Hot story: Miami lawyer’s pants erupt in flames during arson trial in courtBY David Ovalle, March 8A Miami defense lawyer’s pants burst into flames Wednesday afternoon as he began his closing arguments in front of a jury — in an arson case. Stephen Gutierrez, who was arguing that his client’s car spontaneously combusted and was not intentionally set on fire, had been fiddling in his pocket as he was about to address jurors when smoke began billowing out his right pocket, witnesses told the Miami Herald. He rushed out of the Miami courtroom, leaving spectators stunned. After jurors were ushered out, Gutierrez returned unharmed, with a singed pocket, and insisted it wasn’t a staged defense demonstration gone wrong, observers said. Instead, Gutierrez blamed a faulty battery in an e-cigarette, witnesses told the Miami Herald.… Miami-Dade police and prosecutors are now investigating the episode. … Gutierrez was representing Claudy Charles, 48, who is accused of intentionally setting his car on fire in South Miami-Dade. He had just started his closing arguments when the fire broke out. Jurors convicted Charles anyway of second-degree arson. Miami-Dade Circuit Judge Michael Hanzman, in the coming days, could decide to hold Gutierrez in contempt of court.Link

Please continue to remember and be in prayer for our recently departed Brothers Sergio Olavarria and William Seidel, as well as their families and friends as they continue to mourn their loss.

Also please pray for our Brother Andy Kranking and his wife, our Sister, Mary Kranking as they face the difficult challenges presented by Andy's illness. Those wishing to visit Andy are reminded to call Mary first to arrange a convenient time.

Our sincere condolences are sent to our Brother George Fusco on the sudden passing of his infant grandson George Nicholas Fusco on March 11, 2017. He was 2 months old and passed in his sleep. He was the son of George's son George Jr. Funeral services are incomplete. Dear Fellow MCP Alumni,

I want to take this opportunity to thank Director Karl Plitt for all of the hours of dedicated work he does both long distance and locally for the museum project.  Karl came up from his home in Tennessee to attend Bill Seidel's memorial service but while he was here he took an extra day of his visit to meet with county officials and did some more negotiating for the Montgomery County Joint Law Enforcement Museum project.  He will be explaining the progress (or lack of) with county bureaucrats in his own report.  While we have the total support of Chief Tom Manger and his staff and the other local Chiefs, dealing with others outside of our police family hasn't, in my opinion, been very successful.   Be sure to look for Karl's report(s) in the next few issues.  Again I thank him and everyone who has been helping with the project.  Hang in there, we will persevere!

I want to share a message from Robin Russell....."Tonight was the first time I actually took the time to check out the MCPAA Calendar (on the website) and my hat is off to the person(s) who created it. I strongly suggest for anyone trying to find the dates of upcoming events to go there rather than try to dig up the old newsletters to find the information. I realize that most of the members are probably up to date on its benefits but some of us are just a little slow on the uptake! "  Have you taken a minute to go to www.mcpalumni.org?  Our website has been totally revised by Communications Director Bob Philo and you need to take a few minutes to go to it and check it out.  There is the calendar that Robin mentioned, with all MCPAA functions on it.  You can see the LEOSA schedules and link to the MCP's website to get the LEOSA forms.  You can pay your dues, go to the MCPAA store and see the new items Merchandise Director Diane Tillery has added.  Featured are two new shirt styles and two new hats.  While there go to our memorial section where the MCP's "Fallen Heroes" are listed along with the memorial pages for all deceased MCP personnel.  While looking through the names of the men and women who helped make the MCP into what it is today if you notice anyone missing (and there are no doubt some missing) please take the time to send Bob Philo a message and advise him so we can include them.  Until next time.....to all those in the frozen north - keep warm!  To the rest we are green with envy!

“OLD-SCHOOL”

Well, the month of March is upon us.  And that means spring, and most of us are thinking of outdoor activities, such as playing golf, tennis, getting the boat ready, going fishing, playing softball or getting ready for the South Carolina reunion (May 5 - 7).  

For some of us, March has a different meaning.  Our Department lost four of our finest in the line of duty in the month of March:  Lt. Donald A. Robertson (1972); Officer Philip C. Metz (1981); Captain James E. Daly, Jr. (1976); and Corporal John M. Frontczak (1976).  

