the appIication for climate cont「o=ed minirstorage at 341 Harman Park Drive. Staff has met with the

appiicants for a pre-aPPiication conference. Staff provided adequate public no輔cation for this

heari=g. The pianning commission approved a conditional use permit for this appIication on

December 8, 2015. The app!icant has provided updated mate「ials to the commission for軸eir review

along with pubIic comment on the project. Brad Ash describes the project in detail. He says that they

have worked directIy with st押on the design on add「essing various issues. They have decided not to

incorporate the signage as part of this review. In terms of equipment, they w紺p「ovide screening as

needed ifthey come up and w紺workwith staffon this issue. There is 17置18 feetfor an easement on

the eastern line for a potentiaI future tra旧t is a 50,000s(担buiIding and u輔zes a metaI and stucco

Dickhoff goes through the Land Use Development Code and how the propertv reiates. ArticIe 3 of

the Land Use Development Code does訓ow this use with the approval of a conditional use permit,

Which the appiicant has been approved. The proposed deveiopment meets the requirements set

forth in Article 5 ofthe Land Use DeveIopment Code. The project is not in a floodpIain and must have

a State Storm Wate「 Management PIan and permit that includes construction e「osion controI. it is

requi「ed to show proofof軸s priorto construction. The app=cant w川be p「oviding a detention pond

to help with drainage on the prope申′・ The Town Code requires at Ieast lsqft of snow storage per

every 2sqft to be cIeared. Brad Ash states that the detention pond w紺be u輔ze for the phases of

the project for drainage and snow removai. There is pienty ofspace fo「 snow storage, but sta什needs

a designated area as thjs is a phased project. The app=cants are working with the Harman Park HOA

for sewer and wate「 needs. The subject site is reiativeiy flat and has gentIe sIopes. Brad Ash states

that the trees wi= be addressed by phase and w紺try to save as many t「ees as possible. Tra怖c

generation does not dictate any imperfects to the Ha「man Park Intersection with US HWY 160.

Harman Park Drive has not been accepted into the Town, but w川appear before Town Counc旧o

COnSider at a futu「e meeting. There are currentIy two entrances planned for phase one of this

PrOject. The eastem entrance sits on a 50-foot easement for the future of the Town to Lakes Traii

and u輔ties. Planning Director 」ames Dickhoff states that the appIicant intends to have about 17ft

dedicated for this. Currentiy, there are oniy over head power Iines on the eastem entrance. Mike

Davis of Davis engineering discusses the site plan for ut航es and the easements. They kept the

eastem entrance 17feet o什ofthe property because ofthe grade ofthe property and there is shaIIow

bedrock. A= ofthe site drainage w川be co=ected and placed into the detention pond. He says that

Curb and gutter couid be added to the othe「 side ofthe eastem road for a future trail, The「e is one

POWe川ne on the eastern road. Commissioner Martinez asks for phase two the power Iine wouid be

left in the middle ofthe road. Mike Davis states only if it’s not a probIem withしa PIata. Commissioner

Adams asks about the phasing of the p「oject and the u輔ties. Mike Davis discusses how the project

W紺be phased. Commissioner Martinez asks how many units are in the first phase. 304 units are in

the first phase. She asks if there are enough parking spaces. The requirement is one space for 50

units. TheyonIy need 6 spaces and theyare providing about 9 spaces in the first phase. Commissioner

Parker is concemed about the number of spaces. PIanning Director 」ames Dickho什says that the

Parking is based off of the buiId out plan, but by phase. As each phase comes through the

COmmission, the applicants w紺need to accommodate for parking. The applicants wouId just need

to modify their designs. Ke=ey Dunn would like to be ab看e to bu冊buiIding number two (second

StOrage bu‖ding) as a she= becausetheY are gOingto be pouring a lot ofconcrete. 1tw掴bethe same

building size and style. Planning Director 」ames Dickho什says that this would need to come before

the commission. Commissioner Adams asks if the 17feet is ok over the 20 feet fo「 the easement.

Planning Director」ames Dickhoff says that he is ok with this ifthe roadway is one way. Brad Ash says

that there is a totaI of8feet in change from the front ofthe buiIding to the back and can’t rea=y be

moved forwaterdrainage and trucks tuming. Commissioner Martinez asks about how large ofa truck

COuld fit in the port. A fairly Iarge truck couId fit. PIanning Di「ectorJames Dickho什says that he wouid

「ea=y need to inspect where the road fa=s in pe「spective ofthe prope直y line・ Mike Davis cIaims that

the easement isn’t excIusive and the 30foot access easement is just a generaI easement.

