

    Zavrijemegraenjakaoizavrijemeprobnogradapredvienojeviemjerazatiteokolia.Nakonprestanka rada,provodit e semjerepraenja stanja okoliapropisane u RjeenjuMinistarstva.

    Hereafter jointly referred to as "the Parties" or individually as "the Beneficiary", in the case of the

    Government of the Republic of Croatia, or "the Commission", in the case of the European

    Commission,

    Whereas

    1) On 17 July 2006, the Council of the European Union adopted Regulation (EC) No 1085/2006establishing an Instrument for Pre-Accession Assistance1 .

    2) On 12 June 2007, the Commission adopted Regulation (EC) No 718/2007 implementing

    Council Regulation (EC) No 1085/2006 establishing an instrument for pre-accession

    assistance (IPA)2 detailing applicable management and control provisions.

    3) On 29 November 2007, the Commission adopted Decision C(2007)5734 approving the multi-annual operational programme "Environmental" for Community assistance from theInstrument for Pre-Accession Assistance for the Regional Development Component inCroatia. On 23 October 2012, the Commission adopted Decision C(2012) 7401 modifying themulti-annual operational programme "Environmental".

    4) On 27 August 2007, the Beneficiary and the Commission concluded a Framework Agreementsetting out the rules for co-operation concerning the EU financial assistance from theInstrument for Pre-Accession Assistance (IPA).

    5) On 10 November 2008, the Beneficiary and the Commission concluded a FinancingAgreement laying down specific provisions for the implementation of the multi-annual

    programme "Environmental". This Financing Agreement entered into force on 15 December

    2008. A modified Financing Agreement was concluded on 13 December 2012 and enteredinto force on 22 March 2013.

    6) In accordance with Article 54 of the Financing Agreement, on 28 December 2012, theOperating Structure submitted to the Commission the major project application: "OsijekWater Infrastructure Improvement Project", which envisages a contribution from theInstrument for Pre-Accession Assistance under priority axis 2 - Protecting Croatia's water

    resources through improved water supply and integrated wastewater management systems - ofthe multi-annual operational programme "Environmental".

    7) On 26 June 2013, the Commission adopted decision C(2013) 4058 approving a Community

    contribution to the major project "Osijek water infrastructure improvement project".

    8) In accordance with Article 54 of the Financing Agreement, the decision of the Commissionapproving the project should be followed by a Bilateral Project Agreement with theBeneficiary.

    HAVE AGREED AS FOLLOWS:

    Article 1

    Subject matter

    1. This Bilateral Project Agreement is concluded between the Government of the Republic ofCroatia and the European Commission. It concerns the major project "Osijek waterinfrastructure improvement project" adopted by Commission Decision C(2013) 4058 asdescribed in the Annex. All documents and correspondence pertaining to this project shall

    bear the reference CCI 2013 HR 16IPR 001.

    Article 2

    Project funding

    1. The eligible expenditure, calculated in accordance with Article 150 of Regulation (EC) No718/2007, is set at EUR 62.350.110,74.

    2. The co-financing rate for the priority axis 2 - "Protecting Croatia's Water Resources throughImproved Water Supply and Integrated Wastewater Management Systems" - of theoperational programme "Environmental" applies to the project. The maximum IPAcontribution to the project is set at EUR 52.997.594,13.

    3. The IPA contribution to the co-financing of the project is subject to the fulfilment of theprovisions of this Bilateral Project Agreement and the obligations and conditions set out inthe Framework Agreement, Financing Agreement as well as the regulatory and conventionalframework applicable to pre-accession assistance.

    Article 3

    Eligibility period

    1. The eligibility period is as laid down in Articles 11(3), 34, 43 of the Financing Agreement.

    Article 4

    Eligible expenditure

    2. Expenditure incurred in the implementation of the project shall be eligible for IPA co-

    financing if:

    a) it has been actually incurred within the eligibility period referred to in Article 3 andis supported by receipted invoices or accounting documents of equivalent probativevalue;

    b) contracts giving rise to such expenditure are consistent with the project, as adoptedby Commission Decision C(2013) 4058 of 26 June 2013;

    c) it has been incurred in accordance with the principles of sound financial management

    and, in particular, of economy and cost-effectiveness and

    d) it conforms to the eligibility rules laid down in Chapter VI of the FinancingAgreement.

    Article 5

    Agreement

    1. An agreement, as laid down in Article 51(3) of the Financing Agreement, must be signedprior to the commencement of any contract within the project. The agreement shall alsodefine the modalities of handing over the project to the end recipient of assistance after itscompletion.

