Isang mapagpala atmakakalikasang umaga po sa inyonglahat. (A blessed and environmentalmorning to all.)

Sa mga kasamahan natin sa usaping “Recognizing Indigenous andTraditional Management of Biodiversity,” lalung-lalo na sa mga kasama kosa presidential table, sa mga kasamahan kong commissioners at regionaldirectors na narito ngayon, at sa lahat ng mga NCIP personnel, lalung-lalona sa mga may malaking taya sa usaping ito— ang tinutukoy ko po ay angating mga kapatid mula sa indigenous cultural communities o indigenouspeoples na kinakatawan ng kani-kanilang mga lider na kasama natinngayon,ako po ay nagpupugay sa inyong lahat. (To our partners [in thisConference] Recognizing Indigenous and Traditional Management ofBiodiversity, especially to those seated with me in the presidential table, tomy co-commissioners and to the regional directors who are with with ustoday, and to all the NCIP personnel, especially those who have a lot atstake in these discussions—I am referring to our brothers and sisters fromthe indigenous culutral communities or indigenous peoples who are

represented by their respective leaders present with us today,I salute all ofyou.)

It is an honor to welcome you all to our Second National Conferenceon Indigenous Peoples and Local Communities Conserved Areas andTerritories or ICCA na may temang (with the theme) “Pagpapahusay saTradisyunal na Pamamahala ng Lupaing Ninuno at Pangangalaga ngLaksambuhay.”

At the close of the 20th century, biodiversity has become the call ofthe time, urging countries all over the world to sit down together and drawthe line of cooperation. Thus, the Convention on Biological Diversity (CBD)was adopted in 1992, was operationalized in 1993 by the UN system andwas ratified by the Philippine government on 8 October 1993. However,while talks and negotiations in the implementation of the CBD are ongoingat the regional and international levels, biodiversity initiatives in thePhilippines have already been gaining ground. We are not behind in termsof domestic instruments in addressing biodiversity. The IPRA -(IndigenousPeoples’ Rights Act-) alone provides specific provisions on protecting andpromoting biodiversity. More so, our IPs -indigenous peoples-) since timeimmemorial have been in the forefront in sustaining biodiversity within theirancestral domains. Kaya nga po alam natin na ang IPRA ay hindi langtungkol sa mga karapatan ng mga katutubong pamayanan kundi ang IPRAay isinasaad din ang mga obligasyon ng mga katutubo sa usapingkalikasan. (This is how we know that the IPRA is not only about indigenouspeoples’ rights. It also enumerates the IPs’ obligations with regard to theenvironment.) Ito po yung (These are): 1) to restore denuded areas; 2) toensure ecological balance; and 3) to observe laws na hindi lang IPRA-—madami din tayong mga batas. (not just the IPRA—we also have severalother laws [regarding the environment and the rights of the IPs]-.

Right now, NCIP is enhancing its ADSDPP [ancestral domainsustainable development and protection plans] guidelines and projectdevelopment guidelines to ensure that these concerns are clearly clusteredto sustain and further promote the fact that biodiversity management hasbeen the indigenous peoples’ way of life since time immemorial. Under theprinciple, land is life. For the indigenous peoples, their ancestral domains,their environment, their culture and spirituality, are free entities woven intoone. These are crucial to sustaining life for the next generation.

Please allow me to course through and recognize the achievementof our Philippine delegation to the 12th Conference of Parties on theConvention on Biological Diversity held from October 5 to 17 inPyeongchang, South Korea. The Philippine delegation was headed byDirector Mundita Lim of the Biodiversity Management Bureau withrepresentatives from the NCIP, Department of Foreign Affairs and the civilsociety organizations. We are happy to report to you one of the manyachievements by the Philippine delegation, which directly concern the fulland complete recognition of indigenous peoples in the works of the CBD -(Convention on Biological Diversity-).

As a short backgrounder, Article 8 Paragraph J of the CBD providesthe terminology “indigenous and local community.” Coined in 1992, the term“indigenous and local community” had already outdone its use and sparkeddebates for change in terminology among countries. We now have the UNDeclaration on the Rights of Indigenous Peoples or UNDRIP, and most, ifnot all, countries have already adopted the use of the term “indigenouspeoples” in common usage. Our Philippine Constitution of 1987 providesthe term “indigenous cultural communities,” while our IPRA provides theterm “indigenous cultural communities/indigenous peoples”.

At the 12th CBD, the United Nations Permanent Forum onIndigenous Issues together with the Philippines and other countries pushedfor the use of the terminology, “indigenous peoples and local community”under the Convention, to spell out the difference of indigenous peoplesfrom local community. This had triggered lengthy discussions, yet we areproud to say that out of the 172 countries participating, the Philippines wasone of the few countries which was convened to form part of the contactgroup to find solutions and consensus in the terminology. Eventually,following the exchange of views, the use of the terminology “indigenouspeoples and local communities” was decided and adopted at the workinggroup and plenary level. Palakpakan natin yung nagsisikap doon. (Let’s allgive a round of applause for all those who are involved in these efforts.)

All of these should not end here. We have yet to move for thesubstantial inputting in the full recognition of traditional knowledge andculture in the CBD and in its secondary document. We have to sustain ourgain. We cannot let it falter. We humbly recommend to the DENR, throughthe Biodiversity Management Bureau, the designation of a national focalperson on Article 8 Paragraph J which is currently vacant. This will ensurethat current efforts initiated will be sustained, and consistency andcontinuity of targets are assured in the succeeding words under the CBD.

On behalf of the NCIP, gusto po naming magpasalamat sa lahat ngpartner-agencies, sa civil society organizations, sa mga indigenous peoplesorganizations at sa ating mga communities lalung-lalo na sa DENR,through the BMB, for this partnership and convergence. (On behalf of theNCIP, we would like to thank all our partner-agencies, civil societyorganizations, indigenous peoples organizations and our communities,especially DENR, through the BMB, for this partnership and convergence.)

Alam po natin na ang NCIP ay hindi po kayang panindigan anglahat ng ito kung wala ang tulong galing sa inyong lahat. (We all know thatthe NCIP would not be able to do all these without all of your help.)

Allow me to quote an IP from Mindanao who said, “we, indigenouspeople, wear no shoes, neither do we wear slippers simply because ourumbilical cord is with Mother Nature that sustains us.” Hence, thisundertaking requires the active participation of the indigenous culturalcommunities and their free and informed consent. Hinahangad natin na angplatapormang ito ay magdadala sa atin tungo sa maunlad at mapayapangpamayanan na nangangalaga sa kalikasan. (We hope that this platform willlead us to progressive and peaceful communities that are taking care of theenvironment.)

Congressman Teddy Baguilat,our chairperson of NCIP Hon. Quintayo,Atty. Osorio, Dr. Faucon, UndersecretaryIgnacio, Director Mundita Lim, Team

leader from UNDP, Ma’am Baby Supetran, other guests andrepresentatives, representatives of donor agencies and governmentagencies, IP groups and partners in conservation, the PTFCF is pleased tobe part of this Conference as it strengthens the recognition on the role ofIPs in managing and protecting a variety of environments and ecosystemsfor various purposes as well.

We join this celebration because we think this highlights thediversity of approaches that communities already use to manage their ownareas and shows us how these approaches can be applied for conservationprograms of government and funding institutions.

These flexible site-specific approaches are necessary as we look forways to address problems such as deforestation, degradation and even

climate change. Lastly, we are also pleased to take part in this Conferencebecause of all the IP representatives here. Majority of all the conferencesthat I have attended, at least, were designed primarily for protected areamanagers, researchers and government agencies, while this is organizedfor practitioners—people who are directly engaged in conservation actionsso that they may learn from each other and strengthen each other’s efforts.This is one conference that breaks that mold.

Dito po, ngayong araw, ang mga namumuno sa napakaramingkatutubong pamayanan na nagtataguyod sa mga pamayanan, nagliligtas atnamamahala rin ng mga hayop, ng mga halaman, ng mga puno ng mgakagubatan, ng mga tubig at mga bundok (Today, [we can see] that theleaders of the indigenous communities not only take care of their respectivecommunities, they also take care of animals, plants, the trees in the forests,and the waters and mountains.). In this two-day Conference, we lookforward to learning from you and learning from the time-tested conservationapproaches that you practice. We look forward as well to developingpartnerships that we hope will bring about joint problem-solving, sociallearning, knowledge integration and multi-level conservation.

To all guests, organizers andparticipants to this event, good morning.

Two years ago, in 2012, the firstICCA Conference in the Philippinesdubbed as “Nature in the Footsteps ofOur Ancestors” was held in Quezon City.

The Foundation for the Philippine Environment (FPE) was amongthe many participants in that conference that took particular interest in thestatement of Dr. Grazia Borrini Feyerabend of the Global ICCA Consortium,that “the international community is looking up to the Philippines to learnhow indigenous peoples and local communities can be effectivelyempowered to protect, sustainably manage and restore their ICCA; and thatthis is crucially important today, as ICCA play- among others—anirreplaceable role in disaster prevention and resilience in the face of climateand other global changes.”

We concur with her statement because studies have gatheredconclusive evidence that our remaining rainforests and reservoirs ofbiodiversity in the Philippines are mostly located in ancestral domains. They

have remained protected because their existence is intertwined with thetraditional beliefs and practices of indigenous communities.

We likewise believe that the first ICCA Conference succeeded inforwarding a framework for the advancement of ICCA in the country. So wethank the IP communities, the organizers of the first Conference and thissecond Conference on ICCA and those who are now part of the ICCAConsortium in the Philippines.

Now the time has come to assess what had been done, what hadbeen achieved and how far do we have to go to effectively sustain ICCA(indigenous peoples and local communities conserved areas and territories)as a governance mechanism for conservation areas.

Let me forward these thoughts that might help in the assessment:

1. In ICCA-declared and to-be-declared areas, do our indigenouscommunities feel that the threats to their culture, food and waterresources have been significantly reduced, if not eliminated? If yes orno, why?

2. In ICCA-declared and to-be-declared areas, do our indigenouscommunities feel that the local and national government authorities aregiving them the primary decision-making power on how they should useand benefit from the natural resources within their domain? If yes or no,why?

3. In areas already declared as an ICCA, do the indigenous communitiesknow exactly what to do to sustain their ICCA and do they have themeans and the support to do it? If yes or no, why?

To sustain ICCAs, our IP communities must feel and believe theyhave choices, there is hope not hopelessness, they are powerful notpowerless and there is equitable sharing of benefits from conservation ofnature. And those around them must recognize IP communities as effectivetraditional managers and ICCA as an effective governance regime forconservation areas.

Allow me to cite the case of Maeng Tribe in Mt. Poswey andBuasao Watershed in Tubo, Abra (under the EU-FPE-PAFIDMainstreaming IP Participation in Environmental Governance Project), onhow IP community empowerment helps sustain IP community-ledmanagement of conservation areas:

First, the Maeng Tribe has interfaced their traditional system ofgovernance (dap-ay) using the principles of collective decision-making,collective leadership and tribal solidarity in local governance. Empowermentis manifested in their having successfully pushed for an installed indigenouspeople mandatory representation (IPMR) as required by IPRA, in theProvincial Government of Abra. Today, all ten municipalities of Abra haverepresentations from its different tribes.

Second, empowerment is manifested when the tribal leadersstopped the operation of a big mining corporation in the ancestral domainand halted an application for mining by another big firm.

Third, as part of sustainability of ICCA through education, the NCIPand the Maeng IP organization pushed for the adoption of Lapat, a culture-based system of forest management, by the Department of Education inAbra for elementary and high school students. We hope that more ICCA

good practices can be documented and integrated in the school curricula sothey can be afforded the recognition, respect, and equality they deserve.

Fourth and last, of prime importance in the empowerment of IPcommunities and sustainability of ICCA governance is the livelihood andmarket support for IP products. There has to be a mechanism to addressextreme poverty that continues to be a challenge for indigenouscommunities. The Maeng of Tubo was able to generate PhP19 millionpesos from raising native trees and they are now starting to earn from softbroom-making microenterprise. The next step is capacitating the IPcommunities in proper financial management.

At the national level, the FPE, together with NCIP and theBukidnon Higaonon Tribal Association in the Upper Pulangi Watershed, ispushing for a more inclusionary administrative guideline that address thewelfare and due benefits of indigenous communities residing within theenergy-generating watershed areas, and strengthen watershedrehabilitation and management through revenues generated under EnergyRegulation 1-94, as amended, and the universal charges-environmentalcharges (UC-EC) of the Electric Power and Energy Reform Act or EPIRA.Among the proposed administrative guidelines is the adoption of awatershed consortium definition that will benefit IP communities. If thissucceeds, it can benefit many IP communities and ICCA in watershedareas in the Philippines.

In closing, let me say that the FPE is very open and willing tosupport the initiatives to sustain ICCA as a governance regime forconservation areas, under our regular grants portfolio and the GEF-SmallGrants Programme 5 where the FPE acts as the grants manager in thePhilippines.

Good morning, CongressmanBaguilat, Chairperson Quintayo, Usec. Ignacio, Director Lim, Atty. Canivel,Atty. Osorio, Ms. Amelia Supetran.

It is a pleasure for me personally, already working here for morethan four years; it is a pleasure to see so many familiar faces and also somany new faces still. It is a pleasure that I see so many IP representatives,IP leaders; it is a pleasure to see a lot of NCIP Commissioners, NCIPcolleagues, DENR colleagues and so many people also from civil society. Ithink having been part of the earlier ICCA conferences, I think this, in itself,is already getting bigger and taking bigger steps forward.

I think a lot has been said already. DENR and NCIP overlap theirmaps of ancestral domains, of protected areas, of the key biodiversityareas, the water maps also; we can see all the areas where indigenouspeoples live. It is a big overlap. It is very clear that indigenous peoples livein critical habitats, and that they are doing something for that habitat.

There is still a lot to learn, this is why I welcome this Conference.Because it is a way to understand from each other and to learn from thosewho can already share how they are addressing these concerns. And this, Ithink, is much appreciated. To share with you, there are existing programsin the German-Philippine partnership, in fact, all work for the broader field ofconservation and resource management. There is also the Protected AreaManagement Enhancement Program together with BMB, and the REDD+Program with the DENR.