Commissioner Parker asks about sh曲ng the project 3feet to the west. Mike Davis says that this

WOuId be a cha=enge because ofthe grade and drainage. PIanning Director」ames Dickhoff is okwith

the appIicants pian for the 17イoot easement. Mike Davis says that because the slope goes from the

west to the east, Sh冊ng the property w川not he!p the project or drainage. Brad Ash states that the

drainage pond rea=y takes up a large portion of the NE comer of the property and the deveIopers

have u輔zed訓ofthe ava=able space. The p「esented plans are a workabIe solution to this issue. The

parking !ots spaces are compliant with the Town code at 9 feet wide and 18feet long. The drive aisIe

at 22.5 feet is ok because this w紺most =keIy be a one-Way Street and there are no parking spaces

on the other side to interfere with tra冊c. The applicant is providing 9 spaces forthis fi「st phase and

2 are ADA. The Town code requires l tree for each 5 pa「king spaces and the appIicant has provided

3 trees as per sta菅requests. 10% ofthe parking lot must be a=ocated to landscaping. The detention

pond w紺be qua冊ed as a Iandscaped area. The Planning Di「ector」ames Dickhoffsaysthat given the

fu= build out ofthe site, he says thatthe landscaping requi「ements a「e met. No pa「king lot =ghting

is proposed, but wa冊ghts are. The applicants are aware ofthe Town’s light code and are subject to

review and inspection. There currently is no sidewalk along Harman Pa「k Drive, but the applicant

intends to provide connectivity within the site. Piaming Director 」ames Dickho什discusses the

eIevation dressing provided. The applicants have broken up the roofiine and provided 5 feet bump

outs. The metal treatment to the outside of the bu冊ing is a painted bronze metai. There are

windows on the northem eIevation with the port. The snow sheds a「e on the north and south sides

Dickho什saysthatthis is a very large building and modulation is important. Commissioner Parker says

that the east and west elevations a「e ofthe iargest concem. As there are no snow sheds here, this

WOu!d be a good opportunity to o什set the design to a human scale. Landscaping and trees camot be

used as moduiation, but possibIy to buffer the uses. Commissioner Martinez asks if the commission

Can requeSt Where to plant the trees. Typica=y, this is up to the applicant, but the commission can

recommend where to pIant the trees. Commissioner Adams asks about the north eievation verticai

lines. Brad Ash says those are the support posts. CommissionerAdams wants to see consistency with

modulation in the neighborhood. Other criterion to consider is architectural cha「acter or features.

B「ad Ash says that the roof ridges mimic the character of the area. Commissioner Adams asks about

b「eaking up the fa鱒de on軸e south side. Commissioner Maez states that the last bu脚ng in the

Phase would rea=y need to be addressed for its south facing fa鱒de. This issue wi= s副need to come

back for another resign review for that phase. Pianning Director 」ames Dickhoff states that is correct.

One consideration to discuss is breaking up the east and west facades with simple a「chitectural

features・ Perhaps verticaI features, COIors, stuCCO treatmentS, Or Sm訓roofs ove「 the doorways. Brad

Ash provides a rendering of the buiIding to give the commission a bette「 idea of the facades.

Commissione「Adams wouId =ke to have some kind ofbump out on the east and west facades. Brad

Ash states that they could provide a verticaI, COIored stucco treatment and design to the east and

WeSt elevationsto moduIate them. Two-foot-Wide, stuCCO bump outs on the east and west eIevations

COuid have 34 of these treatments. The appIicants are meeting the landscaping requirements for

Phase one. Commissioner Parker asks about having some drainage directed intothe landscaped beds

for water. Mike Davis says that some runo什w紺 be directed there. Commissioner Parker

recommends mulch for the Iandscaping and a dry rock bed in between. The strip of land between

the potentiaI front retaii and the sidewalk w帥be kept native. PIanning Director 」ames Dickho什says

that sta苗w帥wo「k with the applicant on exterio川ghting and signage. No pubIic comment was

received. Commissioner G=es asks about the impact fees of ;129,000 per buiIding and if there is a

Commissioner Parker moves to approve the Pagosa C=mate Controi Storage, Inc. Major Design

