candidates likely to be affected by this list may file objections if any, duly enclosing relevant documents addressed to the

Whereas, the Hon’ble High Court of Karnataka in WP No.41595/2011 and 44187-88/2011 c/w WP Nos. 44141-

143/2011 (MV) has made an order on 14/02/2013. Wherein Para (2) of the said order is as follows:-

“ 1. During the pendency of these writ petitions, the respondent State Government issued a notification on

03/12/2012 extending the time for fitment of speed governor to the vehicles in question upto 01/06/2013.

Further, it is seen that the Ministry of Road Transport and Highways, the Government of India issued a

notification on 31/12/2012 specifying uniform fitment of speed governor to the vehicles specified therein.

The petitioners have no grievance in so far as the notification issued by the Government of India on

31/12/2012 which will come into effect from 01/04/2014. The only grievance of the petitioners is for the

period from 01/06/2013 to 01/04/2014. Liberty it reserved to the petitioners to make a representation to

the Government of Karnataka for extending the time from 01/06/2013 till 01/04/2014. If such a

representation is given by the petitioners then the respondents to consider the same keeping in view of the

earlier extension of time and the present notification issued by the Government of India. Accordingly, the

writ petitions are hereby disposed off.”

Whereas, a situation has arisen for the fitment of Speed Governors in the State of Karnataka, wherein the

Central Government has issued notification No.GSR 943(E) dated 31/12/2012 prescribing the speed on the class of

vehicles to be fitted with speed governors w.e.f.01/04/2014.

Now, therefore, in supercession of all the notification issued in this behalf, the Government of Karnataka

hereby,-


1. Specifies that new transport vehicles of the following category shall be fitted with Speed Governors with

immediate effect, namely,-

a) State Carriages

b) Contract Carriages with seating capacity exceeding 7+1.

c) Maxi cabs;

d) Educational Institutional Buses;

e) Private Service Vehicles (Transport)

f) Omni Buses (Transport)

g) Motor Cabs

h) Tourist vehicles covered with permits issued under Sec.88(9) of Motor Vehicles Act

1988 (AITOB) and

i) Goods vehicles except 3 wheeler goods vehicles.

2. Specifies that registered transport vehicles of the following category shall be fitted with Speed Governors at the

time of renewal of fitness certificate, namely,-

a) Educational Institutional Buses;

b) Private Service Vehicles (Transport) and

Whereas the draft of the following rules further to amend the Karnataka Civil Services Rules, was published as

required by clause(a) of sub-section-(2) of Section 3 read with section 8 of the Karnataka State Civil Services Act, 1978

(Karnataka Act 14 of 1990) in Notification No. FD 01 SRA 2013, dated 10.12.2013 in Part IV-A of the Karnataka Gazette

dated 12.12.2013 inviting objections and suggestions from all persons likely to be affected thereby within fifteen days from

the date of its publication in the Official Gazette.

Whereas the said Gazette was made available to the public on 12.12.2013.

And whereas, no objections and suggestions have been received by the State Government.

Now, therefore, in exercise of the powers conferred by sub-section(1) of Section 3 read with Section 8 of the

Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby makes the

following rules, namely:-

1. Title and commencement.- (1) These rules may be called the Karnataka Civil Services (1st Amendment)

Rules, 2014.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of Appendix-(1).- In Appendix I to the Karnataka Civil Services Rules, under the heading “I.

Major Heads of Departments”, after serial number 86 and the entries relating there to, the following shall be inserted,

3. ªÉÄÃ É NzÀ ÁzÀ (3) gÀ°è £ÀUÀgÁ©üªÀÈ¢Þ E¯ÁSÉAiÀÄ ¥ÀæzsÁ£À PÁAiÀÄðzÀ²ðAiÀÄªÀgÀ CzsÀåPÀëvÉAiÀÄ°è ¢£ÁAPÀ: 11.06.2007gÀAzÀÄ ¸À sÉ dgÀÄVzÀÄÝ, £ËPÀgÀgÀ£ÀÄß «°Ã£Áw ªÀiÁqÀÄªÀ §UÉÎ F PÉ¼ÀPÀAqÀ µÀgÀvÀÄÛUÀ¼À£ÀÄß «¢ü¸À®Ä ¸À sÉAiÀÄ°è wÃªÀiÁð¤¸À ÁVzÉ.