So, what we can see with these programs is that we need a lot ofaccess around if we want to achieve these goals, and if we want to reallymove forward with the conservation where the indigenous people rights arealso recognized. But more than that, they are also participating andbenefiting from the conservation. I went back, it is true that the firstconsultation on ICCA was in fact in 2011. As I said, we have already takena big step forward. I would like to say congratulations to the Philippines.

[In] the past four years, [we] have done a lot already in the directionof more convergence and bringing more actions. Let me give you someexamples. HLURB [Housing and Land Use Regulatory Board] recentlyworked on its enhanced guidebooks for the comprehensive land use plan(CLUP). These HLURB enhanced guidebooks, due to a lot of help fromconsultations, have now a whole section focused on how this is to happen—from the LGU side to the indigenous land and to ancestral domain—being clearly committed to an ICCA governance, and trying to see what itmeans to protected areas management. That is also a big step forward.

You have heard from Chairperson Quintayo that they are workingon the ADSDPP guidelines. These are big steps necessary for theconservation of biodiversity. I would like to say that there are already a lot

of learnings [from the efforts of the different stakeholdres]. We know aboutthe ICCA governance, [and] how it works together with ADSDPP, theancestral domain sustainable development and protection plan. However,we still need to use this Conference to dig deeper and to look into thechallenges that we may be faced with. Use this time to also talk about thechallenges.

Of course at the core, there is the recognition of indigenous landand ancestral domain. A lot of effort is going into the recognition of IPcommunities and [their] rights, and we can already see that. Having this[recognition of indigenous land and ancestral domain] will determine what inthat area is going to happen. You should openly discuss this because someof the conflicts in the country are related exactly to these topics, andsometimes, they even escalate into bigger challenges. Another challengethat was already mentioned is, of course, the income generation.Conservation without income generation will have an adverse effect on thelivelihood of the indigenous peoples.

Use the time here to also talk about the best practices, thechallenges we are experiencing, and what the solutions are to overcomethem.

conference- Folay Eleazar, Dave de Vera, Giovanni Reyes, and all thosewho have helped. Actually, I am not a Tagalog [Filipino] speaker but I wasrequested to speak in our national language. I am an Ilonggo so those fromthe Visayas: maayong maaga sa inyong tanan [good morning to all of you.])

I was not in the first Conference; I understand it had a veryinteresting start. Medyo madaming kontrobersya pero look at where you arenow (There were several challenges but look where we are now.). We arenow in the second Conference. Ang ibig sabihin nito ay merong naibibigayang ICCA process dito sa Pilipinas, kung bakit tayo nandito ngayon, atnapakadami (This only means that the ICCA process really has a bigimpact here in the Philippines). In fact, I am really very impressed with theparticipation, of course, sa ating mga kapatid na katutubo at ang mgasinusuportahan ninyo, kasama na kami diyan (In fact, I am really veryimpressed with the participation, of course, of our indigenous brothers andsisters and all your advocacies. We are with you in these efforts.).

The Philippines is actually gaining recognition globally on ICCA,dahil napaka-active raw natin (because we are very active). Bakitimportante yung ICCA? Siguro alam na ninyo yung sagot, ‘di ba? (Why isthe ICCA very important? I am sure you already know the answer.) TheNIPAS [National Integrated Protected Areas System] is not enough. In fact,mayroon kaming mission sa ngayon on another issue pero relatedmasyado dito sa biodiversity conservation and they were so impressed bythe number of legislations that we have on the environment. Pero sabi nila,bakit parang napakalaki pa rin ng problema ng Pilipinas pagdating sa pag-manage sustainably ng kanyang environment and natural resources? (Infact, we have other undertakings on another issue that is so related tobiodiversity conservation, and they were so impressed by the number oflegislations that we have on the environment. But according to them, why is

the Philippines still facing problems when it comes to the sustainablemanagement of its environment and natural resources?)

Well, ‘yung ating reflection diyan is that, marami sa mga legislationhave been lifted from the web. Tayong mga Pilipino, kung anongnakagawian natin, ‘yun na ‘yun, ‘di ba? So, sa customary law, angunderstanding namin ay iyon ang de facto na in effect. Naging 21 years naako in environment sector and most of that of course was in DENR, andbefore that, yung national environmental protection council, and we knowhow these legislations evolved. (Well, my reflection is that most of ourlegislations have been lifted from the web. Also, we Filipinos tend to stick toour old ways. So, in our society, customary laws are de facto in effect. Iknow how these pieces of legislation have evolved since I have been in theenvironment sector for 21 years, and most of these I have spent in DENR.Also, prior to this, I was with the national environmental protection council.)

However, we also see na hindi sila ang sagot sa ating problema.(However, we also see that this is not the solution to our problem.) Soimportante ang ICCA dahil 71 percent ng KBA (key biodiversity areas) ayancestral domain. Hindi ko alam kung tama exactly itong data na ito, peroito ang ibinibigay at ginagamit natin. (So ICCA is important because 71percent of key biodiversity areas are ancestral domain. I am not sure if thisdata is correct, but this is what was given to us so this is what we areusing.)

Pero bakit kailangan nating mag-conserve—from the proverbial useng environment and natural resources in sustainable development‘yunbang pragmatic nating issue ngayon. ‘Yan ay dahil sa 28 percent pa dinang ating poverty level. Twenty-eight percent of a hundred million people ayhindi maliit na problem, hindi po ba? (But why is it necessary for us to

conserve—from the proverbial use of the environment and naturalresources in sustainable development to the more pragmatic issues weface today? This is because our poverty level is still pegged at 28 percent.Twenty-eight percent of a hundred million is not a small problem, am Iright?) And unfortunately, most of this poverty is existing in our ecosystem.Pero bakit importante yung biodiversity? Napag-usapan na natin kung bakitmayroon tayong Convention on Biodiversity, kung saan actually nanggalingang ating Philippine delegation who performed admirably. Ako naman aytechnical adviser so nakita natin kung papaano sila nagtrabaho at kungpapaano ipinaglaban iyong mga karapatan ng katutubo at karapatan ngmga developing countries. (But why is biodiversity important? We havealready discussed the need for the Convention of Biodiversity, where thePhilippine delegation performed adimirably. I was the technical adviser so Iwas able to see how they worked and how they pushed for the rights ofindigenous peoples in developing coutnries.)

So importante ang biodiversity dahil sa tingin namin, ito ay, mayroonkaming advocacy dito, dahil nakikita natin na ang biodiversity resource iskey. Paano? Employment generation? We don’t think so. Unfortunately,ang ating Philippine Development Plan ang pinaka-anchor strategy niya isemployment generation. So ang ini-introduce nating konsepto sa ngayon isreally wealth creation. And wealth creation from where else? Sa atingresources. Kung saan sinasabi nating nakadepende ang two-thirds ng atingmga kababayan sa natural resources. Siguro ito din ang key, hindi langpara maibsan, kundi para mawala ang kahirapan. (So biiodiveristy isimportant because as we see it—and we have an advocacy here—biodiversity resource is key. How? Employment generation? We don’t thinkso. Unfortunately, the anchor strategy of our Philippine Development Planis employment generation. What we are introducing now is really wealthcreation. And wealth creation from where else? From our resources where

we say two-thirds of us depend on. Maybe this really is the key to alleviate,if not totally eliminate, poverty.)

Ano iyong sinasabi natin? Specific. Kung pinag-uusapan natin angkahirapan, pinag-uusapan na din natin ang pera. Ano iyong mayroon tayo?Ano ang kino-conserve natin, etc.? For example, iyong income from theglobal sales of pharmaceutical products ay US$300 billion annually. (Whatare we saying? Specific. When we talk about poverty, we also talk aboutmoney. What do we have here? What do we conserve, etc? For example,the annual income from the global sales of pharmaceutical products isUS$300 billion.)

And up to 50 percent of this annual income is actually derived fromgenetic resources—mga bagong gamot sa cancer, sa mga neurologicaldisorder, etc. (new cancer drugs, and also those for neurological disorders,etc.) In fact, mayroong plea to address iyong Ebola from genetic resources.Ang traditional knowledge which you have is at the heart of thispharmaceutical breakthrough. So ganoon tayo dapat ka-specific mag-isip.At bakit ulit importante iyong ICCA maliban sa ito ay alternatibonggovernance mechanism na de facto na gumagana other than NIPAS? It isbecause iyong mga areas ninyo are home to the knowledge-practice-beliefna nagnu-nurture nitong resources from which we can generate substantivewealth. Ang pinakamaganda ko palaging example diyan ay iyong OPEC[Organization of the Petroleum Exporting Countries]. Ano bang mayroonsila? Oil. Importante iyong oil. Mahal ang oil. Wala nga silang tubig eh.Bakit napakayaman nila? Kasi nagiging napaka-strategic nila. Tayo, angdami natin, hindi ba? Sa sinabi kong ito, hindi na ito bagong concept-pinagkakakitaan na ito. (In fact, there is a plea to address the Ebola fromgenetic resources. The traditional knowledge which you have is at the heartof this pharmaceutical breakthrough. We must be this specific when coming

up with solutions. Again, why is the ICCA important—aside from the factthat it is a de facto alternative governance mechanism other than theNIPAS? It is because your areas are home to the knowledge-practice-beliefwhich nurture these resources from which we can generate substantivewealth. The best example, for me, is the OPEC. What do these countrieshave? Oil. Oil is important. Oil is expensive. They do not even havewater,yet why are these countries so rich? Because they are strategic.What I am saying is that the use of these resources for wealth creation isnot a new concept.)

On the other hand, we also have minerals kung saan ang estimateng US ay—and if the USA estimates, you can be very sure there is harddata behind that—US$6 billion per mineral annually. (On the other hand,we also have minerals which the USA has estimated to be worth US$6billion per mineral annually).

Mind-boggling, hindi ba? Ang pinag-uusapan dito, dollars (Mind-boggling, isn’t it? And we are talking about dollars here.). We foresee, ofcourse, that the ICCA can be a formidable mechanism. Ang sabi nga niVictor Hugo (To paraphrase Victor Hugo), ICCA is an idea and its time hascome. So we hope that you will nurture this idea, and proceed, and thatyour tribe may increase.

grow, for example, cure to diseases, new technology, know-how to advancedevelopment, I think iyon lang ang gusto naming iparating from the UNDP.Hindi kami donor, kami ay kasama ninyo. (In developing countries, we havea lot of partners who can help with this when we do not have a biogeneticpool from which we can grow, for example, cure to diseases, newtechnology, know-how to advance development, This is what we fromUNDP, want to convey. We are not just donors, we are with you in thiscause.

In fact, kami ay utusan ninyo. Ang UN ay sumusuporta sa inyo (Infact, we are just your helpers. The UN supports you.). It is an organizationof the national government and we are there to help you. We are anormative organization that will always be there. We think that, for thePhilippines, biodiversity management is key to many of our problems. It canrival the utilization of our resources.

Kami po sa DENR, it is our privilege to co-host itong 2nd NationalConference on ICCA. Ang tema po natin dito na “Pagpapahusay saTradisyunal na Pamamahala ng Lupaing Ninuno at Pangangalaga ngLaksambuhay” ay hindi po lamang importante, napaka-relevant din po nitosa buhay natin ngayon. Alam naman po natin na ang success ng mgaconservation efforts, hindi po natin maa-attain, hindi po natin iyanmakukuha kung walang partisipasyon ang ating indigenous peoples. Masalam ninyo po ang konserbasyon kaysa po sa amin. (It is an honor for theDENR to co-host the 2nd International Conference on ICCA. The theme isnot only important, it also very relevant in our lives. We all know that thesuccess of our conservation efforts would only be attained with theparticipation of our indigenous brothers and sisters. You know conservationbetter than we do.)

We have taken the first step in sustaining traditional resourcemanagement practices noong nag-convene po tayo noong una natingconference on ICCA at noong pinirmahan po natin ang Manila Declaration.Iyon po ang naging batayan ng mga ginagawa natin ngayon. (We havetaken the first step in sustaining traditional resource management practiceswhen we convened in our first conference on ICCA and when we signedthe Manila Declaration. This is the basis of all of our efforts now.)

Ngayon pong pangalawang conference, i-strengthen po natin angating pagsasamahan at ang atin pong mga collaboration sa atin pong mgaprograma. (Through this second conference, we will strengthen ourpartnerships and the collaboration of our different programs.)

We all know that centuries of traditional practices have been largelyresponsible for the conservation of our natural resources. Kaya marami patayong mga natural resources dahil po sa ating mga katutubo, na noon pa

mang unang panahon, ay alam na nila ang tinatawag nating sustainableproduction and consumption po sa ating mga kabundukan. (We still have alot of r natural resources because our indigenous communities, since timeimmemorial, have always known about sustainable production andconsumption in our mountains.)

Kaya lang po itong mga practices na ito are now facing challengessa population growth at napaka-complex ng ating mga legal andgovernment processes. Napakahirap po ng mga legal concepts at mgagovernance projects natin ngayon kaya nagkakaroon tayo ng masmaraming problema. (But these practices are now facing challenges frompopulation growth. Also, are legal and government processes are socomplex. Our legal concepts and governance projects are too arduous andthis is why we now have more problems.)

Kami po sa DENR, mayroon po kaming tinatawag na convergencena ginawa para maibsan po natin ang mga problema ng mga katutubo (Weat DENR have what we call convergence. We have created this to lessenthe problems of the indigenous peoples.). Mayroon kaming tinatawag na(We have what we call the) Joint Agrarian Reform-DENR-LRA [LandRegistration Authority]-NCIP Administrative Order to clarify land policies,jurisdiction, programs and projects, and operational problems. Nag-createdin po kami ng isang Task Force ng mga ahensyang ito para tuloy-tuloyang pag-uusap tungkol dito. Mayroon din po kaming isang Joint DENR-DA-PCSD [DENR-Department of Agriculture-Palawan Council for SustainableDevelopment] at NCIP Administrative Order for Biodiversity ProspectingActivities in the Country. Para iisa lang po ang polisiya natin. (We have alsocreated a Task Force of these agencies to ensure that discussionsregarding this cause would be continuous. We also have the Joint DENR-

Pero ang pinakamalaki pong problema natin, o isa sa mgapinakamalaking challenges sa ating mga IP o sa mga ancestral domain ayang tinatawag po natin na land tenure. Alam po ninyo iyan kapag po pinag-uusapan ang mga problema natin. Pinakamalaki rin pong hamon ito saICCA natin. Baka mas alam ninyo ito kaysa sa akin. Mga katutubong lupa,meron po iyang CADT (certificate of ancestral domain ttle), mayroon dinpong CLOA (certificate of land ownership award). Nagpapatungan po iyan.At mayroon pa pong papatong diyang pangatlo- agricultural patent naibinibigay ng DENR. Tatlong patong na po iyan. May pang-apat na patongpa- official title na ini-issue po ng ating korte. Pang-apat na patong po iyan.At mayroon pa po diyang pang-lima- iyong mga land claims po ng mgaindividual private persons na ang hawak-hawak po nila ay tax declaration.(But one of our biggest problems is what we call land tenure. We all knowthis. This is also the biggest challenge that the ICCA is facing. Maybe youeven know about this better than I do. For ancestral domains, there is theCADT, there is also the CLOA. Then there is also the agricultural patentwhich is issued by the DENR. Then there is the official title which is issuedby the courts. Then there is the fifth one- the tax declarations of individualprivate persons for their land claims. These five overlap each other.)

