REVIZUIRII ULTERIOARE A
CONSTITUŢIEI ROMÂNIEIDE LA 1
IULIE 1866

Abstract: Valul revolutionar de la 1848 a zguduit
intreaga Europa, producand consecinte profunde si
asupra spatiului romanesc.
Tratatul de pace de la Paris din 1856 avea sa
confere Principatelor Romane un nou statut prin
desfiintarea protectoratului Rusiei tariste si trecerea
Principatelor Romane sub garantia colectiva a celor
sapte puteri semnatare.
Pentru cele doua Principate Romane, Conventia
de la Paris a reprezentat o Constitutie stabilita de
puterile europene care nu au admis unirea efectiva a
Principatelor,stabilind ca fiecare Principat sa aiba
organe de conducere distincte,respectiv domnitor si
parlament proprii.adevarata Constitutie
Cu toate ca Statutul dezvoltator al Conventiei de
la Paris preciza ca legea fundamentala a Romaniei
ramane pe mai departe Conventia de la Paris,
Statutul lui Cuza a reprezentat o adevarata
Constitutie pentru partea modificata din Conventia
de la Paris, constituind un" produs" exclusiv
national.
Constitutia de la 1866 a reprezentat fundamentul
regimului politic de monarhie constitutionala din
Romania de dupa unirea din 1859,ea fiind ceruta de
Programul divanurilor ad-hoc,alaturi de autonomia
si neutralitatea celor doua Principate, unirea lor
intr-un singur stat sub numele de Romania,avand in
frunte un principe strain ereditar dintr-o familie
domnitoare din Europa,un guvern reprezentativ si
constitutional.
Constitutia de la 1866 este prima intocmita de
reprezentantii legitimi ai natiunii romane pe baza
principiului castigat de domnitorul Alexandru Ioan
Cuza in 1864 prin care s-a recunoscut suvernitatea
interna a Romaniei si reprezinta o optiune
europeana a elitei politice romanesti,o garantie a
stabilirii unor regulide guvernare moderna a
societatii romanesti.

THE SOCIO-POLITICAL AND
HISTORICAL CONTEXT OF THE
ADOPTION AND FUTURE REVISION
OF THE ROMANIAN CONSTITUTION
FROM THE JULY 1, 1866

Abstract: The revolutionary wave of 1848 shook
the whole Europe, producing deep consequences also
on the Romanian space.
The Peace Treaty from Paris from 1856 was to
grant the Romanian Principalities a
new status through the abolition of the Tatar
State Prosecutor and the passing of the Romanian
Principalities under the collective guarantee of the
seven signatory powers.
For the two Romanian Principalities, the Paris
Convention represented a Constitution founded by the
European Powers who did not allow the effective
unification of the Principalities, establishing that each
Principality had distinct governing bodies, namely its
own ruler and parliament.
Although the developing status of the Paris
Convention states that the Fundamental Law of
Romania remains the Paris Convention, Cuza's status
was a true Constitution for the modified part of the
Paris Convention, being an "exclusively" national
product.
The Constitution of 1866 represented the base of
the political regime of constitutional monarchy in
Romania after the unification from 1859, as required
by the Ad-Hoc Divan Program, along with the
autonomy and neutrality of the two Principalities, their
unification in one state under the name of Romania,
advancing a hereditary foreign prince from a reigning
family in Europe, a representative and constitutional
government.
The Constitution of 1866 was first drawn up by
the legitimate representatives of the Romanian nation
based on the principle gained by the ruler Alexandru
Ioan Cuza in 1864, through which Romania's internal
sovereignty was recognized and which represents an
European option of the Romanian political elite, a
guarantee of establishing some governing rules for the
modern Romanian society.