    2. A signed copy of the agreement shall be sent to the Commission services.

    3. Notwithstanding paragraphs 1 and 2, the requirements of Article 27 of the Financing

    Agreement remain applicable.

    Article 6

    Procurement rules and procedures

    1. The procurement rules and procedures to be followed are stipulated in Articles 44, 46 and 48of the Financing Agreement. Where applicable, the rules laid down in Article 20 of the

    Financing Agreement governing procurement by International Financial Institutions (IFIs)shall also apply.

    2. In duly substantiated exceptional cases, derogation from the rules of participation and originmay be authorised by the Commission pursuant to Article 19(6) of Regulation (EC) No1085/2006.

    Article 7

    Monitoring

    1. Monitoring refers to the use of a system of information in order to trace the progress made inimplementing the project. Monitoring shall use financial and physical indicators whichenable actual progress towards completion oftheproject to be compared with the Indicative

    Work Schedule/Expenditure Plan presented in the Annex to this Agreement.

    2. The implementation of the project shall be monitored in line with the stipulations of ChapterXIII (Monitoring and Evaluation) of the Financing Agreement. This, amongst others, willrequire:

    a) the Operating Structure, and where appropriate the relevant Contracting Authority,managing the project monitoring activities;

    b) the Sectoral Monitoring Committee reviewing the progress of implementation;

    c) the preparation of the monitoring sheets provided by the Commission; these monitoringsheets form the principal part of the sectoral annual report on implementation inaccordance with Articles 84 and 85 of the Financing Agreement;

    d) special or ad-hoc monitoring reports, if deemed necessary by the Operating Structure or

    the Commission services;

    e) physical on the spot checks.

    Article 8

    Evaluation

    1. An assessment of the project may be carried out during its implementation at the request ofthe Beneficiary, or on the initiative of the Commission, in order to assess whether the projectis proceeding towards completion in accordance with the objectives originally laid down inthe Annex to this Agreement and to propose adjustments to take account of problemsencountered during implementation.

    2. An ex-post assessment of the impact of the project may be carried out by an assessorappointed either by the Beneficiary or the Commission once the project has been completed.

    Article 9

    Project modification1. Any modification to the approved project shall require the approval of the Commission by

    way of a modifying decision or by exchange of letters between the Beneficiary and theCommission services.

    2. Expenditure relating to a physical object introduced in the project by way of a modification

    is eligible from the date of approval of the modification by the Commission.

    3. Any modification to the project described in the Annex which affects the content of theoperational programme "Environmental", will necessitate not only a Commission modifying

    decision concerning the project, but also a decision concerning modification of theoperational programme. Therefore, such project modification requests are receivable only ifsubmitted in parallel with the necessary request for a modification of the operational

    programme.

    4. Any major modification to the project, as described in the Annex, requires the approval by

    the Commission by way of a modifying decision. Such modifications must be supported bya duly motivated request to be submitted before the end of eligibility period referred to inArticle 3.

    A modification is consideredmajorwhen it involves:

    a) a change in any of the elements described in points 4 (Project Description) and 5(Objectives) of the Annex ; or

    b) any change in the amount of IPA contribution allocated to the project; or

    c) a change in the eligible expenditure of the project; or

    d) a substantial change in the physical characteristics or the functional purposes of theproject, which alter its objectives, including the addition of a physical component notcovered by the original decision; or

    e) a change in the conditions of ownership or operation of the project.

    5. Any minor modification to the project can be approved by way of an exchange of lettersbetween the Beneficiary and the Commission services, on the basis of a duly motivatedproposal to be submitted before the end of eligibility period referred to in Article 3.

    Except in cases referred to in paragraph 4, an amendment is considered minor,and notably

    when it concerns,

    a) an extension to the period of implementation initially envisaged in the project

    application; or

    b) amendments to the Indicative Work Schedule/Expenditure Plan that do not fall under

    paragraph 4 point c ); or

    c) a change to the physical characteristics or functional purposes of the project that does

    not affect its overall objectives.

    6. The Sectoral Monitoring Committee shall be informed about major and minor project

    modification proposals.

    7. As a general rule, the number of major project modifications requiring Commission

    modifying decisions should be kept to a minimum.

    8. Each request for a modification, be it major or minor, will be examined by the Commission

    on a case-by-case basis.

    9. The Commission reserves the right to refuse project modification requests which would

    result in modifications of the operational programme it deems unacceptable.

    Article 10

    Special Conditions

    1. Energy recovery from sludge should be included in the tender for waste water treatment

    plant and in the design concept for the plant by installing a combined heat/power plant.

