38.5.1

Pemohon mengakui bahawa penyerahan permohonan ini dan/atau penyempurnaan Kriteria Kelayakan seperti yang dinyatakan dalam Item 38.6 di bawah tidak mewujudkan obligasi atau jaminan di pihak MyCreative untuk meluluskan permohonan ini. Jika permohonan ini diluluskan, apa-apa keputusan yang disampaikan oleh MyCreative kepada Pemohon tentang skop dan amaun pembiayaan yang ditawarkan ("Geran") dan syarat yang Geran tersebut tertakluk kepadanya, adalah muktamad dan tidak terbuka kepada apa-apa rundingan, rayuan atau hak tuntutan lain. JIKA PERMOHONAN DITOLAK, KEPUTUSAN YANG DISAMPAIKAN OLEH MyCreative KEPADA PEMOHON ADALAH MUKTAMAD DAN TIDAK TERBUKA KEPADA APA-APA RUNDINGAN, RAYUAN ATAU HAK TUNTUTAN LAIN OLEH PEMOHON.

The Applicant acknowledges that the submission of this application and/or the fulfillment of the Eligibility Criteria as specified in Item 37.4 below do not create an obligation or guarantee on the part of MyCreative to approve the application herein. If this application is approved, any decision conveyed by MyCreative to the Applicant on the scope and amount of the funding offered (“Grant”) and the conditions upon which the Grant is subjected to, shall be final and not open to any negotiation, appeal or other recourses. IF THE APPLICATION IS REJECTED, THE DECISION CONVEYED BY MYCREATIVE TO THE APPLICANT SHALL BE FINAL AND IS NOT OPEN TO ANY NEGOTIATION, APPEAL OR OTHER RECOURSES BY THE APPLICANT.

38.5.2

Pemohon dengan ini mengakui bahawa walaupun MyCreative akan menggunakan usaha yang sewajarnya untuk melindungi kerahsiaan maklumat yang dikemukakan dalam permohonan ini, MyCreative berhak untuk melakukan perkara berikut:

The Applicant hereby acknowledges that while MyCreative will use reasonable effort to safeguard the confidentiality of the information submitted in this application, MyCreative shall be entitled to do the following: -

To disclose the information submitted herein to such persons involved in the evaluation process of this application including without limitation MyCreative’s employees, consultants, agents, advisors and/or such other persons as may be appointed by MyCreative; and

(b) Untuk menggunakan apa-apa maklumat yang dikemukakan dalam permohonan ini bagi tujuan penyatuan, analisis, dan/atau penyediaan statistik, dengan syarat bahawa tiada butiran Pemohon yang dapat dikenal pasti didedahkan dan jika Pemohon tidak bersetuju bahawa mana-mana bahagian maklumat yang diberikan di sini boleh digunakan untuk tujuan tersebut, ia hendaklah dengan nyatanya mengenal pasti data tersebut dan menekankan perkara yang sama kepada MyCreative terlebih dahulu dalam Borang Permohonan ini.

38.5.3

MyCreative tidak bertangungjawab terhadap maklumat proprietari dan/atau maklumat harta intelek yang disertakan dalam borang permohonan ini. Mutakhirnya, saya/kami adalah bertanggungjawab sepenuhnya untuk melindungi maklumat sensitif.

The Applicant acknowledge that MyCreative considers all submitted applications as confidential. However, MyCreative cannot guarantee complete confidentially for proprietary matters. MyCreative is not responsible for any proprietary information and/or intellectual property included in a submitted application. Ultimately, I/We am/are solely responsible to protect sensitive materials.

38.6

Kriteria Kelayakan :Comment by Diyana: We would suggest that this criteria be more obvious for the applicant.

Eligibility Criteria:

1) Terbuka untuk individu, perniagaan, pertubuhan, perkongsian atau syarikat yang ditubuhkan di Malaysia sahaja;

2) Warganegara Malaysia untuk individu;

3) Untuk syarikat atau perkongsian, lebih 50% pemilikan sah dan kepentingan terletak pada Warganegara Malaysia; dan

4) Pemohon bukan subjek dalam sebarang perintah penggulungan (untuk Syarikat ) atau individu yang muflis (untuk individu).

