April 14, 2011 *S594-v-1* A BILL TO BE ENTITLED 1 AN ACT TO ALLOW THE TRANSPORTATION AND POSSESSION OF A DANGEROUS 2 WEAPON OR SUBSTANCE DURING A RIOT OR DECLARED STATE OF 3 EMERGENCY AND TO PROHIBIT THE ENACTMENT OR ADOPTION OF ANY 4 DIRECTIVE, PROCLAMATION, OR LOCAL ORDINANCE THAT WOULD ALLOW 5 OR IMPOSE ANY OF THE FOLLOWING DURING A STATE OF EMERGENCY: (I) 6 THE TAKING, CONFISCATION, OR SEIZURE OF LAWFULLY POSSESSED 7 FIREARMS AND AMMUNITION OR (II) ADDITIONAL RESTRICTIONS OR 8 PROHIBITIONS ON THE POSSESSION, CARRYING, TRANSPORTATION, SALE, 9 PURCHASE, STORAGE, OR USE OF OTHERWISE LAWFULLY POSSESSED 10 FIREARMS OR AMMUNITION. 11 The General Assembly of North Carolina enacts: 12 SECTION 1. Article 36A of Chapter 14 of the General Statutes is amended by 13 adding a new section to read: 14 "§ 14-288.1A. Limitation. 15 Nothing in this Article shall be construed to authorize or allow ordinances, proclamations, 16 directives, or other enactments that would allow or impose any of the following during a 17 declared or undeclared state of emergency: (i) the taking, confiscation, or seizure of otherwise 18 lawfully possessed firearms, ammunition, or components thereof or (ii) additional restrictions 19 or prohibitions upon the possession, carrying, transportation, sale, purchase, storage, or use of 20 otherwise lawfully possessed firearms, ammunition, or ammunition components." 21 SECTION 2. G.S. 14-288.7(b) reads as rewritten: 22 "(b) This section does not apply to persons exempted from the provisions of G.S. 14-269 23 with respect to any activities lawfully engaged in while carrying out their duties.duties or to 24 persons otherwise lawfully in possession of firearms, ammunition, or components thereof." 25 SECTION 3. G.S. 14-288.12(b) reads as rewritten: 26 "(b) The ordinances authorized by this section may permit prohibitions and restrictions: 27 (1) Of movements of people in public places, including directing and 28 compelling the evacuation of all or part of the population from any stricken 29 or threatened area within the governing body's jurisdiction, to prescribe 30 routes, modes of transportation, and destinations in connection with 31 evacuation; and to control ingress and egress of a disaster area, and the 32 movement of persons within the area; 33 (2) Of the operation of offices, business establishments, and other places to or 34 from which people may travel or at which they may congregate; 35 (3) Upon the possession, transportation, sale, purchase, and consumption of 36 alcoholic beverages; 37

The General Assembly of North Carolina enacts:12

SECTION 1. Article 36A of Chapter 14 of the General Statutes is amended by13adding a new section to read:14

"§ 14-288.1A. Limitation.15

SECTION 2. G.S. 14-288.7(b) reads as rewritten:22"(b) This section does not apply to persons exempted from the provisions of G.S. 14-26923

with respect to any activities lawfully engaged in while carrying out their duties.duties or to24

persons otherwise lawfully in possession of firearms, ammunition, or components thereof."25

SECTION 3. G.S. 14-288.12(b) reads as rewritten:26

(4) Upon Subject to G.S. 14-288.1A, upon the possession, transportation, sale,1

purchase, storage, and use of dangerous weapons and substances, and2

gasoline; and3(5) Upon other activities or conditions the control of which may be reasonably4

necessary to maintain order and protect lives or property during the state of 5

emergency.6

The ordinances may delegate to the mayor of the municipality the authority to determine and7

proclaim the existence of a state of emergency, and to impose those authorized prohibitions and8 restrictions appropriate at a particular time."9

SECTION 4. This act becomes effective December 1, 2011.10
