ALL RECCOMMENDATIONS

The state has not undertaken signifi cant eff orts towards the implementa on of recommenda ons received during the second cycle of the UPR. Par cularly, no progress was registered to ensure the independence of judiciary, eff ec ve inves ga on of torture complaints and reforma on of the electoral law

RIGHT TO FAIR TRIAL

o Carry out ve ng of judges, prosecutors, inves gators and police offi cers based on law and objec ve, non-discriminatory criteria;

o Provide mechanisms for appealing the Supreme Judicial Council’s disciplinary, appointment and dismissal decisions, restrict the Council’s discre onary powers and increase its accountability;

o Establish an -corrup on courts with a corpus of specialised and high-integrity judges elected through transparent procedures;

o Secure cons tu onal mechanisms of parliamentary and civil oversight of security bodies and police, including their repor ng to the parliament, elec on of the ins tu ons’ heads by the majority vote in the parliament;

o Secure ins tu onal independence of the security, inves ga ve bodies and police from the execu ve through the elec on of the heads of these bodies by parliament;

o Unify all inves ga ve agencies of diff erent state ins tu ons under the framework of the Inves ga ve Commi ee.

Poli cally mo vated persecu ons; Excessive use of deten on; Access to jus ce

o Swi ly adopt new Criminal and Criminal Procedure Codes, providing eff ec ve alterna ves to pre-trial deten on and extend the mandate of the Proba on service to cover the pre-trial stage;

o Revise the law on NGOs to allow them apply to court for the protec on of public interest;o Establish specialised pool of judges to hear domes c violence cases; develop separate guidelines for judges

on accommoda on of hearings on domes c violence cases and cases with the par cipa on of persons with intellectual and psychosocial disabili es in administra ve, criminal and civil courts.

TORTURE AND OTHER ILL-TREATMENTGaps in preven on and punishment of torture and other ill-treatment

o Criminalise ill-treatment and ensure documenta on of injuries for persons subjected to torture or other ill-treatment based on the Istanbul Protocol;

o Ensure adequate qualifi ca on of cases of torture and other cases of ill treatment;o Exclude the use of evidence extorted through torture at any stage of proceedings, provide eff ec ve mechanisms

for review and redress with no statute of limita ons;o Provide adequate rehabilita on services to vic ms of torture and other ill-treatment, including medical,

psychological, social and legal;o Introduce mechanisms to provide pecuniary and non-pecuniary damages to torture vic ms regardless of the

inves ga on outcome.

Police, military police and deten on centres

o Install audio-video recording in interroga on rooms of all deten on centres and inves ga on rooms;o Increase the eff ec veness of early release mechanisms;o Ensure legisla ve clarity on the func ons of Military police in military ba alions and disciplinary cells;o End impunity for the torture and ill-treatment in military and punish high level responsible personnel.

Peniten aries

o Carry out independent and eff ec ve inves ga on into the cases of ill-treatment and self-harming in peniten aries that would lead to the iden fi ca on and punishment of responsible persons;

o Ensure access to remedy for torture vic ms and their representa ves; o Transfer the prison healthcare under the Ministry of Health and ensure the quality and accessibility of medical

services for inmates;o Undertake legisla ve and other measures to eradicate criminal culture in prisons and discriminatory policies

towards inmates;o Improve the access to methadone subs tu onal therapy for prisoners.

Life prisoners

o Repeal part of the 2003 presiden al decree and ensure appropriate remedies for the abuse of due process;o Raise the age of life imprisonment from 18 to 21 years; o Ensure the applica on of early release mechanisms to the cases of life prisoners;o Ensure the eff ec ve applica on of early release mechanisms to the cases of life prisoners by a) se ng clear

criteria for person’s correc on evalua on, b) intensifying the rehabilita on work with inmates, and c) ensuring the quality and impar ality of reports prepared by the Proba on service.

Denial of pain treatment as torture or other ill-treatment

o Put an end to excessive police interference in the prescrip on process;o Ensure access to adequate pain medica on for all pallia ve care pa ents suff ering of moderate to severe pain.

RIGHT TO LIFE

Non-combat deaths

o Conduct eff ec ve inves ga ons to hold state representa ves responsible for non-combat deaths.o Ensure transparency and accuracy of repor ng about deaths in the army;o Ensure genuine inves ga on of reopened cases of non-combat deaths, provide remedies to vic ms’ families;o Enact legisla ve mechanisms to ensure pecuniary and non-pecuniary compensa on to soldiers who suff ered

health problems during the military service.