Our love, thoughts and prayers continue to flow to the families of all eighteen fallen heroes.  We will never forget them.  We will honor all our fallen officers on

Wednesday, May 3rd, at headquarters during police month.  From the bottom of our hearts and on behalf of all retired officers, I would like to thank Officer Steven Smugeresky, MCP, for his dedication and loyalty of standing vigil at the grave sites for one hour, regardless of weather conditions.  We hold Officer Steven Smugeresky in high esteem, and recognize the ongoing dedication of John Cady to our fallen as he attends every vigil.

So today I would like to share with those who may not know that Captain James E. Daly, Jr. has an elementary school named in his honor.  It is located in Germantown, MD.  The Daly Elementary School was built in 1988 on a 10 acre site, serving families living in East Germantown, MD and on Sunday, May 20, 1990, the dedication ceremony and celebration was held at the school named in honor of Montgomery County Police Captain James E. Daly, Jr., a respected police officer, educator, and public servant.  The Captain was committed to excellence for himself and for the Montgomery County Police Department.  Captain Daly was the highest ranking officer to die in the line of duty in Montgomery County Police history.  A later addition to the school grounds is a memorial garden to Captain Daly, located on the circle in front of the building.  This "see, touch, and smell" garden will be an enjoyable educational area for the children of the school community.  

At the ceremony, the Daly chorus sang "The Greatest Love of All".  How fitting - as Jim was an educator and instructor.  The first lines of that song are: "I believe the children are the future, teach them well and let them lead the way".  Another line in the song is "Everybody's searching for a hero, people need someone to look up to".  Our "someone" is the 18 officers who gave the ultimate sacrifice - they are our heroes.   Oh, and how about this?  The school motto is "Every child is a Daly success". 

As you know, I am a little prejudiced.  I had the honor of riding motorcycles with Jim Daly out of Silver Spring.  And from July 1964 to September 1967, Jim Daly was my supervisor on motorcycles; and then again in August 1970, I was assigned to the Police Academy as a full time instructor and Jim Daly was my supervisor as Director of the Academy.  Jim Daly was the best supervisor anyone could work for.  

In John 15: 1 2-13 :This is my command.  Love one another as I have loved you.  No one has greater love than this.  That someone would lay down his life for his friends.

As each month of the year passes by, let us all take a moment out of our daily lives to remember and reflect on those 18 MCP heroes.

POST SCRIPT:  "LAMBERT"  -  BILL SEIDEL'S K-9 PARTNER

Today (Wednesday, 15 March, 2017) I met MCPD K-9 Officer John Greene behind the two old courthouse buildings in Rockville. There was multi-agency K-9 training underway in the old gray courthouse.  He answered a nagging question that I had and so many friends of our Brother William M "Bill" Seidel.  John was a very close friend and colleague with Bill in MCPD K-9.  John explained that it was Bill's wish, actually a dying wish, that his dog "Lambert" be re-assigned as a working dog in law enforcement.  Like Bill, Lambert was happiest and in his best element when he was working.  The German Shepherd Dog is truly a "Working Dog".  John Greene further explained that they boarded Lambert for a short period, to allow him to calm down, rest, and be willing to accept the human contact of a new handler.  The Maryland Department of Corrections has a strong K-9 program.  Lambert was introduced to a new young handler and they hit it off right away.  Before this, the only people he didn't want to eat were Bill and John Greene.  Now he's starting to bond with this new young handler.   The MD DOC Supervisor I met said they were proud and honored to receive Bill's dog, and would do justice by him.  I am very happy with this final chapter in the life of my friend, Bill Seidel. I grew up in the Kensington area and graduated from Walter Johnson High School in 1972. After graduation I attended Montgomery College starting in the Electronic Technology curriculum. After wiping out in a calculus class I decided to change my major to Criminal Justice.

Running out of money for college I went to work for an electronics manufacturing company in Silver Spring, attended classes at night and worked part time in the security office at Montgomery College.

One day I walked into the Bethesda Station and asked the

Sergeant working the desk how would I apply to become a Montgomery County Police Officer? Being 20 years old the Sergeant told me I needed to be 21 to be a Police Officer, but I could apply to the Police Cadet Program. After applying to the Cadet Program I was hired on August 19, 1974 and reported to the Records Section at Police HQ in the basement of the old Rockville Mall working midnights. After two weeks I was reassigned to EOC and remained there until March 10, 1975, the first day at The Academy for Session 4.

