Regulations Amending the Food and Drug Regulations

His Excellency the Governor General in Council, on the rec­ommendation of the Minister of Health, pursuant to subsec­tion 300) of the Food and Drugs Act and subsection 55(1) of the Controlled Drugs and Substances Acta, hereby makes the annexed Regulations Amending the Food and Drug Regulations.

REGULATIONS A.t\1ENDING THE FOOD AND DRUG REGULATIONS

A..'JENDMENTS

1. Subparagraph C.Ol.004(1)(b)(ii)1 of the Food and Drug Regulationsl is replacw by the following:

(ii) the symbol "¥;}" in a clear manner and a conspicuous colour and size, in the case of a controlled drug, other than a controlled drug contained in an agricultural implant and set out in Part III of the schedule to Part G, and

2. Paragraph (b)3 of the definition ''phannacist'' in subsec­tion G.Ol.OOl(l) of the Regulations is replaced by the follow­ing:

(b) includes, for the purposes of sections G.Ol.OO2, G.Ol.003, G.03.002 to G.03.008, G.03.014, G.03.015 and G.03.017 and subsections G.05.003(3) and (4), a person who is registered and entitled under the laws of a province to practise phannacy and who is practising phannacy in that province; (pharmacien)

3.. The Regulations are amended by adding the following af­ter section G.Ol.OOl:

G.01.002. (1) A person is authorized to have a controlled drug set out in any of items 1 to 3 of Part I of the schedule to this Part in his possession where the person has obtained the controlled drug pursuant to these Regulations or in the course of ac:tivities performed in connection with the enforcement or administration of an Act or a regulation, and the person

(a) requires the controlled drug for his business or profession and is

(i) a licensed dealer, (ii) a phannacist, or (iii) a practitioner who is registered and entitled to practise in the province in which he has such possession;

(b) is a practitioner who is registered and entitled to practise in a province other than the province in which he has such

Reglement modifiant le Reglement sur Ies aliments et drogues

Sur recommandation du ministre de la Sante et en vertu du pa­ragraphe 30(1) de la Loi sur les aliments et drogues et du para­graphe 55(1) de la Loi reglementant cenaines drogues et autres substances', Son Excellence le Gouverneur general en conseil prend le Reglement modifiant le Reglement sur les aliments et drogues, ci-apres.

REGLEMENT MODIFIANT LE REGLEMENT SUR LES AL~NTSETDROGUES

MODIFICATIONS

1. Le sous-alinea C.Ol.004(1)b)(ii)' du Reglement sur les aliments et drogues l est remplace par ce qui suit:

(ii) le symbole «/6» inscrit clairement, d'une couleur et de dimensions bien ~sibles, s'il s'agit d'une drogue contr61ee autre qu'une drogue contr61ee contenue dans un implant agricole et mentionnee a la partie III de l' annexe de la par­tie G,

2. L'alinea b)3 de la definition de « pharmacien », au para­graphe G.Ol.OOl(l) du meme reglement, est remplace par ce qui suit:

b) s'entend en outre, pour 1'application des arti­cles G.01.OO2, G.Ol.003, G.03.002 a G.03.008, G.03.014, G.03.015 et G.03.017 et des paragraphes G.05.003(3) et (4), d'une personne inscrite et autorisee en vertu des lois d'une province aexercer la phannacie et qui exerce la pharmacie dans cette province. (pharmacist)

3. Le meme reglement est modlfie par adjonction, apres l'article G.Ol.OOl, de ce qui suit :

G.01.002. (1) Une personne est autorisee aavoir en sa posses­sion une drogue contr61ee mentionnee aux articles 1, 2 ou 3 de la partie I de l'annexe de la presente partie si elle l'a obtenue con­formement au present reglement ou lors de I'exercice d'une ac­tivite se rapportant a I'application ou a l'execution d'une loi ou d'un regiement et que, selon le cas :

a) elle a besoin de cette drogue pour son entreprise ou sa pro­fession, etant :

