GARIS PANDUAN KERJA PERUNDINGAN
1.0 PEMAKAIAN
1.1 Garis Panduan ini diluluskan ole Ahli Majlis UPUM untuk
digunapakai oleh semua staf UM.
1.2 Garis Panduan ini hendaklah terpakai kepada semua staf
Universiti Malaya.
1.3 Ahli Majlis UPUM boleh membenarkan apa-apa
pengecualian daripada mana-mana bahagian Garis
Panduan ini jika difikirkan sesuai.
1.4 Keputusan Ahli Majlis ke atas semua perkara berkenaan
tafsiran Garis Panduan ini, atau mana-mana perkara atau
perkara-perkara di mana Garis Panduan ini tidak mempunyai
peruntukan mengenainya, adalah muktamad.

2.0 DEFINISI PERUNDINGAN
2.1 Satu kegiatan yang melibatkan seseorang atau sekumpulan
orang untuk memberi perkhidmatan kepakaran atau
kemahiran kepada pihak yang memerlukan, sama ada
dengan mendapat bayaran atau tanpa bayaran.
2.2 Kegiatan perundingan yang termasuk dalam definisi di atas
adalah seperti berikut:-
2.2.1 Perundingan di antara Universiti dengan pelanggan
dengan bayaran (kontrak institusi dengan bayaran);
2.2.2 Perundingan di antara staf Universiti dengan
pelanggan dengan bayaran (kontrak persendirian
dengan bayaran).
2.3 Selain kegiatan perundingan di atas (2.2) Khidmat
Perundingan turut melibatkan aktiviti seperti berikut:-
2.3.1 Kajian oleh Pakar-Pakar Universiti untuk
melaksanakan keperluan terma rujukan pelanggan.
2.3.2 Penyelidikan Kontrak.
2.3.3 Perkhidmatan Nasihat Pakar.
2.3.4 Perkhidmatan Latihan Akademik dan Teknikal.
2.3.5 Perkhidmatan Pengurusan Kemudahan.
2.4 Staf universiti bermaksud staf akademik dan staf P&P yang
berkhidmat di UM.
2.5 UPUM ialah Unit Perundingan Universiti Malaya, sebuah Unit di
bawah Institut Penyelidikan dan Pemantauan (IPPP) Universiti
Malaya.

3.0 TAKRIF
Dalam Garis Panduan ini melainkan jika kandungan ayatnya
mengkehendaki makna yang lain:-
“Kerja Perundingan” merujuk aktiviti khidmat perundingan yang
dibayar mengikut terma yang ditetapkan oleh pihak klien.
Khidmat perundingan meliputi khidmat nasihat, latihan dan uji
bahan.
“Kajian/Projek Perundingan” bermakna satu aktiviti perundingan
yang berdaftar dengan UPUM/Kementerian Kewangan/Badan
Profesional dan diberikan satu nombor rujukan khusus. Kadar
bayaran, terma, jangkamasa kerja dan perunding-perunding
dinyatakan dengan jelas bagi setiap projek;
“Ketua Perunding” bermakna staf UM yang dilantik dari kalangan
perunding untuk mengetuai serta bertanggungjawab
sepenuhnya ke atas kejayaan Projek Perundingan;
“Perunding” bermakna semua staf UM merangkumi kakitangan
akademik yang menjalankan kerja Perundingan;
“Pegawai Penyelidik/ Pembantu Penyelidik” bermakna mana-
mana individu yang dilantik oleh Ketua Perunding untuk memberi
bantuan kepada mana-mana Projek perundingan;
“Klien” bermakna orang perseorangan, agensi kerajaan dan
badan berkanun, agensi swasta dan pertubuhan bukan kerajaan
(NGO), atau mana-mana organisasi sama ada di dalam atau di
luar Malaysia memohon khidmat perundingan daripada UPUM;