(1) Taking pay scale as a criteria, the Bruhat Bangalore Mahanagara Palike would work out a formula for

fitment of officer’s and officials of CMCs/TMC and Gram Panchayaths for the purpose of absorption.

(2) The Bruhat Bangalore Mahanagara Palike shall explore the possibility of protecting the respective interse

seniority of officers and officials of CMCs/TMC and Gram Panchayaths within the ambit of rules and

regulations, since the constitution of Bruhat Bangalore Mahanagara Palike was in public interest. This

will be based upon the prevailing seniority rules.

(3) The BBMP shall prepare the list of 317 officials of the Directorate of Municipal Administration (excluding

officers on deputation from other departments) within 15 days and shall submit a concrete proposal to

Director of Municipal Administration so as to enable them to call for options for absorption from these

employees.

(4) The Director of Municipal Administration, as the Appointing Authority shall take action to obtain

willingness from the employees of the erstwhile CMCs/TMC subject to the guidelines for seniority and

fitment of posts proposed by the Bruhat Bangalore Mahanagara Palike within a time limit of 8 weeks.

Those not submitting any option will be deemed to have opted for absorption. This will be made explicit in

the letters the concerned.

(5) Until Rules for absorption are finalised, the Bruhat Bangalore Mahanagara Palike shall not promote any

of its officers. However, if there are any compelling reasons, requiring some immediate action, the Bruhat

Bangalore Mahanagara Palike may fill up the vacancy on working arrangement (in charge) basis only.

(6) With regard to the daily wagers of erstwhile CMCs/TMC the Director of Municipal Administration as the

Appointing Authority shall take necessary steps in conformity with the DPAR (SR) guidelines issued from

time to time within a period of two months.

(7) In view of the abolition of DUDC Cell in Bangalore (Urban) DC Office, Bruhat Bangalore Mahanagara

Palike will provide the minimum staff for monitoring and finalisation of some of the ULB issues including

regularisation of daily wagers to the Deputy Commissioner, Bangalore (Urban).

(8) As regards Watermen and Valvemen of the CMC/TMCs, it was decided that the matter be discussed with

the BWSSB subsequently.

Sub: Development of Bijapur Airport – Termination of the Project Development Agreement signed

with M/s. Marg Ltd.,

issued by the Indian Bank in favour of Government of Karnataka.

Preamble:

Sanction of the Government was accorded on 23.03.2007 to develop an airport at Bijapur on public private

partnership (PPP) basis. M/s.Marg Ltd., was selected as the developer for the development of the airport project. The

project development agreement was signed with them on 18.01.2010. As per project agreement, airport works had to be

completed within 24 months from the date on which the land for airport is handed over to the developers. For the

development of this project, Bank Guarantee of Rs.2.50 crores has been obtained as Performance Guarantee from the

developers i.e., M/s Marg Ltd., and the same has been renewed upto 31.12.2013. The Government has acquired 727 acres

of land at a cost of Rs. 6401.39 lakhs for the development of this airport. The land required for this airport has been

acquired but the developers have not signed the land lease agreement even after several reminders though they were asked

to take possession of this land. In the meeting held on 05.06.2012 under the Chairmanship of Chief Secretary, the

Chairman of M/s Marg Ltd., had explained that after conducting extensive technical and financial feasibility study of the


land sanctioned for the Bijapur Airport, there is necessity of taking up large scale cutting and filling up work in the lands

allotted to the airport and approximately Rs.81.00 crores may be required for that and the project is not feasible since it

involves more capital investment.

2. On this occasion, the Chief Secretary stated that this project is likely to be feasible, because Bijapur is a tourist

centre, and the State Government has taken up several developmental works here. Important among them are extensive

cultivation of horticultural crops, establishing Kudagi Power Plant, Sugar factories, Solar Park, extending the irrigation

area etc. As a result there may be increase in number of air passengers and cargo capacity.

