My job has its moments....The art of doing a fine job at anything is to make it look easy.....so everyone thinks they can do it! Well, now lets talk about one of my responsibilities that I can’t make look easy or feel good and I bet no one wants to do it! For over 2 years, that’s 24 months, our staff and leadership have done their best to get 1,350 members to follow the rules and do the right thing! Yes, that’s a lot of people and everyone has a mind of their own, feeling as though they are doing what is best for their clients and customers.....or are they? My job is to tell you, “Please, the rules must be followed”. I have asked the staff for a list of constant questions and complaints that filter into our offices on a daily basis (see be-low). Also, I am including the statuses and the interpretations of each below. Please print these out. Tape them to your computer and follow them! I am add-ing “please” and ending in “thank you”, and telling all of our members that this is how we make the system work. Changing the status as required will reduce your Broker’s liability, your liability, and the customers’ and clients’ frustration. It will also stop the second guessing and streamline all of our members’ business practices for a more cohesive way of doing business for over 8,000 MEMBERS who are paying to gain access to the database of CNYIS through our membership in the New York State Alliance of MLS’S! When a Broker subscribes to the Multiple Listing Service (CNYIS), they agree to follow the rules of the service. They also agree that their licensees will follow these same rules. No buyer or seller may require a broker or agent to break the rules. These are the rules! Does anyone have another way for us to convince our members to follow the rules of the service? The only thing I can think of is to reward the person turning in the complaint. If everyone could follow the rules, we won’t have to go that far!

David Hanlon, CRB, GRI, CRS, Associate- Broker has been a member of GSAR since 1980 and has previously served two terms as a director of the organization from 1985-1996. In 1995 David served the Association as President. David has received numerous sales awards and in 1997 received the GSAR REALTOR® of the Year Honor. Having served on many Association Committees during his career, David has most recently been a member of the Grievance Committee since 2010. His wide range of real-estate experiences has included: Company Management and Administration; Broker-Ownership; Residential and

Commercial Sales, New Construction, Land Development and Commercial Leasing. As a musician David has recorded on over 30 CDs, been inducted into the Syracuse Sammy Hall Of Fame and lead his own band, Dave Hanlon’s Cookbook, for the last 29 years. “I would be honored and excited to be able to contribute to our REALTOR® community by serving again on the GSAR Board of Directors”

Jennie Chapin is a life long resident of CNY and has been a Real Estate Professional since 1989, specializing in resi-dential real estate. She has been approved to teach Real Estate in New York State and has taught portions of the licensing course at the Professional Career Center. Jennie is currently serving on the Grievance Committee for GSAR, and is also the New York State President for Certified Residential Specialist who travels across the state meeting with CRS agents and providing Mastermind Top Producer Panelists Sessions, CRS Classes, Banking Updates. She regularly travels to the NAR and CRS meetings in the spring

and fall and serves on CRS National Education committee. Jennie has won numer-ous awards for Top Producer and has received the Gold and Silver and Platinum Award for sales production when they were given annually by the GSAR. “I am honored and thrilled to be nominated to be on the Board of Directors. If elected, my enthusiasm, strengths, efforts, motivation and my love of the business will help me guide the membership. I understand the importance of relationships and the ability to work as a team to accomplish what is best for our members.”

I, Bill Bigelow, am a life resident of Central New York. I hold an Associate Broker License having served on the Grievance Committee, and now Professional Standards and RPAC. I was a former broker/owner of a popular real estate franchise, successfully reestablishing the brand to our market. I have extensive knowledge and insight in busi-ness management; owning and operating local service companies for twenty years. I am a Navy veteran, graduate of Utica College, and a member of the Dewitt Community Church as a commissioned Stephen Minister. It would be great honor to serve and represent my fellow REALTORS®

on the Board. “Forward thinking is paramount to the success our profession in these tough economic times, and as a member of the Board, I will dedicate my time and effort to ensure our future.”