1. Contextul social-politic şi istoric
anterior adoptării Constituţiei
Este îndeobşte cunoscut că valul
revoluţionar din anul 1848 avea să zguduie
întreaga Europă şicare, desigur, a produs
consecinţe profunde şi asupra spaţiului
românesc. După cum se cunoaşte, ladata de
19 aprilie / 1 mai 1849 Rusia şi Turcia ai
încheiat Tratatul de la Balta Liman care
încălca autonomia Moldovei şi a Valahiei în
sensul că Domnitorii urmau să fie numiţi de
cele două puteri:Turcia şi Rusia. Potrivit art.
I şi II din respectivul Tratat adunările
obşteşti au fost desfiinţate şiînlocuite cu
divanuri.
În anul 1853 izbucneşte un nou război
ruso-turc finalizat prin Tratatul de pace de la
Paris din1856. Acest Tratat încheiat la 18/30
martie 1856 conferea un nou statut
Principatelor Române însensul că a desfiinţat
protectoratul Rusiei ţariste şi a trecut
Principatele Române sub garanţia colectivă
acelor şapte puteri semnatare1.
S-a dispus convocarea Divanurilor ad-
hoc şi consultarea românilor cu privire la
organizarea definitivă a Principatelor
(eventuala lor unire).
Divanurile au fost convocate în
septembrie 1857 şi au stabilit următoarele:
- respectarea autonomiei Principatelor
conform vechilor capitulaţii2 din 1393, 1460,
1511 şi 1634;
- unirea politică a Principatelor într-un
singur stat sub numele de „România”;
- consacrarea pe tronul ţării a unui
principe străin ales din una din dinastiile
europene;
- organizarea unui regim constituţional-
parlamentar.
La 07 august 1858 a fost finalizată
Conferinţa ambasadorilor puterilor
contractante prinîncheierea Convenţiei de
la Paris.
Pentru cele două Principate Române
Convenţia de la Paris a reprezentat o
Constituţie stabilită deputerile europene care
nu au admis unirea efectivă a Principatelor şi
au stabilit ca fiecare ţară să aibăorgane de

historical context prior to the adoption
of the Constitution It is common knowledge that the
revolutionary wave in 1848 would shake
the whole of Europe and that, of course, it
also produced profound consequences on
the Romanian space. As it is known, on
April 19 / May 1, 1849, Russia and Turkey
concluded the Liman Balta Treaty that
violated the autonomy of Moldavia and
Wallachia in the sense that the Governors
were appointed by the two powers: Turkey
and Russia. According to art. I and II of
that Treaty, the public assemblies were
abolished and replaced with divans .
In 1853, a new Russo-Turkish War
starts and ends in 1856 through the the
Peace Treaty from Paris. This Treaty,
concluded on March 18/30, 1856, gave a
new status to the Romanian Principalities,
by abolishing the tsarist Russian
protection, and included the Romanian
Principalities under the collective
guarantee of those seven signatory
powers7.
The ad-hoc Divans’ convocation and
the Romanians’ consultation in regard to
the final organisation of the Principalities
(their eventual union) were ordered.
The divans were convened in
September 1857 and established the
following:
– the respect for the Principalities’
autonomy according to the old
capitulations8 from 1393, 1460, 1511 and
1634;
- the political union of the
Principalities in a single state under the
name of "Romania";
- the consecration on the country’s
throne of a foreign prince elected from one
of the European dynasties;
– the organization of a constitutional-
parliamentary regime.
On August 7 , 1858, the Conference of
Ambassadors of the Contracting Powers
was finalized by the conclusion of the