Deaths in Peniten aries

o Conduct eff ec ve inves ga ons into the deaths of prisoners; provide remedies to the families of vic ms.

RIGHT TO FREE ELECTIONS

o Ini ate a comprehensive electoral reform to adopt a new Electoral Code, developed in close consulta on with civil society organisa ons, taking into considera on the recommenda ons of interna onal and local observa on missions.

ANTI-DISCRIMINATION

The majority of recommenda ons related to the issues of discrimina on and gender equality issued during the second cycle of UPR remained unaddressed. The state failed to adopt an eff ec ve domes c violence and an -discrimina on legisla on and ra fy the Istanbul Conven on and CRPD Op onal Protocol. Furthermore, no eff ec ve ac ons were taken towards comba ng hate speech and hate crime against LGBTI persons, and fi gh ng discrimina on against ethnic minori es and people with disabili es.

An -Discrimina on law

o Adopt a comprehensive and eff ec ve an -discrimina on legisla on, which will provide eff ec ve mechanisms for protec on, access to jus ce and eff ec ve remedies for vic ms of discrimina on, and will establish an independent and eff ec ve na onal equality body empowered with support and li ga on competences;

o Conduct awareness raising campaigns, including through public television, targe ng harmful stereotypes and discriminatory prac ces against marginalised groups.

Freedom of religion

o Revise current Law on Religious Organisa ons in line with Venice Commission Recommenda ons (2011 and 2018) par cularly in regards to the dominance of the AAC, the high threshold for the registra on of organisa ons and labelling of preaching as “soul hun ng” (prosely sm);

o Align the public school course “History of the Armenian Church” with OSCE Toledo Principles;o Prohibit forceful par cipa on of soldiers in religious rituals by AAC clergy;o Remove legisla ve limita ons and restric ons upon law enforcement and military units regarding the membership

to religious organisa ons;o Address the propaganda and hate speech against other religions and hold perpetrators accountable.

Discrimina on on the ground of SOGI

o Include sexual orienta on and gender iden ty as protected grounds in the an -discrimina on legisla on;o Criminalise hate speech by state offi cials based on SOGI and make SOGI-mo vated bias an aggrava ng

circumstance in criminal law;o Conduct eff ec ve and comprehensive inves ga on into the cases of homophobic and transphobic a acks as hate

crimes;o Adopt a legisla on recognising and regula ng gender reassignment as a health service.

Ethnic minori es

o Develop a na onal strategy for protec ng the ethnic, cultural, religious and linguis c iden ty of minori es and crea ng condi ons for the promo on of that iden ty in line with the UN Declara on of the Declara on on the Rights of Persons Belonging to Na onal or Ethnic, Religious and Linguis c Minori es;

o Improve legisla on and enforcement mechanisms to prevent underage marriage;o Establish an eff ec ve mechanism for iden fi ca on and referral of out-of-school children.

Gender-based violence and reproduc ve rights

o Ra fy the Council of Europe Conven on on preven ng and comba ng violence against women and domes c violence (Istanbul Conven on) without any reserva ons and amend the na onal legisla on, including the Criminal Code; conduct awareness-raising on the Conven on;

o Develop the capaci es of the judiciary, law enforcement and social workers to secure eff ec ve response to cases of gender-based violence and enforcement of protec ve measures;

o Adopt a comprehensive legisla on on sexual violence and harassment, and establish eff ec ve mechanisms for preven ng and addressing the cases of sexual assault; provide a defi ni on of consent;

o Repeal the legisla ve requirement of mandatory wai ng period and mandatory counselling for women seeking abor on, and provide impar al counselling on family planning.

People with disabili es

o Adopt an eff ec ve law on the rights and inclusion of persons with disabili es and ensure that the Ministry of Labour and Social Aff airs overseeing its implementa on has the legal standing to demand its implementa on in court;

o Ensure the implementa on of legal guarantees to accessibility in all areas, including appropriate sanc ons in the Code on Administra ve Off ences for breaches of accessibility norms and standards; set up a monitoring mechanism based on repor ng to ensure the eff ec ve implementa on of such norms and standards;

o Introduce eff ec ve quotas and incen ve measures for employers in public and private sectors to employ people with disabili es;

o Ensure that women with disabili es have access to medical services and facili es, including sexual and reproduc ve health.

FREEDOM OF ASSEMBLY AND ASSOCIATION, FREEDOM OF MEDIA, AND PROTECTION OF HUMAN RIGHTS DEFENDERS

The majority of recommenda ons issued during the second cycle of UPR with regards to the freedom of assembly and associa on, of media, and protec on of human rights defenders have remained unaddressed.