One recruit quit the first day and about a week later Sergeant Ed Joyner the Entrance Level Commander came into the classroom and tapped a recruit on the shoulder and directed him out the back of the classroom. That recruit was never seen again.After graduation I was assigned to the Wheaton-Glenmont Station Shift 1 supervised by Sergeant Woody Pifer.

For 9 years I worked in Wheaton with temporary assignments to Wheaton Detective Bureau and the

Wheaton Alcohol Enforcement Unit. After a year in the Germantown District I returned to Wheaton to the Traffic Section where I worked for 11 years. In 1995 I was selected as a Charter Member of the newly formed Collision Reconstruction Unit in SOD. I also worked on a temporary basis in The Tactical Support Unit driving Field Comm I and the other tactical vehicles. Like many officers I took many part time jobs over the years, mostly in security. The best years of my career were the time I spent in traffic and CRU.

I retired in November 1999 and moved to a 10 acre spread in rural eastern North Carolina. The two years after retirement were spent building a new house and automotive shop. Always wanting to fly, I obtained my pilots license. I worked as an aircraft mechanic at a local airport and as a Licensed Private Investigator for 6 years and currently work part time in my own shop restoring classic cars.

I married my wife Colleen in 1977. We have a son Christopher. We proudly raised him for 17 years until he entered The United States Military Academy. He graduated in 2007 and served two tours in Afghanistan.

Colleen and I have traveled the country in our RV. We have also traveled to Europe. Not being able to get Harley Davidson out of my blood I bought an Electra Glide and am active in the Blue Knights NC XXI Chapter.

Help Wanted:  Treasurer.  Need a volunteer to join the Board of Directors of The Montgomery County Joint Law Enforcement Museum, Inc. (MCJLEM)  Duties include opening and managing the museum bank account, filing required IRS and State of Maryland forms, as they are needed.  Need to attend Board of Director's meetings for the museum, as they are scheduled, either in person or by teleconference. Update: The Montgomery County Joint Law Enforcement Museum, Inc. (MCJLEM)

On Wednesday afternoon I met with Mr. Greg Ossont, Deputy Director of Department of General Services at his office at the EOB.  Attending were A/C Luther Reynolds, MCPD, Sandra Batterden, Capitol Projects, MCPD, and Karl E. Plitt, Rockville City PD.  The discussion was wide ranging, but it opened on a couple of clauses in the "License Agreement" they recently proffered to our MCJLEM Board of Directors.  The most serious was a "Rent" clause.  They were asking us to agree to a rent of $2750 per month for the spaces in the Red Brick Courthouse that we desire. Do the math:  That works out to $33,000 per year.   I said that it was a deal breaker and there is no way we can afford that.  I explained the background of our effort, the original guidelines that we were operating under (i.e., NO Rent), and what we have accomplished so far.  We have, in fact, established ourselves as a State of Maryland Corporation, a 501.c.3 non-profit museum, and have a board of directors in place.  We own furniture, have police related artifacts in our possession, a design for our interior spaces, and lots of ideas. Ossont countered was that we needed to provide a strong business plan that outlined sources of funding, be it grants or sale of mementoes, fund raising events in the planning, and other assets that we can bring to bear.  They just wanted to make sure that we, as an organization, have the organization and substance to indicate to them that we can begin and SUSTAIN this effort.  They need some solid plans and numbers.  They have other organizations, well meaning, that were granted use of county facilities, only to be found to be in utter chaos and insolvent after about a year, thus forcing the county to evict them.  As to the the rent question we can talk about reducing it to an amount that we can afford, and he's willing to set that aside for the time being.  Chief Manger may have helped by personally interceding on our behalf.  It seemed that way during this meeting." On this point I have to agree with them.  We must be able to demonstrate to them that we are for real.  I have had discussion with Brothers Disinger and Sterling on this very subject.  One thing that must be done, after we show that we have a solid business plan and funding plan, is that we sign a License Agreement with the County that must be approved by the County Council.  Once that agreement is signed and solid, it makes us immune from being thrown out with a change of the County Executive.  An agreement of this sort spans an administration change.  Ike Leggett leaves in two years. That is what we need." Out of this meeting grew a deadline:  One Month for a response and funding plan.  That would be April 16th.  Greg Ossont explained that many County Government organizations are vying for office space and are eyeing the Red Brick Courthouse.  He says he's holding them in abeyance but we need to act. Ossont, and his boss David Dise, Director of DGS, and County Exec Ike Leggett want us in there, and agree that our effort is more fitting a use for that historic building.  It's our turn to "Put up or shut up."" We will be very busy in the next month meeting these requirements.  'Now is the time for good men (and women) to act.'  We need a Fundraising Manager now. One with enthusiasm and imagination. That person can parcel out small parts of the task for write-up.  Even if you want to only handle a small piece of this effort, please get in touch  Call me for details.  Make that call very soon.