3. This project will not only encourage aviation industry but also create opportunity for establishing horticulture

related industries in this area. Further airport policy for minor airports for operation of small aircrafts in the state is

under consideration. Further, the Chief Secretary stated that, approximately 1000 acres of land which is there at the

disposal of KIADB is in the Land Bank, and if the land allotted for the Bijapur airport is not suitable, then alternative place

in the said land may be identified. He requested the Deputy Commissioner, Bijapur to identify a suitable place for the

airport after conducting joint survey along with KIADB and M/s. Marg Ltd..

4. Accordingly, further action was expected from the developers. But in the letter dated: 27.7.12, the developers

have expressed that they would like to withdraw themselves from this project by stating that the Bijapur airport project is

technically and financially not feasible and even if alternative land was provided in 1000 acres industrial area, approvals

have to be obtained once again from the Defence Ministry and Ministry of Civil Aviation and there is no sufficient demand

for establishing the airport in this area.

5. Against the above background, the question of terminating the Project Development Agreement entered into

with the Developers M/s. Marg Ltd., was examined by the Government with reference to Article 4 and other relevant

clauses for termination of the said agreement. Further, as per Clause 2.5.1 and Clause 2.5.2 of the RFP, bidders were

encouraged to submit their bids after visit the project site and ascertaining the location, site conditions, utilities and such

other information as are relevant before putting together their proposals. It is deemed that by submitting a proposal, a

bidder is agreed not to use any of these as a ground for termination of the Project Development Agreement. As such all the

bidders including M/s. Marg Ltd., were expected to assess various aspects including site conditions, state of economy,

viability, financial capacity etc. before submitting their proposal and only after undertaking reasonable assessment of

these conditions they were required to submit their bids. Therefore to take extreme steps of discontinuing with the project

on the basis of technical and financial viability of the project is not acceptable at this juncture when the Government

relying on the capacity of M/s. Marg Ltd., has gone much ahead in the project and has also acquired the land required for

the project. Typically, under a BoT arrangement, the commercial issues are allocated to the private party. Hence, seeking

termination of a contract for reasons of unviability of a project is not warranted at this stage as the same would lead to

breach of terms of the project contract. Section 73 of the Indian Contract Act, 1982 provides that, in the event of breach of

contract, the party who suffers by such breach is entitled to receive from the party who has broken the contract,

compensation for any loss or damage caused thereby. Applying these principles of Law of Contract, Government is entitled

for compensation for loss and damage caused by breach of contract.

6. Further, in the Letter of Bid (Appendix-I submitted as part of the Bid), M/s Marg Ltd., has undertaken that, the

Lease Rentals are quoted by them after taking into consideration all the terms and conditions stated in the RFP, draft

Project Development Agreement and based on their own estimates of costs and revenues and after a careful assessment of

the site and all the conditions that may affect the Bid.

7. If the agreement gets terminated for the reasons of M/s. Marg Ltd., finding the project unviable, considering the

effort put by Government in selecting the Bidder, executing the Agreement, acquiring land required for the project etc. and

taking into account the losses and damages likely to be incurred in terms of cost and effort, Government has a right to

forfeit the Performance Security submitted by M/s. Marg Ltd., for the project and claim additional damages as it may deem

appropriate.

8. After examining all aspects, a decision was taken by Government to revoke the Bank Guarantee and to make a

claim before the Bank.

9. Accordingly, a letter read at Sl No. 5 above was issued to Indian Bank, Harbour Branch, Chennai to revoke

the Bank Guarantee in favour of Governor of Karnataka. The Demand Drafts for Rs.2.5 crores in favour of Governor of

Karnataka have been obtained from the said bank and is being remitted in the relevant Head of A/c.