conducere distincte respectiv domnitor şi
parlament proprii.
Au fost constituite două instituţii
politico-juridice comune Principatelor
Române şi anume: Comisia Centrală şi
Curtea de Casaţie, ambele având sediul în
oraşul Focşani.
Principatele au fost organizate avându-se
în vedere principiul separaţiei puterilor în
stat3. Astfel, puterea legislativă era
încredinţată hospodarului (domnitorului),
Adunării Elective şi Comisiei Centrale de
la Focşani.
Pregătirea legilor de interes comun se
realiza de Comisia Centrală, iar a celor de
interes special de către hospodarul
(domnitorul) fiecărui Principat. Legile erau
supuse de domnitor Adunăriiprin votare.
Puterea executivă aparţinea
hospodarului (domnitorului), iar puterea
judecătorească seexercita de judecători,
numiţi de hospodar, în numele acestuia.
După înfăptuirea Unirii Principatelor
Române, guvernul prezidat de Mihail
Kogălniceanu ademarat procedura revizuirii
raporturilor dintre proprietarii de pământ şi
ţărani.
Acestei reforme i s-a opus, după cum era
de aşteptat, Adunările parlamentare
(compuse dinmoşieri) fapt ce l-a determinat
pe domnitorul Alexandru Ioan Cuza să le
dizolve, dând o proclamaţiecătre popor, la 2
mai 1864 şi unde a propus modificarea
Convenţiei de la Paris şi a legii electorale.
În aceste condiţii, la data de 2 iulie 1864
a intrat în vigoare Statutul confirmat prin
plebiscit şi recunoscut de puterile garante.
Potrivit Statutului dezvoltător al
Convenţiei de la Paris, cunoscut şi sub
numele de Statutul lui Cuza, parlamentul s-a
organizat bicameral şi anume în
Adunarea electivă şi Adunarea
ponderatoare.
Puterea legislativă era exercitată de cele
două adunări împreună cu domnitorul.
Puterea executivă aparţinea exclusiv
domnitorului. Aceasta avea dreptul de
iniţiativă legislativă. Proiectele de legi erau
Paris Convention.
For the two Romanian Principalities, the
Paris Convention constituted a Constitution
set up by the European deputies who did
not allow the effective unification of the
Principalities and established that each
country should have its own leadership
bodies, respectively their rulers and their
own parliament.
Two politico-judicial institutions
common to the Romanian Principalities
were set up: The Central Commission
and the Court of Cassation , both having
their headquarters in the city of Focsani.
The Principalities were organized
taking into account the principle of
separation of powers within the state9.
Thus, the legislative power was entrusted
to the ruler, to the elected assembly and
to the Central Commission of Focsani. The drafting of the laws of common
interest was made by the Central
Commission, and the ones of special
interest by the ruler of each Principality.
The laws were subjected to the Assembly
by the ruler via vote.
The executive power belonged to the
ruler, and the judiciary power was
exercised by the judges, who were
appointed by the rule on his behalf.
After the establishment of the Union
of the Romanian Principalities, the
government chaired by Mihail
Kogălniceanu took over the process of
reviewing the relations between
landowners and peasants.
The parliamentary assemblies
(constituted by landowners) have opposed
to this reform, as expected, fact that
determined the ruler Alexandru Ioan Cuza
to dissolve them by giving a proclamation
to the people on May 2, 1864 through
which he proposed to amendment of the
Paris Convention and the electoral law.
In these circumstances, on July 2,
1864 the status confirmed by a plebiscite
came into force and was recognized by the
guarantor powers.

susţinute de miniştri sau de membri
Consiliului de Stat în faţaAdunării elective.
Corpul ponderator – Senatul era condus
de mitropolitul primar al României şi era
alcătuit din:
- mitropolit;
- episcopi;
- întâiul preşedinte al Curţii de Casaţie;
- cel mai vechi general de armată în
activitate;
- 64 de membri numiţi de domnitor.
Senatul avea în atribuţii ocrotirea
Constituţiei, realizând un control al
constituţionalităţii legilor.
Adunarea electivă – camera inferioară a
Parlamentului era competentă să adopte
bugetul statului.
Domnitorul – şeful puterii executive–
guverna prin decrete-legi până la efectuarea
unor noi alegeri legislative.
Statutul dezvoltător al Convenţiei de la
Paris preciza că legea fundamentală a
României rămânepe mai departe Convenţia
de la Paris.
Cu toate acestea, Statutul lui Cuza a
reprezentat o adevărată Constituţie pentru
partea modificată din Convenţia de la Paris.
Ea constituie un „produs” exclusiv naţional.
În temeiul Statutului s-au adoptat:
Codul civil, Codul de procedură civilă,
Legea privind administraţia publică şi
justiţia, Legea instrucţiunii publice – acte
normative fundamentale pentrudezvoltarea
României moderne.
Legea electorală era anexată la Statut
şi stabilea:
- drepturile electorale;
- condiţiile necesare pentru exercitarea
dreptului de vot şi a dreptului de a fi ales;
- normale tehnice privind procedura
desfăşurării alegerilor.
2. Adoptarea Constituţiei
Constituţia de la 1866 reprezintă
fundamentul regimului politic de monarhie
constituţională dinRomânia de după unirea
din 1859, fiind promulgată de Carol I, la 1
iulie 1866.
Constituţia a fost cerută de programul
According to the Developing Status of
the Paris Convention, also known as Cuza's
Status, the Parliament had been organized
as bicameral, namely in the elective
Assembly and the weighting Assembly.
The legislative power was exercised
by the two assemblies together with the
ruler.
The executive power belonged
exclusively to the ruler. This power had
the right of legislative initiative. The law
drafts were supported by ministers or
members of the State Council before the
elective Assembly.
The Weighing Pitch - The Senate was
led by the Primary Metropolitan of
Romania and was composed from:
- the Metropolitan;
- the bishops;
- the first president of the Court of
Cassation;
- the oldest army general in operation;
- 64 members appointed by the ruler.
The Senate was responsible for the
protection of the constitution, controlling
the laws’ constitutionality.
The elective Assembly - the lower
chamber of Parliament, was able to adopt
the state budget.
The Ruler - the head of the executive
power, ruled through law decrees up until
the execution of new legislative elections.
The developing status of the Paris
Convention stipulated that the fundamental
law of Romania continues to remain the
Paris Convention. Despite this, Cuza's status represented a
true Constitution for the amended section
from the Paris Convention. It is an
exclusively national product.
Under the Status the Civil Code, the Code
of Civil Procedure, the Law Of Public
Administration and Justice, the Law of
Public Instruction - Fundamental
Normative Acts for the Development of
Modern Romania were adopted.
The Electoral Law was annexed to
the Statute and established:

