Enclosed is copy of a Complaint concerning you which has been received by me as Secretary-Treasurer of the Texas State Board of Dental Examiners. I have caused this Complaint to be Docketed in the name of the Texas State Board of Dental Examiners vs. yourself and have caused copies to be made and mailed to you by Registered Mail and to the members of the Board.

The Board will meet in San Antonio, Texas on Thursday, Friday and Saturday, April 29, 30 and May 1, 1982 when all complaints to be heard and considered by the Board will be called and heard. This case has been scheduled for Thursday, April 29, 1982 at 9:00 a.m. in the Board Hearing Room at the San Antonio Convention Center, San Antonio, Texas, and could possibly be heard on Friday and Saturday, April 30 and May 1, 1982, if all cases are not finished on Thursday, April 29, 1982.

This is to further advise you that you may appear and offer such evidence as is pertinent to your defense to said Complaint. You may be represented by counsel if you so desire.

Civil Statutes, as amended, and by Rules of Procedure Governing Grievances, Hearings and Appeals duly adopted by said Board, said Laws and Rules are enclosed herewith. Rules 382.13.02.008 (b) and .020 (a) also provide that the Board may revoke, cancel or suspend said Doctor's dental license to practice dentistry in Texas, or it may find said licensee not guilty as charged on any or all of said allegations or counts. Any final decision or order will be by majority of said Board (Rule 382.13.02.043 and .044). Your attention is specifically called to Rule 382.13.02.026 (a) which specifically delegates the authority to the "Board" to conduct hearings and to'Rule 382.13.008 (a), (b), etc.

BEFORE ME, the undersigned authority, on this day personally appeared EDGAR F. BLOOD, hereinafter called AFFIANT, wh 0, aft e r having been duly sworn by me on his OATH, did depose and say:

I, EDGAR F. BLOOD, of Houston, Harris County, an employee of the Texas State Board of Dental Examiners, did in the course of such emp loyment, make certain investigations into the professional conduct and acts of one JOHN M. PEACOCK, D.D.S., of Galveston, Galveston County, Texas, a practicing dentist in the State of Texas and the holder of Texas Dental Lic'ense No. 9105, previously issued by the Texas State Board of Dental Examiners, duly authorized to grant and issue such license.

As an employee of the Texas State Board of Dental Examiners, I, EDGAR F. BLOOD, do hereby present to the said Secretary-Treasurer of the Texas State Board of Dental Examiners the following Complaint against the said JOHN M. PEACOCK, D.D.S., hereinafter called RESPONDENT.

I.

On or about July ,18, 1981, JOHN M. PEACOCK, D.D.S., licensed to practice dentistry in Texas and having been issued Texas Den ta 1 Lic ens e No. 9105, and hereinafter called RESPONDENT, had as his dental patient S M. A , hereinafter called PATIENT. RESPONDENT, practicing under the trade name Kashmere Dental Clinic, did then and there in his dental office in Houston, Harris County, Texas, undertake to treat PATIENT'S dental needs, said treatment consisting of the extraction of PATIENT'S mandi bular left first and second molars. During a portion of the extraction procedure, RESPONDENT was assisted by P M who attempted to work on one of PATIENT'S teeth and accidentally knocked off a crown. P M was not and is not a licensed dentist in the State of Texas.

PATIENT continued to have pa in fo 11 owing treatment by RESPONDENT and sought other professional dental care ,and was advised that there was a bur cut into the distal root of the left mandibular second bicusp id. Clinic a 1 and X-Ray examina t ion revealed a large sequestrum of bone on the buccal and lingual

aspect of the mandible. Treatment consisted of medication for pain, removal of the sequestra, and removal of the left mandibular second bicuspid.

II.

It is the opinion of AFFIANT, EDGAR F. BLOOD, that the said RESPONDENT, JOHN M. PEACOCK, D.D.S., because of the c onduc t and acts a's set out in Paragraph 1. hereinbefore, is GUILTY of violating the following Laws relating to dentistry:

(1) V.A.T.S. Article 4549, Section 2

(g) that a dentist employs' or permits or has employed or permitted persons to practice dentistry in the office or offices under his control or management, who were not licensed to practice dentistry.

(1) that the holder thereof (of a dental license) has been negligent in the performance of dental services which injured or damaged dental patients.

III.

Article 4549, V.A.T.S., provides as follows:

Section 2. The Texas State Board of Dental Examiners and the District Courts 0 f th is S ta t e sha 11 have concurrent jurisdiction and authority, after notice and hearing as hereinafter provided, to suspend or revoke a dental license or a dental hygienist license,~ to place on probation a person whose l:i,cense or certificate is suspended, or tQ reprimand a licensee or certificate holder for anyone or more of the following causes:

(g) that a dentist employs or permits or has employed or permitted persons to practice dentistry in the office or offices under his control or manage-ment, who were not licensed to practice dentistry.

(i) that the holder thereof has failed or refused to comply with any State law relating to the regulation of dentists or dental hygienists.

The Texas State Board of Dental Examiners finds that' JOHN M. PEACX>CK, D.D.S. has been guilty of the'violations set forth in theDJcketed Com-plaint, to-wit:

1. Dr. John M. Peacock has been guilty of negligence in the performance of dental services which injured and damaged his dental patient in violation of Article 4549, Section 2 (1), Texas Revised Civil Statutes.

IV. BE IT KNOWN that on the' 23rd day of September', 1982·, a quorum of

the Texas State Board of Dental Examiners, have voted, by'majority vote, to SUSPEND for a period of TWO (2) YEARS, .effective September 23, 1982, License No. 9105, heretofore issued to Dr. John'M. Peacock of Galveston, Texas; however, such SUSPENSION is PROBATED for all but THIRTY (30) DAYS thereof (January I,. through '30, '1983), subject to the' following, to-wit:

1. Dr. John M. Peacock. shall conducthiinself inconformity with . this Order, shall conform to all laws and rules and regulations govern-ing the practice of dentistry in this State; and, that the said Dr. John M. Peacock shall not practice dentistry or aid or abet another so to do in the State of Texas during such 30. day period of suspension, which is conditioned' as follows:

(a) Office to'be closed except for administrative purposes (niaking future appointments when suspension is over, opening mail, referring patients, accepting payments on' accounts and general office chores); . .

(b) No dental,hygienist shall be on the premises nor shall he lease his office space nor make any monet~ gain for the period of time that the'office is closed;

. (c) If there is an associate arrangement, the' associate can continue to. work on his own patients of recbrd, but the' . provisions listed above still apply.

IT IS ACCORDINGLY ORDERED that License No. 9105, heretofore issued to Dr. John M. Peacock,' be SUSPENDED for TWO (2) 'YEARS, 'effective September 23, 1982; however, such SUSPENSION is PROBATED for all but the first THIRTY (30) DAYS thereof (January 1 through 30, 1983), subject to the foregoing conditions.

1. On or about January 24, 2003, the Respondent failed to meet the minimum standard of care in failing to adequately document the diagnosis that indicated the necessity of bone graft· treatment for patient T.Z.

2. On or about January 24,.2003, the Respondent fell below the. minimum standard, of care by failing to make, maintain, and keep adequate dental records on patient T.Z. Specifically, the record does not include: a notation of initial blood pressure and pulse, or a statement explaining why these vItal signs were not obtained; written informed consent signed by the patient covering all treatment provided;-documentation of how the patient's mitral valve prolapse was, to be addressed; or documentation of the type or source of material for the bone graft treatment performed.