I am very pleased to have been nominated to run for a director position. I feel I am ready to undertake new chal-lenges, as my two children are now in college and the days of competitive high school sports are over. I graduated from Bishop Ludden High School and SUNY Geneseo, and have been a REALTOR® since 1987. In addition to being an agent for 24 years, I hold an Associate Broker’s License. I have an understanding of the “day to day” obstacles and issues we face as REALTORS®, and feel that I can bring a new voice to the organization. I am asking for your vote in this year’s election. It would be an honor to represent you.

Kathy Kennedy is a Licensed Associate Broker and has been a REALTOR® since 1985. Kathy has been on the Education Committee for the last 3 years serving as the Chair this year. She has been on the CNYIS Forms Committee for the last 6 years. Having also been the new agent company trainer for her company for the last 8 years, as well as a branch manager for 1 1/2 years, she has been able to keep up with the many changes in the real estate business. Kathy has been involved with many, many char-ity auctions volunteering with her husband Jim Kirby as his

assistant. “I am so excited to be nominated to be on the Board of Directors and if elected, I would be honored to serve this Association.”

Actively and successfully listing and selling homes in Central New York, Don Gendron has garnered a reputation as the First Class Agent. Earning his real estate license in 1986 and his broker’s license in 2005, Don has spent more than half of his life in the real estate profession. He has functioned as the marketing director for three real estate companies and in 2003 received a Statewide Manager of the Year award. Don holds the CBR & ABR Designations, is a New York State Certified Paralegal and also a Certified Sales Trainer with Buffini & Company. Outside of real estate, he has served on the Town of DeWitt Parks and Recreation Commission for

seven years, attends evening classes at Columbia College, volunteers for Golisano Upstate Children’s Hospital and enjoys traveling with his wife and two daughters. Don is running for the Director position because he believes he can positively contribute to the current management and functionality of our current board.

Pei Lin HuangThough a “transplant” to Syracuse, I received my degree from Syracuse University’s Newhouse School of Public Communications, and after several years working in New York City, moved back to Syracuse in 1986. It was a thrill to be back, and I certainly did not miss the 2-hour commute (each way) to work in NYC! I’ve been licensed and working as a REALTOR® since 1987. I surprise myself a bit, as I never envisioned myself in sales, despite the encouragement of my former Marketing Manager at ADT. I see myself more as a house therapist and matchmaker--and it’s wonderful to know I make a

difference in people’s housing lives. I’ve seen a lot of changes to the industry (I was first licensed pre-computers, pre-internet, pre-faxes, and pre-cell phones!) and enjoy keeping up with technology and better ways to service and help my clients. If it makes my life easier--or my clients--I’m there! My husband David has been teaching at the Newhouse School since 1979, and my son Kent has been a computer geek since the age of 3. He has never wavered from that track! I come from a sharing background, and look forward to contributing and sharing what I learn, as well as learning from my fellow REALTORS®. It would be an honor and privilege, if elected, to contribute and serve our Association.

Janet WenzelJanet Wenzel is a life long resident of Central New York and is a former teacher. She has been licensed and a member of GSAR since 1986, she holds on associate brokers license. She also holds the following designa-tions, CRS, GRI, CBR, CSP and CEA. Janet is currently serving on the Grievance committee, has served on the Education Committee and the RPAC committee, and has most recently been asked to chair the new Leadership Development Task Force. Janet has always been active in her community and believes in giving back. “It would

be an honor to serve on the GSAR Board of Directors.”

Professional Standards Case InterpretationsWe hope that you noticed in our last issue of the REALTOR® News that we starting running case interpretations as a way to keep these issues fresh in our minds. We are continuing with this issue, with an article that has been coming up with us locally as well.

These Interpretations of the Code of Ethics have been devel-oped by the Professional Standards Committee of the National Association of REALTORS® to help REALTORS® and REAL-TOR-ASSOCIATE®s understand the ethical obligations created by the Code of Ethics, and as a reference work for Grievance Committees, ethics and arbitration Hearing Panels, and Boards of Directors.

Interpretations of the Code of Ethics presents specific situations involving charges of alleged unethical conduct by REALTORS® and/or REALTOR-ASSOCIATE®s, which are reviewed by a peer panel of Board Members and in which decisions as to ethical conduct are reached. Each case provides the Hearing Panel’s decision based on the facts and the rationale for the decision, but does not specify a specific sanction or discipline to be imposed. There are two reasons for this. First, any sanction imposed must always fit the offense and must involve every consideration of justice, equity, and propriety. Second, a Hearing Panel may base its recommendation for discipline on a Member’s past record of ethics violations.