divanurilor ad-hoc alături de autonomia şi
neutralitatea celor două Principate, unirea
lor într-un singur stat sub numele de
România, având în frunte un principe străin
ereditar dintr-o familie domnitoare din
Europa (familie care să nu fie rusă sau
austriacă), un guvern reprezentativ şi
constituţional – garanţia colectivă a celor
şapte Mari Puteri europene.
Pentru operativitate şi evitarea inutilelor
confruntări în Adunarea electivă s-a
constituit un „comitet compromisoriu”
format dintr-un număr egal de reprezentanţi
ai grupărilor liberale şi conservatoare.
Constituţia a fost o opţiune europeană a
elitei politice româneşti, o garanţie a stabilirii
unorreguli de guvernare modernă a societăţii
româneşti.
Constituţia din 1866 este prima
întocmită de reprezentanţii legitimi ai
naţiunii române pe baza principiului
câştigat de Alexandru Ioan Cuza în 1864,
prin care se recunoştea suveranitatea
interioară a României.
Este o Constituţie dată printr-un acord de
voinţă între Adunarea Deputaţilor,
reprezentând naţiunea şi suveran, în
contextul ameninţării Unirii din 1859 şi în
condiţiile izbucnirii războiului austro-
prusac.
A avut ca model de inspiraţie Constituţia
belgiană, la rândul său chintesenţă a
modelelorfrancez, englez şi american, care în
multe privinţe era apreciată ca fiind cea mai
înaintată şi cea maiechilibrată din Europa.
Faţă de Constituţia belgiană,
Constituţia României din 1866
prevedea: indivizibilitatea teritoriului
(art.2), oprirea colonizării cu străini (art.3),
cazurile de expropriere (art.19),garantarea
suprafeţelor agrare acordate clăcaşilor, la
1864 (art 133), menţiunea că
puterilenaţiunii nu se puteau încredinţa
decât prin delegaţiune, desfiinţarea
Consiliului de Stat şitrecerea
prerogativelor sale la Curtea de Casaţie.
Cu toate acestea ea a fost apreciată ca
fiind o improvizaţie făcută în grabă după
- the electoral rights;
- the conditions required for the
exercise of the right to vote and the right
to be elected;
- technical norms regarding the
procedures for the conduct of elections.
2. Adoption of the Constitution
The Constitution from 1866 is the
foundation of the political regime of
constitutional monarchy in Romania after
the unification from 1859, promulgated by
Charles I on July 1, 1866.
The constitution was demanded by the
ad-hoc divans’ program alongside the
autonomy and neutrality of the two
Principalities, their unification in one state
under the name of Romania, having a
leading foreign hereditary prince of a
reigning European family (a non Russian
or Austrian family), a representative and
constitutional government - the collective
guarantee of the seven Great European
Powers.
For convenience and avoidance of
unnecessary confrontations in the elective
assembly, a “Compromise committee"
consisting of an equal number of
representatives of the liberal and
Conservative was constituted.
The Constitution represented an
European option of the Romanian
political elite, a guarantee of establishing
the modern governance rules of the
Romanian society.
The Constitution of 1866 was the first one
drawn up by the legitimate
representatives of the Romanian nation based on the principle gained by Alexandru
Ioan Cuza in 1864, through which
Romania’s internal sovereignty had been
acknowledged.
It is a Constitution given by a will
agreement between the Assembly of
Deputies, representing the nation, and the
ruler, in the context of the threat of the
1859 Treaty and the outbreak of the
Austro-Prussian war.

