Preamble Whereas the Parliament of Canada recog-nizes the objective of protecting the health andsafety of the public;
Whereas the Parliament of Canada recog-nizes that human pathogens and toxins posevarying levels of risk to the health and safety ofthe public;
Whereas the Parliament of Canada recog-nizes that a lack of full scientific certainty re-garding the risks posed by certain humanpathogens and toxins is not to be used as a rea-son to postpone measures that protect the healthand safety of the public;
And whereas the Parliament of Canada rec-ognizes that human pathogens and toxinsevolve and can be altered and that new humanpathogens and toxins appear continually, there-fore creating unique challenges in meeting theobjective of protecting the health and safety ofthe public;

Now, therefore, Her Majesty, by and with theadvice and consent of the Senate and House ofCommons of Canada, enacts as follows:

Definitions 3. (1) The following definitions apply inthis Act.
“controlledactivity”« activitéréglementée »
“controlled activity” means an activity referredto in subsection 7(1).
“conveyance”« véhicule »
“conveyance” means a vessel, aircraft, train,motor vehicle, trailer or other means of trans-portation, including a cargo container.
“disease”« maladie »
“disease” includes intoxication.
“humanpathogen”« agentpathogènehumain »
“human pathogen” means a micro-organism,nucleic acid or protein that
(a) is listed in any of Schedules 2 to 4 or inPart 2 of Schedule 5; or
(b) is not listed in any of the Schedules butfalls into Risk Group 2, Risk Group 3 orRisk Group 4.
“licence”« permis »
“licence” means a licence issued under section18.
“Minister”« ministre »
“Minister” means the Minister of Health.
“person”« personne »
“person” means an individual or an organiza-tion as defined in section 2 of the CriminalCode.
“personalinformation”« renseigne-mentspersonnels »
“personal information” has the same meaningas in section 3 of the Privacy Act.
“possession”« possession »
“possession” has the same meaning as in sub-section 4(3) of the Criminal Code.
“produce”« production »
“produce”, in respect of a human pathogen ortoxin, means to create it by any method or pro-cess, including
(a) by manufacturing, cultivating, develop-ing, reproducing or synthesizing it; or
(b) by converting or refining a substance,micro-organism, nucleic acid or protein, orby using any other means of altering itsphysical or chemical properties.
“release”« rejet »
“release” means any discharge, anywhere, andincludes leaking, spraying, depositing, dumpingor vaporizing.

“Risk Group 2”« groupe derisque 2 »
“Risk Group 2” means a category of humanpathogens that pose a moderate risk to thehealth of individuals and a low risk to publichealth and includes the human pathogens listedin Schedule 2. They are able to cause seriousdisease in a human but are unlikely to do so.Effective treatment and preventive measuresare available and the risk of spread of diseasecaused by those pathogens is low.
“Risk Group 3”« groupe derisque 3 »
“Risk Group 3” means a category of humanpathogens that pose a high risk to the health ofindividuals and a low risk to public health andincludes the human pathogens listed in Sched-ule 3. They are likely to cause serious diseasein a human. Effective treatment and preventivemeasures are usually available and the risk ofspread of disease caused by those pathogens islow.
“Risk Group 4”« groupe derisque 4 »
“Risk Group 4” means a category of humanpathogens that pose a high risk to the health ofindividuals and a high risk to public health andincludes the human pathogens listed in Sched-ule 4. (a) a substance that contains a humanpathogen or toxin; and
(b) any synthetic form of the humanpathogen or toxin.

(ii) has been expelled by a human suffer-ing from a disease caused by that humanpathogen or toxin, or
(iii) is in or on a cadaver, a body part orother human remains;
(b) a drug in dosage form whose sale is per-mitted or otherwise authorized under theFood and Drugs Act or a human pathogen ortoxin contained in such a drug; or
(c) any activity that is a controlled activitywithin the meaning of the Assisted HumanReproduction Act.

6. Every person who knowingly conductsany activity referred to in section 7 involving ahuman pathogen or toxin shall take all reason-able precautions to protect the health and safetyof the public against the risks posed by that ac-tivity.

7. (1) No person shall knowingly conductany of the following activities unless a licencehas been issued by the Minister that authorizesthe activity:
(a) possessing, handling or using a humanpathogen or toxin;
(b) producing a human pathogen or toxin;
(c) storing a human pathogen or toxin;
(d) permitting any person access to a humanpathogen or toxin;
(e) transferring a human pathogen or toxin;
(f) importing or exporting a human pathogenor toxin;
(g) releasing or otherwise abandoning a hu-man pathogen or toxin; or

Other Acts (2) Subsection (1) does not apply to
(a) any activity to which the Transportationof Dangerous Goods Act, 1992 applies; or
(b) the export of human pathogens or toxinsauthorized under the Export and Import Per-mits Act.

9. (1) If the Minister is of the opinion that asubstance is produced by, or derived from, amicro-organism and is able to cause disease ina human, the Minister may, by regulation, addit to Schedule 1.

(1) The Minister may, without the con-sent of the person to whom the information re-lates, disclose personal information and confi-dential business information obtained underthis Act to a person from whom the Ministerseeks advice, to a department or agency of thegovernment of Canada or a province, to a for-eign government or to an international organi-zation if
(a) the disclosure is necessary for the ad-ministration or enforcement of this Act or theregulations;
(b) the Minister has reasonable grounds tobelieve that the disclosure is necessary to ad-dress a serious and imminent danger to thehealth or safety of the public; or
(c) the disclosure is necessary to enableCanada to fulfil its international obligations.

(c) respecting facilities in which controlledactivities are authorized, including
(i) the location, design, construction, lay-out and upgrading of those facilities,
(ii) the material and equipment at thosefacilities,
(iii) heating, ventilation, air conditioningand air handling systems, and
(iv) biological safety cabinets;
(d) respecting access to facilities in whichcontrolled activities are authorized, including
(i) the conditions to be met by persons toobtain access to those facilities, and
(ii) the screening of persons accessingthose facilities;

(c) designate an individual with the ap-propriate safety training in the area of hu-man pathogens and toxins or relevantwork experience as the contact person forthe Minister and advise the Minister ofthat individual’s name.
70. 71. (1) Every person who, on the day onwhich section 8 comes into force, possesses ahuman pathogen or toxin listed in Schedule5 shall
(a) inform the Minister of the humanpathogen or toxin in their possession with-in 30 days after the day on which that sec-tion comes into force;
(b) provide the Minister with any infor-mation that the Minister may require withrespect to it; and
(c) dispose of it in accordance with theMinister’s instructions.