FREEDOM OF ASSEMBLY AND ASSOCIATION

o Carry out within a reasonable me a comprehensive and impar al inves ga on of criminal cases of violence against assembly par cipants and reporters during the assemblies of June 2015, July 2016 and April 2018 and iden fy all perpetrators;

o Enhance nego a on skills of the policemen involved in the administra on of assemblies; their strict compliance with the standards of using physical force and special means during assemblies; their wearing of uniform and iden fi ca on insignia when performing du es; authorise the use of special means in the police gear only to specially trained service persons;

o Ensure protec on of the right to freedom of assembly for vulnerable groups providing addi onal security measures if needed;

o Develop taxa on and accoun ng requirements for public organisa ons based on the peculiari es of their ac vity.

FREEDOM OF MEDIA

o Prescribe by law the requirement of publicity of the actual and formal owners of mass media, ownership share and funding sources;

o Develop mechanisms to dismantle the monopolisa on of adver sing industry and its impact on media;o Promote self-regula on and ethical standards for media but refrain from legal regula ons that could be misused

for arbitrary censorship;o Amend the Law on Television and Radio by clarifying the broadcast licensing procedure, ensuring transparency

and fairness of compe ons;o Clarify the status of marz TV channels without a digital broadcas ng license;o Ensure actual independence of broadcas ng regulatory body by establishing public control mechanisms;o Carry out a full and impar al examina on of all cases of physical violence against journalists and hindering to

their professional ac vi es.

HUMAN RIGHTS DEFENDERS

o Ensure immediate inves ga on of all threats and a acks against human rights defenders and bring the perpetrators to jus ce;

o Ensure that the an -discrimina on legisla on provides protec on for human rights defenders and their family members from associa ve discrimina on including mechanisms to counter hate speech, harassment and smear campaign against human rights defenders;

o Ensure that the rights and freedoms referred to in the Declara on on human rights defenders are eff ec vely guaranteed; that poli cal leaders publicly express support to human rights defenders and their work and condemn publicly and fi rmly the threats against them.

CHILD RIGHTS AND EDUCATION

No signifi cant progress towards the implementa on of recommenda ons from the second cycle of UPR was made, specifi cally related to the persis ng issues in regards to the protec on of children’s rights.

CHILD PROTECTION AND JUSTICE FOR CHILDREN

o Adopt an independent mechanism for the assessment of poverty and mul ple depriva on of children separate from the family poverty assessment;

o Ra fy Lanzarote Conven on. Create an integrated database of children in confl ict with law. Establish and develop community based social and rehabilita on services for children in confl ict with the law and children subjected to domes c violence.

RIGHT TO EDUCATION

o Introduce transi onal measures, such as organisa on of extra-curricular, catch-up classes, tutoring, learning materials, to compensate the knowledge gap among students lacking func onal literacy so that in the course of the next 3-5 years, performance of rural and urban children, those living in poverty, as well as other aff ected groups is improved;

o Revise the mechanisms of assessment and funding of special needs in educa on so that wider needs in educa on are targeted and adequately addressed within inclusive educa on policy framework, and quality support to children with special need in educa on is provided within mainstream schools;

o Adopt provisions in the laws on Educa on and General educa on to ensure gender-sensi ve and non-discrimina ve teaching, as well as improve the content of textbooks and other learning materials licensed by the state authorised bodies to mainstream gender equality and promote zero tolerance towards any types of discrimina on.

o Improve the system of iden fying and referring children that dropped out of educa on by: a) adop ng the Government Decree on Iden fying, Registering, and Referring Children that Dropped out of Compulsory Educa on; b) defi ning the list of cases and/or scenarios to be considered as dropped out of educa on; c) maintaining reliable sta s cs to monitor dropout cases.

HEALTH AND SOCIAL RIGHTS

The state has not undertaken signifi cant eff orts towards the implementa on of recommenda ons received during the second cycle of the UPR. Along with the obliga ons to protect social right, li le progress was registered in the fi elds of mental health deins tu onalisa on, confi den ality and personal data protec on, access to strong opioids for pallia ve care.