1) Open to individual, businesses, association, partnership or Company which was registered/incorporated in Malaysia only;

2) For individuals, Malaysian citizens only;

3) More than 50% ownership and effective interest reside with Malaysian citizen for partnership and company; and

4) Applicants in not subject to any winding up procedings (for Company) or bankrupt (for individuals).

38.7

Penggunaan Geran

Utilisation of Grant

Geran hendaklah digunakan untuk membiayai kos boleh tuntut yang diluluskan sahaja ("Kos Boleh Tuntut Diluluskan"), iaitu apa-apa item dan amaun yang layak dituntut di bawah Geran berhubung dengan Projek. Item dan amaun ini hendaklah diluluskan oleh jawatankuasa yang berkaitan serta dinyatakan dalam Perjanjian Pembiayaan; dan boleh merangkumi gaji, kos penyumberan luar dan/atau apa-apa item lain sebagaimana yang diluluskan oleh jawatankuasa yang berkaitan.

The Grant shall only be used to fund approved claimable costs (“Approved Claimable Costs”), which are such item(s) and amount(s) that are eligible to be claimed under the Grant in relation to the Project. These item(s) and amount(s) shall be approved by the related committee and be specified in the Grant Agreement; and may cover salaries, outsourcing costs and/or such other item(s) as may be approved by the related committee.

38.8

Liabiliti untuk Membayar Balik Geran selepas Penamatan

Liability to Repay the Grant upon Termination

Sekiranya permohonan ini diluluskan dan kemudiannya Geran itu ditamatkan menurut Perjanjian Pembiayaan, Penerima hendaklah bertanggungjawab untuk membayar balik kepada MyCreative sama ada amaun penuh Geran yang dibayar kepada Penerima di bawah Geran itu atau apa-apa amaun yang lebih kecil seperti yang MyCreative tentukan mengikut budi bicara mutlak dan tunggalnya ("Amaun Tertunggak") dalam masa yang ditetapkan oleh MyCreative dalam notis yang menghendaki Penerima membuat pembayaran balik tersebut.

In the event this application is approved and subsequently the Grant is terminated pursuant to the Grant Agreement, the Recipient shall be liable to repay to MyCreative either the full amount of the Grant disbursed to the Recipient under the Grant or such smaller sum as MyCreative in its sole and absolute discretion may specify (“Outstanding Amount”) within such time as specified by MyCreative in a notice requiring the Recipient to make such repayment.

38.9

Pemohon dengan ini mengakui bahawa semua maklumat, laporan dan dokumen lain serta data yang diberikan, atau yang akan diberikan kepada Unit Sekretariat CIRG, berkaitan dengan Projek dan permohonan ini tidak mengandungi apa-apa pernyataan yang tidak benar dan telah disediakan dengan jujur serta dibuat selepas siasatan yang sewajarnya dan teliti, dan Pemohon tidak terlupa untuk menyatakan apa-apa fakta yang, jika tertinggal akan menjadikan pernyataan tersebut mengelirukan.

The Applicant hereby declares that all information,reports and other documents and data furnished, or to be furnished to MyCreative, in connection with the Project and this application does not contain any untrue statements and were honestly provided and made upon due and careful inquiry and the Applicant has not omitted to state any fact(s), the omission of which makes such statements misleading.

38.10

Pernyataan Perlindungan Data Peribadi

Personal Data Protection Statement

Pemohon dengan ini menyatakan dan menjamin MyCreative bahawa berhubung dengan data peribadi (seperti yang ditakrifkan di bawah Akta Perlindungan Data Peribadi 2010) yang diberikan atau yang akan diberikan kepada MyCreative bagi maksud dan/atau berkaitan dengan Borang Permohonan ini, Pemohon telah mendapat keizinan yang diperlukan dan telah memberikan pemberitahuan yang diperlukan kepada subjek data bagi MyCreative memproses data peribadi berkenaan. Pemohon bersetuju bahawa berhubung dengan data peribadi yang diberikan atau yang akan diberikan oleh MyCreative kepada Pemohon bagi maksud dan/atau yang berkaitan dengan Borang Permohonan ini, Pemohon hendaklah, dan akan memastikan bahawa semua pekerja, penjawat dan pengkhidmatnya akan bersama-sama, mematuhi Akta Perlindungan Data Peribadi 2010.