Constituţia belgiană4
Titu Maiorescu a acuzat Constituţia de
la 1866 de un „prematur liberalism”, el
susţinând, cade altfel şi alţi înaintaşi, precum
I. H. Rădulescu, Al. Russo, M.
Kogălniceanu, Gheorghe Asachi, că în
modernizarea noastră şi, deci, şi în
elaborarea Constituţiei de la 1866 păstrarea
şi continuarea aceea ce este în consonanţă
cu specificul poporului şi nu renunţarea la
tot ce a fost trecut.
Constituţia din 1866 are girul regelui Carol
I care avea să afirme că: „Eu vă aduc …
acelrespect pentru lege pe care l-am cules în
exemplul alor mei”5
Rolul lui Carol I a fost determinat în
stabilirea structurii parlamentului, respectiv bicameralşi în circumstanţele în
care urma să funcţioneze dreptul de veto, ca
drept absolut de care însă Carol nus-a folosit.
La 12 zile după promulgarea
Constituţiei Carol I depunea jurământul
arătând că: „Prin Constituţia ce dăm
astăzi Statului român, realizăm aspiraţiile
legitime ale naţiunii, garantând interesele
tuturor stărilor precum şi toate drepturile pe
care cetăţeanul trebuie să le găsească într-o
societate civilizată. Acest act pentru mine
este cel mai însemnat al vieţii mele căci el
este pactuldefinitiv care mă leagă pentru
totdeauna cu destinele noii mele ţări, cu
România … Un guvern monarhic este aşezat.
Să stăruim dar cu toţii ca prin leală şi
sinceră aplicare a principiilor acestei
Constituţii,ea să poată produce
binefăcătoarele ei roade”6
Cel puţin la început, Carol I s-a arătat
satisfăcut de Constituţie întrucât era parte a
puterii legislative, alături de Camere şi
Senat, fiind un fel de „a treia cameră cu
puteri legiuitoare”, după expresia
inspirată a lui Tudor Drăganu. Astfel, domnitorul avea dreptul de a
convoca, a deschide, a amâna, a închide şi
dizolva Camerele, avea dreptul de a întocmi
regulamente pentru executarea legilor.
Ca reprezentant al puterii executive,
suveranul îi numea şi revoca pe miniştri,

the most balanced in Europe.
Compared to the Belgian Constitution, the
Romanian Constitution from 1866
provided: the indivisibility of territory
(Article 2), the cease of foreign
colonization (Article 3), the cases of
expropriation (Article 19), the guarantee
of agricultural lands granted to a
worker10 in 1864 (Article 133), the
mention that the Powers of the Nation
could not be entrusted only by
delegation, by abolition of the State
Council and by granting of its
prerogatives to the Court of Cassation. However, it was appraised as an
improvisation made hasty by the
Constitution Belgian11.
Titu Maiorescu accused the
Constitution from 1866 of a "premature
liberalism", as he argued, like other
predecessors, like IH Radulescu, Al.
Russo, M. Kogălniceanu, Gheorghe
Asachi, the retention and continuity of
what is in line with the specifics of the
people in our modernization and thus also
in the development of the 1866
Constitution, and not the renouncement of
everything that was in the past.
The Constitution of 1866 has the royal
endorsement of the Kind Charles I, that
would come to affirm that „Eu vă aduc …
acel respect pentru lege pe care l-am cules

