•US Pat. Nos. 7,031,728 / 7,672,681 에 대한 무효 사건
– 복수의 휴대 전화 사용자가 지도 정보와 같은 시각적 디스플레이를 통해 타인의 위치 및 상태를 모니터링 할 수 있는 셀룰러 통신 시스템

3. A communication system to provide a cellular phone network for a group of participants, each of the participants having an individual portable cellular phone that includes voice communication, free and operator selected text messages, photographs and video, a CPU and a GPS navigational system that can accurately determine the location of each cellular phone, each of the cellular phones in the communications net of participants containing: said CPU and memory; a touch screen display; symbol generator in said CPU that can generate symbols that represent each of the participants' cell phones in the communication network on the display screen; a database that stores the individual telephone numbers related to each of the symbols each of which represents a participant in the communication network; cellular phone call initiating software in said CPU connected to the telephone number database and the touch screen and the symbols on the touch screen whereby touching an individual symbol will automatically initiate a cellular phone telephone call to the user represented by the symbol that includes said voice communication, free and operator selected text messages, photographs and video; and said display including databases that display geographical information that includes showing the geographical location of each of the symbols representing participants in the communication network, fixed locations, and entered items of interest. 10. A cellular phone for use in a communication network for a plurality of participants comprising: a cellular phone transmitter and receiver for transmitting and receiving voice communication, free and operator selected text messages, photographs, and video; a small hand held portable housing containing said cellular phone transmitter and receiver; a touch display screen mounted in said housing; a modem connected to said cellular phone transmitter and receiver; a CPU connected to said cellular phone transmitter and receiver; a GPS navigation system connected to said CPU and to said cellular phone transmitter and receiver on said touch screen; a database connected to said CPU that includes of a list of telephone numbers that relate to specific symbols; a symbol generator connected to said CPU and said database for generating symbols on said touch display screen; CPU software for selectively polling other participants with a cellular phone; call initiating software connected through said CPU and said telephone database and said symbol generator whereby when a user touches the symbol displayed on a said touch display screen the cellular phone call is automatically initiated to the cellular phone represented by the symbol; and a geographical database connected to said CPU to provide a geographical display on said touch screen representing a defined geographical area that also displays symbols representing each of the participants by latitude and longitude.

An element in a claim for a combination may be expressed as a means or step for
performing a specified function without the recital of structure, material, or acts in
support thereof, and such claim shall be construed to cover the corresponding
structure, material, or acts described in the specification and equivalents thereof. 결합형식의 청구항의 구성요소는 그 구조, 재료 또는 작용을 언급하지 않고 특정 기능을 수행하는 수단 또는 단계로 표현 될 수 있으며, 이러한 청구항은 그와 상응되게 명세서에 기재된 구조, 재료 또는 작용 및 그 균등물을 나타내는 것으로 해석해야 한다.
기능식 청구항에 대한 판단 일반
•미국 특허법 112조 6항이 적용되어야 하는가?
– means 또는 step 용어가 사용되었는가?
– means라는 용어를 사용하지 않은 청구항을 기능식 청구항으로 볼 수 있는가?
• (판례) 명시적으로 수단의 용어가 들어 있지 않더라도, 기능을 수행하는 것을 설명하는 용어가 들어있고, 그런 기능을 수행하기 위한 구조가 청구항에 설명되어 있지 않으면, 112조 6항이 적용된다.
•미국 특허법 112조 2항의 명확성의 요건을 만족시키는가?
– 판단기준
• 기능을 표시하는 용어가 당해 분야의 당업자에 의해 충분히 명확한 의미를 갖는 것으로 이해되는지 여부를 판단

당해 사건에 대한 법원의 판단
•미국 특허법 112조 6항이 적용되어야 하는가?

– 기능을 달성하는데 필요한 구조가 해당 청구항 내에 기재되어 있지 않으므로, 112조 6항이 적용된다.
•미국 특허법 112조 2항의 명확성의 요건을 만족시키는가?
– (지방 법원) 기능을 달성하는데 필요한 구조가 명세서에 기재되어 있지 않으므로, 청구항은 불명확하게 되어 무효
– (연방항소법원) symbol generator의 기능을 달성하는데 필요한 작동 알고리즘을 기재하지 않았으므로 불명확하여 무효.

당해 사건에 대한 법원의 판단
•미국 특허법 112조 6항이 적용되어야 하는가?
– Symbol generator가 그 자체로 구조(structure)을 나타낼 수 있는가? – That presumption falls, however, if the claim itself recites sufficient structure to perform the claimed function.