    2. Mid-term and long-term sludge treatment solution needs to be in place before the expiry ofthe short-term solution of sludge storage.

    3. Measures need to be taken during the lifecycle of the project to stimulate the take-up bypeople of a sewer connection (e.g. publicity measures from the project, stimulations...).

    This Bilateral Project Agreement is drawn up in duplicate in the English language.

    north east of the country and comprises the city of Osijek and a number of surroundingsettlements.

    The project includes measures inwaste water collection and treatmentwhich will ensurecompliance with the Urban Wastewater Directive, and measures in water supply whichwill ensure compliance with the Drinking Water Directive.

    The measures in Waste water collection and treatment include the extension andimprovement of the existing sewerage system and the construction of a waste watertreatment plant, resulting in minimisation of the discharges of pollutants to the Drava river(Danube river basin). The measure affects approx. 135.000 people and relates to theOperational Programme Measure 2.2: Construction of WWTP for domestic and industrialwastewater and upgrading the sewerage network.

    The measures in Water supply include reconstruction and improvements in the supply

    network and the extension of the water treatment facility for arsenic removal, resulting in

    safe and reliable drinking water supply. The measure affects approx. 125.000 people and

    relates to the Operational Programme Measure 2.1:Establishment of modern water supply

    and networks.

    Presently, 84% of the population in the agglomeration Osijek has access to a sewerage

    collection network. The network has a length of 370 kilometres and includes a large

    number of pumping stations. The waste water is collected in two main collectors. All waste

    water which is collected in the agglomeration Osijek is conveyed to the disposal point near

    Nemetin, at the eastern edge of Osijek. Waste water undergoes coarse screening before

    disposal.

    The agglomeration Bilje/Darda which is located to the North of Osijek will be connected to

    the agglomeration Osijek for the purpose of the treatment of waste water in the central

    treatment plant of Osijek.

    The total pollution load generated by population (123.000 PE) and industry (47.000 PE) inthe agglomerations Osijek and Bilje/Darda currently amounts to approx. 170.000 PE. TheIndustrial pollution derives from currently measured and estimated data. Apart from one,none of industries have pre-treatment facilities. The total pollution load over the project

    period is expected to remain more or less constant till 2020 and thereafter to decreaseslightly.

    At the moment, almost all raw water is abstracted from the Vinogradi well field. Withinthe water supply activities, water quality of the Vinogradi well field is the main issue.Although treated, the supplied water does not meet the requirements of the Drinking WaterDirective (in terms of arsenic content - at around 30-40 ug/1). The water supply networkoperated by Vodovod Osijek has an overall length of approximately 470 km and servessome 39,590 metered connections (114,000 population). The distribution system is aged,with around 50%) of the network being more than 30 years old and is constructed of avariety of materials (HDPE, PVC, Cast iron and asbestos cement). The network is subject

    have a combined population of around 18,000 where at present only limitedconnectionsexist;

    Constructionandreconstructionofthenorthcollector(sewer)andtheconstructionofa wastewater treatmentplant (to tertiary treatment levels for acapacity of 170,000PE)thatwouldservetheOsijekandBilje/Dardaagglomerations;

    Theextension of the Osijek water treatmentplant including enhanced treatment ofarsenic as well as small measures to improve the reliability and operationalefficiency ofthepotablewaterdistributionnetwork.

    OBJECTIVES

    The overall objective of theproject is to improve the environmental quality andprotecthumanhealth intheOsijek areaby improving thecollectionandtreatmentofwastewaterandby improving the quality of water supply in compliance with the national and EUdirectives.

    Specific objectives are:

    Reduce the discharge of untreated waste water to the sensitive areas of the Danube

    river basin by appropriate treatment in Waste Water Treatment Plant in accordance

    with the requirements of the Urban Waste Water Treatment Directive

    Reduce the uncontrolled discharge of waste water to groundwater for the protection

    of water resources Optimize the performance of the Waste Water Treatment Plant by reduction of

    leakage in the sewer network

    Reduce the frequency of overflows from the sewerage network to open water bodies

    Provision of sufficient quantities of quality drinking water for domestic water supply

    SUMMARY OF THE MAIN RESULTS OF THE ECONOMIC AND SOCIAL COST-BENEFIT

    ANALYSIS

    According to the Cost Benefit Analysis (CBA) carried out by the Croatian Authorities, the

    principal indicators of the economic and social cost benefit analysis are as follows:

    - The estimated ENPV for the project is EUR 80.485.709 and the social discount rate

    used is 3,5 %.

    - The estimated Benefit/Cost ratio is 1,81.

    The estimated ERR=11.71%.