“Perjanjian Projek” bermakna satu bentuk dokumen bertulis yang
ditandatangani oleh UM dan klien bagi sesuatu Projek
Perundingan;
“Kos Overhead” bermakna bayaran yang perlu dibayar kepada
UPUM untuk kos bahan (contoh: bahan kimia, kertas, thumbdrive,
CD, data, peta, alatulis dan lain-lain) dan kos perkhidmatan
(contoh: upah separa profesional, perkeranian, perjalanan,
komunikasi, percetakan, sewa dan lain-lain).
“Yuran Profesional” bermakna bayaran yuran yang diterima oleh
Perunding UM hasil daripada Kerja Perundingan yang dijalankan;
4.0 KEPENTINGAN PERUNDINGAN
4.1 Perundingan adalah salah satu fungsi asas Universiti, iaitu
memberi perkhidmatan kepada masyarakat.
4.2 Kegiatan perundingan merupakan sebahagian bidang
tugas staf akademik dan dinilai dalam prestasi tahunan.
4.3 Memberi khidmat kepakaran dan nasihat kepada industri,
masyarakat dan negara.
4.4 Memberi peluang pada staf akademik untuk menambah
pendapatan disamping menjana dana tambahan untuk
Universiti.
4.5 Memberi khidmat kemudahan peralatan yang terdapat di
Universiti kepada industri-industri.
4.6 Sebahagian daripada tanggungjawab sosial.

5.0 KEBENARAN UNTUK MENJALANKAN PERUNDINGAN
5.1 Setiap staf perlu mendapat kebenaran rasmi (Borang
Kebenaran Menjalankan Kerja Perundingan) daripada Ketua
Jabatan/Ketua PTj untuk menjalankan kerja perundingan.
5.2 Semua kerja perundingan diwajibkan melalui UPUM termasuk
kerja-kerja perundingan yang diperolehi oleh staf itu sendiri.
5.3 Sebarang cadangan kerja perundingan yang diperolehi oleh
staf secara persendirian hendaklah dirujuk kepada UPUM
secepat mungkin, iaitu sebelum penyerahan cadangan
kepada klien. Ini bertujuan memastikan kertas cadangan
disediakan dengan kemas dan perundingan dengan klien
dijalankan secara sistematik dan profesional.
5.4 Dalam pertimbangan untuk memberi kelulusan permohonan
menjalankan perundingan, perkara berikut akan diberi
perhatian:-
5.3.1 Kerja perundingan tidak akan menjejaskan tugas
pengajaran dan tugas-tugas rasmi lain.
5.3.2 Kerja perundingan tersebut memberi faedah dalam
bentuk peningkatan ilmu dan pengalaman kepada
staf dalam bidang pengkhususannya.
5.3.3 Tempoh keseluruhan kerja perundingan hendaklah
tidak melebihi tempoh maksimum yang dibenarkan
bagi setiap staf, iaitu empat (4) bulan-kerja (man-
month) bagi satu tahun kalendar. UPUM akan
menyimpan rekod kerja perundingan setiap staf.

5.3.4 Staf tersebut dapat menyelesaikan kerja perundingan
sebelum persaraan wajib atau tamat kontrak
perkhidmatan dengan Universiti Malaya.
5.5 Kerja Perundingan setara dengan penyelidikan. Oleh itu Staf
boleh memohon cuti penyelidikan untuk kerja perundingan
yang melibatkan perjalanan jauh (outstation). Semua rekod
ini harus diselaraskan dengan Jabatan/ PTj/ BSM. Untuk
perjalanan sekitar Lembah Klang, Staf perlu mengikut
prosedur semasa yang digunapakai, untuk menghadiri
mesyuarat, seminar atau kajian lapangan.
6.0 PELANTIKAN KETUA PERUNDING, PERUNDING DAN STAF SEPARA
PROFESIONAL
6.1 Pelantikan Ketua dan Perunding
6.1.1 Perlantikan Ketua Perunding dan Perunding akan dibuat
oleh Pengarah UPUM setelah mendapatkan kebenaran
sebagai perunding dari Ketua Jabatan dan PTj masing-
masing.
6.1.2 Pada dasarnya UPUM tidak akan bertanggungjawab ke
atas sebarang penglibatan perunding yang tidak dilantik
oleh UPUM.