According to the district court, “a plain reading of the term in context of the relevant claim language suggests the term ‘symbol generator’ is analogous to a ‘means for generating symbols’ because the term is simply a description of the function performed.”
“Dr. Goldberg testified that those skilled in the art would have understood a ‘symbol generator’ to refer to a well-known class of existing, available, standard modules of software code used to generate symbols on a display”
We see no clear error in the district court’s findings regarding Dr. Goldberg’s testimony. Dr. Goldberg’s testimony that the terms “symbol” and “generator” are known within the field of computer science is not dispositive and does not require us to find that 35 U.S.C. § 112, ¶ 6 does not apply. See J.A. 11 (stating that “Dr. Goldberg testified he was aware of the terms ‘symbol’ and ‘generator’ separately, but was unaware of the use of the specific term ‘symbol generator’ within the field of computer science” (citation omitted)). Irrespective of whether the terms “symbol” and “generator” are terms of art in computer science, the combination of the terms as used in the context of the relevant claim language suggests that it is simply an abstraction that describes the function being performed
Finally, the claim term “symbol generator,” by itself, does not identify a structure by its function,

[Finisar Corp. v. DirecTV Grp., Inc., 523 F.3d 1323, 1340 (Fed. Cir. 2008) ] The specification can express the algorithm “in any understandable terms including as a mathematical formula, in prose, . . . as a flow chart, or in any other manner that provides sufficient structure.”

Although the district court recognized that “the specification describes, in general terms, that symbols are generated based on the latitude and longitude of the participants,” it nonetheless determined that the specification “fails to disclose an ‘algorithm’ or description as to how those symbols are actually ‘generated.’”
[728 patent col. 3 ll. 57–61] stating that “when the cellular phone/PDA/GPS System user uses his stylus or finger to touch one or more of the symbols or a location on the cellular phone display, the system’s software causes the status and latitude and longitude information concerning that symbol or location to be displayed”)
[728 patent col. 3 ll. 35–41] Although the specification of the ’728 patent suggests that these symbols are generated via “a map database and a database of geographically referenced fixed locations . . . with a specified latitude and longitude, . . . And a database with the constantly updated GPS location,” this only addresses the medium through which the symbols are generated.

•기능식 청구항에 대한 명세서 기재 요건
– 제42조 6항 (거절이유, 무효사유에 해당하지 않음)
– 단, 발명의 특정에 문제가 있는 경우 제42조4항2호에 해당할 수 있음
•제42조4항2호 관련 판례

- 청구항에 발명의 기능이나 효과를 기재한 기능적 표현이 포함된 경우, 그러한 기재에 의하더라도 발명의 구성이 전체로서 명료하다고 보이는 경우가 아니면 허용될 수 없다(대법원, 1998. 10. 18. 선고 97후1344 참조). - 여기서 기능적 표현에 의하더라도 발명의 구성이 전체로서 명료하다고 인정되는 경우라고 함은, ① 종래의 기술적 구성만으로는 발명의 기술적 사상을 명확하게 나타내기 어려운 사정이 있어 청구항을 기능적으로 표현하는 것이 필요한 경우(BM발명이나 컴퓨터관련 발명 등 기술분야에 따라 발명의 특성상 특허청구범위를 구체적인 구조의 기재만으로 표현하기 어려운 경우가 있다), ② 발명의 상세한 설명과 도면의 기재에 의하여 기능적 표현의 의미 내용을 명확하게 확정할 수 있는 경우 등을 가리킨다(특허법원 2006. 11. 23. 선고 2005허7354 참조). - 청구항이 기능적 표현을 포함하는 경우, 심사관은 그 발명이 속하는 기술분야에서 통상의 지식을 가진 자의 입장에서 발명의 상세한 설명이나 도면 등의 기재와 출원 당시의 기술상식을 고려하여 특허청구범위에 기재된 사항으로부터 특허를 받고자 하는 사항을 명확하게 파악할 수 있는지를 판단하여 그렇지 않다고 인정되는 경우 특허법 제42조제4항 제2호 위반으로 거절이유를 통지한다(대법원 2007.9.6. 선고 2005후1486 참조).
실무상 고려 사항
•기능식 청구항의 기재
– 청구항에 기능부와 구조를 함께 기재 (기능식 청구항X)
– 범용적 기능을 수행하는 기능부의 청구항 기재는 지양
• Ex. 데이터 입/출력부, 송/수신부
• 기능부가 범용적 알고리즘으로 구현될 수 있더라도, 명세서에 미 기재시 본 사건과 같이 청구항의 명확성이 문제될 수 있음.
• (청구항에 기재된 기능부가 구조를 포함하지 않음기능식 청구항에 해당청구항의 명확성 요건이 문제됨)
– 기능식 청구항 기재 시, 명세서를 통하여 기능 달성을 위한 “구조” 필수 기재
• 가능한 다양한 실시예, 구현예를 기재할 필요
• 특히, S/W 발명에서 발명의 핵심 기술적 특징이 아니고, 범용적 기능을 수행하는 기능부에 관하여도 명세서에 순서도, 블록도 등을 이용하여 알고리즘을 충분히 설명할 필요가 있음