Marami pong ganyang problema nationwide, napakarami po nito,kaya po affected po kayo nito. Even iyong ICCA natin, mate-threaten poiyan kung hindi po ito maaayos. (This problem is prevalent nationwide.This affects you. Even the ICCA would be threatened if this problem is notaddressed accordingly.)

Kaya gusto ko pong ipaalam sa inyo na ito pong mga problemangito ay umpisahan na po nating ayusin sa isang komprehensibongpamamaraan. (This is why I want you all to know that we have alreadystarted to provide a comprehensive solution to this problem.)

Two weeks ago po, nagpunta po sa atin sa DENR si SecretaryDelos Reyes ng Agrarian Reform. Sabi po niya sa amin, kailangan nanating ayusin ang pagpatong-patong na tenure na ito. So, ang mag-uusap-usap po dito, ang mag-uusap ay ang DAR [Department of AgrarianReform], DENR, at NCIP. Dati-rati po, pinag-uusapan na ang mgaproblemang ito. Ngayon po bibigyan na natin ng aksyon. (Two weeks ago,Agrarian Reform Secretary Delos Reyes paid us a visit at the DENR. Heinformed us the need to solve the overlapping of tenures. This will beattended by the DAR, DENR, and NCIP. We will now find a solution toaddress these problems.)

Una pong gagawin namin, kukunin po naming lahat ng records saNCIP, lahat ng records sa DAR, lahat ng records ng DENR, ipagsasama-sama po naming lahat iyan. Ia-identify po naming lahat ng pumatong-patong sa buong Pilipinas sa mapa. (The first thing that we will do is to getall the records from DAR and DENR. We will consolidate all of these. Thenwe will identify which of these areas on the Phillipine map are overlapping.)

So DENR na po ang gagawa niyan. Dati po hindi po nagagawaiyan, dahil dati po ang mga ahensya natin ay hindi po nagbibigay ng mgarecords at information. So mula ngayon po, iisa-isahin natin iyan,ipagpapatong-patong natin iyan sa isang mapa. At ‘pag nagawa na po natiniyan, pag-uusapan po natin iyan, pag-uusapan natin iyan kung anong legalprocesses ang kailangan natin para maresolba ang mga ito. (We havealready started doing this in the DENR. This has not been done before

From here on, we will take all these records andinformation into consideration and we will see where they overlap. We havestarted doing this, and we will also continue to discuss what legalprocesses we will need to resolve this problem.)

Hindi po madali ito. At hindi po mabilis ito. Pero at least po, mayroonna kaming pag-uusap, may agreement na kami, may aksyon na kaminggagawin, at hindi naman po ito pagsasabay-sabayin sa buong bansa.Pwede nating unahin iyong priority areas para unti-unti, nare-resolve natinang problemang ito. (This is not easy. It will take time. But at least we havealready started the discussion. We already have an agreement. We will betaking it one area at a time. We have already taken the necessary actions.We will be starting with the priority areas so we can carefully resove thisproblem.)

So, iyan po ang isang malaking trabaho, isang malaking hamon nagagawin po ng ahensya namin. Ang importante po dito, lahat po kami, nag-a-agree na dapat ma-resolve ito. Otherwise, lahat ng pinagtratrabahuhannatin, lahat ng programa natin, lahat po iyan mate-threaten nitongproblemang ito. Kaya iyan ang pinaka-basic na dapat nating ayusin. (This isan arduous task- a big challenge that our agency will be undertaking. Butwhat is important is that we have all agreed that this problem needs to beresolved. Otherwise, all our efforts and programs would be threatened bythis problem.)

Siguro po ang gagawin natin, iyong mga ma-identify na ICCA, iyanpo siguro ang kauna-unahan nating imamapa. Diyan muna natin titingnanang tinatawag nating overlap para ma-resolve na natin. Iyan po angimumungkahi natin sa DAR at sa NCIP. Isa po iyang maganda at

positibong development sa pag-uusap namin. (Maybe what we can do is toprioritize the areas that would be identified as ICCA. We will check if thereare overlaps here so we can immediately resolve them. This is what wesuggest to DAR and NCIP. This is a positive development from ourdiscussions.)

Outside of that, kami po ay masaya na ang ating ICCA ay umuusadnang mas mabilis (Outside of that, we are pleased that our ICCA is movingforward at a fast pace.). We need to attend to what we have accomplishedand draw out our roadmap to make ICCA a preferred and sustainable modeof governance in our protected area system.

Kami po ay napaka-interested na marinig kung ano ang mga istoryaninyo, kung papano ang ICCA has become an effective instrument forpeace-building, revival of cultural traditions, and in the conservation of ournatural resources. (We are all very interested to hear your stories abouthow ICCA has become an effective instrument for peace-building, revival ofcultural traditions, and in the conservation of our natural resoruces.)

Rest assured po na kami sa DENR, committed po kami sa ICCAprocess. At kami po ay susuporta dito hangga’t gusto ninyo po kamingkasama. (Rest assured that we at the DENR are committed to the ICCAprocess. We will be here to support you for as long as you will be needingus.)

At hindi lang po kami sa ICCA papapel. Ito pong ICCA, ipapasok nadin po namin ito sa protected area masterplan po namin para magingintegral part po siya ng protected areas natin. (We will not concentrate onICCA solely. We wil also integrate the protected area masterplan into this inorder for it to be an integral part of our protected areas.)

Hindi lang po iyan,balak po naming ipasok itong ICCA sa amingECC process. Iyan po ang environmental compliance certificate process.Lahat po ng proyekto, kumukuha po niyan. So ilalagay po namin diyan,magkakaroon po kami ng kondisyon. Kailangan po may mga kondisyon potayo roon para po hindi nila masira ang ICCA. Ibig pong sabihin, ipapasoknatin sa polisiya ng DENR at sa programang naming ito na ICCA. SaDENR, ang mangunguna po dito ay ang Biodiversity Management Bureauna pinangungunahan ni Director Lim. (Not only that,. we also plan toinclude ICCA in our ECC process. This is the environmental compliancecertificate process. All projects are issued with this certificate. When weissue this certificate, there should be a condition stating that the ICCAshould not be compromised. This means that we will include ICCA in thepolicies and programs of the DENR. This will be spearheaded by theBiodiveristy Management Bureau, led by Director Lim.)

Lastly, kami po ay nagpapasalamat sa aming development partners- sa GIZ, sa UNDP, lalong lalo na sa inyong lahat, sa pagtitiwala ninyo posa amin sa DENR na maging kasama ninyo sa pagsulong ng ICCA. (Lastly,we thank our development partners from GIZ, UNDP, and especially to allof you who trust the DENR and who are with us in advocating the ICCA.

I will read my message and at the same time interject mycomments. Pero bago ko basahin ang aking mensahe, nais ko sanangmagbigay-pugay sa mga nagsimula po ng ICCA dito sa ating bansa. (Butbefore I read my message, I would like to commend all those whospearheaded the ICCA in our country). I remember the last time I attendeda conference on ICCA. I think that was the first National Conference.

Napakaliit pa nung kuwarto noon sa isang obscure buildingsomewhere in Quezon City. (We started in a very small room in an obscurebuilding somewhere in Quezon City) And after a year, we are now here inCrowne Plaza with all of these dignitaries in front of us. So malaki na rin poang ating narating magmula nung sinimulan po natin itong ICCA. (We havecome a long way from the time we have started with ICCA.)

In this conference, we will discuss the state of the indigenous[peoples and local] communities conserved areas and territories (ICCAs).We will examine the challenges faced by those who seek to protect ICCA.And more importantly, we will consider the solutions to these challenges.And at the end of the day, the key lies with kayo pong mga katutubo (And atthe end of the day, the key lies with our indigenous brothers and sisters).Despite all the support mechanisms na manggagaling po sa amin saKongreso, sa atin pong pamahalaan, (despite all the support mechanismsfrom the Congress and from our government) and we are happy that Usec.Ignacio expounded on the policy of DENR with regard to ICCA, as well asthe support from our partner agencies, pero ang tagumpay ng ICCA aynasa kamay ninyong mga katutubo (the success of ICCA lies with ourindigenous brothers and sisters).

I have just recently returned from a study trip in Germany where Iand some fellow legislators were given a first hand look at the country’sland use and management policies. Kagagaling lang po namin sa Germany(We have just come from Germany.). Kalalapag po lang namin kahapon atkasama po natin ang chairperson ng Committee on Environment saSenado, si Senator Loren Legarda, Senator Greg Honasan, Senator SergeOsmena at iba pang mga legislators naman galing sa House ofRepresentatives, at pinag-aralan po namin ‘yung land use policy saGermany. At kaakibat sa pag-aaral po ng land use policy sa Germany,kasama na rin doon ang forest management practices sa bansang Aleman.And I was surprised that more than 50 percent of Germany’s forests areprivately-owned and managed, either by cooperatives or farmers. Dito posa ating bansa, baliktad. Of course, we follow the Regalian Doctrine ofwhich, it is the state that owns the forests and manages the forestsprimarily. Doon po sa Germany, baliktad. And aside from this fact, side byside with production forest, [they] also have protected forests in Germany. (Iwas with the chairperson of the Committee on Environment in the Senate,Senator Loren Legarda, Senator Greg Honasan, Senator Serge Osmenaand other legislators from the House of Representatives. We discussedabout the land use policy and forest management practices of Germany.And I was surprised that more than 50 percent of Germany’s forests areprivately-owned and managed, either by cooperatives or farmers. In ourcountry, it is the opposite. Of course, we follow the Regalian Doctrine,wherein it is primarily the state that owns and manages the forests. Andaside from this fact, side by side with production forest, they also haveprotected forests in Germany.)

Of course iba ang sitwasyon dito sa Pilipinas. Iilan na lang po angnaiiwang natural forests natin. (Of course, we have a different situation herein the Philippines. We only have a few of our natural forests left.) Less than

5 percent ang primary forest, perhaps including the residual or secondaryforests, less than 10 percent, unlike in Germany that they have 30 percentof their land as forest cover. So kasama doon ‘yung timber production,napakahalaga (This also includes timber production, which is veryimportant.). At mayroon din silang protected areas. Dito po sa ating lugar,iba naman po ang sitwasyon. (They also have protected areas. In ourcountry, the situation is different.)

But it was eye-opening to note that in this first world country, whichis among the leaders of industrialization, Germany has a strongenvironment management program that emphasizes forest managementwith protection and production forest. Now this led me to think and reflecton my role as a legislator. Sa tingin ko (The way I see it), it is high time thatthe Philippines look for other modes of forest and natural resourcemanagement beyond the traditional modes presented under the RegalianDoctrine. Likewise, alam naman po natin na batay sa ating karanasan,napakahirap pong ipagtanggol ang forest resources based purely on thecurrent laws that we have in the Philippines. (We know from experiencethat it is very difficult to advocate for our forest resources based purely onthe current laws that we have in the Philippines. A good place to start wouldbe the management systems employed by indigenous peoples as well aslocal communities. Like for instance, in my own province in Ifugao, of which90 percent are considered as public forest or part of the public domain kasi(because) [they are] more than 18 percent slope. In areas where there areweak indigenous forest management practices, na supposedly ito po ‘yungmga areas (supposedly, these are the areas) that are under the domain ofthe DENR – the PENRO [Provincial Environment and Natural ResourcesOffice] and CENRO [Community Environment and Natural Resources

Butdoon naman po sa mga lugar na napakalakas po at sinusunod pa rin yungtraditional forest management practices ng mga Ifugaos, kahit wala pongmga forest rangers doon, very healthy o malusog po yung kagubatan, ‘yungforest cover. (But in the areas where there are no forest rangers and wheretraditional forest management practices of the Ifugaos are being observed,the forest cover is still very healthy.)

I am sure sa inyo pong lugar, mayroon din po kayong mgatraditional forest management practices. (I am sure that you also havetraditional forest management practices in your respective communities)Doon po sa amin (In our community), we have the muyong system. Themuyong system is both a cultural property as well as a traditional forestmanagement practice. Bakit ko nasabi na cultural property ito? (Why do Isay this is a cultural property?) Because bahagi ito ng mana ng mgaIfugaos (because this is part of the Ifugao heritage). You inherit the housekung ikaw po ‘yung panganay (if you are the eldest), you inherit a riceterrace or parcel of the rice terrace, and you inherit a muyong which is asmall woodlot or small forest. It is also a traditional management practicekasi (as) it includes selective cutting, and at the same time, the planting of avariety of forest and wood trees, both hardwood and softwood, as well asother wood products. And the forest management practice allows selectivecutting. It has largely worked for us in Ifugao. This is also being recognizedby the DENR as one of the successful forest management modes in thecountry.

Ngayon (Now), as a legislator, one of the ways I intend to help in thedialogue about ICCA is to explore possible amendments to the NIPAS

[National Integrated Protected Areas System] Act of 1992. And in fact nag-usap-usap na po kami ng mga miyembro ng Committee on Environment.(And in fact, we, the members of the the Committee on Environment, havealready started discussing this.) We are going to push, first, ‘yung (the)expansion of the NIPAS Act to include 200 declared protected areas namany of which had been approved through executive proclamations, perokinakailangan po ng batas (but enactment of a law is also needed). But Iam also exploring the possibility of filing or initiating the filing of a bill thatwould recognize ICCA, as part of the protected area system of thePhilipines.