    SUMMARY OF THE FINANCIAL ANALYSIS

    Based on the information provided in the application form:

    The FNPV with IPA funding for the project is estimated at EUR -2.704.953

    The FRR with IPA funding is estimated at 4.18%

    - The eligible expenditure (funding gap rate of 85.99%) as calculated in accordancewith Articles 17 and 19 of the Financing Agreement is set at EUR 62.350.110,74.

    The IPA contribution is set at EUR 52.997.594,13.

    POLLUTER PAYS PRINCIPLE

    Increases in the water and wastewater tariffs are assumed to support the investmentprogramme. The Polluter Pays Principle is applied in the developing tariff forecasts inaccordance with Art. 9 of the Water Framework Directive 2000/60/EC. The tariff systemassumes the pollution to be proportional to the water consumption. The system applies tohouseholds and commercial/industry.

    System operation and maintenance costs following completion will fully be coveredthrough the water tariff from the price for the provision of water services. Likewise, sinceall the customers are equipped with flow meters, the amount to be paid by each customer

    will not be calculated in the lump, but exclusively on the basis of calculated consumption.A special form of the polluter pays principles is reflected in the water protection charge.This charge is included in the total price of water for all customer categories. The charge iscalculated in accordance with the level of pollution caused by each customer.

    FINANCIAL SUSTAINABILITY AND AFFORD ABILITY

    The financial analysis carried out by the Croatian Authorities shows that the project over

    its life time is financially sustainable.

    Affordability analyses indicates that the average monthly invoice for water and wastewaterto be paid by an average income households will be about 2,5% of the average monthly

    household income, and will decrease continuously to a level of 2,1%) by the year2043.

    OPERATION AND MAINTENANCE

    The Project Beneficiary is Hrvatske Vode. Hrvatske Vode is a national body whoseresponsibilities include infrastructure project development and implementation in the watersupply and wastewater sector. Following completion of the project, project assets will betransferred to Vodovod Osijek. The necessary and skilled staff should be in place inVodovod Osijek for the operation of the WWTP.

    The responsibility for the collection of waste water in the agglomeration Bilje/Darda lieson the local water companies/communal companies of Bilje and Darda. At the last pumpstation, before entering the sewerage system of Osijek, the collected quantities will bemeasured and Vodovod Osijek will invoice the treatment fees to the network operators ofBilje/Darda.

    It is important that the work on reform of the sector continues in line with the Long Term

    Investment Plan for water supply and waste water collection and treatment, based on the

    strategic objectives as formulated in the Water Management Strategy as referred to under

    B.4.1 under the subheading "Contribution to objectives of the Water Management

    Strategy" and Strategic Operational Goals for the Water company which result from the

    future consolidation of water companies into a regional water company.

    SUMMARY OF THE MAI N FINDINGS OF THE ENVIRONMENTAL IMPACTASSESSEMENT

    For all project components development consent has been given by the approval of therelevant Environmental Impact Assessment studies. Three separate EIAs were carried out

    during 2004 and 2005:

    1) Water supply region of Osijek (excluding the extension of the water treatment plant

    which is covered by the EI A screening in 2011)

    2) Sewerage system for City of Osijek, and

    3) Construction of waste water treatment plant Osijek (in the meantime the capacity of the

    WWTP was reduced from 250.000 PE to 170.000 PE).

    Public hearings and public discussions for the three EIA were advertised in localnewspaper. During the processes of public discussions there was one comment receivedconcerning water supply system on which the author of the EIA prepared an answer andthe Committee approved this answer. For other components there were no comments,opinions or proposals submitted.

    On March 2011 the relevant Ministry issued a Decision (based on the EIA screening study)that the procedures regarding Environmental Impact Assessment have been conducted inaccordance with valid national and EU legislation and that no further assessment isnecessary. The Ministry concluded that impacts of the project are not significant.

    The project is located on the edge of NATURA2000 sites on small area (3 ha). The

    Ministry of Environmental and Nature Protection issued an opinion that there will be no

    significant effect on the integrity of the sites concerned. It is elaborated that by avoiding

    disturbance of target species the project will not have significant influence on populations

    of target species. The improvement of environment condition will lower the existing

    pressure on water quality downstream and ensure better ecological conditions for targetspecies. Therefore the Ministry concludes that proposed project will have no significant

    effect on sites of nature conservation and therefore an appropriate assessment according

    Article 6 (3) was not deemed necessary.

    Several environmental protection measures are envisaged during the construction as well

    as during the trial operations period. After cease of the operation, programme monitoring

    measures shall be implemented as specified in the EIA decision.