10. After considering all aspects of the matter, the following orders are issued:-

GOVERNMENT ORDER NO: IDD 166 DIA 2013, BANGALORE, DATED: 10-01-2014

In the detailed circumstances, explained in the preamble, sanction of the Government is accorded to:

I. Forfeit the bank guarantee of Rs. 2.50 crores furnished by the developers

M/s. Marg Ltd., for the Bijapur Airport Project in favour of Government of

Karnataka.


II. Terminate the Project Development Agreement entered into with the

Developers M/s Marg Ltd.,

III. Take legal action in accordance with the provisions of the Project

Development Agreement.

2. This order is issued in consultation with Law Department vide note No: Law 739 Opinion 2013, dated

10-12-2013 and with Finance Department vide note No: FD 1511 Exp-1/13, dated 16-12-2013.

THE KARNATAKA CIVIL SERVICES (WATER RESOURCE SERVICE) (SPECIAL

RECRUITMENT OF ASSISTANT ENGINEERS AND JUNIOR ENGINEERS) ACT, 2013

(Received the assent of the Governor on the twelfth day of December, 2013)

An Act to make special recruitment of Assistant Engineers and Junior Engineers in the Karnataka Civil Services

(Water Resource Services).

Whereas, the High Court of Karnataka in Writ Petition No. 41145-58/2010 (G. Ravi and 3 others) and connected

other 3 Writ petitions, has declared that the Karnataka Civil Services (Absorption of Assistant Engineers and Junior

Engineers appointed on contract basis and on adhoc basis in Water resources Services) (Special) Rules, 2002 – are

contrary to Article 16(3) as well as Article 14 and 16 of the Constitution of India as void ab initio and further directed that

the Government shall initiate recruitment process to the posts which were filled up under the impugned Absorption Rules

forthwith and complete the same within a period of six months from the date of the order outer limit being one year. All the

persons absorbed/appointed/ regularized under the impugned Rules are permitted to continue in service till the

recruitments are made in pursuance of the Karnataka Public Works (Irrigation Services)(Recruitment of Assistant

Engineers and Junior Engineers)(Special) Rules, 1998, within a period of one year, whichever is earlier.

Further, that eligibility for applying as against these vacancies would be that all persons who possess the

requisite educational qualification as well as age as on 11.02.1999, the day on which the aforesaid special rules came into

force. Only those persons who possess the requisite qualification as on 11.02.1999 shall be considered for filling up those

vacancies which were filled up under the impugned Absorption Rules.

Whereas, the Hon'ble Supreme Court has rejected the SLP application bearing No. 38345-38397/2012 and

modified the directions of High Court to the extent that any person who has been working on adhoc basis and was eligible

at the initial time of his appointment, can apply in pursuance of any advertisement made even if he has become over aged.


The Hon'ble Supreme Court also held that, if the selection process in pursuance of the order of the High Court is

not concluded within a period of one year from date of the Court order, any person working in adhoc basis shall cease to

work with effect from 13-12-2013.

Thereby, the services of large number of Assistant Engineers and Junior Engineers will cease to exist and the

interest of the State will be jeoparodised on account of stoppage of ongoing projects undertaken with the aid of World Bank

keeping in view Bachavat Award and recent award passed by the Krishna Water Disputes Tribunal Award-II;

Whereas, the State of Karnataka is under an obligation to complete ongoing projects and also to undertake

further projects to utilize its share of water to serve the large interest of farmers of the State and therefore it is necessary to

utilise the long years of service and experience put in by Assistant Engineers and Junior Engineers absorbed in 2002 rules

in public interest;

Whereas, the Karnataka Public Works (Irrigation Services) (Recruitment of Assistant Engineers and Junior

Engineers) (Special) Rules, 1998 - are one time operational rules and it requires certain modification with reference to the

age limit applicable to the candidates to be recruited in accordance with the above cited judgments and whereas it is also

expedient to provide for protection of the interest of 417 engineers absorbed under the Karnataka Civil Services

(Absorption of Assistant Engineers and Junior Engineers appointed on contract basis and on adhoc basis in Water

resources Services) (Special) Rules, 2002 and to consider their long service rendered in the State Government and for the

purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the sixty fourth year of the Republic of India as follows:-

1. Short title commencement and application.- (1) This Act may be called the Karnataka Civil Services (Water

Resources Services) (Special Recruitment of Assistant Engineers and Junior Engineers) Act, 2013.