Ngayon, ang tanong natin, “Sapat na po ba ang IPRA? Sapat na hoba ‘yung pagkilala sa ating Saligang Batas sa mga indigenous knowledgesystems ng katutubo doon po sa pagpapatuloy o pagtataguyod ng ICCA?”Sa akin, “Sapat na sana.” Ngunit sa tingin ko, sa atin pong bansa saPilipinas, napakaimportante kasi yung institutionalizing of policies e. (Now,we ask, is IPRA enough? Is it enough that our Constitution hasacknowledged the indigenous knowledge systems when we advocated forthe ICCA? For me, it should be enough. But in our country, theinstitutionalizing of policies is very important. Nabanggit kanina ni Usec.Ignacio (Usec. Ignacio has already mentioned this)—and I am very happythat he mentioned this—that DENR is going to recognize ICCA. Okay? Nowthat is executive policy. But the kind of governance that we have in thePhilipines is we hunger for institutionalizing policies. Because of the politicaldynamics – every six years we have a change in administration – which isboth positive and negative. Positive kasi kung may bagong administrasyon,may mga bagong initiatives (It is positive because every new administrationcomes with new initiatives.). Negative because ‘yung mga magagandangnasimulan, maaaring mapalitan (It is negative because of the possibility thatthe worthwhile initiatives of the previous administration may be altered.).

And this is the reason why I think, while the executive department throughthe DENR is recognizing ICCA, mahalaga rin sigurong pag-isipan natinkung kinakailangan nating isabatas yung alituntunin ng ICCA sa atin pongmga forestry or national laws, [and] biodiversity laws (it is also important todiscuss the need to put into law the guidleines of ICCA for our forestry ornational laws). It is either we make an amendment to the NIPAS or asDirector Lim said, perhaps we discuss it as a different mechanism.

Through this Conference, I hope to be enlightened on the variousways by which our indigenous brothers and sisters have successfullypreserved their natural resource areas despite the many seeminglyinsurmountable challenges that have come our way. And maybe, it is alsohigh time that we inform kayo pong mga kapatid kong mga katutubo na saKongreso po, napakarami pong mga proposed environmental bills that willimpact on ancestral domain (It is also high time that we inform you, ourindigenous brothers and sisters, that there are numerous proposedenvironmental bills in Congress that will have impact on ancestral domain.).Unang-una na po dito (The first of these) is the proposed National LandUse Act which we have already passed in the House of Representatives athinihintay po natin ang (we are waiting for) action sa (in the) Senate. Mayepekto po ito sa ancestral domain natin. Dahil ang kinakailangan po natin[ay] i-identify sa inyo pong mga lalawigan, sa inyong mga bayan, sa mgabarangay kung ano yung protected area, ano yung protected forest,protected agricultural lands na hindi basta-basta pwedeng baguhin ‘yungkanyang paggamit, at ano naman ‘yung mga production areas.Naipaglaban po natin bilang isang author, as one of the authors of theNational Land Use Act, naipaglaban po natin as far as ancestral domain isconcerned—it is either protected or production area—because ito ay bataysa pasya or decision ng mga indigenous peoples. Mahalaga po yan. (Thishas an effect of our ancestral domain. One of the things we need to

accomplish is to identify which areas in your provinces, towns, andbarangays are protected forest, protected agricultural lands, and productionareas. The use of these areas can not be altered arbitrarily. As one of theauthors of the National Land Use Act, I have already pushed for this. As faras ancestral domain is concerned—it is either protected or productionarea—because this would be the basis for the decisions of the indigenouspeoples. This is indeed important.)

Pangalawa (Secondly), I am also an author of the Forest ResourcesBill. This seeks to overhaul the forest management or forest protection legalmechanism of the Philippines. Sa ngayon po kasi (As of now), we have anExecutive Order that bans logging or cutting, until we pass a new law. Angdebate po ngayon sa Kongreso (The debate in the Congress now) iswhether we are going to declare natural forest (and many of you live innatural forest) both primary and secondary as protected area, or are wegoing to allow production activities within secondary forest. Iyon po angdebate. Ang sa akin lang (For me), because based on our experience inGermany where [they] have both protected and production in one forest, saakin mahalaga naman po ang timber production (timber production is veryimportant), however, tulad ng sinabi ko (as I’ve said), iba ang sitwasyon ditosa Pilipinas (we have a different situation here in the Philippines.). Iilan nalang ang naiiwan na natural forest po sa ating bansa (We only have a fewnatural forests left). And therefore, my proposal is for Congress and forDENR to look at forests the way IPs view forest resources.

Ano po bang pagtingin natin sa kagubatan? Whether you are an IPfrom Luzon or from Mindanao, saanmang sulok ng Pilipinas, doon po tayonagkakaisa: we look at forests as sacred, ‘di po ba? It is sacred; therefore,it has to be protected. It has to be preserved. It has to be conserved.Pangalawa, we also look at forests as sources of our sustenance. ‘Di po

ba? Dito nanggagaling ang ating pagkain. Dito nanggagaling ang atinglivelihood. That’s why we allow selective, judicious, wise harvesting offorest products. Iyon po sana ang gusto kong igiit dito po sa debate kungano ba ang sustainable management practice. It should be looked as,especially itong mga naiiwan nating natural forest—protected area siya. Butkung kinakailangang magkaroon ng production, then let us make sure thatit is regulated. And let us make sure that the production is sustainable. Asagainst ‘yung current legal dispensation that says that forest ay primarily fortimber production ngunit may mga ibang areas, under the NIPAS Act, thatshould be declared as protected. So, sa akin po, ang default is protectedand maybe, maybe, we could allow some production areas. And perhapsdito po pumapasok yung usapin ng ICCA. Because I am sure na ‘pag ICCAang pinag-uusapan, it is a protected area managed by indigenous or localcommunities, but it allows for selected, judicious cutting. (What do we thinkof our forests? Whether you are an IP from Luzon or from Mindanao,wherever you may be in the Philippines, this is what we agree on: we lookat forests as sacred, do we not? It is sacred; therefore, it has to beprotected. It has to be preserved. It has to be conserved. Also, we also lookat forests as sources of our sustenance. This is where our food comesfrom. This is where we get our livelihood. That’s why we allow selective,judicious, wise harvesting of forest products. This is what I would like toemphasize in our discussions on sustainable management practice. Naturalforests should be regarded as protected areas. But if there is a need forproduction, then let us make sure that it is regulated. And let us make surethat the production is sustainable. As against the current legal dispensationthat says that the forest is primarily for timber production but there areareas, under the NIPAS Act, that should be declared as protected. So forme, the default should be that this is protected and maybe, maybe, wecould allow some production areas. Perhaps this is where discussions onICCA come in. Because I am sure that when we talk of ICCA, it is a

Maliban doon (Aside from this), we also have other laws – aproposed Mining Act, a proposed expansion of protected areas based onirrigation systems – but maybe I could end by advocating something alsofor us indigenous peoples. While lagi po nating sinasabi na in any nationallaw—ako po, ang aking paniniwala is dapat manaig ang karapatan ngkatutubo. Sinasabi kanina ni Usec. Ignacio na minsan po sa ating bansa,napakaraming batas ngunit minsan sila ay medyo naglalaban. Ako po aydating chairman ng Committee on Indigenous Peoples. Ngayon, I am thechairperson of the Committee on Agrarian Reform. May mga lugar saPilipinas na nag-aaway ang CLOA [certificate of land ownership award] atang CADT [certificate of ancestral domain title]. And I think, for theinformation of everyone here, ‘yung binanggit kanina ni Usec. Ignacio,‘yung Joint Administrative Order for DENR, for DAR and NCIP – this was aninitiative of my Committee when I was chair of the Committee onIndigenous Peoples. Because in Oriental Mindoro, mayroon pong away angmga kapatid po nating mga Mangyan at ‘yung mga magsasaka, because‘yung mga magsasaka may CLOA sila, ‘yung mga Mangyan mayroonnaman silang CADT. So I said, “Let us harmonize these laws.” But ang saakin lang, of course this is my bias, this is my personal bias being anindigenous person, nananaig pa rin sa akin yung IPRA. At nananaig pa rinsa akin ‘yung karapatan ng mga katutubo vis-a-vis other sectors. Of course,hindi naman puwedeng sabihin na kinakailangang ‘yung katutubo lang angmasunod. Alam naman po natin na ang ating lipunan, we now live with IPsand non-IPs in our own ancestral domains. (We always say that in anynational law, the rights of the indigenous peoples should always be at theforefront. Usec. Ignacio has mentioned that while we have a lot of lawsregarding this, some of these contradict each other. I was the chairman of

the Committee on Indigenous Peoples. Now, I am the chairperson of theCommittee on Agrarian Reform. There are areas where the CLOA[certificate of land ownership award] and the CADT [certificate of ancestraldomain title] overlap. And I think, for the information of everyone here, theJoint Administrative Order for DENR, for DAR and NCIP mentioned byUsec. Ignacio – this was an initiative of my Committee when I was chair ofthe Committee on Indigenous Peoples. Because in Oriental Mindoro, therewas a conflict between the farmers and the Mangyans. This is because thefarmers had a CLOA while the Mangyan had CADT. So I said, “Let usharmonize these laws.” But for me, of course as an indigenous person, I ambiased towards the IPRA. I focus on the rights of the indigenous peoplesvis-a-vis other sectors. Of course, this is not to say that it is only the IPswho should be followed. We all know that we now live with IPs and non-IPsin our own ancestral domains.)

Now, ang gusto ko po sanang igiit is while we fight for your CADTs,while we fight for the recognition of your ICCAs, kasama rin po dito ‘yungformulation niyo ng inyong mga ADSDPPs [ancestral domain sustainabledevelopment and protection plans]. This has been NCIP’s advocacy, ‘di poba? Sana naman po, while we say that the right to self-determination isparamount in terms of managing our forest, in your ADSDPPs, sanamaipasok ninyo ito. I remember one time when I was a governor, that was adecade ago, when I said that the Ifugaos or the Cordilleran tribes have theright to their forests, ang sagot ng isang regional director sa DENR (hindi kona babanggitin yung pangalan), sabi niya na, “Kapag binigay po natin angkapangyarihan sa local communities, sa mga katutubo, ‘yung managementng forests, siguradong kakalbuhin nila yan.” I hope it is no longer themindset, pero ‘yun po ang sinasabi noon. But at the same time, whileipinaglalaban po ‘yung ating karapatan, sana naman po, let us be true toour ancestors and environmental orientation na ilagay po natin sa

Kasi kung ganoon, I don’tthink we are going to have any problem when we deal with governmentagencies for as long as they recognize our right to these forests and theuse of these resources, and for as long as tayo rin, iginigiit natin ‘yungprotection and conservation of these valuable forest resources. (Now, whatI would like to emphasize is that is while we fight for your CADTs, while wefight for the recognition of your ICCAs, we must also emphasize theformulation of the ADSDPPs [ancestral domain sustainable developmentand protection plans]). This has been NCIP’s advocacy. As we say that theright to self-determination is paramount in terms of managing our forest, wehope that you also take these into consideration in your ADSDPPs. Iremember one time when I was a governor, that was a decade ago, when Isaid that the Ifugaos or the Cordilleran tribes have the right to their forests,a regional director of the DENR answered, “If we give the power to the localand indigenous communities to manage the forests, the forests will surelybe denuded.” That is what he said. I hope it is no longer the mindset. But atthe same time, while while we fight for our rights, let us be true to ourancestors and environmental orientation. Let us include in the ADSDPPsthe protection of the forest resources that are under our dominion andunder our care. This way, I don’t think we are going to have any problemwhen we deal with government agencies for as long as they recognize ourrights to these forests and the use of these resources, and for as long aswe also push for the protection and conservation of these valuable forestresources.)

CONFERENCE OVERVIEW

Introduction

he First National Indigenous Peoples and Local CommunitiesConserved Areas and Territories (ICCA) Conference on 29 to 30March 2012 introduced the concept of ICCA and its value in

sustaining biodiversity in the country. The event likewise became anavenue for various sectors in government, local and internationalinstitutions and the academia to convene and learn from the experiences ofthe indigenous peoples (IPs) and local communities on traditional systemsof governance to uphold environmental sustainability.

With the efforts of the Biodiversity Management Bureau (formerlyProtected Areas and Wildlife Bureau, PAWB) of the Department ofEnvironment and Natural Resources (DENR) through the NewConservation Areas in the Philippines Project (NewCAPP), United NationsDevelopment Programme (UNDP) and Global Environment Facility (GEF),University of the Philippines Office of the Vice-President for Public Affairs

(OVPPA) and the National College of Public Administration andGovernance (NCPAG), Philippine Association for Intercultural DevelopmentInc. (PAFID), and Koalisyon ng Katutubong Samahan ng Pilipinas(KASAPI), the First National ICCA Conference paved way for public andprivate institutions as well as development and nongovernmentorganizations (NGOs) to recognize their role in the ICCA initiative. Thesupport garnered during the Conference led to the creation of the ManilaDeclaration, which affirms the prominent role of IPs and local communitiesin promoting ICCA and Philippine biodiversity.

Two years after the First National ICCA Conference, theBMB/NewCAPP and National Commission on Indigenous Peoples (NCIP),with funding support from the Philippine Tropical Forest ConservationFoundation (PTFCF), Deitsche Gesellchaft fur InternationaleZusammenarbeit (GIZ-GmbH), and UNDP-Philippines through the WealthCreation Project, recognize the significance of a follow-up Conference notonly to celebrate the milestones of the ICCA initiative but also to determinethe prevailing challenges encountered since the creation of the ManilaDeclaration. Hence, the Second National ICCA Conference was designedto highlight the achievements made in ICCA since the First National ICCAConference and reconvene the sectors involved in the ICCA initiative.

The Second National ICCA Conference brings together IP leadersrepresenting the major islands (Luzon, Visayas, Mindanao) and ethno-linguistic groups, support organizations and development institutions, theacademe, private sector and the national government. While the FirstNational ICCA Conference introduces the concept of ICCA, the SecondNational ICCA Conference concentrates on the learnings and experiencesacquired by IP leaders and local communities, support organizations andpublic and private institutions while promoting ICCA in the country. The

The participation in the Second National ICCA Conference signifiesthe continuous commitment of all stakeholders and support institutions tothe ICCA initiative. It serves as a steadfast reminder of the enduring pursuitof accomplishing the commitments made in the Manila Declaration.Nevertheless, a noteworthy distinction of the Second National ICCAConference is the promise of employing the ICCA concept in the NationalCommission on Indigenous Peoples (NCIP) validation of the enhancedancestral domain sustainable development protection plan (ADSDPP). Thisinitiative promises to strengthen the recognition of traditional resourcemanagement especially in designing community conservation plans.