The role of Charles I was determined
in establishing the parliamentary
structure, namely bicameral, and in the
circumstances in which the right of veto
was to function, as an absolute right that
Charles I did not use.
After 12 days after the promulgation
of the Constitution, Charles I lodged an
oath stating that: „Prin Constituţia ce dăm
astăzi Statului român, realizăm aspiraţiile

dizolva Parlamentul, era comandantul
armatei. Era inviolabil în sensul că nu era
răspunzător nici pentru actelesale personale
şi irevocabil, puterile fiindu-i conferite pe
viaţă.
Domnitorul avea atribuţii şi în
exercitarea puterii judecătoreşti. Astfel,
sentinţele judecătoreştise dădeau în numele
suveranului. El este cel care sancţiona şi
promulga legile, amnistia în
materiepolitică şi criminală, fără a putea
suspenda cursul urmăririi judecătoreşti. El
numea în funcţii publicefără a putea crea
noi funcţii, încheia convenţii cu state
străine care nu puteau fi aplicate
fărăaprobarea puterii legislative.
Constituţia de la 1866 are inserate în
cuprinsul său trei principii fundamentale,
şi anume: principiul suveranităţii
naţionale, principiul guvernării
reprezentative şi principiul
separăriiputerilor în stat. Puterea legislativă era exercitată de
Parlament (bicameral) şi de către
rege. Numai cuacordul de voinţă a celor trei
segmente se asigura introducerea şi
funcţionarea legislaţiei.
Puterea judecătorească era formal
independentă de cele două. Nici o justiţie nu
se putea crea decât în virtutea unei legi.
Curtea de Casaţie avea dreptul de a cenzura
actele administrative la cererea unui recurent,
proclamând, dacă era cazul, ilegalitatea lor.
Un astfel de lucru s-a întâmplat în
martie1912, când a fost respinsă Legea
tramvaeelor, adusă de guvernul P. P.
Carp, obligându-l pe acestasă demisioneze.
Puterea executivă avea ascendent
asupra celorlalte două chiar dacă în
conformitate cuprincipiul separaţiei
puterilor în stat cele trei puteri trebuie să aibă
o forţă egală. Ea era asigurată desuveran care
avea titlul de Domn şi de miniştri până la 15
martie 1881, când România s-a
proclamatregat. Iniţial erau 7 miniştri:
- Interne;
- Finanţe;
- Justiţie;
legitime ale naţiunii, garantând interesele
tuturor stărilor precum şi toate drepturile
pe care cetăţeanul trebuie să le găsească
într-o societate civilizată. Acest act pentru
mine este cel mai însemnat al vieţii mele
căci el este pactuldefinitiv care mă leagă
pentru totdeauna cu destinele noii mele
ţări, cu România … Un guvern monarhic
este aşezat. Să stăruim dar cu toţii ca prin
leală şi sinceră aplicare a principiilor
acestei Constituţii,ea să poată produce
binefăcătoarele ei roade”13.
At least in the beginning, Charles I
was pleased with the Constitution as he
was part of the legislative power, together
with the Chambers and the Senate, being
a kind of "third chamber with legislative
powers" after the terse expression of
Tudor Draganu. Thus, the ruler had the right to
convene, open, postpone, close and
dissolve the Chambers, and was entitled to
make regulations for the enforcement of
the laws.
As a representative of the executive
power, the ruler named and revoked the
ministers, dissolved Parliament, was the
commander of the army. He was
inviolable in the sense that he was not
responsible for his personal acts and
irrevocable, in the sense that the powers
were given to him for life.
The ruler had responsibilities also in
exercising the judicial power. Thus, the
juridical sentences were given on behalf of
the sovereign. He is the one who
sanctions and promulgates the laws, the
amnesty in ephemeral and criminal
matters, without being able to suspend the
course of the judicial prosecution. He was
able to appoint in public positions without
being able to create new functions, to
conclude conventions with foreign states, that could not be applied without the
approval of the legislative power.
The Constitution of 1866 has
incorporated into it three fundamental
principles, namely: the principle of

