LE LIBELLÉ (Adapté pour la Colombie-Britannique)

• 23. (1) Les citoyens canadiens :

a)dont la première langue apprise et encore comprise est le français,

b)qui ont reçu leur instruction, au niveau primaire, en français au Canada,

ont, dans l’un ou l’autre cas, le droit de faire instruire leurs enfants, aux niveaux primaire et secondaire, en français.

(2) Les citoyens canadiens dont un enfant a reçu ou reçoit son instruction, au niveau primaire ou secondaire, en français au Canada ont le droit de faire instruire tous leurs enfants, aux niveau primaire et secondaire, en français.

(3) Le droit reconnu aux citoyens canadiens par les paragraphes (1) et (2) de faire instruire leurs enfants, aux niveaux primaire et secondaire, en français :

a)s’exerce partout dans la province où le nombre des enfants des citoyens qui ont ce droit est suffisant pour justifier à leur endroit la prestation, sur les fonds publics, de l’instruction en français;

b)comprend, lorsque le nombre de ces enfants le justifie, le droit de les faire instruire dans des établissements d’enseignement de la minorité francophone financés sur les fonds publics.

En Colombie-Britannique, les immigrants peuvent se qualifier sous l’article 23

(Là où le nombre le justifie…en Colombie-Britannique)

• ont le droit de faire instruire leurs enfants en français dans des établissements où ils et elles s’épanouissent dans la langue et la culture francophone,

• qui offrent des services de qualité égale à celle offerte à la majorité,

• qui sont gérés par leurs représentants qui ont le contrôle exclusif sur les dépenses; la nomination et la direction des personnes chargés de

l’administration de l’instruction et des établissements; l’établissement de programmes scolaires; le recrutement et l’affectation du personnel, notamment

les professeurs et la conclusion d’accords pour l’enseignement et les

services dispensés aux élèves de la minorité.

• « …it is important to note that the commitment of Canadians to bilingualism and biculturalism gives this country a distinct place in the world’s family of nations. The development of any nation is in the historical, social, cultural and political context of its people. From its genesis, Canada brings to the world a unique history and culture of cooperation and tolerance. It is rooted in the commitment of French and English people, who had earlier been separated by geography, a history of divisive disputes, language and culture, to live together, to work together and to share the resources of a new nation. Section 23 restates a fundamental part of that commitment relating to language and culture and acknowledges the vision and faith of our nation’s pioneers. Our distinct place in the world’s family of nations is dependant on governments honouring the commitment entered into more than two centuries through the enanctment of particular provisions of the Canadian Charter of Rights and Freedoms. »

« The remedial aspect of the section (23) acknowledges the need in

some situations, for differential treatment.

Equality in this context does not mean or imply special treatment.

Special treatment is, as the word implies, treatment that is special and of

a particular king and may result from and for a variety of reasons or

circumstances. While special treatment may affect outcome, it is not

delivered with that in mind. Equality of outcome envisioned by s. 23,

may require differential treatment but it is not special treatment when

viewed in the context of outcome. Differential treatment is directly

related to the circumstances intended to be addressed. It is remedial in

nature, related to outcome, which in the circumstances of this case is a

quality of education that is equal to that of the majority. »