6.2 Pelantikan Kakitangan Separa Profesional
6.2.1 Ketua Perunding boleh mencadangkan calon untuk
perlantikan Kakitangan Separa Profesional di mana
kakitangan tersebut dibayar dengan menggunakan
peruntukan Projek Perundingan berkenaan mengikut
kadar yang ditetapkan.
6.2.2 Ketua Perunding/ Perunding perlu menghantar surat
permohonan perlantikan kepada UPUM bersama
dengan resume calon tersebut. Surat permohonan
hendaklah mengandungi maklumat spt kadar gaji dan
tempoh lantikan.
6.2.3 Semua perlantikan adalah bertaraf sementara atau
kontrak.
6.2.4 Ketua Perunding/ Staf Perunding perlu memantau
Kakitangan Separa Profesional di bawah seliaannya dan
memastikan semua arahan kerja dipatuhi.
6.2.5 Kakitangan Separa Profesional boleh dipertimbangkan
untuk mengambil cuti atas budi bicara ketua perunding.
6.2.6 Ketua Perunding perlu menghantar surat pemberitahuan
penamatan Kakitangan Separa Profesional kepada
UPUM.
Kategori Penamatan perkhidmatan seperti berikut:-
a. Tempoh perlantikan perkhidmatan selama satu (1)
hingga dua belas (12) bulan perlu memberi empat
belas (14) hari notis.
b. Tempoh perlantikan perkhidmatan selama satu (1)
tahun dan lebih perlu memberi tiga puluh (30) hari
notis.

Kakitangan bukan akademik Universiti yang terlibat dalam
kerja perundingan perlu mendapat kelulusan daripada Ketua
PTj dan perlu memastikan kakitangan tersebut tidak
menjejaskan tugas hakiki di Universiti.
7.0 PENGIRAAN KOS PERUNDINGAN
7.1 Pada amnya belanjawan bagi setiap kerja perundingan perlu
mengambil kira semua kos. Kos perundingan boleh
dibahagikan kepada 2 bahagian:
7.1.1 Yuran Perundingan (Perunding dan
Pegawai/Pembantu Penyelidik)
Kos ini ditentukan mengikut formula yang ditetapkan
untuk klien kerajaan dan badan berkanun, dan
mengikut kadar pasaran untuk klien sektor swasta.

7.1.3 Kos Overhead

Perolehan Perkhidmatan Perunding (Edisi 2011).
7.2 Staf yang memperolehi kerja perundingan secara
persendirian disarankan mendapatkan garis panduan dan
nasihat UPUM untuk menyediakan belanjawan perundingan.
8.0 AGIHAN PENDAPATAN DARIPADA KERJA PERUNDINGAN
8.1 Agihan pendapatan daripada kerja perundingan adalah
seperti berikut:

9.0 TANGGUNGJAWAB DAN AKAUNTABILITI PERUNDING
9.1 Staf perunding adalah tertakluk kepada peruntukan Akta
Badan-Badan Berkanun (Tatatertib dan Surcaj) 2000 (Akta
605) dan Peraturan-Peraturan Tatatertib Badan-Badan
Berkanun (Jadual Kedua Akta 605) serta Akta Keselamatan
dan Kesihatan Pekerjaan 1994 (Akta 514).
9.2 Staf perunding adalah bertanggungjawab untuk
melaksanakan kontrak perundingan menurut terma
rujukan kontrak perundingan.
9.3 Staf perunding bertanggungjawab untuk
menyelesaikannya tugasnya dengan kualiti kerja yang
tinggi dan dalam tempoh waktu yang ditetapkan.
9.4 Staf perunding hendaklah mengutamakan kepuasan klien
setiap masa, sama ada dalam perhubungan rasmi atau
dalam penyediaan laporan atau apa juga produk
perundingan yang ditetapkan.
9.5 Staf perunding bertanggungjawab memastikan dirinya
dilindungi oleh insuran yang mencukupi dan sesuai
daripada liabiliti yang berkaitan dengan kontrak
berkenaan.
9.6 Staf perunding adalah bertanggungjawab untuk
menandatangani surat indemniti dengan Universiti Malaya
berhubung dengan liabiliti yang timbul terhadap mana-
mana pihak disebabkan oleh ketidakcekapan, kecuaian,
tindakan peninggalan dan salahlaku staf perunding dan