- Externe;
- Culte şi Instrucţiune Publică;
- Război;
- Lucrări Publice.
De la 1 aprilie 1883 apare şi Ministerul
Agriculturii, Industriei, Comerţului şi
Domeniilor,care, la 1 aprilie 1908 se
desparte în două, industria şi comerţul
constituind un minister separat.
Constituţia din 1866 a introdus
principiul eredităţii în desemnarea
monarhului. Numaibărbaţii şi descendenţii
acestora puteau moşteni tronul, prin ordinea
de progenitură, cu excluderea femeilor şi a
coborâtorilor lor.
Puterea executivă era exercitată de către
guvern şi rege care desemna primul
ministru, aprobalista miniştrilor, primea
jurământul lor. Cu mandat regal, regele putea
proroga sau dizolva Parlamentul.La rândul
său, Parlamentul putea da vot de blam unui
ministru sau întregului guvern – cum s-
aîntâmplat la 12 februarie 1901 sau la 17
ianuarie 1922.
3. Reflectarea Constituţiei din 1866 în
practica social-politică ulterioară şi
revizuirea acesteia
Constituţia de la 1866:
- a consacrat unitatea şi indivizibilitatea
statului;
- a stabilit, pentru întâia dată, în
mod oficial, denumirea de România în
locul aceleia de Principatele Unite,
denumire care însă în afară avea să fie
menţinută până la Congresul de la Berlindin
1878;
- a statuat drapelul tricolor: albastru,
galben şi roşu;
- a consacrat ca formă de stat monarhia
constituţională, ereditară în familia
principelui Carol I,în linie directă masculină,
succesorii fiind crescuţi în religia ţării;
- a prevăzut drepturi şi libertăţi
cetăţeneşti;
- a preluat deosebirea dintre ortodocşi şi
neortodocşi din Convenţia de la Paris din
1818,stipulând în art. 7 că: „numai străinii
de rituri creştine pot dobândi
national sovereignty, the principle of
representative government, and the
principle of power separation in the
state. The legislative power was exercised
by the (bicameral) Parliament and by the
king. Only with the agreement of the three
segments the introduction and
functioning of the legislation was
ensured.
The judicial power was formally
independent of the two. A justice could be
created only based on the virtue of a law.
The Court of Cassation had the right to
censor administrative provisions on
demand of an appellant, proclaiming, if
necessary, their illegality. Such a thing
happened in March 1912, when the Tram
Law, brought by the Government of PP
Carp, was rejected, forcing his
resignation.
The executive power overruled the
other two, even if in accordance with the
principle of the separation of powers in the
state, the three powers must have an equal
weight. It was insured by the ruler who
had the title of Lord and by the ministers
until March 15, 1881, when Romania
proclaimed itself a kingdom. Initially,
there were 7 ministers:
- the Minister of Internal Affairs;
- the Minister of Finance;
- the Minister of Justice;
- the Minister of External Affairs;
- the Minister of Cults and Public
Instruction;
- the Minister of War;
– the Minister of Public Works.
Since April 1, 1883, the Ministry of
Agriculture, Industry, Commerce and
Domains, appear, which on April 1, 1908,
is divided into two, the industry and the
commerce being a separate ministry.
The Constitution of 1866 introduced
the principle of heredity in designating the
monarch. Only the bearers and their
descendants could inherit the throne,
through the progeny order, with the

împământenirea”, ceea ce îiexcludea cu totul
pe evrei de la dobândirea cetăţeniei;
- a menţinut sistemul de vot cenzitar;
- a creat o separaţie între stânga şi
dreapta, demarcaţie care-l va împiedica la
începutul domnieisale pe rege să găsească
soluţii de guvernare de mijloc.
La începutul domniei sale, Principele
Carol s-a arătat convins de necesitatea
punerii în practicăa Constituţiei adoptate,
de unde îndemnurile la ordine,
economie, conştiinciozitate, muncă încuvântările sale.
De aceea, principele N. Şuţu nota în
Memoriile sale „Încrederea slăbeşte,
relaţiile sociale se destramă, în general,
publicul priveşte cu dispreţ orice autoritate,
orice agent al puterii …, subalterniise
revoltă împotriva şefilor ierarhici şi publică
prin ziare diatribe şi critici virulente ori de
câte orisunt ameninţaţi cu pedeapsa … Şi
vor să spună că aceasta înseamnă progres,
când, în fond, nu e decâtsporită anarhie
sporită”.
De aceea, începând cu noiembrie 1869 s-
a cerut schimbarea Constituţiei în sens
restrictiv. Celmai radical act al dreptei
politice este aşa numita Petiţie de la Iaşi
iniţiată de conservatorii moldovenidin jurul
lui Grigore M. Sturza şi trimisă
Parlamentului în aprilie 1871.
Cu toate acestea, în acea perioadă de
zbucium Constituţia nu se schimbă.
Prima modificare a Constituţiei are loc în
1879, când Puterile semnatare ale Tratatului
de la Berlin condiţionează recunoaşterea
independenţei României de modificarea art.
7 din Constituţie privitor la dobândirea
cetăţeniei.
O a doua modificare, mai puţin
încrâncenată decât cea din 1879 avea să se
producă în 1884 prinmodificarea a 24 de
articole şi unele prevederi din Legea
electorală.
Urma ca o altă revizuire să se facă în 1914.
Carol I moare în septembrie 1914.
Urmaşul său, Ferdinand I va fi supus
presiunilor evenimentelor care au venit peste