(2) It shall come into force at once.

(3) Notwithstanding anything contained in the Karnataka Civil Services (General Recruitment) Rules, 1977 or in

the Karnataka Public Works (Irrigation Services) (Recruitment) Rules, 1988 or in any other rule made or deemed to have

been made under the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990) or in any Judgment, decree or

Order of any Court, Tribunal or Authority this Act shall apply to the direct recruitment to 550 or such additional number

of vacancies as may be notified by the State Government in the categories of Posts of Assistant Engineers and Junior

Engineers in the Karnataka Civil Services (Water Resource Services):

Provided that nothing in this Act shall apply to more than one recruitment.

2. Definition.- (1) In this Act, unless the context otherwise requires,-

(a) "Adhoc or Contract Assistant Engineers or Junior Engineers" means the adhoc or contract Assistant

Engineers or Junior Engineers as defined and absorbed into the Karnataka Public Works (Irrigation

Service) under the Karnataka Civil Services (Absorption of Assistant Engineers and Junior Engineers

appointed on contract basis and on adhoc basis in Water resources Services) (Special) Rules, 2002;

(b) "selection authority" means such officer or authority as the State Government may by order specify in this

behalf.

(2) The words and expressions used in this Act but not defined herein shall have the same meaning as

in the Karnataka State Civil Services (General Recruitment) Rules, 1977.

3. Selection Authority.-(1) The selection of candidate for the Posts of Assistant Engineers and Junior

Engineers under this Act shall be made by the Selection Authority.

(2) The selection authority shall prepare a list of selected candidates in accordance with section 7.

4. Age.-The candidate who are eligible as on 11-02-1999 in accordance with the age limit specified in

rule 6 of the Karnataka Civil Services (General Recruitment) Rules, 1977 shall only be eligible to apply for the

recruitment under this Act:

Provided that the upper age limit prescribed shall be relaxed in respect of adhoc or contract Assistant

Engineers or Junior Engineers as on 11-02-1999 by such number of years they have served on Adhoc or contract

basis.

5. Qualification.- The qualification for the purpose of recruitment under this Act, to the post of

Assistant Engineers and Junior Engineers shall respectively be the qualification specified for the post of the

Assistant Engineers and Junior Engineers in the Karnataka Public Works (Irrigation Service) (Recruitment) Rules,

1998 as on 11-02-99. The candidates who possessed with the above qualification as on 11-02-99 shall only be

eligible to apply.

6. Application for Recruitment.- Selection Authority shall advertise the vacancies in the official

Gazette specifying the conditions of eligibility, the nature of selection, the number of vacancies to be filled and

classification in accordance with the orders of reservation in force and invite applications from the intending


candidates. Abstract of such advertisement shall also be published in two news papers having wide circulation

in the State.

7. Method of Selection of Candidate.- (1) The selection Authority shall on the basis of the aggregate

percentage of marks secured by the candidates in the qualifying examination and taking into consideration the

weightage allowed under this Act, and subject to orders in force providing for reservation for posts for the

Scheduled Castes, Scheduled Tribes and other Backward Classes or any other reservation as per law in force

prepare in the order of merit, lists of candidates eligible for appointment under this Act to the posts of Assistant

Engineers and Junior Engineers. If the marks obtained by two or more applicants are equal the order of merit in

respect of such candidates shall be fixed on the basis of their age, the older in age being placed above the

younger:

Provided that in case of determination of income for the purpose of reservation of posts, salary income of

the adhoc or contract Assistant Engineers or Junior Engineers shall not be taken into consideration.