Case interpretation related to Article 1: Article 1: When representing a buyer, seller, landlord, tenant, or other client as an agent, Realtors® pledge themselves to protect and promote the interests of their client. This obligation to the cli-ent is primary, but it does not relieve Realtors® of their obligation to treat all parties honestly. When serving a buyer, seller, land-lord, tenant or other party in a non-agency capacity, Realtors®

remain obligated to treat all parties honestly. (Amended 1/01)

Case #1-25: Disclosure of Latent Defects(Adopted November, 2000.)Realtor® A had listed Seller S’s vintage home. Buyer B made a purchase offer that was contingent on a home inspection. The home inspection disclosed that the gas furnace was in need of replacement because unacceptable levels of carbon monoxide were being emitted.

Based on the home inspector’s report, Buyer B chose not to pro-ceed with the purchase.

Realtor® A told Seller S that the condition of the furnace and the risk that it posed to the home’s inhabitants would need to be dis-closed to other potential purchasers. Seller S disagreed and in-structed Realtor® A not to say anything about the furnace to other potential purchasers. Realtor® A replied that was an instruction he could not follow so Realtor® A and Seller S terminated the listing agreement.

Three months later, Realtor® A noticed that Seller S’s home was back on the market, this time listed with Realtor® Z. His curi-

osity piqued, Realtor® A phoned Realtor® Z and asked whether there was a new furnace in the home. “Why no,” said Realtor® Z. “Why do you ask?” Realtor® A told Realtor® Z about the home inspector’s earlier findings and suggested that Realtor® Z check with the seller to see if repairs had been made.

When Realtor® Z raised the question with Seller S, Seller S was irate. “That’s none of his business,” said Seller S who became even angrier when Realtor® Z advised him that potential pur-chasers would have to be told about the condition of the furnace since it posed a serious potential health risk.

Seller S filed an ethics complaint against Realtor® A alleging that the physical condition of his property was confidential; that Real-tor® A had an ongoing duty to respect confidential information gained in the course of their relationship; and that Realtor® A had breached Seller S’s confidence by sharing information about the furnace with Realtor® Z.

The Hearing Panel disagreed with Seller S’s contentions. It not-ed that while Realtors® do, in fact, have an obligation to preserve confidential information gained in the course of any relationship with the client, Standard of Practice 1-9 specifically provides that latent material defects are not considered “confidential informa-tion” under the Code of Ethics. Consequently, Realtor® A’s dis-closure did not violate Article 1 of the Code of Ethics.

GSAR Professional Standards Activity

As you know, one of GSAR’s responsibilities is to provide pro-fessional standards services to our members and consumers. This includes ethics hearings, arbitrations, and mediations. The following report is GSAR’s Ethics activity for the period Jan. 1-June 30, 2011.

Between January 1 and June 30, 2011 GSAR received nine for-mal ethics complaints. The Grievance Committee referred eight of those complaints to a Professional Standards Hearing Panel. Articles of the Code of Ethics alleged to have been violated were Articles 1, 3, 9, 15 and 16. Articles 15 and 16 were the most frequently cited.

Attention Brokers and Managers:We have scheduled the next Broker/Manager meeting for Sep-tember 27th at 2pm.

We will be discussing many important topics including lock-box procedures, ListHub, NYSAR Radio for legal advice, and a special presentation on “Lending Products and Mortgage In-surance: Their Affect on Real Estate Sales” by Craig Lonsinger from Mortgage Guaranty Insurance Corporation, and Greg May from Tompkins Trust Company.

Personal AssistantsFrequently Asked Question:What may a personal assistant legally do?

A personal assistant is unlicensed, therefore, they cannot per-form any function set forth in New York State Real Property Law, Article 12A, §440. As a general rule, any office function that is not set forth in §440 can be performed by a personal assistant.