agennya di dalam menjalankan kerja perundingan
(sekiranya perlu).
9.7 Dalam menjalankan kerja perundingan, staf perunding
hendaklah tidak membelakangkan tugas rasmi demi
kepentingan peribadinya dan tidak menggunakan
kedudukannya sebagai staf perunding bagi faedah dirinya
sendiri.
9.8 Melainkan dengan kebenaran Pengarah Unit Perundingan
Universiti Malaya, seorang staf perunding tidak dibenarkan
menyerahhak dan subkontrak kerja perundingannya.
9.9 Ketua Perunding dan staf perunding hendaklah sentiasa
menjaga nama baik Universiti.
9.10 Menjaga kerahsiaan projek perundingan kecuali dengan
kebenaran pihak klien.
9.11 Staf perunding perlu mematuhi arahan dan keputusan
Ketua Perunding/ Pengarah Projek.
9.12 Staf perunding hendaklah segera memaklumkan kepada
UPUM jika terdapat masalah untuk meneruskan
pelaksanaan kerja perundingan.
9.13 Ketua perunding dan staf perunding bertanggungjawab
untuk mengemukakan semua resit/ tuntutan perbelanjaan
berkaitan projek kepada UPUM dengan segera.

9.14 Ketua Perunding perlu melaporkan kepada Pengarah
UPUM sekiranya ada perunding yang tidak menunjukkan
prestasi kerja yang memuaskan dan dicadangkan untuk
ditamatkan khidmatnya.
10.0 TANGGUNGJAWAB DAN AKAUNTABILITI UPUM
10.1 Mendaftar sebagai Perunding dengan Kerajaan dan
mana-mana agensi yang berkaitan.
10.2 UPUM akan sentiasa giat berusaha mendapatkan kerja
perundingan daripada pihak yang memerlukan dan
menubuhkan pasukan perunding untuk melaksanakan
kerja perundingan.
10.3 UPUM akan bertindak bagi pihak Universiti dalam semua
urusan berhubung dengan kerja perundingan yang
dijalankan oleh staf UM.
10.4 UPUM akan memberi khidmat nasihat dan membantu staf
mengenai penyediaan belanjawan dan kertas cadangan
perundingan, dan lain-lain perkara yang berkaitan.
10.5 UPUM akan membantu staf untuk berunding dengan klien,
jika perlu, untuk mencapai persetujuan mengenai terma
rujukan perundingan dan kadar bayaran yang berpatutan.
10.6 UPUM hendaklah memastikan Staf mendapatkan
kebenaran dari PTj/Jabatan masing-masing, untuk
menjalankan kerja perundingan.

10.7 UPUM akan menyimpan rekod kerja perundingan bagi
setiap staf perunding.
10.8 UPUM akan mengambil langkah-langkah yang wajar untuk
menangani semua bentuk risiko yang terdapat dalam
setiap kerja perundingan. UPUM bertanggungjawab
untuk:-
10.8.1 Mengambil perlindungan insuran yang
mencukupi dan sesuai terhadap liabiliti
professional dan produk berkaitan dengan
kontrak perundingan berkenaan (jika perlu);
10.8.2 Mengambil perlindungan insuran yang
mencukupi dan sesuai berkaitan dengan
keselamatan staf yang terlibat dengan kontrak
perundingan berkenaan;
10.8.3 Memastikan staf perunding menandatangani
surat indemniti dengan Universiti Malaya
(sekiranya perlu);
10.8.4 Mengingatkan perunding mematuhi Akta
Keselamatan dan Kesihatan Perkerjaan 1994
(Akta 514).
10.9 UPUM akan memantau kemajuan kerja perundingan dan
memastikannya berjalan mengikut jadual, dan mengambil
tindakan pembetulan jika terdapat masalah dalam
perlaksanaan kerja.
10.10 UPUM akan menguruskan tuntutan kepada klien dan
menguruskan penerimaan bayaran perundingan daripada
klien dan pembayaran kepada semua pihak yang terlibat
mengikut perenggan 6.1 (Jadual 1) atau perenggan 6.2
(Jadual 2), yang mana berkenaan.