Conference Objectives

he objective of the Second National ICCA Conference is toshowcase the developments in the ICCA initiative andcommitments attained in the Manila Declaration since 2012.

Moreover, it aims to reconvene field practitioners, community leaders, thegovernment, the private sector, the academic community, civil society andfunding and development institutions to be able to review and assess theprogress in the Manila Declaration as well as to address the challengesidentified in incorporating ICCA in the country.

The Second National ICCA Conference was conceptualized toprovide a documentation of best practices in ICCA documentation,recognition and management. Furthermore, it aims to generate policy

Lastly, theevent offers a venue to strengthen partnerships between DENR and NCIPand other partners and support for the passage of the ICCA Bill and re-affirm the statement of support of funding and development agencies,projects and indigenous peoples organizations (IPOs) and communities.

Case presentations in several sessions of the conference programwere conducted to share with the participants the documented bestpractices with regard to ICCA documentation, recognition andmanagement. A cultural night was held to forge unity and socializationamong the stakeholders of the ICCA, including their support system fromthe sectors of government, civil society, nongovernment organizations andinternational community.

SESSION 1: A REVIEW ON NATIONAL AND INTERNATIONAL

DEVELOPMENTS ON ICCA RECOGNITION

he first session covered the developments on the initiatives madeon ICCA at the local and global levels. BMB Director TheresaMundita S. Lim discussed the highlights of the First National

Conference on ICCA and the status of the national recognition on ICCA,which includes the ICCA registry, ADSDPP, free and prior informed consent(FPIC) and protected areas (PA) system masterplan. International PolicyAssistant of the ICCA Consortium-Global, Ms. Holly Jonas, shared thedevelopment of ICCA within a global context.

Presentation of the Summary of the National ICCA Conference

and Report on the Status of National Recognition on ICCA

Director Lim walked through the First NationalICCA Conference held on 29-30 March 2012at the UP NCPAG, attended by about 260participants from indigenous peoplesorganizations, international organizations anddonor agencies, national agencies, NGOs,LGUs, academe and private sector. It was acollaborative effort among DENR-BMB-

Philippines (KASAPI), UP-NCPAG, UP-OVPPA and the ICCA Consortium.

Global and local perspectives of ICCA were presented to give theparticipants an overview of the different initiatives supporting ICCA,including the agreed set of principles on how government, civilsociety/assisting organizations and IP communities can work together withregard to ICCA management and governance.

Further, Director Lim reiterated the action plan that focused on fivecrucial areas in ensuring the recognition and promotion of ICCA in thePhilippines, to wit:

a) establishment of partnership structures/mechanisms;b) documentation, mapping, declaration and registration of

ICCAsc) policy development;d) capacity development; ande) financing

External and internal threats to ICCA in the Philippines identified inthe First Conference were also discussed in view of the coordinated effortsfrom various organizations in addressing these.

External Threats to ICCA

a) Development Aggression - ICCA have been under threat by largescale economic development and infrastructure projects likeurbanization projects, road structures, fossil fuel extraction, mining,and logging, among others, causing destruction or damage to thedetriment of the ICCA.

b) Expropriation and encroachment of lands - there were instanceswhen the national government expropriated community lands andmade them available for private use. Land grabbing issues andconflicts with neighboring communities are common.

c) Natural and environmental threats - climate change also impactsnegatively on the ICCA, particularly on the coastal areas. Naturaldisasters that wreak havoc in the ICCA also abound. Air, water, andchemical pollution from extractive industries as well as the spread ofinvasive/exotic species of flora and fauna also threaten the ICCA.

d) Violence and/or war - war and violent conflicts cause destruction tothe ICCA, not only in terms of physical damage but also in culturaland spiritual beliefs.

Internal Threats to ICCA

here are also threats within the communities of ICCA, arising fromthe interaction of the IPs within their territories with those outsidethe ICCAs, or from changes in the immediate society of the IPs. A

most serious internal threat is the erosion of traditional knowledge andwisdom on the management of the environment and natural resources.

A number of factors cause the active acculturation of IPs in theICCA, such as formal education programs not adapted in the local cultures;evangelization; and mainstream media which influence the lifestyle andworld views of the IPs in the community.

ICCA Governance Triad

rom the discussions in the First Conference, the participantsrecognized that all these threats can be addressed through anICCA Governance Triad that strengthens the connection between

the IP communities, government, and support groups.

In recapitulation, the First National ICCA Conference gave a verygood understanding of the global and national ICCA perspectives. Theconference enabled the participants to relate their situation with the globalmovement, and how such developments can benefit the advocacy forICCA, amidst the unique Philippine political, economic and socio-culturalcontexts.

The ICCA case studies presented by some IP leaders enabledothers to link how ICCA and its processes can be beneficial to both

protecting valued traditions and cultures and strengthening of IP rights toconservation of biodiversity.

The outputs of the Subnational ICCA Conferences explicitlydiscussed the issues, concerns and threats to ICCA being faced by some185 IP communities throughout the country. Likewise, the delegatesreached a consensus that the effective way to address the challenges isthrough a strong collaboration among government, IP communities and civilsociety groups, including the private sector and the academe, working on acommon vision.

Manila ICCA Declaration

he Manila Declaration on the ICCA was the culmination ofcollaborative efforts of the IP leaders and other stakeholders duringthe subnational workshops. It reflected the way IPs interpret and

understand their environment. The ICCA are shaped by a history ofindigenous activities, and the IPs should, therefore, define the future of theICCA through the footsteps of their ancestors.

Taking off from the Manila Declaration, Director Lim enumerated theplanned and implemented activities for recognition and support of the ICCA:

1. Documentation and Mapping of ICCAs – Documentation foradditional three ICCAs were completed and are up for registrationwith World Conservation Monitoring Centre (WCMC) namely: Faganoon Furohayo (Buhid-Bangon ICCA) – 16,904

hectares, Mt. Iglit, Baco National Park, Oriental Mindoro Imong Ji I-Vanao (Banao ICCA) – 23,806 hectares,

Balbalan, Kalinga Mamanwa-Manobo ICCA - 2,000 hectares, Mt. Hilong-

Hilong, Jabonga, Agusan Del Norte

There was also a mention of the medium-sized grant from UNDP-GEF to support the National ICCA Program.

2. Formulation of policies and establishment of processes forthe recognition and support of ICCA; and integration in the nationaland local development planning:

Several IP groups, such as the Banao and Balatoc in Kalinga,Buhid and Bangon in Oriental Mindoro, BUKLURAN (PhilippineICCA Consortium) and the Mamanwa in Agusan del Norte,submitted community resolutions to the Office of Cong. Baguilatrequesting to draft an ICCA Bill, which the Ifugao Representativesupported.

3. Pursuance of schemes such as PES, capacity building, anddevelopment of alternative livelihood to raise funds for financingICCA plans

4. Establish the National ICCA Network in the Philippines

The Philippine ICCA Consortium or the Bukluran ng mga KatutuboPara sa Pangangalaga ng Kalikasan ng Pilipinas (BUKLURAN) wasestablished.

The founding meeting of the group was held on February 20, 2013,followed by the second meeting on July 9-10, 2013 and the third meetingon March 11, 2014. The ICCA Consortium (BUKLURAN) SteeringCommittee members are:

In addition, the ICCA Network in the country has started theirinternational linkages through the Convention on Biological Diversity -Conference of Parties (CBD-COP). The Manila Declaration was alsopresented in the World Indigenous Network (WIN) Conference.

While there were several positive outcomes since the First NationalICCA Conference, Director Lim qualified that sustainability of theseinitiatives requires technical and financial support.

The prominent approach inadvocating ICCAs has been multi-leveland integrated. As explained by Ms.Jonas, countries have been organizinggroups and federations beyond the locallevel. Focusing on human rights, manycountries are forging partnerships andinstitutional support, not only from thegovernment but from other stakeholdersas well, which can provide financial andtechnical support for ICCA initiatives.She further emphasized that diversesources of support proved advantageousin generating recognition for the ICCAsby sharing ICCA-related news fromaround the world.

South America

1. Argentina: The Confederación Mapuche de Neuquén is amobilization against Chevron because of its encroaching activitieson IP lands.

2. Bolivia: The IPs are facing a wide range of industrial threats,particularly in agriculture (soy bean). They are developing a toolboxfor environmental monitoring of ICCAs.

3. Chile: Manquemapu ICCA received 2014 Equator Prize forsustainable forest and fisheries management. IP lawyers arelobbying the Senate’s Environment Committee because of the newprotected areas law that excludes IPs.

North and Central America

1. North America: A workshop was conducted with first National andNative American Tribes, who are using ICCAs as tool for marineplans.

2. Costa Rica: Marine and coastal: Held CBD expert workshop onmarine spatial planning; influenced COP 12 decision on marine andcoastal biodiversity.

Africa

1. Senegal: First community to receive devolved management rights.Recipient of 2012 Equator Prize; 2014 Global Biodiversity Outlook4.

2. Democratic Republic of Congo: The 2014 National Decree wasissued recognizing collective forest concession in perpetuityfollowing provincial environmental code (South Kivu).

3. Kenya: ICCA are gaining ground. The National ICCA Committeefacilitated by SGP-Kenya held three workshops already.

4. Namibia: Engagement between the indigenous Khwe andgovernment officials were held on the basis of community protocols.The discussion focused on what they want and what thegovernment can do for them.

Europe

1. Croatia: There is a project on community management of floodplains and advocacy for recognition of common pastures.

2. Spain: There is a resurgence of the commons--Declaration ofValdevaleano de Tera.

Asia

1. Iran: The president of the ICCA Consortium is from Iran. They aredoing re-empowerment; participatory documentation; tribal herbaria;participation in protected areas (PA) management and codificationof new Natural Resources Law that explicitly recognizes ICCA andthe participation and involvement of IPs.

2. India: They have a very progressive law, “Forest Rights Act”, whichtries to address the historical injustices to the different IPs. Thechallenge remains in the implementation.

3. China and Taiwan: An ICCA working group has been establishedwhich conducted a workshop. In Taiwan, there is the eco-occupation, they are trying to reconnect with the traditionalterritories, showcasing that “this is their land and this is how they areprotecting them.”

4. Island South East Asia: There are a growing number of localinitiatives in the area. Regional networks have also beenestablished.

Developments in International Law and Policy

here is a growing recognition of the ICCA through the increasingadoption of supportive international laws and policies, withemphasis on climate change. The ICCA were referenced a few

times in the 11th Conference of the Parties to the CBD (with threedecisions). In the 2014 COP, there were 12 decisions where the ICCA wererecognized. In the 2012 IUCN World Conservation Congress, they adopteda resolution specifically on the ICCA. There was also the World IndigenousNetwork (2013) and the upcoming World Parks Congress.

Agriculture and Sustainable Development

s. Jonas discussed the Food and Agriculture Organization (FAO)voluntary guidelines on tenure recognizing the indigenouspeoples’ customary tenure systems. She also mentioned that

the Rio + 20 also recognized IP rights.

Key Trends and Trajectories

There is an increase in sophistication of self-organization. Workinggroups, networks, and different organizations are sprouting.

Multi-level approach to learning, engagement, and advocacy. The trendis going beyond the community and increase in support to variouscommunities. Networking and institutional support are also emphasized,with recognition of key players such as the GEF-SGP and CBDsecretariat.

More integrated approach of law and policy. Direct engagement withgovernment officials and policymakers are being practiced.

Ms. Jonas emphasized that the world is looking at the Philippines asa leader in the ICCA and it will be a good example for the rest of the world.

Open Forum

here were suggestions made during the open forum embracing thefollowing: (1) inclusion of a cultural impact assessment in the ICCAprocess to be able to enforce accountability; (2) formulation of an

indigenous approach in resolving the issue of food security; inclusion ofBugkalot, Ilongot, Quirino, Nueva Vizcaya as an ICCA; and (3) highlightingof headwaters or water continuum as a concern on developmentalaggression. It was also suggested that documentation and presentations bedistributed to the participants for the IPs to have a ready reference upontheir return to their respective areas. Nevertheless, there have beenunresolved issues raised during the open forum such as the hapless meansto protect their ICCAs and ancestral domain due to the lack of certificatesand the upholding of the Regalian Doctrine.

Falios U. Antaw of Buhid and Bangon of Mt. Iglit Baco discussedtheir activities such as basic resource inventory, carbon monitoringorientation and training, data validation and analysis, which wereundertaken in partnership with Philippine Association for Inter-CulturalDevelopment, Inc. (PAFID) and NewCAPP.

Manobo tribal leaders Randy Catarman and Anlagan explained thesignificance of Panlabao to the Mamanwa of the Manobo Tribe, thechallenges in protecting Panlabao from militarization, mining and logging,and the value of ICCA registration to address these concerns.

Susana Sabas of the Banao Tribe in Kalinga imparted theexperience of the Banao community in developing the Balbalasang,Balbalan National Park as an ICCA in collaboration with BMB, NCIP,Concerned Citizens of Abra for Good Government (CCAGG) and PAFID.

Albert Maiyao, tribal leader of the Balatoc Tribe, and WendyGumisa, recollected the experience of the Balatoc Tribe in ICCAregistration.

Case Presentation 1: ICCA and PES- The Case ofMILALITTRA-Payments for Ecosystem Services (PES) forMILALITTRA in Mt. Kalatungan Range Natural Park(From the inputs of Datu Rio Besto, Tribal Leader)

Datu Rio Besto provided an overviewabout the Talaandig-Kalatunganon and itsCADT, explaining what has been doneincluding the ecosystem service,development of the communitydevelopment plan, prioritization of the CDPmanagement intervention in strategicareas, determining funding requirements,designing the PES mechanism, andfinalization of the PES contract.

The Sustainable Financing of ProtectedAreas Project of World Bank-DENR came

Step 1. Identifying a significant ecosystem service that is increasingly beingthreatened in the area.