Some of these general office activities that may be performed by an employee, secretary or a personal assistant who does not hold a real estate license are:

• Answer the phone, forward calls, and take messages.• Arrange appointments by telephone for the licensee.• Follow up on loan commitments after a contract has been negotiated & generally secure status reports on the loan progress.• Assemble documents for closing.• Write ads for approval of broker & place approved classified advertising.• Type contract forms for approval of broker.• Submit approved listings and changes to MLS.• Compute commission checks.• Place or remove signs from property.• Order items of repair as directed by the broker.• Secure public documents from county clerks, courts, water and/or sewer departments or any document from another public repository.• Prepare flyers and promotional information for approval by broker.• Schedule appointments for licensees to show listed property.• Gather information for a comparative market analysis.• Gather information for an appraisal.• Monitor licenses and personnel files.• Perform secretarial & clerical duties such as typing of letters & filing.

What are personal assistants NOT allowed to do?

The items listed below are those considered to be a licensed activity pursuant to Section 440 of Article 12A of the New York State Real Property Law:

• Host open houses.• Show property.• Explain or interpret information on listings, contracts or other information relating to a transaction.• Negotiate or agree to a commission/commission split with any individual.• Making phone calls, telemarketing or performing other activities to solicit business on behalf of the broker.• Any other activity not set forth above for which a license is required.

Both of these are local charities that can really use these types of donations! They must be unused bottles/bars of soap, shampoo, lotion, shower gel, toothpaste, etc.

REALTOR® Party Political Survival Initiative

As most of you know, the National Assocaition of REALTORS® has approved the REALTOR® Party Political Survival Initiative, that goes into effect in 2012. This means a $40 dues increase for all NAR members. We are providing the following Frequently Asked Questions Update for you, to help you understand the Ini-tiative. What does the Supreme Court Ruling – Citizens United vs. Federal Election Commission -- mean for NAR?The ruling eliminates the requirement that hard dollars (or per-sonal voluntary contributions) be used to pay for campaigns designed to influence the outcome of an election. Soft dollars, which in our case are dues dollars, can now be used when com-municating with the public to influence voter opinions. While the ruling addresses candidate campaigns, it also makes it much more expensive to communicate with our members and with vot-ers on important real estate issues.

Why do we need to do this now?There are a number of forces at work right now to cut away at private property rights, home ownership and affordable lending. We are approaching a “perfect storm.” The mortgage interest de-duction is being threatened; affordable insurance is tougher to get; getting a loan, even for well-qualified buyers, has become especially challenging; communities are increasingly being bur-dened with higher property taxes and transfer fees; and dedi-cated housing resources at the state and local levels are being diverted to offset budget shortfalls. It’s time to meet these chal-lenges. While the cost of the initiative is high, the cost of NOT doing it is higher.

Can’t NAR just tighten its belt and fund RPPSI by cutting spending in other areas?NAR has indeed taken a number of cost-cutting measures. In ad-dition to eliminating 33 staff positions, reducing staff benefits and freezing salaries, every operating area of the organization has instituted austerity measures designed to trim up to 20 percent off their expenditures. This is resulting in an overall savings of $12 to $15 million per year for the next three years.

Doesn’t a dues increase dedicated to this initiative make us just like unions that require members to support specific po-litical candidates?Only 27 percent of the RPPSI funds have anything to do with candidate funding activities. The other 73 percent is dedicated to services and funding needs for voter records database use, partnering on state/local issue advocacy efforts and grassroots outreach. If approved, the RPPSI funds will help our REALTOR® Family address the monumental public policy issues we face to-day – issues like the future of mortgage finance, facilitating short-sales and access to affordable insurance. Our livelihoods depend on the outcome of these issues and they transcend political party

lines. While unions contribute the vast majority of their political advocacy funds to just one party, RPAC is bi-partisan, splitting contributions nearly 50/50 between Democrats and Republi-cans. Just like RPAC, RPPSI will support REALTOR®-friendly candidates and issues. As a REALTOR®, your input into those decisions is welcome at all levels of the REALTOR® family.