(2) The number of candidates to be selected under sub-section (1) shall be equal to the number of

Vacancies notified:

Provided that while preparing the above lists,

(a) A weightage of five percent for each year of service subject to a maximum of thirty percent shall

be added to the percentage of total marks secured by the candidate in the qualifying examination,

if such candidate has served as Assistant Engineer or Junior Engineer, as the case may be in the

Irrigation Department in the State; and

(b) a weightage of one percent shall be added to the percentage of marks secured in the qualifying

examination in respect of the candidates belonging to displaced families.

Explanation 1.- For the purpose of the weightage under Clause (a), service rendered for

fraction of a year shall also be reckoned as service rendered for a whole year.

Explanation 2.- Displaced family in relation to a person means the individual, the husband or

wife as the case may be, or such individual and their son and un-married daughter residing with

them and dependent on them for livelihood and such person being a tenure holder, tenant,

Government lessee or owner of property has been displaced from this land or other property on

account of acquisition of such land including a plot in the Gramathana or other property in the

affected zone for the purpose of the Irrigation project. The 'Authority' for issuing the certificate

relating to a displaced family shall be the Deputy Commissioner.

(3) The select list shall be published on the notice board of the office of the Selection Authority and in the official

Gazette and a copy there of shall be sent to the Appointing Authority.

8. Appointment of candidates.-(1) The candidates whose names are included in the selection list made available

by the selection Authority shall be appointed by the appointing Authority in the order in which their names appear in the

final select list. Before such appointment, the Appointing Authority shall satisfy itself regarding the suitability of

candidate for appointment with reference to their antecedents character and physical fitness in accordance with the

provisions of the Karnataka Civil Services (General Recruitment) Rules, 1977.

(2) Inclusion of name of a candidate in the select list shall not confer any right on the candidate for appointment.

(3) The entire process of selection of eligible candidates and notifying such names shall as far as may be

completed within one year from the date of commencement of this Act.

9. Period of operation of the Selection List.-The list of candidates selected by the Selection Authority and

assigned to the Appointing Authority shall be valid till all the candidates included in the list are appointed.

10. Liability of Candidates to serve in any part of the State.- The candidates selected under this Act and

appointed shall be liable to serve in any part of the State.

11. Counting of previous service.- Notwithstanding anything contained in any Judgment, decree or Order of

any Court, Tribunal or Authority or any other Law for the time being inforce,-

(1) The Adhoc or Contract Assistant Engineers or Junior Engineers shall be continued to work in the post with

the same terms and conditions in which they are holding on the tenth day of December, 2013 as if they have been

recruited regularly, subject to application of all other rules relating to conditions of service, till the recruitment process

under this Act is completed.

(2) The service rendered by adhoc or contract Assistant Engineers or Junior Engineers before the commencement

of the Karnataka Civil Services (Absorption of Assistant Engineers and Junior Engineers appointed on contract basis and

on adhoc basis in Water resources Services) (Special) Rules, 2002 shall not count for the purpose of leave, pay, pension or

seniority:


Provided that the service rendered by adhoc or contract Assistant Engineers or Junior Engineers in the Public

Works (Irrigation Service) after the commencement of the Karnataka State Civil Services (Absorption of Assistant Engineers

and Junior Engineers appointed on contract basis and adhoc basis in the Water Resource Service) (Special) Rules 2002

and before the commencement of this Act shall count for the purpose of leave, pay, pension or seniority:

Provided further that fixation and protection of pay shall be notional and they shall not be eligible for any arrears

of salary.

12. Application of other Rules.- The provisions of the Karnataka Civil Services Rules, the Karnataka Civil

Services (General Recruitment) Rules, 1977, the Karnataka Civil Services (Conduct) Rules, 1966 and all other rules made

or deemed to have been made under the Karnataka State Civil Services Act, 1978, in so far as they are not inconsistent

with the provisions of this Act shall be applicable to the persons selected and appointed under this Act.

13. Power to remove difficulty.- If any difficulty arises in giving effect to the provisions of this Act, the

Government may, by general or special order, make such provisions as it appears to be necessary or expedient to remove

the difficulty.