Montgomery County Police Captain Don Johnson, the 3rd District Commander, retired after 29 years on the job. Johnson was hired by the Montgomery County Police Department in 1985 when “Don Johnson” was already a household name due to the popularity of the television show, “Miami Vice”, starring the actor with the same name.

This link to pop culture and policing still brings questions and jokes about his name today, but police say Captain Don Johnson earned his excellent reputation. Promoted to Captain in 2007, Johnson was immediately selected by Chief Manger to run what is arguably the busiest and most complex police district in Montgomery County- the 3rd District Station in Silver Spring. Normally, newly promoted captains are not assigned as district commanders, but Johnson’s outstanding accomplishments and talents were recognized by Chief Manger. Johnson must have done something right, as the Chief continued to hold him in that position for the last seven years of his career. Johnson did leave his place as Commander to become acting assistant chief for six months during 2012 and 2013. When asked how he manages his time of being a husband, a father to six children, and a district commander, Commander Johnson said, “I’ve been blessed with the best wife and family anyone could ever have.”

Don Johnson’s last day was scheduled to be June 10, 2014. From there he moved on to pursue another one of his passions – fishing. For years he has “captained” a fishing boat on the Chesapeake Bay during his free time, and now he is full-time. That’s right, he is still a captain – the difference being that he

isn’t working the streets of Silver Spring anymore, but he is fishing the waters of the Chesapeake.

Don has been married for 28 years to his wife Madie (real name), who often works on the boat with him. They have six children, none are married yet and no grandkids yet. Three have graduated from UMD. His son Matt is in his third year at the Naval Academy, one in high school and one in middle school. His wife has a home daycare that he helps out with from time to time. 

His true passion in life (other than family), has been the water and fishing. He has done it in one form or another all his life. He bought his first boat at age 21 and has owned one ever since. Currently, he owns a 46-foot charter boat named "Hot Pursuit" and runs it out of Chesapeake Beach, Md. It's about 15 minutes from Upper Marlboro. 

Since retiring he has been able to work fishing charters full time. Don will typically run about 100 charters per year. In the off season he loves to travel with his wife and family. They will typically make a couple trips to Florida every year and will probably end up somewhere south in the future. For now they still enjoy trips to Ocean City and live in Brookeville, MD.

This Week in Montgomery County Police History By Jack Toomey

1943

Webster Parker, of near Germantown, reported that he suspected that Woodrow Taylor had stolen some jewelry from his house.  Officers Ralph Howard and Leroy Mullinix went to Taylor's house near Boyds and confronted Taylor.  They asked Taylor his name and were told "Jones".  Taylor produced a draft card and when Howard went to a lamp to better see the card Taylor took off running out the door.  Howard and Mullinix opened fire apparently missing Taylor.  Later in the day Officers Broschart and Offutt encountered Taylor and again he tried to run.  This time he was brought down by a bullet in the leg.  He was treated and later charged with housebreaking.

1953

The Montgomery Personnel Board rejected a pay raise for the county police.  In a letter addressed to Kenneth

Watkins, president of the Police Association, the board said that they could not justify singling out the police for a raise.  The proposal would have raised starting salaries for privates from $3350 to $3800. Watkins had argued that the county would not be able to attract qualified applicants with such a low starting salary.

1963.

District and Montgomery County police chased a stolen car from the area of Calvert Street, N.W. to Connecticut and Warner Street in Kensington.  District police first spotted the car and chased at speeds up to 90 mph.  At Chevy Chase Circle county cruisers joined the chase.  At Connecticut Avenue and Saul Road the car had a blowout but continued on until it struck a county cruiser occupied by Officer Marvin Jesse and John Reges.  At that time the driver was arrested and Jesse and Reges were taken to Holy Cross Hospital suffering from face lacerations.