Director 」ames Dickhoff discusses the permit appIication. The property is Iocated in an R-6

residentialIy zoned district. The permits needed for his appiication are a business iicense and Iodging

tax license, Which the appiicant has begun with the Town. P「eviously, Staff has dealt with these

applications administrative!y. Vacation rentals do require an approved conditionaI use permit as per

the adopted Land Use DeveIopment Code. PIanning Director 」ames Dickhoff describes the

requirements the proposed use must meet in order to be approved. 」urgen Montgomery is the

app=cant and he describes the use ofthe property. The applicant does live in Town and w川be abie

to fu=y maintain the property. Commissioner Maez asks how Iong the average rental w旧ast. Mr.

Montgomery states that he w紺Iimit the renters to a few days at a time. Commissioner Parker asks

how he w紺advertise the p「opertY. The app=cant says that he w紺u輔ze online sites =ke BRBO.

Commissioner Parker asks how the appIicant w川prevent issues with renters. He states that renters

W紺sign a contract saying that they w紺fo=ow the rules set for the in the document. Commissioner

Ma由nez asks how many bedrooms and bathrooms a「e in the property. The「e are three bedrooms

and two bathrooms. PIanning Di「ector 」ames Dickho什states that statf has adequately notified about

this hea「ing. CommissionerAdams asks if the applicant taIked to the neighbo「s about how Iong his

rental season w川Iast. The appiicant statesthat he intendsto rent itout in the summer months, and

lives there part time. Planning Director 」ames Dickhoff describes the required criteria and how the

applicant has metthese or intends to meet these. He says thatthe appIicant and proposed use meets

訓of the required criteria set forth in the Land Use Deveiopment Code. Pianning Director 」ames

Dickho廿describes some recommended contingencies attached to this conditionaI use permit if

approved: Ample on site parking must be maintained and provided. Snow removaI must be removed

Changing current zones based upon cur「ent structures with the districts. Goidmine Drive and T「inity

Lane would be key a「eas to iook at for metal buiIdings. 14th and 15th street wouid also be important

to Iook at. The code heIps to not Iimit uses lOO%, but pieces and parts such as storage containers

and metal siding. This wi= be bene砧aI before the Comprehensive Plan gets updated in the fa帖

CommissionerAdams says that this w紺be a very invoIved discussion and suggests a work session for

D. Consideration of Vacation RentaI Zoning Recommendations: Pianning Director 」ames Dickhoff

PrOVides an updatefrom the IastTown Council meet活g. TheTown Council wou刷ike the commission

to flush this out and have a work session together with them. The town Counci=s concemed about

the spi輔ng of Iots being taken up by oniy short term rentals. They suggested possibly piacing

reguIations on this issue. The prima「y concem is wo「kforce housing availab掴ty. Commissioner Maez

SaySthat he is not opposed tovacation rentais, but he wantsto make surethev are a= goingthrough

the right process. Durango is a good model for these types of regulations. Staf自s cu什entIy looking

into other communities for reIevant exampies. Commissioner Adams agrees that Durango is a good

model to leam from, but the entire country is going through this probiem.

A. Staff Report_ Projects, Updates and Upcoming Deveiopment Appiications: Planning Director 」ames

Dickhoff providesthe commission with a brief update. TheTown has received a Safe Routesto SchooI

Grant・皿s is close to a $500,000 project. Staffw川keep the commjssion updated on the graveI pit,

as there is an immediate need for one in Town. The Town wants to ensure the routes aren’t soIely

down South 8th street, but broken up through other roads. The Town received the last easement

donation this moming for the Town to Lakes traiIs. This w紺be sent to CDO丁immediately because

the traiI needs to be built this year or the project loses funding. The South 8th street project is out to

bid and responses w紺be in this week. The results w川be presented to Town Councii next week.

Every re-PaVement PrOject takes significant funds and constant upkeep. 8th street is a major

thoroughfare and w紺only get busier if the proposed schooI campus becomes a reality. The

Rumbaugh Creek Bridge has an RFP out to bid for guard ra冊g designs and inst訓ation. Those

PrOPOSais w紺be in by」une 6th. The「e wilI be a pubIic work session in the future forthe best uses of

the water works site in general. Staff would Iike to hear from the public on this matter. Planning

Director 」ames Dickhoff discusses the ava帖ble tax credits for commercial and residential properties.
