Question 1 (page 1) Please find enclosed the response to this question. Question 2 (page 1) You state with respect to the statistics under the headings of (g) and (h), the data appears to be contradictory. As clearly indicated in our response of 6 July, in providing detail for these questions, when you referred to ‘new or additional programme’ we have interpreted this as an ‘additional programme of study’. Therefore, in the context of answering these questions, our response to the Freedom of Information request of 6 July is accurate. The requests for the 22 cases were submitted for an extension to their agreed programme of study. However, on review of the requests, it was Welsh Government’s view that the reasons provided for the extension did not meet the exceptional assessment criteria to necessitate an extension to the original agreed programme of study. On further review, it was Welsh Government’s view that the requests were in fact for an additional programme of study rather than a continuation of an existing agreed programme of study. procedures that should be followed in respect of applications for additional programmes of study, the decision for the young people to continue at the specialist FE establishment was therefore agreed. Question 1 (page 2) You asked what is the current population of Wales whom are recorded as suffering from a recognised learning difficulty and provide their age ranges where possible. Stats Wales provides data on persons with learning disabilities by local authority, service and age range. Question 2 (page 2) You asked for clarity of the assertion about when s140 assessments are undertaken. In line with Welsh Minister’s statutory duties (s140 (1)), Welsh Ministers must undertake a s140 assessment where a young person has a statement of SEN; is in their final year of schooling; and there is the intention to access to further education. This is when the majority of s140 assessments take place. Under s140 (3), Welsh Ministers may undertake

an assessment and is therefore discretionary. As outlined in the policy and covered under the Technical Guidance for Careers Wales, para 43(b) provides guidance on when Welsh Ministers may undertake an assessment. Question 3 (page 2) The Welsh Government is committed to meeting the educational needs of all learners, including those with learning disabilities. Our commitment to supporting young people who have been identified as requiring specialist provision is demonstrated though our funding of programmes of studies designed to meet their individual needs. Successful completion of the programmes of study means these young people achieve their identified outcomes, are reaching their educational potential and improve their prospects in adult life.
