AN ORDINANCE CREATING A LEGISLATIVE BACKSTOPPING COMMITTEE (LBC) OF THE

SANGGUNIANG BAYAN OF BOLINEY, ABRA, PROVIDING FOR ITS COMPOSITION AND

FUNCTIONS AND APPROPRIATING FUNDS THEREOF

WHEREAS, the Sangguniang Bayan of Boliney, Abra, as a legislative body, has the

power to perform oversight functions to ensure that approved ordinances and

resolutions are implemented or enforced;

WHEREAS, the conduct of oversight activities would determine whether existing

legislative measures are administered efficiently in a manner consistent with legislative

intent and whether said measures need amendments or improvements;

WHEREAS, in order to carry out this function, there is a need to create a legislative

backstopping committee that would assist the Sangguniang Bayan in the performanceof this duty;

NOW THEREFORE, on motion of Hon. Beny S. Luis, with the unanimous accord of

the members of the Sangguniang Bayan present;

BE IT ENACTED, by the Sangguniang Bayan in session assembled, that:

ARTICLE I

Title

SECTION 1. The committee shall be known as Legislative Backstopping Committee(LBC) under the Office of the Municipal Vice Mayor.

ARTICLE II

Composition

SECTION 1. The Legislative Backstopping Committee shall be composed of the

following:

Chairman : Municipal Vice Mayor

Vice Chairman : Chairman - Committee on Rules, Laws and

Privileges

Members : Secretary to the Sanggunian

Member/s of the Committee on Rules, Laws andPrivileges

ARTICLE III

Functions

SECTION 1. Establish a management information system for legislative action or

decision.

SECTION 2. Provide assistance in the preparation of the local legislative agenda.

SECTION 3. Conduct researches in aid of local legislation.

SECTION 4. Act as liason between local government executive departments and the

Sanggunian.

SECTION 5. Take charge of the tracking and analysis of enacted ordinances and

resolutions to:

a. Find out whether an approved ordinance or resolution is actuallyimplemented or enforced by the department or office responsible for the

implementation or enforcement of the same;

b. Determine whether the target sector of the population is aware of andfamiliar with the said ordinance or resolution;

c. Evaluate the effectiveness of an implemented or enforced ordinance orresolution; and,

d. Make reports to the Sanggunian of both negative and positive feedbacks ona certain legislative measure.

SECTION 6. Provide assistance in the review of ordinances and resolutions of

Sangguniang Barangays.

SECTION 7. Perform other legislative-related functions as may be assigned by the

sanggunian.

ARTICLE IV

Funding

SECTION 1. Funds shall be allocated annually by the municipality to defray the

operating expenses of the committee.

ARTICLE V

Repealing Clause

SECTION 1. Any ordinance, rules and regulations or parts thereof which are

inconsistent or in conflict with any of the provisions of this ordinance are hereby repealedor modified accordingly.

ARTICLE VI

Separability Clause

SECTION 1. If for any reason, any provision, section or any part of this ordinance is

declared invalid by any court of competent jurisdiction or suspended or revoked by the

Sangguniang Bayan, such judgment shall not affect or impair the remaining provisions,

sections or parts hereof which shall remain and continue to be in full force and effect.

ARTICLE VIIEffectivity Clause

SECTION 1. This Ordinance shall take effect immediately upon its approval.
