El borrador del Acta de las sesión plenaria anterior de fecha 25.01.2012, resulta aprobada en su integridad, por unanimidad de los trece miembros corporativos que de hecho y derecho componen la Corporación Municipal, procediendo a su trascripción al Libro de Actas según lo dispuesto por el Art. 110.2 del Real Decreto 2568/1986 de 28 de noviembre por el que se aprueba el Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Corporaciones Locales.

3.-DESIGNACIÓN DE LOS MIEMBROS DE LAS MESAS ELECTORALES, ELECCIONES AL PARLAMENTO ANDALUZ A CELEBRAR EL DIA 25 DE MARZO DEL 2012.-

Por el Sr. Alcalde se da cuenta onvocadas las Elecciones Autonómicas en Andalucía por el Decreto del Presidente 1/2012, de 30 de enero, de disolución del Parlamento de Andalucía y de convocatoria de elecciones, y de conformidad con el artículo 26 de la Ley 5/1985, de 19 de junio, del Régimen Electoral General, debe procederse a la designación por sorteo público entre la totalidad de las personas incluidas en la lista de electores de la Mesa correspondiente, que sepan leer y escribir y sean menores de setenta años del Presidente y los Vocales de cada Mesa.

Las personas designadas deben saber leer y escribir y ser menores de setenta

años, si bien a partir de los sesenta y cinco años podrán manifestar su renuncia en el plazo de siete días.

El Presidente deberá tener el título de Bachiller o el de Formación Profesional de segundo grado o, subsidiariamente, el Graduado Escolar o equivalente. Asimismo, los cargos de Presidente y Vocal de cada Mesa son obligatorios y no pueden ser desempeñados por quienes se presenten como candidatos.

Previa determinación de las personas que pueden concurrir al sorteo público, de conformidad con el artículo 26 de Ley Orgánica 5/1985, de 19 de junio, del Régimen Electoral General, se extraen las «papeletas» con los nombres de los designados. [Se podrán utilizar diferentes medios materiales para realizar el referido sorteo. Las personas designadas deben saber leer y escribir y ser menores de setenta años, si bien a partir de los sesenta y cinco años podrán manifestar su renuncia en el plazo de siete días. El Presidente deberá tener el título de Bachiller o el de Formación Profesional de segundo grado o, subsidiariamente, el Graduado Escolar o equivalente. Asimismo, los cargos de Presidente y Vocal de cada Mesa son obligatorios y no pueden ser desempeñados por quienes se presenten como candidatos. Según establece el Acuerdo de 29 de enero de 2000 de la Junta Electoral Central, sobre si una persona ciega puede ser designada miembro de Mesa Electoral: «Aun cuando la LOREG no excluye a priori para ser designado miembro de Mesa Electoral a ningún ciudadano, mayor de edad y que sepa leer y escribir, la minusvalía física consistente en ceguera impide a la persona afectada por la misma el correcto desarrollo de las funciones encomendadas a los miembros de Mesas Electorales, tales como identificación de los votantes, examen de las papeletas de votación y participación en el escrutinio y otras que exigen el conocimiento físico directo de distintos documentos, cuya adaptación al braille no está en la actualidad legalmente prevista»]. Téngase en cuenta que, a partir de los sesenta y cinco años, los designados podrán manifestar su renuncia a dicha designación en el plazo de siete días, conforme a lo previsto en el artículo 26.2 de la Ley Orgánica 5/1985, de 19 de junio, del Régimen Electoral General. El Acuerdo 9/2/00, de la Junta Electoral Central, sobre el sorteo para designación de los ciudadanos que han de formar parte de las Mesas Electorales, establece que «La designación de los miembros de las Mesas Electorales corresponde a los Ayuntamientos en Pleno, en sorteo público —y no al Alcalde ni a una Comisión designada por el Pleno ni a otro miembro de la Corporación en quien el Pleno delegue— que habrá de celebrarse bajo la supervisión de la Junta Electoral de Zona —de la que el Secretario del Ayuntamiento es delegado—, lo que se traduce en la adopción de las medidas que aquella considere, en su caso, procedentes». El Acuerdo 15/2/00, de la Junta Electoral Central, sobre problemas que el quórum en la sesión plenaria del Ayuntamiento en la que se haya de designar miembros de Mesas Electorales, establece que sobre problemas de quórum en la sesión plenaria del Ayuntamiento en la que se haya de designar miembros de Mesas Electorales: «Tratándose de un sorteo, y no de una deliberación o adopción de libre acuerdo por el Pleno del Ayuntamiento, no resulta condición imprescindible la existencia del quórum legalmente establecido». El sorteo se realizará entre los días vigésimo quinto y vigésimo noveno posteriores a la convocatoria.