In exercise of the powers conferred by sub-section (1) of section 14 of the Karnataka Education Institutions

(Prohibition of Capitation Fee) Act, 1984 (Karnataka Act 37 of 1984), the Government of Karnataka hereby makes the

following rules, further to amend the Karnataka Conduct of Entrance Test for Selection and Admission to Postgraduate

Medical and Dental Degree and Diploma Courses Rules, 2006, namely:-

RULES

1. Title and commencement.- (1) These rules may be called the Karnataka Conduct of Entrance Test for

Selection and Admission to post Graduate Medical and Dental Degree and Diploma Courses (Amendment) Rules, 2014.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of rule 2.- In rule 2 of the Karnataka Conduct of Entrance Test for Selection and Admission to

post Graduate Medical and Dental Degree and Diploma Courses Rules 2006 (hereinafter referred to as the said rules),-

(i) in clause (a), after the brackets, words and figures “(Regulation of Admission and Determination of Fee) Act,

2006” the words “or such other committee as may be notified by the Government” shall be inserted.

(ii) in clause (c-2), after the brackets, words and figures “(Regulation of Admission and Determination of Fee) Act,

2006” the words “or such other committee as may be notified by the Government” shall be inserted.

3. Amendment of rule 3.- In rule 3 of the said rules, in sub-rule (2), for the words “as on the last date of receipt

of application for the Entrance Test” the words and figures “as on 31st March in the year that the Entrance Test is

conducted” shall be substituted.


4. Amendment of rule 4.- In rule 4 of the said rules, in explanation to proviso,-

(a) the words “shall not able” shall be omitted.

(b) in clause (i), for the word “seven” the word “ten” shall be substituted.

(c) for clause (iv), the following shall be substituted, namely:-

“ (iv) Son or daughter of serving Defence personnel or Ex-serviceman from Karnataka who at the time of joining

the Defence Service had declared his hometown a place in the State of Karnataka. If he is a serving Defence

personnel Proof of such domicile shall be produced by obtaining the extract from the AG’s branch (Army Hqs)

respective branch of integrated HQ of MoD for Officers and respective Record Officers for JCOs / OR provided

that in case of Ex-Serviceman from Karnataka who at the time of joining the Defence service had declared his

hometown a place in the State of Karnataka proof of such domicile shall be obtained from the Deputy Director,

Department of Sainik Welfare and Resettlement. Further, in each of the above two circumstances the candidate

must have passed the Qualifying Examination from a University or Board or any other institution located

anywhere in India”.

5. Amendment of rule 7.- In rule 7 of the said rules,-

(i) in sub rule (1), after the words “monitored by” the words “such committee as may be notified by the

Government or by the” shall be inserted.

(ii) for sub rule (2), the following shall be substituted, namely:-

“(2) All private professional education institutions imparting professional medical or dental course shall make

admission through a Common Entrance Test conducted on All India basis at State level and followed by

Centralized counseling through a single window in accordance with such procedure as may be specified by the

such committee as may be notified by the Government or by the Admission Overseeing Committee constituted

under the Karnataka Professional Educational Institutions (Regulation of Admission and Determination of fee)

Act, 2006 or Admission in such private professional educational institutions may at the option of the said

institutions be done by the Entrance Test Committee through the Karnataka Admission Authority or by the

National Board of Examination.”

(iii) in sub rule (3), for the words “ shall be followed” the word “or” shall be substituted.

6. Amendment of rule 10.- In rule 10 of the said rules, in sub-clause (a) for the words “as on the last date of

receipt of applications for the Entrance Test” the words and figures “as on the 31st March in which the Entrance Test is

held” shall be substituted.

7. Amendment of rule 16.- In rule 16 of the said rules, after the brackets, words and figures “(Regulation of

Admission and Determination of Fee) Act, 2006” the “or such fee as may be notified by the Government” shall be inserted.

The draft of the following rules further to amend the Karnataka Excise (Sale of Indian and Foreign liquor) Rules,

1968, which the Government of Karnataka propose to make in exercise of the powers conferred by section 71 of the

Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966) is hereby published as required by sub-section (1) of the said

section for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be

taken into consideration after thirty days from the date of its publication in the official Gazette.