Scoping activities by the Project Team was conducted throughinterviews with provincial and municipal LGUs, Bishop Ledesma of XU, andagri-industrial plantations. They also participated in the Cagayan de OroRiver Basin Management Council (CDORBMC) meeting. They identified themajor ecosystem service being threatened if another Sendong hitsCagayan De Oro City—the Batang Watershed—found within Talakagmunicipality and MILALITTRA ancestral domain, which needs to berehabilitated.

Step 2. Identifying the ecosystem service provider (or seller), documentingland use changes in the ecosystem service provider’s area and proposedland use management interventions.

Community consultations and re-coding of the MILALITTRA 3D mapwere done. More positive land cover changes (non-forest to forest, forestmaintained) are happening in MILALITTRA ancestral domain (2013 re-coded MILALITTRA 3D map).

Green means that forest areas have been maintained in the area.Yellow means non-forest areas such as agricultural, grassland, and brushland areas have been transformed to forest. Gray means it remained asnon-forest, but there were changes in these areas that meant improvedcover (agricultural to brush land).

The MILALITTRA CDP (2014-2018) was developed to identifyactivities that can be funded by PES resources. The proposed priority CDPmanagement interventions are identified in strategic areas where water

sources are located and adjacent to natural forests. Other priority CDPactivities are the (1) tulugan (tribal hall): a sacred venue for communitydialogues, consultations and rituals; (2) potable water systems forincreased productivity and access to safe drinking water; and (3) incentivesfor Bantay Lasang.

Step 3. Determining Funding Requirements for MILALITTRA CDP

To determine the funding requirements for the MILALITTRA CDP,the following components and its corresponding costs were identified.

Step 4. Identifying beneficiaries of the ecosystem service (or the buyer)and conduct of social marketing activities for MILALITTRA CDP

In order to identify the beneficiaries of the ecosystem service, abuyers’ forum was conducted which were attended by various groups,namely:

For social marketing, various sectors were encouraged toparticipate in the CDO River Basin Management Council meetings whichled to the passage of the Cagayan de Oro River Basin ManagementCouncil (CDORBMC) resolution adopting the payment for ecosystemservices (PES), development of the sustainable financing mechanism forrehabilitation and development of the MILALITTRA ancestral domain in Mt.Kalatungan Range Natural Park (MKaRNP) and; creation of PES technicalworking group (TWG).

Moreover, one-on-one social marketing discussions were alsoconducted with Capitol University (CU), Cooperative Development Authority(CDA)-Region 10, Office of the CDO Vice-Mayor, CDO SangguniangPanglungsod Chair on Environment, and the CDO Water District.

Different groups contributed in the design of the PES mechanism.These include representatives from the local government unit (LGU),NGOs, academic and the IP community.

Step 7. Finalization of the PES Contract: MOA Signing held on May 21,2014

The MinDA provided seed money amounting to PhP200,000 for theMILALITTRA PES. Moreover, pledges of commitments were also signed bythe Mindanao Alliance Self-Help Society–Southern Philippines EducationalCooperative Center (MASS-SPECC), Bukidnon PharmaceuticalMultipurpose Cooperative (BUPHARCO), First Community Cooperative(FICCO), National Federation of Cooperative Primaries in the Philippines(NAFECOOP), Oro Savings and Sharing Cooperative (OSSC), and thePhilippine Federation of Credit Cooperatives-Mindanao League (PFCCO-ML).

Lessons Learned

he Buhid Bangon tribe has many sound policies and plans butproper implementation and good management remain a bigchallenge for them. The registration of the Faganoon Furohayo in

the National ICCA Registry does not necessarily mean that it will solve theproblem of illegal activities; more work is needed to fully protect the forests.

The government should fully support Buhid Bangon and empowerthe indigenous community. Regular monitoring of the IPs living in theforests is important, since the IPs guard their environment and their lands,hence, the need for the government to support their local and indigenouspolicies.

Dialogues with neighboring tribes, other IP communities and non-IPcommunities need to be conducted on a regular basis to have better andcommon actions in protecting the forests.

IPs learned the importance of technology in monitoring the foreststhrough the use of GPS, computers and maps.

Ways Forward

roper agreement between DENR Region IV, BMB and the tribesneeds to be forged to ensure that the ICCA will be protected anddeveloped by its indigenous peoples. Likewise, the continuous

and continue the dialogues for the implementation of plans to effectivelypreserve the forests.

The IPs can also consider the possibility to make programs relatedto PES that have good impact on IP community and their lands.

Representation of the IPs in the local development council needs tobe realized to empower the IP community. Lastly, the awarding of CADTwill secure the lands of the IPs.

Case Presentation 3: The Case of Mt. Hilong-Hilong

everal issues affecting the Manobos and Mamanwas were sharedby Mr. Catarman and Mr. Anlagan, such as the frequent conflictsbetween the two tribes, continuing discrimination they suffer where

people still make fun of them, prevalence of poverty which caused them toforsake their culture and abuse their environment, encroachment activitiessuch as rampant mining and logging made worse by militarization, and thelack of trust in the government and other organizations due to the belief thatthey have not been truthful to the IPs.

Implemented Activities

hey had performed the traditionalritual of Kahimunan for theBinantasan ng Banwa as a symbol

of peace for the Manobo and Mamanwa.They both agreed that it is important forthem to give attention to their environment.They launched consultations and dialoguesthat paved the way to open their minds onthe importance of forging partnerships toaddress the different issues in their area.

They conducted documentation and mapping of their ICCA thathelped them know each other’s beliefs and traditions, and learned the

importance of the ICCA. Moreover, the resource inventory and creation ofthe community conservation plan (CCP) made them understand deeper theneeds of their environment and communities.Results

he Mamanwa and Manobo are now united and aware of theiridentity because of their ICCA, which are now protected. Thiseventually can lessen the mining activities in the area.

The tribes regained their trust with the government as they see themnow as partners in protecting the environment.

Way Forward

he Mamanwa and Manobo tribes will continue to implement theirplans and build strong partnership with the government for theprotection of the ICCA. More trainings are needed to fully equip the

IPs. The creation of CCP is big step for them, but they still need to finishtheir ADSDPP.

Case Presentation 4: The Case of Banao

which include the full documentation of the Banao community, developmentof the seven thematic maps, and the formulation of the CCP of the BanaoICCAs.

Implemented Activities

ommunity consultations orbarangay assemblies werelaunched in Pantikian, Talalang

and Balbalasang and were participated by448 households. The Banao tribeexpressed their acceptance to the projectthrough a resolution endorsed by theSangguniang Bayan of Balbalan. Representatives from the DENR Regionaland Provincial Offices assisted the Concerned Citizens of Abra for GoodGovernment (CCAGG) project facilitators during the conduct of theorientation meetings. Two NCIP representatives witnessed the conduct ofthe meetings and spoke on the Indigenous Peoples Rights Act (IPRA).

The resolutions of the three barangays accepting the ICCA Projectwere submitted to the NCIP Provincial Office, including the processing ofthe FPIC and certificate of precondition.

Three community researchers attended the indigenous knowledgesystems and practices (IKSP)) Orientation Workshop on the Lapat—BanaoIndigenous Resource Management System—and were trained in datagathering on the Banao’s traditional farming systems, customs on burial,community work, construction of communal irrigation systems, on building

houses and community values. This resulted to the documentation of IKSPtitled “O-od ji Banao, a Watershed Heritage of the Banao Tribe.”

The Banaos have their own traditional and indigenous system ofprotection and conservation of communal watersheds, communal forests,rivers and endangered plants and wild animals, rare trees and criticalresources that are within their domain. It is called lapat or palit, whichmeans prohibit or regulate. According to them, lapat is a ‘legacy’ theyinherited from their forefathers.

The organizational capacity self-assessment (OCSA) of the BanaoBodong Association (BBA) revealed that association is strong in terms ofleadership and has established its own organizational managementstructure. On the other hand, the implementation of its policies, systemsand procedures is weak. The organization needs more training on financialmanagement and enterprise or business development.

Banao and Balatoc Council of Elders’ meeting and ICCA actualresearch and documentation were part of the focus group discussions(FGDs) to generate data. Using the 3D map, the community had locatedtheir lapat areas and areas of significance to undertake the resourceinventory and validation. Field research for bio-physical data and resourceinventory was conducted with the assistance of PAFID and DENR-Cordillera Autonomous Region (CAR).

A community conservation planning worskhop was conducted forthe lapat, which is divided into the following areas or land-uses:

There were also unplanned activities which happened, such as theBanao-Balatoc dialogue where both tribes signed a MOA stipulating theagreement declaring the conflict area “untouched” or as a commonprotected area, while they proceeded on their ICCA documentation andregistration. Their participation in the training of local researchers inImugan, Nueva Viscaya on actual field research and documentation, andtheir cross-visit to Cabangan, Zambales were also unplanned activities.

A training workshop on geographic information system (GIS)mapping was conducted with some technical staff from PAFID as resourcepersons in thematic maps formulation. This produced the Banao ICCAmaps that were finalized by the DENR-CAR.

A. Strengths:

he existing/established organizational structure of the BanaoBodong Association (BBA), which exercises consensus decision-making, helped in its implementation of activities. Its strong belief to

IKSPs, the use of traditional justice system in settling conflicts and othercrimes (amicable settlement), existence of bodong (peace-pact with othertribes) in the whole Banao ancestral domain (with its tribe, resources,culture and traditions) are considered strengths.

The support of the local government in the municipal and barangaylevels is also considered a favorable factor. The existing barangayordinances on environmental protection indeed were helpful in thepursuance of the ICCA.

Community cooperation, unity and acceptance to engage with lineagencies and NGOs are positive factors in the implementation ofdevelopment projects.

C. Opportunities

he presence of technical, financial and project managementsupports from FPE, UNDP, DENR-CAR, NewCAPP projectmanagement, CCAGG and other partners like PAFID brought about

by Project Management Unit (PMU) coordination and collaboration is agreat opportunity for the BBA. Both tribes (Balatoc and Banao) haveinterest to settle their conflict regarding their boundary. The NCIP’sassistance for Balatoc and Banao CADT application and as mediator intheir conflict settlement is also a window for smooth implementation. Inaddition, the presence of the Protected Area Management Board (PAMB)provides augmentation for the protection of Balbalasang, Balbalan NationalPark.

D. Hindrances:

hree hindrances in the implementation of activities were identified,such as the presence of boundary conflict with other tribes likeBalatoc and Gubang, bad road conditions during rainy season that

cause delays in implementation, and communication inaccessibility.

E. Facilitating Factors

he facilitating factors that contributed to the implementation of theproject were the participation of multistakeholders, the continuinginterest and support from the LGU of Balbalan particularly the

F. Project Results

he full documentation of the Banao community in Balbalan, Kalingawas completed, at least seven thematic maps were developed, andthe community conservation plan of the Banao ICCA was

formulated.

Implemented Activities

he peace process between theBanao and Balatoc tribes wereforged through the NewCAPP

ICCA program. The two tribes were able tocome together, even after long years of animosity, to discuss how to solvetheir long standing disputes, and how to protect their ancestral domainsfrom exploitation and destruction.

Initial meetings with the tribe elders and leaders were coordinatedand conducted separately with the two tribes. NewCAPP acted ascoordinator, at the same time, the peace negotiator.

Community consultations and peace agreement between Banaoand Balatoc tribes were critical and very important because it openedpossibilities for ICCA registration for both tribes. The most importantagreement then was for both tribes to proceed with ICCA registrationprocess but to exclude the conflict area in their maps. This means that theconflict area will remain as a conservation area for both tribes.

The Balatoc Kalinga Tribe as Local Responsible Partner

new scheme was adopted by NewCAPP to consider theindigenous peoples organization to conduct the documentationprocess of their own ICCA application, an opportunity for a greater

Open Forum

Discussions during the open forumhighlighted the value of ICCA inbiodiversity conservation, upholding IPculture and integrity and, resolvingconcerns on ADSDPP, land tenure, andresource sustainability. The followingwere some of the recommendations thatwere forwarded in the forum:

(1) The expansion of ICCA coverage toinclude water resources and other areassuch as territory of the Tiruray Tribe inthe Maguindanao region; Brgy. Dibod,San Luis, Aurora; Brgy. Marine Norte,

San Andres, Romblon; San Antonio, Nueva Ecija;

(2) The recognition of the role of IP women in the ICCA process;

CULTURAL NIGHT

he cultural night was organized to provide a venue for participantsfrom various sectors to socialize and exchange insights on ICCAand IP-related concerns. The activity also served as a means to

showcase IP culture through indigenous dances and musical presentations.

The program began with a cultural dance presentation from theCordillera people, followed by an energizer, gangsa musical presentation,and an indigenous chant from the Kalinga. A song number from theDumagat and a dance presentation from the IPs of Mindanao were alsoperformed.

The speakers include Dr. Vincent “Toto” Hilomen, executive directorfor Priority Programs of the BMB, who made a recollection about his yearsin the University of the Philippines, and how the cultural night is reflective ofthe solidarity of the IP community, and Reynaldo Dingal, administrativeofficer of the NCIP, who expressed his gratitude for the event and brieflytalked about the ADSDPP which would be discussed in the next day’sconference session. The program concluded with an acapella performancefrom the DENR.

SESSION 3: ADSDPP AS A BIODIVERSITY CONSERVATION

MECHANISM

The ancestral domains sustainabledevelopment and protection plans(ADSDPP) is rooted behind the variousprovisions under Chapters III and IV ofthe Indigenous Peoples’ Rights Act orRepublic Act No. 8371 outlining therights, duties, and responsibilities ofindigenous communities when it comesto developing, maintaining, harnessing,and protecting their ancestral domains.Moreover, the said provisions of theIPRA strengthen and justify the claims ofownership and stewardship of IPs of theirown respective ancestral domains.

While ADSDPP is not a requirement, neither is it a pre-requisite ofgetting their ancestral domain titles and claims, the ADSDPP rather servesas a manifestation of the genuine intent of IPs to improve, maintain, andserve as stewards of their ancestral domains. Like any other type of plan,the ADSDPP outlines in the most concrete terms the means and themechanisms whereby IPs can improve and steward the land.

As such, the documentation of indigenous practices serves as aninstrument to enhance and harmonize the ADSDPP and the protectedareas (PA) management plan. The best practices in support of theADSDPP were discussed in two case studies in Mindanao. Mr. Owen

Decena presented the conflict sensitive resource and asset managementprogram (COSERAM) implemented in the Agusan Marsh, while Ms. ErlindaMalo-ay and Mr. Joping Malo-ay discussed the experience of the Mat-I,Man-ibay, Civoleg and Langguyod (MAMACILA) organization, a federationof Higaunon tribes from Mat-I, Man-ibay, Civoleg and Langguyod, in theBantay Kalikasan project.

