“consolidated financial statements” mean the financial statements of an MNE group in which the assets, liabilities, income, expenses and cash flows of the ultimate parent entity and the constituent entities are presented as those of a single economic entity;

Question: According to the recent notification issued by KPRA on March 15, 2019 regarding the subject matter. So being a resident service provider if we render, originate or commence service from the designated areas falling in FATA and PATA and the same service is also consume, execute or terminate within the designated areas than exemption from levy of sales tax would be available otherwise not except the Telecommunication Services. Kindly ratify if we are correct or otherwise what should be implication of this notification. Answer: Yes, exemption from KP sales tax is available on services provided and consumed in FATA. Such exemption is granted for the period of 5 Years starting from 1st June, 2018 to 30th June, 2023.

--------------------------------------- Question: As per normal practice Municipal Committees award contact of collection of fee to individual contractors against bid for collection of TMA Advertisement Fee. Sample of authority letter of a TMA attached. We have to issue cheque at the name of individual contractor as per authority letter. Please advise is withholding income tax and sales tax applicable in such case?

Answer: In this case, the contractor is collecting fee on behalf of Municipal Committee, so providing service to Municipal Committee and not you. He’ll issue sales tax invoice to Municipal Committee for his services charges and Municipal committee will be responsible to withheld sales tax and income tax. What you are paying does not attract withholding of tax, because he is not providing service to you, he is only collecting fee on behalf of Municipal Committee.