10.11 Sekiranya berlaku masalah yang melibatkan prestasi staf
perunding, Pengarah UPUM hendaklah mengambil
langkah berikut untuk mengatasi masalah berkenaan:-
10.11.1. Pengarah UPUM perlu berbincang dengan
perunding bermasalah tersebut.
10.11.2. Pengarah UPUM perlu berbincang dengan
kumpulan perunding untuk mengatasi masalah
perunding berkenaan.
10.11.3. Pengarah UPUM perlu mengadakan mesyuarat
dengan klien untuk tujuan penamatan dan
penggantian.
10.11.4. Pengarah UPUM perlu memastikan semua
dokumen dan peralatan berkaitan projek
dikembalikan oleh perunding berkenaan.
10.11.5. Satu (1) salinan surat rasmi penamatan hendaklah
dihantar kepada Jabatan/ PTj dan klien.
10.12 Dalam keadaan tertentu perunding boleh melantik
pembantu perunding yang terdiri dari kalangan staf
akademik UM dengan persetujuan Pengarah atau
Timbalan Pengarah UPUM.
11.0 PENGGUNAAN KENDERAAN DAN PERALATAN UPUM
11.1 Ketua Perunding/ Perunding perlu mengisi borang
permohonan untuk tujuan penggunaan kenderaan dan
peralatan UPUM.
11.2 Penggunaan perlu mendapatkan kelulusan dari Pengarah
atau Timbalan Pengarah UPUM.

11.3 Penggunaan kenderaan hendaklah menggunakan
pemandu dari UPUM melainkan telah mendapat kelulusan
dari Pengarah atau Timbalan Pengarah UPUM.
11.4 Ketua Perunding/ Perunding hendaklah memastikan
peralatan yang dipinjam sentiasa dalam keadaan baik
11.5 Ketua Perunding/ Perunding bertanggungjawab terhadap
barang yang digunakan/dipinjam.
11.6 Sekiranya berlaku kerosakan atau kehilangan peminjam
perlu menggantikan atau memperbaiki.
12.0 HAK HARTA INTELEK
Hak harta intelek yang terhasil daripada kerja-kerja perundingan
adalah tertakluk kepada dasar harta intelek Universiti dan undang-
undang harta intelek yang berkenaan.
Asas rujukan Garis Panduan ini hendaklah mengambilkira perkara
berikut:
1) Arahan Kerja UPUM
2) Garis Panduan berkaitan yang diterimapakai oleh UM
3) Borang Kebenaran menjalankan kerja perundingan
4) Surat Akuan Melaksanakan Kerja (jika berkenaan)
5) Manual Perolehan Perkhidmatan Perunding (Edisi 2011)

GUIDELINES FOR CONSULTANCY SERVICES
1.0 APPLICATION
1.1 The guidelines have been approved by the Board of UPUM
and are applicable for all UM staff.
1.2 The Board of UPUM may allow exemption from any parts of
the guidelines if deemed suitable.
1.3 The decision of the Board of UPUM on all matters related to
these guidelines, or any consultancy related items that are
not covered by these guidelines, is final.
2.0 DEFINITION OF CONSULTANCY SERVICES
2.1 An activity that involves an individual or a group of people
who provides expertise services or skills, either with or without
charges.
2.2 Consultancy activities, as mentioned above, are inclusive of
the following:
2.2.1 Consultancy activities between the University and
clients with charges (institutional contract with
payment).
2.2.2 Consultancy activities between University staff and
clients with charges (Personal contract with
payment).
2.3 In addition to the consultancy activities stated in (2.2), the
following are also considered consultancy activities:

2.3.1 Research conducted by experts in the University
according to the Terms of Reference from clients.
2.3.2 Research Contract.
2.3.3 Professional Advise.
2.3.4 Academic and Technical training.
2.3.5 Facilities Management.
2.4 University Staff includes academic and P&P staff servicing the
University of Malaya.
2.5 UPUM is the acronym of University of Malaya Consultancy
Unit, a unit under the umbrella of the Institute of Research
Management and Monitoring, University of Malaya.
3.0 TERMINOLOGY
The following shows the definition of the terms used in the
guidelines, except otherwise meant in a particular sentence:
“Consultancy Services” refers to consultancy activities that are
paid according to the terms proposed by clients. Consultancy
services include advisory activities, training and material testing;
“Consultancy Research/ Project” refers to any consultancy
activities registered with UPUM/ Ministry of Finance/ Professional
Bodies, which are given a specific reference number each. The
payment rate, term, research duration and consultants are
specified in each project;
“Lead Consultant” is a UM staff (among the appointed consultants)
who is appointed to lead and take full responsibility of the success
of a consultancy project;

“Consultant” refers to all UM staff, including academic staff who
provide consultancy activities;
“Research officer/ Research Assistant” refers to any individuals who
are appointed by the Lead Consultant to help in any consultancy
projects;
“Client” refers to any individuals, government agencies, statutory
bodies, private agencies and NGO or any organizations, either in
or outside Malaysia that require consultancy services from UPUM;
“Project Agreement” refers to a written document that is jointly
signed by UM and clients for a consultancy project;
“Overhead Cost” refers to payment that is to be paid to UPUM for
material cost (examples: chemicals, papers, thumbdrives, CD,
data, maps, stationeries and others) and service cost (examples:
cost of hiring semi professionals and clerks; travel, communication,
printing, rental and other costs);
“Professional Fees” means payment that is received by UM
consultants for a consultancy project.
4.0 IMPORTANCE OF CONSULTANCY
4.1 Consultancy, which is a type of services for the society, is one of
the functions of a university.
4.2 Being involved in consultancy activities is one of the job
scopes of academic staff and such involvement is evaluated
as a part of Key Performance Index every year.
4.3 Provide expertise service and advice to the industries, society
and country.

4.4 Provide an opportunity for the academic staff to increase
income and at the same time, generating income for the
University.
4.5 Offer usage of University facilities and equipment to the
industries.
4.6 It is a part of social responsibilities.
5.0 APPROVAL FOR CONDUCTING CONSULTANCY SERVICES
5.1 Every staff must obtain official approval (approval form for
conducting consultancy activities) from the Head of
Department/ Head of PTj for conducting consultancy
activities.
5.2 All consultancy activities must go through UPUM, including
those secured by an individual staff him/ herself.
5.3 Any consultancy projects secured by an individual staff must
be referred to UPUM as soon as possible before a proposal is
sent to a client. This is to ensure that the proposal is done in a
proper manner and the consultancy activities are conducted
systematically and professionally.
5.4 The following will be considered by UPUM before approving a
consultancy project:
5.3.1 The consultancy project will not affect the teaching
and other official jobs of a staff member.
5.3.2 The consultancy project benefits a staff member in
terms of knowledge and experiences in his/ her field.