The case of Agusan Marsh showed the significance of participatoryaction research (PAR) in enhancing IP participation. Majority of the keybiodiversity areas (KBAs) of the IPs in Caraga Region overlap with theirancestral domains. In the beginning, this caused several problems andtension among the local government, the NGOs/developmentorganizations, and the IPs. Another main roadblock to this initiative is thediffering views of indigenous practices in documentation as compared tothe academic research process. Eventually, they were able to come up witha mechanism to incorporate indigenous practices in documentation, withoutcompromising academic processes. The result of this initiative is the PAR.

The greater involvement of the IPs in the COSERAM produced aculture-sensitive and conflict-sensitive plan as well as fostered ownershipamong the IPs, leading to increased acceptability during programimplementation. Together with the local government, they underwent aseries of consultations to discuss the possibilities where the IPs and theentire community could participate. During these consultations, they wereable to identify goals and strategies that are aligned with the practices ofthe community. Specifically, the IPs were involved in the decision-makingand implementation of the program, wherein they were primarily involved inthe documentation and guarding of their ancestral domains.

While the PAR proved beneficial, Mr. Decena emphasized that theprocess was tedious and time-consuming. Hence, it is recommended thatthe procedure must be designed in line with the community process. It mustlikewise foster collaboration and harmonize the political structure of IPgovernance system as management bodies.

The case of MAMACILAorganization in Claveria, MisamisOriental was presented by itschairperson, Erlinda Malo-ay andMr. Joping Malo-ay, overallchief ofBantay Kalasan. It is largely aboutthe community-based approach inthe conservation of Mt. Balatukanforest margins. She first discussedthe importance of MAMACILA’sCADT area, which covers more than17,000 hectares. It is a KBA, whichis home to the Philippine eagle andother significant flora and fauna likethe lauan, apitong, wild pig and deer,

among others. It is also the home of Cabulig Watershed, the headwater andthe third largest watershed in Misamis Oriental. It supports severaldownstream industries like fishing, and eight hydroelectric powerplants.

Ms. Malo-ay described the processes involved that resulted in apartnership between the Higaonon tribes, Landcare Foundation of thePhilippines, Inc. (LFPI) and PTFCF in implementing two successfulconservation projects in the area: (1) the community-based conservation ofindigenous trees - rainforestation at the Cabulig and Mt. Balatukan Forest

Margins; and (2) the expansion of community-based conservation ofindigenous trees - rainforestation at the Cabulig and Mt. Balatukan ForestMargins. It includes capability building among locals on forest conservationpractices that can also be turned into livelihood development activities, likeseedling propagation and abaca production. These activities were later onpromoted and extended its coverage to other barangays and municipalgovernment units. Moreover, the recognition of the Higaonon’s traditionalmanagement system and structure called Bantayan Kalasan (BK)—theforest guards—was incorporated in the new management system.

The partnership not only provided an opportunity for greater IPinvolvement but likewise paved way for the sustainability of the two projectsthrough the subsequent support provided by the municipal government.These include financial support in terms of monthly honorarium for the BKand inclusion of the BK in the municipal budget since 2011, provision forsupply paraphernalia for monitoring, training for BK second-liners andimplementation of sustainable livelihoods such as abaca production andagroforestry. Moreover, the involvement of the Higaonon tribes as BKempowered their role in protecting their ICCA.

Two presentations from Datu Alfonso Tumopas of the Menuvu Tribeand Ms. Elsa B. Dioayan of Tubo-Boliney showed that efforts towardsintegrating indigenous management systems in contemporary governmentframeworks are promising and favorable for both IPs and governmentinstitutions.

area management plan (PAMP) proved difficult in the initial stages ofintegration. While the Menuvus recognize their own system of managingMt. Kalatungan Range Natural Park, the DENR and the LGU struggled tounderstand and incorporate the system in their own management plans. Tobridge the gap, the Menuvu tribe, in partnership with PAFID, DENR-Region10 and UNDP-GEF NewCAPP, documented their ICCA and designed theirCCP. These efforts led to a plan harmonization workshop between theMenuvu tribe, DENR Regional Office and the LGU, which resulted to theintegration of the Menuvu’s CCP into the PAMP. The Menuvu’s strategy totranslate and contextualize their traditional management system within thePAMP framework enabled a collaborative enterprise in designing amanagement plan for Mt. Kalatungan without compromising their traditionalmanagement system.

At present, they maintain good working relationships throughconstant coordination with the local government and NGOs that helpedthem come up with the CCP. They are also coordinating with otheragencies to acquire funding to improve their existing livelihood programs,like upgrading their indigenous weave products and business expensesavings training. They are very keen and positive in maintaining theseworking relationships with various agencies because they have seen thegreat benefits of collaborative efforts in conserving their ICCA. DatuTumupas even requested that the same officials who helped them at thestart of the initiative to assist them further in the continuation of the projectin preserving and protecting their ICCA, especially in the implementation ofthe CCP and crafting of ADSDPP.

Lapat Module: Product of Maeng Tribe and DepEd’sCollaboration in Tubo, Abra

Ms. Elsa B. Dioayan of Tubo-Boliney unveiledtheir experiences in the integration of thelapat in the Department of Education’s(DepEd) local school curriculum in Tubodistrict. Lapat is the Maeng’s indigenousresource management systems andpractices. It is called “kaynga,” which meansto take care. They have been using it toprotect around 2,600 hectares of flora andfauna in the Maeng of Tubo ancestral domain.

The primary objective of including the lapat in the curriculum is toincrease the appreciation, awareness, consciousness, and understandingof the people on the indigenous environmental management practices ofthe Meang Tribe of Tubo, Abra. The drafting of the Lapat Module involvedseveral steps including a writeshop, presentation to local special bodies,lobbying to the Sangguniang Barangay for the endorsement to theDepartment of Education, and finally, the submission of a resolution.Afterwards, they conducted a series of meetings and consultations toreview and finalize the Lapat Module that will be included in the elementaryand high school curricula.

The main topics of the Lapat Module include the functions of lapaton environmental protection, fishing, solid waste, conservation of naturalresources and climate change for sustainable development, and TuboLapat Association (TULAS) to name a few. The high school module

includes the impact of human activities (fishing, kaingin, hunting etc.) andsolid wastes in the ecosystem, biodiversity, and climate change.

Collectively, their initiatives and cooperation with the local andnational government agencies and NGOs produced better understandingand appreciation of the Maeng of Tubo ancestral domain. These efforts hadalso led to the recognition of the sustainable traditional indigenous forestresource management systems and practices (STIFRMSP) of DENR andNCIP, and formal partnership among DENR, NCIP, LGU-Tubo and theMaeng Tribe. Moreover, the lapat became an integral management systemrecognized by the municipality.

Open Forum

he discussions in the open forum focused on strategies to assistIPs in securing and protecting their ICCAs. The recommendationsinclude: (1) the need for a more convenient and efficient

mechanism in negotiating with the IPs to produce immediate governmentaction in their favor, (2) faster ICCA registration process, and (3) formalrecognition among IP tribes to manage their own water resources. A lot ofIP leaders came up and expressed their concern with industrial activitieslike mining and other extractive industries in their ICCAs. They suggestedthat there should be a way to register their ICCAs faster to protect it fromextractive industries. Relative to that, one IP leader suggested that IPsshould be given the right to manage their water resources. Therefore,permits or other forms that give authority to harness their water resourcesto the LGU/NGA or private entities should not be allowed.

An Overview of the ADSDPP

The ADSDPP, in essence, is a consolidationof the various plans of IPs in terms ofdeveloping and protecting their lands,enriching their IKSPs; and improving thehuman resources within their ancestraldomains. It is a long term plan that embodiesthe various goals and aspirations of the IPs ina given indigenous community.

The ADSDPP is recognized as a tool forthe empowerment of indigenous cultural

communities (ICCs)/IPs towards the fulfillment of the general well-being ofthe current ICC/IP generation without compromising the needs of futuregenerations. The ADSDPP is also expected to (1) ensure the compliance of

ICCs/IPs to their responsibilities to maintain ecological balance, restoredenuded areas as well as to observe the requirements of the IPRA; (2)facilitate the conduct of the FPIC process; and (3) provide a checklist ofprioritized development programs/projects as ready reference forcollaborative efforts with development partners and/or grant of assistanceto ICCs/IPs in an ancestral domain.

ADSDPP Guiding Principles

he NCIP issued Administrative Order (AO) No. 1, series of 2004,which provided the guiding principles in formulating the ADSDPP.First, ADSDPPs must follow the rights-based approach to

development. It must highlight the importance of both the inherent humanrights and the indigenous peoples’ rights in crafting of the long termADSDPPs.

Second, the ADSDPP has to be holistic, comprehensive, andintegrated. It must be noted that the ADSDPP is a conglomeration of thevarious plans within the ancestral domain. It contains not only thedevelopment plan of the ancestral domain, but it must also contain plans onthe utilization of indigenous knowledge, skills, and practices. The ADSDPPmust not only be a compilation of stand-alone and heterogeneous plans. Itmust be able to integrate as well as merge the seemingly different plans ofthe IP community.

Third, the ADSDPP must be community- or people-driven. At thecenter of the ADSDPP are the members of the indigenous community. Totruly own and reflect the development aspirations of the IP community, the

crafting of the ADSDPP must not only be placed on the hands of the IPsthemselves, rather, its contents must be favorable to them as well.

Fourth, the ADSDPP must embody freedom of initiative and self-reliance or non- intervention. This means that economic opportunitiescreated by the state must also be extended to the IPs, however, the IPsshall be given a free hand in determining their own track of development.This rests on the notion that the IPs are in the best position to know what isbest for them.

Fifth, the ADSDPP has to be culturally sensitive. It has to take intoconsideration the cultural intricacies and uniqueness of the indigenouscommunity. It shall serve as a mechanism for the protection and promotionof the cultural heritage of the IPs.

Sixth, the ADSDPP has to be gender responsive. In the crafting ofthe ADSDPP, specifically in the laying down of the situationer, the planmust be able to capture the gender status in the community, and provideclear cut solutions to address gender issues should they arise.

Seventh, the ADSDPP formulation must be consultative. Allstakeholders must be taken into consideration. IP and non-IP communities,particularly those that may be affected by IP policies as a result of theADSDPP, must be sufficiently and genuinely consulted.

Finally, the ADSDPP and its formulation process must be iterativeand strategic. Once the plan is crafted, it does not mean that it will remainas it is. It must be dynamic and able to adapt to the changing times and totechnological and social developments.

Components of the ADSDPP

he ADSDPP, which requires at least five years of programming,has three important components - the ancestral domain andcommunity situationer, development plans and programs, and

implementation policies and mechanisms.

The situationers include the ancestral domain situationer, thecommunity situationer, IKSPs, and the development needs of the ICCs andtheir ancestral domain. The ancestral domain situationer must contain theprofile as well as the environmental and ecological conditions of theancestral domain. The community situationer must present the history ofthe tribe, their origins and their formation. It must also discuss the life,practices, and cultural systems as well as the status of human developmentin the community. The IKSPs must be able to document indigenouspractices in terms of ownership, watershed management, resourcegeneration, and sustainable practices that have been employed by the IPcommunity in the stewardship of their ancestral domain. Under thedevelopment needs component, the ADSDPP must sufficiently reflect theissues and extent of problems that the community is facing.

The development plans and programs component contains theactual programs and projects that the community seeks to establish orimplement within their respective ancestral domains. It begins with theactual conduct of spatial measurements so as to determine the territory ofthe community. Moreover, it contains the protection and conservation plansfor flora, fauna, and the general environment in the community. Theprograms and plans address the identified problems and issues andconsider a strategic approach.

The implementation policies and mechanisms component containthe means and the actual strategy in plan execution. It has regulatorymechanisms and instruments that will serve as tools to regulate the use ofland, air, and water resources in the community. The implementationschemes must be cognizant of the full ownership and accountability of thecommunity in the actual realization of sustained development of the ICCand the IPs. Likewise, they also outline the means of sharing the benefitsand profits, if there are, and provide mechanisms for shared responsibilitiesamong the members of the tribe and the community.

It must be noted that the community is being empowered to pursuetheir own ends, socially, and economically. Hence, they must be able topresent, package, and market their respective plans to governmentagencies, funding institutions, and to other indigenous communities. Theprivate sector as well as international institutions can be strategicallytapped, not only as a source of funding, but also as partners in sustainabledevelopment. Monitoring and evaluation system should also be put in placeto determine the progress of the ADSDPP implementation, which must betracked and corrected if ever it veers away from its original objectives.

The ADSDPP Formulation

he ADSDPP process has ten basic steps. The culmination of theADSDPP is with the submission and integration of the approvedADSDPP into the NCIP plans and programs and in the LGU plans

wherein the ancestral domain is located.

1. Pre-planning consultations. These entail informing the IP community oftheir rights and roles as well as getting their commitment in the

formulation of the ADSDPP. Members of the group who will be formingthe ADSDPP are identified in this step.

2. Formation of the working group for the crafting of the ADSDPP. Themembership of the group must be diverse and must include the variousstakeholders including the IP community. The work and financial planmust be prepared to ensure the continuation and smooth drafting of theplan. It must include the timelines, the expected outputs anddeliverables, as well as the budgetary requirements of the lined-upactivities.

3. Data gathering and assessment. This step includes gathering baselinedata and first hand information about the geo-physical, social,economic, structural, and cultural situation of the ancestral domain. Thedocumentation must include the population, natural resources,livelihood situation, the IKSPs, land use, water management uses, andother concerns.

4. Formulation of the framework of their chosen path to development.Their development framework must be guided by sustainable andrights-based approaches and principles, be written in the language thatis understood by all the members of the community, and subsequentlybe translated into English.

5. Interface of the development framework with existing government plansand programs to maximize the benefits and impacts, and minimize theduplication of functions. Government agencies are to be invited topresent their existing government programs and plans for thecommunity so as to fully apprise them of their development options and

6. Identification and prioritization of programs and projects. The programsand projects identified will be presented and would include possibleimplementation mechanisms.