RIGHT TO HEALTH

Right of access to medical services

o Adopt a law defi ning the list of free-of-charge medical services, the list of their benefi ciaries, and provision procedures;

o Review the deployment map of medical ins tu ons and redistribute them in accordance with the number of popula on and medical personnel;

o Use incen ves and other methods to increase the number of medical personnel in rural or remote areas;o Improve and ensure geographic and physical accessibility of health services, par cularly in remote areas, including

access to facili es, medical equipment and essen al medica on;o Adopt a law on E-health system to ensure mechanisms for electronic data protec on.

Pallia ve care

o Increase investment in preven on, educa on and informa on programs about pallia ve care pain management to ensure quality pallia ve care delivery in the country;

o Scale up home based care and inpa ent units in all regions of Armenia to meet the pallia ve care needs;o Ensure the right of pa ents to privacy and confi den ality;o Cease police interference into opioids prescrip on process; o Ensure physical accessibility of oral morphine and other pain medica on in all the regions of Armenia.

Right to health of persons living with HIV

o Create a mechanism for regional medical ins tu ons to par cipate in HIV/AIDS preven on and monitoring processes;

o Carry out regular training on human rights, HIV/AIDS, and discrimina on for the staff of regional medical ins tu ons;

o Adopt the Law on Discrimina on, prohibi ng discrimina on against persons living with HIV and providing addi onal protec on mechanisms for women with HIV;

o Defi ne “medical secrecy” in the Armenian legisla on.

Mental health

o Ra fy the Second Op onal Protocol to the Interna onal Covenant on Civil and Poli cal Rights and the remaining op onal protocols on individual complaints procedures of the interna onal human rights trea es;

o Stop priori sing investments in large psychiatric hospitals and residen al ins tu ons for people with mental health condi ons and scale up investments in alterna ve mental health services and support models that respect the dignity and autonomy of users of services and empower them;

o Repeal laws and prohibit deten on, including involuntary hospitalisa on and forced ins tu onalisa on, and non-consensual psychiatric treatment on the grounds of impairment; introduce a provision for a periodic review of involuntary civil hospitalisa on at least once every six months.

o Revise the Civil and Civil Procedure Codes to abolish regula ons allowing depriva on of legal capacity and develop supported decision-making mechanisms in line with CRPD principles.

Children’s rights to health

o Following the Cons tu onal provision, adopt a law defi ning the list of free-of-charge medical services, list of their benefi ciaries, and provision procedures;

o Implement eff ec ve control and quality assurance mechanisms to improve the transparency of provided accessible, aff ordable, free-of-charge, and concessional medical care and services (including medica on provision) to children under the age of seven and children with disabili es under the age of eighteen;

o Abandon the legacy of outdated policies and services reliant on large psychiatric hospitals and long-term care ins tu ons and develop mechanisms for deins tu onalising children’s mental health services;

o Develop the fi eld of child psychiatry, organise the treatment and care of children with mental health issues in general hospitals, by developing the capacity of medical personnel.

ENVIRONMENT

o The Ministry of Health should carry out full-scale studies in the areas adjacent to metal mines to assess the impact of heavy metals on people’s health;

o The Ministry of Health should be involved in the exper se and licensing process along with other decision makers.

LABOR RIGHTS

o Establish an independent and eff ec ve Labour Inspec on in compliance with the standards of the ILO Conven on No. 81;

o Revise the Labour Code in line with the interna onal labour rights standards;o Eliminate the limita on that requires an employment contract with the same employer as a condi on for the

crea on of a trade union;o Expand the list of en es, having the right to organise a strike, the list should include the Strike Commi ee

elected directly at the Congress of Employees and trade unions opera ng in the sector.

Migrants’ rights

o Incorporate into the State Migra on Strategy 2017-2021 a chapter on immigra on management with par cular stress on labour migra on;

o Develop legal mechanisms regula ng labour migra on, work permit, and protec on of labour migrants’ human rights.

REFUGEE HOUSING

o Develop and implement mechanisms to provide long-term solu ons for the housing problems of refugees;

o Revise the refugee integra on policy of Armenia and the mechanisms for its implementa on;o Document cases of discrimina on against refugees and viola on of their rights in the spheres of labour

rights, healthcare and interac ons with law-enforcement bodies, and provide remedies; o Inves gate the cases of fraud, blackmail and coercion in housing provision and ensure compliance of

provided housing with interna onal standards.

ELDERLY SOCIAL PROTECTION

o Adopt Ar cle 23 of the Revised European Social Charter and undertake the commitments prescribed therein for safeguarding social protec on of the elderly;

o Ensure geographically propor onal distribu on and availability of social services for the elderly people;o Develop and implement mechanisms to ensure a longer working life for the elderly, including

mechanisms for lifelong learning.