Any objection or suggestion which may be received by the State Government from any person with respect of the

said draft before the expiry of the period specified above, will be considered by the State Government. The objections or

suggestions may be addressed to the Principal Secretary to Government, Finance Department, Vidhana Soudha,

Bangalore-01.

DRAFT RULES

1. Title and Commencement.- (1) These rules may be called the Karnataka Excise (Sale of Indian and Foreign

liquor) (Amendment) Rules, 2013.

(2) They shall come into force from the date of its publication in the Official Gazette.

2. Amendment of rule 3.- In the Karnataka Excise (Sale of Indian and Foreign liquor) Rules, 1968 (hereinafter

referred to as the said rules) in rule 3, after clause (7-C), the following shall be inserted, namely:-

"(7-D). Hotel and Boarding House Licenses owned by the person belonging to Scheduled Castes and Scheduled

Tribes-

(a) A license under this clause shall be applied for and obtained in Form CL-7D from the Deputy

Commissioner.

(b) No liquor under this license shall be sold to persons other than those accommodated in the licensed

hotel and boarding houses and their guests and casual visitors who take meals in such places.

Provided that no license under this clause shall be granted unless the hotel and boarding house is

having a minimum of fifteen double rooms in Corporation areas and ten double rooms in other areas."

3. Amendment of rule 3A.- In rule 3A of the said rules, after the letter and figure "CL-7" the letter and figure

"CL-7D" shall be inserted.


4. Amendment of rule 8.- In rule 8 of the said rules, in sub-rule(1) after serial number

(7-C), the following shall be inserted, namely:-

"(7-D) Hotel and Boarding House Licenses owned by the person belonging to Scheduled Castes and Scheduled Tribes

specified in clause 7D of rule 3, in the case of,-

(a) City Municipal Corporation areas having population more than

20 lakhs

Rs.6,60,000 per year

(b) Other City Municipal Corporation areas Rs.5,80,000 per year

(c) City Municipal Council areas Rs.4,30,000 per year

(d) Town Municipal Council/Town Panchayat areas Rs.3,64,000 per year

(e) Other areas Rs.2,80,000 per year

5. Insertion of new Form CL-7D.- After Form CL-7C appended to these rules, the following new form shall be

inserted, namely:-

"Form CL-7D

(see rule 3(7-D)

License for the sale of Indian liquor (other than arrack) or Foreign liquor or both to be drunk in

the premises, combined with meals and refreshments in the Hotel and Boarding House owned by the

person belonging to Scheduled Castes and Scheduled Tribes.

CONDITIONS

1. The licensee shall be bound by the provisions of the Karnataka Excise Act, 1965, and any general specific rules

prescribed or which may from time to time be prescribed there under.

2. The privilege under this license extends to the sale of Indian liquor (other than arrack) or Foreign liquors of the

brands furnished by the licensee. Any alterations and additions to the lists furnished shall be approved by the

Commissioner. No liquors below the strength of 250 UP (under proof) in case of Brandy, Whisky and Rum and 350 UP

(under proof) in case of Gin and not more than 8 percent of alcohol by volume in case of Beer will ordinarily be included in

the list.

3. The holder of this license shall upon requisition by any officer not below the rank of Sub-Inspector of Excise be

bound to produce to such officer the original invoice showing the procurement of all liquors for the sale of which this

license is granted for inspection and to all the samples of the liquors in the shop to be tested.

4. The licensee is bound to maintain correct daily accounts of transactions and submit the return every month to

the Excise Officer concerned, within the first week of the following month.


5. The license may be suspended or cancelled in accordance with the provisions of Section 29 of the Act and

licensee or his employee shall be liable for prosecution for beach of any of the conditions of the license, under the

provisions of the Act or the rules and orders there under.

6. The license shall continue in force till the…..

7. The sale of liquor is restricted to the residents for their own use and that of their guests requiring liquor with

the meals supplied to them,

8. The opening and closing hours shall be form 9.00 AM to 12 midnight.