(i) soit un distributeur autorise, (ii) soit un phannacien, (iii) soit un praticien inscrit et autorise a exercer dans la province ou elle detient cette drogue;

b) elle est un praticien inscrit et autorise a exercer dans une province autre que celle ou elle detient cette drogue et la

possession and such possession is for emergency medical pur­poses only; (c) is a hospital employee or a practitioner in a hospital; (d) has obtained the controlled drug for his own use from a practitioner or pursuant to a prescription that is not issued or obtained in contravention of these Regulations; (e) is a practitioner of medicine who received the controlled drug pursuant to an authorization issued under subsec­tion G.06.00I(1) and whose possession is for a purpose set out in the authorization; if) is an agent of a practitioner of medicine who received the controlled drug pursuant to an authorization issued under sub­section G .06.00 1(1) and whose possession is for a purpose set out in the authorization; (g) is employed as an inspector. a member of the Royal Cana­dian Mounted Police. a police constable. peace officer or member of the technical or scientific staff of any department of the Government of Canada or of a province or university and such possession is for the purposes of and in connection with such employment; (h) is a person referred to in paragraph G.06.001(1)(a) or (d) who has been issued an authorization under subsec· tion G.06.00I(I) and whose possession is for a purpose set out in the authorization; or (i) is a person referred to in paragraph G.06.001(5)(b).

(2) A person is authorized to have a controlled drug referred to in subsectlon (1) in his possession where the person is acting as the agent for any person referred to in paragraph (1)(a) to (e), (h) or (0.

(3) A person is authorized to have a controlled drug referred to in subsection (l) in his possession where

(a) the person is acting as the agent for a person he has reason­able grounds to believe is a person referred to in para­graph (l)(g); and (b) the possession of the controlled drug is for the purpose of assisting that person in the enforcement or administration of an Act or a regulation.

4. The Regulations are amended by adding the following af· ter section G.02.002:

G.02.002.1 A licensed dealer is authorized to have a controlled drug in his possession for the purpose of exporting the controlled drug from Canada if he has obtained the controlled drug pursuant to these Regulations.

5. The Regulations are amended by adding the following af· ter section J.01.004:

J.01.004.1 A licensed dealer is authorized to have a restricted drug in his: possession for the purpose of exporting the restricted drug from Canada if he has obtained the restricted drug pursuant to these Re:gulations.

COMING INTO FORCE

6. These Regulations come into force on November 20,. 1997.

dans un h6pital; d) elle a obtenu cette drogue pour son propre usage d'un prati­cien ou en vertu d'une ordonnance qui n'a pas ete delivree ou obtenue en violation du present reglement; e) elle est un praticien de la medecine qui a re~u cette drogue conforrnement a une autorisation visee au paragra­phe G.06.00I(l) et qui l'a en sa possession aux fins enoncees dans I' autorisation; f) elle est un agent d'un praticien de la medecine qui a re~u

cette drogue conforrnement a une autorisation visee au para­graphe G.06.00I(I) et qui l'a en sa possession aux fins enon­cees dans l'autorisation; g) elle est employee a titre d'inspecteur, de membre de la Gen­darmerie royale du Canada, d'agent de police, d'agent de la paix ou de membre du personnel technique ou scientifique de tout service du gouvernement du Canada, d'une province ou d'une universite, et elle a cette drogue en sa possession dans le cadre de ses fonctions; h) elle est une personne visee aux alineas G.06.00I(l)a) ou d) qui a re~u une autorisation aux terrnes du paragra­phe G.06.00I(l) et qui a cette drogue en sa possession aux fms enoncees dans I'autorisation; i) elle est une personne vi see al'alinea G.06.001(5)b).

(2) Une personne est autorisee a avoir une drogue contr61ee mentionnee au paragraphe (1) en sa possession lorsqu'elle agit comme agent de toute personne visee aI'un des alineas (l)a) ae), h) eti).

(3) Une personne est autorisee a avoir une drogue contr61ee mentionnee au paragraphe (I) en sa possession lorsque :

a) d'une part, elle agit comme agent de toute personne dont elle a des motifs raisonnables de croire que celle-ci est une per­sonne visee aI'alinea (l)g); b) d'autre part, la possession de la drogue a pour but d'aider cette derniere dans I'application ou I'execution d'une loi ou d'un reglement

4. Le meme reglement est moditie par adjonction, apres l'article G.02.002, de ce qui suit:

G.02.002.1 Un distributeur autorise est autorise a avoir une drogue contr61ee en sa possession, en vue de son exportation, s'il l'a obtenue conforrnement au present reglement

S. Le meme reglement est moditie par adjonction, apres l'article J.01.004, de ce qui suit:

J.01.004.1 Un distributeur autorise est autorise a avoir une drogue d'usage restreint en sa possession, en vue de son exporta­tion, s' ill' a obtenue conforrnement au present reglement

6. Le present reglement entre en vigueur le 20 novembre 1997.