5.3.3 The maximum duration of the consultancy project
does not exceed the maximum consultancy duration
allocated for every staff member, which is four (4)
man-month of a calendar year. UPUM will keep a
record of consultancy activities of every staff member.
5.3.4 A staff member will be able to complete the
consultancy project before compulsory retirement or
end of service contract with the University of Malaya.
5.5 Consultancy is equivalent to research. Therefore, a staff
member can apply for research leave for outstation
consultancy activities. The record should be standardized
across the department/ PTj/ BSM. A staff member should
oblige by the current travel procedures while travelling within
Klang Valley to attend meetings, seminars and to conduct
field work.
6.0 APPOINTMENT OF THE LEAD CONSULTANT, CONSULTANTS AND SEMI-
PROFESSIONAL STAFF
6.1 Appointment of the Lead Consultant and Consultants
6.1.1 Appointment of the Lead Consultant and Consultants will
be done by the Director of UPUM after obtaining
approval from the respective Head of Department and
PTj of the consultant(s).
6.1.2 UPUM is not responsible for involvement of any individuals,
who are not appointed by UPUM, acting as consultant(s).
6.2 Appointment of Semi-Professional Staff

6.2.1 The Lead Consultant can suggest appointment of semi-
professional staff to help in a consultancy project. The
candidate will be paid according to a fixed rate using
the existing allocation of the consultancy project.
6.2.2 The Lead Consultant/ Consultants must send an
appointment application letter to UPUM together with
the resume of the candidates. The payment rate and
duration of the appointment must be mentioned in the
application letter.
6.2.3 All appointments are temporary or contract based.
6.2.4 The Lead Consultant/ Consultants must supervise semi-
professional staff to make sure that they conduct their
work accordingly.
6.2.5 Semi-professional staff can take leave, subject to the
approval by the Lead Consultant.
6.2.6 The Lead Consultant must notify UPUM of the termination
of semi-professional staff through a letter of termination.
The categories for termination of service are as follows:
a. A fourteen-day (14) notice for an appointment
duration of one (1) to twelve (12) months.
b. A thirty-day (30) notice for appointment duration of
one (1) year and above.
Prior approval must be obtained from the respective Head of
PTj for involvement of non-academic staff of the University and
the Lead Consultant must make sure that such involvement will
not affect the official jobs of the staff member in the University.
7.0 CALCULATION OF CONSULTANCY COST

7.1 Generally, the expenses of every consultancy project must
include all relevant costs. Consultancy cost can be divided
into two parts:
7.1.1 Consultancy Fees (Consultants and Research
Officers/ Assistants)
This cost is calculated according to the guideline for
government’s clients and statutory bodies and it
follows the market rate for clients from the private
sector.

7.2 A staff member who has secured any consultancy projects on
his/ her own is advised to read the guidelines by UPUM or
consult UPUM while projecting consultancy budgets.

9.0 RESPONSIBILITIES AND ACCOUNTABILITY OF CONSULTANTS
9.1 Consultants are subjected to Statutory Bodies (Discipline
and Surcharge) Act 2000 (Act 605) and Statutory Bodies

Disciplinary Regulations (Second Schedule)(Act 605) and
Occupational Safety and Health Act 1994 (Act 514).
9.2 Consultants are responsible for fulfilling consultancy
contracts according to the relevant Terms of Reference.
9.3 Consultants are responsible for completing their tasks and
producing high quality work within the stipulated duration.
9.4 Consultants must prioritise clients satisfaction at all times,
either during communication or in preparation of reports
and any consultancy products that have been agreed
upon.
9.5 Consultants must make sure that they are sufficiently
covered by insurances for liabilities associated with
consultancy activities.
9.6 Consultants have to sign an indemnity letter with the
University of Malaya with regards to any liabilities that may
arise due to incompetence, negligence, omission and
misconduct of consultants and their agents while
conducting consultancy activities (if deemed applicable).
9.7 Consultants should not neglect their official jobs while
conducting consultancy activities and they should not take
advantage of their position as consultants to gain personal
interest.