list of the ministers and received their oath.
With a royal mandate, the king could
prophesize or dissolve the Parliament. In
its turn, the Parliament could blame by
vote a minister or the entire government -
as it happened on February 12, 1901 or on
January 17, 1922.
3. The reflection of the Constitution
of 1866 in the subsequent social and
political practice and its review
The Constitution of 1866:
- consecrated the unity and
indivisibility of the state;
- established officially for the first
time, the name of Romania instead of that
of The United Principalities, name that
would, however, be maintained until the
Berlinden Congress from 1878;
- statuted the tricolor flag: blue, yellow
and red;
- enshrined as a form of state the
constitutional monarchy, hereditary in the
family of Prince Charles I, in direct male
line, the successors being raised in the
country’s religion; - provided citizens' rights and
freedoms;
- took over the distinction between
Orthodox and non-Orthodox from the Paris
Convention of 1818 stating in Article 7 that
"numai străinii de rituri creştine pot
dobândi împământenirea"14, which
completely excluded the Jews from the
acquisition of citizenship;
- maintained the censorship voting
system;
- created a separation between the left
and the right, split that will prevent the
king from finding middle governing
solutions.
At the beginning of his reign, Prince
Charles was convinced of the need to apply
the adopted Constitution, from which the

România,care în 1917 dă o proclamaţie
redactată de Nicolae Iorga unde se spunea:
„Vouă fiilor de ţărani, careaţi apărat cu
braţul vostru pământul unde v-aţi născut, aţi
crescut. Vă spun, eu, regele vostru, că, pe
lângă răsplata cea mare a izbânzii, care vă
asigură fiecăruia recunoştinţa neamului
nostru întreg, aţi câştigat totodată dreptul de
a stăpâni într-o măsură mai largă pământul
pe care v-aţi luptat. Eu,regele vostru, voi fi
întâiul a da pildă. Vi se va da şi o largă
participare la trebile statului …”.
Cu adoptarea acestei revizuiri cea de-a
doua fază a adoptării reformelor agrară şi
electoralăavea să ia sfârşit.
Cu acestea, o altă Românie se întrezărea
la finele războiului.
urges in his speeches to order, economy,
conscientiousness and work. That is why prince N. Şuţu stated in

That is why, starting with November
1869, the change of the Constitution was
desired in a restrictive way. The most
radical act of the political right is the so-
called Petition from Iasi initiated by the
Moldavian conservatives around Grigore
M. Sturza and sent to the Parlament in
April 1871.
However, at this time of struggle the
Constitution does not change.
The first amendment to the
Constitution takes place in 1879, when the
signatory Powers of the Treaty of Berlin
condition the recognition of Romania's
independence by amending Article 7 of
the Constitution regarding the acquisition
of citizenship .
A second change, less aggravated than
the one from 1879, was to take place in
1884 through the modification of 24
articles and of some provisions of the
Electoral Law.
Another revision followed in 1914.
Charles I dies in September 1914.
His successor, Ferdinand the 1st, will
be subjected to the pressures of the events
that came over Romania. He gave a
proclamation in 1917 drafted by Nicolae
Iorga where it was said: " Vouă fiilor de

pământul unde v-aţi născut, aţi crescut. Vă
spun, eu, regele vostru, că, pe lângă

With the adoption of this review, the
second phase of the adoption of the
agrarian and electoral reforms will come to
an end.
With this, another Romania saw itself
at the end of the war.