7. Formulation of the ADSDPP implementation strategies andmanagement plan. This contains the proposals on how the programsand projects would be carried out, including the monitoring andevaluation tools that will be utilized.

8. Scrutiny and approval of the ADSDPP by the members of thecommunity and its submission to NCIP. The working group will conductcommunity assemblies wherein they will present the draft ADSDPPprior to its submission to the NCIP.

9. Incorporation of the ADSDPP into the plans of the NCIP and itssubsequent inclusion in the budgetary allocations of the Commission.

10. Inclusion in the LGU development plan. The approved ADSDPP willalso be transmitted to the LGUs for incorporation into their respectivedevelopment plans.

Role of NCIP in the ICCA and ADSDPP Process

he NCIP is mandated to perform key support roles in ensuring thatthe respective ADSDPPs of IP communities are properly craftedand implemented. Article V of AO No. 1, s. 2004 specifically calls

on the NCIP to assist and support communities in the formulation,implementation, and monitoring of their respective ADSDPPs. Moreover,they are also mandated to provide capacity building to ICCs and IPs.

To fully understand the role of NCIP in the ADSDPP process inparticular, and in the implementation of the IPRA in general, it would beadvantageous to look into the entire planning process of the NCIP.

The organizational performance indicator framework (OPIF) servesas the guiding mechanism for the NCIP. ICCA forms an integral part of theNCIP planning process as embodied in their major final outputs (MFOs).Their MFOs are four-fold: indigenous peoples and cultural communitiespolicy services, ancestral land and domain titling services, human andeconomic development services; and indigenous peoples rights protectionservices.

Their first MFO, the crafting of policies and guidelines, subsumesthe creation of the ADSDPP guidelines. A crucial MFO wherein the ICCAand the ADSDPPs are contained is in their third MFO—human andeconomic development services. In here, they provide assistance to theADSDPP formulation in compliance with the mandate contained in AONo.1. Moreover, they also provide assistance in socio-economic services,education and advocacy programs, and in IP culture and health programand services.

There are two major sources of the plans of the NCIP. One, theseplans are culled from the Millenium Development Goals, the PhilippineDevelopment Plan, their identified key result areas, and even from the IPRAitself. The other source of the NCIP plans is the ADSDPPs that aresubmitted to them. It must be remembered that the ADSDPPs that aresubmitted to the NCIP are integrated into the agency’s own plans andprograms and are included for appropriation in its budget proposal.

The NCIP also coordinates with different stakeholders and ensuresthat indigenous communities submit their plans to the NCIP forincorporation in their budget requests to Congress. The NCIP alsofacilitates the crafting of proposals.

Budgets are then prepared and included in the proposed agencybudget to Congress which the latter authorize or legislate. The budget thengoes to budget execution or the implementation of the projects of theagency. Capping the cycle is the performance monitoring where it will bedetermined whether or not the goals of the program have been met andaccomplished.

As of the latest updates of the NCIP, there are 166 areas alreadywith CADTs, 145 are in different stages of delineation and titling, 57 are inthe process of conversion from CADC to CADT, 363 are with pendingCADT applications, while there are 340 areas that are already identified butwithout applications yet. In total, there are 1,071 CADCs and CADTs indifferent stages of accomplishment.

about the ADSDPP, Director Quilaman facilitated the workshop proper. Theplenary was divided into four workshop groups. Each group was assignedto a specific provision of the ADSDPP to discuss.

Group 2 presents the proposed amendments under Article II of the ADSDPP Guidelines

The groups are expected to review and provide inputs andcomments on the provisions assigned to them. The following provisionswere distributed to these groups: Article 1-Preliminary Provisions; Article 2-Basic Components of the ADSDPP; Article III- ADSDPP Formulation; andArticles IV- Support to ICCs/ IPs for ADSDPP Formulation, Article V-SpecialProvisions, and Article VI- Final Provisions. The different groups sharedtheir inputs using metacards and assigned among themselves adocumentor and a rapporteur.

Ms. Isaac emphasized that theNEDA will continue to support in upholdingthe rights of indigenous peoples and infacilitating their development, respectingtheir own unique cultures and practices,through the following:

1. Incorporation in the PhilippineDevelopment Plan

The PDP 2011-2016 midterm updatehas included the unique considerations ofthe IPs in the national development

process. In particular, the Plan targets to implement innovative financemechanisms and/or options for effective and efficient management ofthe environment and natural resources by empowering indigenouspeoples to harness the potential of protected areas in ecotourism.

In addition, the Plan also pursues strategies that will help the IPsgain better access to justice as well as to peace and security through: a)strengthening processes towards full recognition of certificates ofancestral domain title, b) establishing mechanisms to protect IP rights,c) complying with the International Convention on the Elimination of AllForms of Racial Discrimination and Convention of the Rights of theChild, and d) ratifying the International Labour Organization ConventionNo. 169, or the Convention on Indigenous and Tribal Peoples.

2. On ICCA

According to Ms. Isaac, the IPs are recognized for having a majorrole to play in managing the environment and natural resources,particularly as stewards of protected areas. Recognizing this criticalrole, through the concept of ICCA, will facilitate effective managementof the environment and natural resources using community-basedmanagement principles, anchored on existing indigenous practices.

3. On NEDA’s role in the NewCAPP

As a member of the NEWCAPP Project Board, NEDA will continueto support the project’s implementation towards expanding andstrengthening the terrestrial protected system by forging strong links tolocal communities and indigenous peoples through integration of newconservation areas.

Commissioner Antonio M. BernardoHousing and Land Use Regulatory Board (HLURB)

Commissioner Bernardo stressed the HLURB’sutmost support in the implementation of the ManilaDeclaration of 2012, specifically on the formulation ofpolicies and establishment of processes for therecognition and support of ICCAs and the integrationof ICCA plans into the local land use plans.

The lCCA plansto be formulated by the indigenous peoples will likewise be considered andadopted in the spatial planning of areas covered by their territories.

Ms. Anna BrillanteInternational Land Coalition (ILC)

Ms. Brillante explained that the InternationalLand Coalition is a global alliance of CSOsand intergovernmental organizations. Sheprovides that their work is on land, access,and control over land, for poor men andwomen, including the IP sector.

ILC has funded the documentation initiatives on some cases on theeffects of mining in Asia, including the Philippines. In the Philippinesspecifically, ILC is working with PAFID, Xavier Science Foundation andother CSOs. ILC has supported the spatial planning and map generationactivities of PAFID, like those used by the IPs in South Cotabato. The ILCsupported Xavier Science Foundation in their assistance to the TalaandigTribe. The ILC also provided support to Pakisama in its assistance to theAgtas in Aurora Province.

ILC will continue to support different groups in their documentationinitiatives and also in the protection of the land and the ancestral domains.

Mr. Genaro ‘Gen’ CastroUN Food and Agriculture Organization (UNFAO)

According to Mr. Castro, UNFAO, as aUN agency focused on agriculture andfood, supports the aims and aspirationsof the ICCA. He shared the differentprograms of UNFAO that address theneeds of IPs. One of these is the globallyimportant Agricultural Heritage, aprogram of UNFAO and otherinternational organizations whereinUNFAO recognize the importantagricultural heritage systems around theworld, one of which is in the Philippines. Mr. Castro explains the role of UNFAO

in promoting ICCA

In the past four years, the Philippines has been part of the program, butonly one area has been included in the global list - the Ifugao rice terracesin Hungduan and Kiangan.

UNFAO, with DENR and DA, would want the agricultural heritagesites to be known worldwide. He also provides that UNFAO envisions tohave a nationally important agricultural heritage system. Mr. Castroexplained that UNFAO have been pushing for this since it was envisionedas a mechanism or way for protection of the important agricultural heritagesystems. It is also a means for dynamic conservation, which can be utilizedto garner support from other funding and international bodies.

UNFAO will continue to push for and support this program inpartnership with relevant government agencies. Mr. Castro emphasizedthat UNFAO would want due recognition and support for our heritage sites.

Mr. Rolando ArbanInternational Fund for Agriculture and Development (IFAD)

Mr. Arban explained that IFAD is part of theUN system. Its priority programs, aside fromagriculture, are in nutrition, food securityand rural development.

IFAD has a policy on engaging withIPs. IFAD hosts an annual gathering of IPsin all countries where the organization has aMr. Arban explains the IFAD and its

presence. The Philippines is included in this year’s regional gathering ofIPs.

The engagement of IFAD with IPs in the Philippines, dates back asearly as the 1990s. IFAD has worked in the formulation of the ADSDPPsand has helped in the livelihood of IPs as well as in the strengthening of IPsystems. IFAD works in the Cordilleras and in Mindanao.

IFAD continues to commit in assisting the IPs because it is the heartof IFAD—to provide assistance in the livelihood and mapping of theirterritories, especially in the highland areas.

Mr. Uychiaoco thanked the body for theircontinued trust to GIZ. He also thanked thegroup for continuously engaging with them intheir various initiatives.

GIZ commits that they will continue toinclude the IPs in whatever they are doing,especially in their areas where IPs also reside.

Ms. Tena expressed thanks for thecontinued trust of the stakeholders on theNewCAPP Project of the UNDP.

Aside from the NewCAPP, sheinformed the participants on another projectthat may help the ICCA - the BiodiversityPartnership Project. In addition, UNDP isworking closely with the NCIP in theimprovement of the ADSDPP guidelines.There are also small grant programs withBMB, which seek to support theestablishment and management ofconservation areas like the ICCA. Anotheraim of the project is to showcase theeconomic potential of biodiversityresources. This means that whoever is

protecting the natural resources, they should also be deriving somematerial benefits from them.

There are also programs that seek to provide more venues forparticipation of IPs. Together with the NCIP, the UNDP is working for themandatory inclusion of IPs in the local government processes, thedocumentation of customary laws and practices, and in the learning centerof indigenous knowledge.

The UNDP is also developing several programs in partnership withthe BMB and NCIP, which include the National ICCA Project. The UNDP iscoordinating with the ICCA Consortium with regards to the implementationof the National ICCA Project.

Atty. Canivel thanked the organizers,saying that the Conference is alsovery important to PTFCF. PTFCFhas learned a lot of things throughthe Conference - the practices,procedures, indigenous knowledgeon protection and conservation,among others.

PTFCF assures that it willshare what it has learned to itspartners in other areas. Moreover, insupport to the initiatives, thePTFCF’s call for proposals for 2015has already been posted. PTFCFcan fund programs that deal with anyof the different initiatives listed in themanifesto of commitment.

National Anti-Poverty Commission (NAPC)

Ms. Raymundo explained the IP SectoralCouncil (IPSC) sectoral agenda andhighlighted the accomplishments of theIPSC.

The following are the five thematicpolicy agenda formulated by the IP sectorduring the 2011 National Sectoral Assembly:

Respect IP rights to self-determination;

Review the implementation of IPRAand reform NCIP;

Provide and prioritize the delivery ofbasic social services to communities;

Protect the IPs from developmentaggression, human rights violationslike killings of IP leaders, andmilitarization; and

Recognize the role of IPs in peaceprocesses.

1. Fast tracking the issuance of CADT and CADC

In 2012, the Council spearheaded the organizing of an inter-agency dialogue in Polomolok, South Cotabato primarily aimedto expedite the resolution of CADT/CADC and CLOA overlaps inthe area that for years have already cost the lives of IP leaders.Agencies and LGUs present during the dialogue had pledgedtheir respective commitments for the resolution of cases andissues. Earlier in 2012, the joint memorandum circular (JMC)and joint administrative order (JAO) on administering land titlingunder CADT and CLOA were signed aiming to address thePolomolok conflict, but instead, these caused morecomplications to the already complicated case and causedfurther delay in the resolution of the case.

2. Ratification of International Labour Organization (ILO) 169

The Council has established coordination with the Office of Rep.Baguilat and Rep. Catamco in pursuing the initiative to ratify theILO treaty in the country.

It co-sponsored the March 2014 Indigenous Peoples-Government Dialogue on the Ratification of ILO 169 with theOffice of Rep. Baguilat, where the output was DOLE’spronouncement to assign to NCIP the lead role in the facilitatingthe ILO ratification since NCIP has the mandate and capacity onIP concerns.

3. Policy Review

On FPIC, the Council has staged a dialogue with the NCIP-ADOoffice during the second and third quarter meetings in June andAugust 2014, respectively. In the June dialogue, representativesfrom the IPOs identified and presented their respective issuesand concerns with NCIP for case studies. A consensus wasdrawn on two common issues:

a. FPIC, in most instances, have yielded results favoringproponent/s of projects, concession or investors becausethese entities or individuals funded the FPICprocess/activities until a “yes” answer of the communityis gathered, these were made possible due to cooptedNCIP personnel;

b. Budget for the conduct of FPIC should be included in theNCIP annual budget.

On JAO 01-12 of DAR, DENR, LRA, and NCIP. With theexistence of said policy and procedures, NCIP has approved163 CADT applications covering 4 million hectares plus 2 millionhectares which are still in the pipeline. Of the 163 CADTapplications, 100 CADT applications have ADSDPP. There areabout 500 pending applications to be processed in thesucceeding year. Case studies presented in the June 2014dialogue with IP leaders and council members showed that thepolicy had caused the snail-paced processing of ancestraldomain claims. Likewise, almost no distribution of titles was

made despite the volume of approved CADT applicationspending at the NCIP. A policy review is needed to enhance anddistill policy issues, or probably call for the repeal of the saidpolicy.

4. On IP rights and the peace process

Two members of the IP Council sit as representatives of thesector to the government- organized body under Office of thePresidential Adviser on the Peace Process (OPAPP) on thedevelopment of the peace framework in Mindanao and ensuringthe rights of the IPs in the Bangsamoro Basic Law.

The IP Council denounced the killings of IP leaders and issued acondemnation statement on these incidents.

Commissioner Espana thanked theorganizers and all those who werepresent for the enriching and educationalconference where she learned a lot ofthings, foremost were with regard to theICCA. She admitted that it was her firsttime to really listen on what ICCA are allabout.

The Conference was anopportunity to demonstrate how the NCIPcan communicate with the differentgroups and individuals present, how they can work together to protect andnurture the environment.

She challenged the participants to find the best way to balancebetween utilizing natural resources, and at the same time working for itsconservation. She said that there are a lot of things that only nature canprovide, and that these have to be tapped.

She was grateful that there are open lines of communication and themeans for dialogue are in place.