What funds and services will be available for state and lo-cal associations to advance their issue and candidate advo-cacy efforts?Two-thirds of the $194 million five-year initiative ($119 million) is tied to programs and services that state and local associa-tions can access to augment their issues advocacy campaigns and/or independent expenditure campaigns. Only the state/local independent campaign funding is allocated for distribution on a per-member basis. However, in order to receive funds, the state and/or local association must first elect to engage in a pro-RE-ALTOR® Party candidate’s race. In addition to this much-talked-about assistance for independent expenditure campaigns, other services and funding are available for state and local associa-tions, as well. Approximately $82 million will be available in direct funding of issues mobilization requests, coordinated issue cam-paigns, independent expenditure campaigns and direct RPAC fundraising grants. Another $37 million will be in the form of ser-vices such as the Campaign Services program with voter records database and consulting support, the RPAC PAC management software, administration of the broker involvement program, and the online advocacy member communications software.

Homeownership Tax Benefits Must bePreserved, Say REALTORS®

Any changes to the mortgage interest deduction now or in the future could threaten recent progress toward stabilizing the housing market, critically erode home prices and values, destroy middle-class wealth accumulation and hurt economic growth.

That was the message delivered by National Association of Re-altors® NAR Chief Economist Lawrence Yun during the recent Rethinking the Mortgage Interest Deduction forum, where he joined a panel of experts to debate the future of the MID. The event was hosted by the Tax Policy Center, a joint venture of the Urban Institute and Brookings Institute, and the Reason Founda-tion.

“As the leading advocate for housing and homeownership, NAR firmly believes that the mortgage interest deduction is vital to the stability of the American housing market and economy,” said Yun. “The MID facilitates home ownership by reducing the car-rying costs of owning a home, and it makes a real difference to hard-working middle-class families.”

Yun argued that now is the worst possible time to discuss chang-ing the tax laws, which could further impair the housing market’s fragile recovery and a broader job market recovery.

“One thing that is indisputable is that eliminating the MID will lower the homeownership rate in the U.S.,” he said. “While we must ensure that the conditions that led to the artificially inflated home ownership rate of the bubble years do not resurface, we also need to create the conditions for sustainable home owner-ship, which has been shown to provide myriad social benefits for families and communities.”

During the debate, Yun challenged recent proposals calling for changes to the tax code, stating that it’s a misplaced argument to say the MID was a cause of the housing market bubble and is suddenly part of the deficit problem, when it’s been part of the federal tax code for more than 100 years.

Reducing or eliminating the MID is a de facto tax increase on homeowners, who already pay 80 to 90 percent of U.S. federal income tax. Yun said the share could rise to 95 percent if the MID is eliminated.

Yun also asserted that it’s a misconception that only the wealthy benefit from the MID, when in reality it benefits primarily middle- and lower income families. Almost two-thirds of those who claim the MID are middle-income earners and 91 percent of people who claim the MID earn less than $200,000 per year.

Other panelists at the Rethinking the Mortgage Interest Deduc-tion forum were Seth Hanton, director of fiscal policy, Center for American Progress; Dean Stansel, adjunct fellow, Reason Foundation; and Eric Toder, institute fellow, Urban Institute, and co-director of the Tax Policy Center. The event was moderated by Edmund Andrews, managing editor for economics, taxes and budget at the National Journal.

Foreclosure activity decreases in all New York State metro areas ; Syracuse 209 out of 211!In its mid-year 2011 metropolitan foreclosure market report, Re-altyTrac, Inc. reported that all eight of New York’s metropolitan areas with populations of 200,000 or more posted decreased foreclosure filings from the previous six months as well as the first six months of 2010. Additionally, the Utica-Rome, NY metro-politan area, with one in every 9,757 homes receiving a foreclo-sure in the first half of 2011, had the lowest foreclosure activity of all U.S. metropolitan areas. Of these 211 metropolitan areas in the country, Utica-Rome came in at number 211.

The rest of New York State’s metropolitan areas weren’t far be-hind. Syracuse was number 209, Rochester was number 207, Buffalo-Niagara Falls was number 206, Albany-Schenectady-Troy was number 203, and Binghamton was number 200. The New York City region, including Northern New Jersey and Long Island; and the Poughkeepsie-Newburgh-Middletown areas had a slightly higher foreclosure rates, although still raking modestly among the rest of the nation at numbers 181 and 163 respec-tively.