9.8 Unless otherwise approved by the Director of UPUM,
Consultants are not allowed to surrender or engage a sub-
contractor for the consultancy project.
9.9 The Lead Consultant and consultants must always take
care of the reputation of the University.
9.10 Consultants must uphold the confidentiality of consultancy
projects.
9.11 Consultants must follow the instruction and decision made
by the Lead Consultant/ Project Director.
9.12 Consultants must notify UPUM of any problems related to
continuation of the consultancy project.
9.13 The Lead Consultant and Consultants are responsible for
submitting all receipts/ reimbursement application related
to consultancy activities to UPUM promptly.
9.14 The Lead Consultant must notify UPUM shall any consultants
fail to perform satisfactorily and that they should be
terminated.
10.0 RESPONSIBIITIES AND ACCOUNTABIITY OF UPUM

10.1 Register as a Consultant with the Government or any
relevant agencies.
10.2 UPUM will always strive to secure consultancy projects from
those in needs and form suitable consultancy teams.
10.3 UPUM is representing the University in all matters related to
consultancy activities undertaken by UM staff.
10.4 UPUM will advise and help staff in preparing consultancy
budgets, proposals and other relevant items.
10.5 UPUM will help staff in dealing with clients, if needed, in
order to achieve reasonable Terms of Reference and
payment.
10.6 UPUM must make sure that the staff has obtained approval
from the respective PTj/ Department to conduct
consultancy activities.
10.7 UPUM must keep a record of consultancy activities of each
consultant.
10.8 UPUM will take proper measures to mitigate all kinds of risks
associated with a consultancy project. UPUM is responsible
for:
10.8.1 Undertaking insurances that are sufficient and
suitable for protection against professional and
product liabilities related to a consultancy
contract (if needed);

10.8.2 Undertaking insurances that are sufficient to
consultants who are involved in a consultancy
contract;
10.8.3 Making sure that Consultants sign the letter of
indemnity with the University of Malaya (if
needed);
10.8.4 Remind Consultants to oblige by the
Occupational Safety and Health Act 1994 (Act
514).
10.9 UPUM will monitor the progress of all consultancy projects
and make sure that the projects progress as planned. It will
undertake corrective measures if there are problems in
implementing consultancy activities.
10.10 UPUM will manage payment from clients and pay involved
the staff according to Paragraph 6.1 (Schedule 1) or
Paragraph 6.2 (Schedule 2).
10.11 Shall problems associated with staff performance arise, the
Director of UPUM should take the following steps to solve the
problems:
10.11.1. The Director of UPUM should have a discussion with
the involved consultant(s).
10.11.2. The Director of UPUM should have a discussion with
the consultancy team to solve the problems.
10.11.3. The Director of UPUM Director should have a
meeting with client(s) for termination or
replacement of the involved consultant(s).

10.11.4. The Director of UPUM must make sure that all the
documents and equipment related to the project
are returned to UPUM by the involved
consultant(s).
10.11.5. A (1) copy of an official termination letter must be sent to
the Department/ PTj and client(s).
10.12 Under certain circumstances, Consultants can appoint
assistants among the UM academic staff with approval
from the Director or Deputy Director of UPUM.
11.0 USE OF UPUM VEHICLES AND EQUIPMENT
11.1 The Lead Consultant/ Consultants have to fill out an
application form in order to use UPUM vehicles and
equipment.
11.2 The use must be approved by the Director or Deputy
Director of UPUM.
11.3 UPUM vehicles must be driven by a driver from UPUM, unless
otherwise approved by the Director or Deputy Director of
UPUM.
11.4 The Lead Consultant/ Consultants must make sure that the
borrowed equipment is always in a good condition.
11.5 The Lead Consultant/ Consultants are responsible for the
borrowed equipment.
11.6 The borrower must repair or replace damaged or lost
equipment.

12.0 INTELLECTUAL PROPERTY
Intellectual properties resulted from consultancy activities are
subjected to the intellectual property policy of the University and
relevant regulations.
The basic terms of reference of the guidelines are built upon the
following:
1) Appointment by UPUM
2) Related guidelines used by UM
3) Approval form for conducting consultancy activities
4) Confirmation letter for conducting consultancy activities (if
relevant)
