A LOS VOTANTES HABILITADOS RESIDENTES DE

LA CIUDAD DE CORPUS CHRISTI, TEXAS

SE AVISA que se Ilevara a cabo una eleccion en la ciudad de Corpus Christi, Texas el 6 de mayode 2017, PARA LA ELECCI6N DE ALCALDE, TODO apegado a una ordenanza presentada por laciudad de Corpus Christi, Texas el 28 de febrero de 2017, dicha ordenanza se recitasustancialmente de la manera siguiente:

Esta ordenanza decreta a una elección general que se llevará a cabo el 6 de mayo de 2107 en la ciudad de Corpus Christi para la elección de un alcalde que cumpla el término actual de ese puesto; autoriza, además, a una elección de desempate, para el 24 de junio de 2017, en caso de ser necesario; estipula las provisiones para llevar a cabo dicha elección; identifica a los oficiales de la elección; autoriza un acuerdo de servicios de elección con el condado de Nueces; y promulga las provisiones incidentales y relacionadas con el asunto y propósito de esta ordenanza.

EN VISTA QUE, la ciudad de Corpus Christi llevó a cabo una elección general el 8 de noviembre de 2016 para la elección de Alcalde y Miembros del Concilio;

EN VISTA QUE, el alcalde renunció a su puesto el 18 de enero de 2017, dicha renuncia fue aceptada por el concilio de la ciudad el 24 de enero de 2017;

EN VISTA QUE, existe una vacante en el puesto de alcalde;

EN VISTA QUE, el Artículo II Sección 12 (a) de la Carta de la Ciudad estipula que el resto de los miembros del concilio de la ciudad debe convocar a una elección para cubrir la vacante del puesto de alcalde en caso de quedar un año o más antes de su vencimiento;

EN VISTA QUE, la próxima fecha de elección uniforme para la elección especial es el sábado, 6 de mayo de 2017;

EN VISTA QUE, se estipula en la Sección 3.004 del Código Electoral de Texas que el cuerpo gubernamental decretará a elecciones pertinentes en asuntos municipales, y otras provisiones del Código Electoral estipulan el aviso y el nombramiento de oficiales para la elección que lleven a cabo dicha elección; incluyendo otros asuntos relacionados para llevar a cabo dicha elección;

EN VISTA QUE, dicha elección especial se llevará a cabo de acuerdo con las secciones del Código Electoral de Texas citadas en este documento;

AHORA, POR LO TANTO, DECRETA EL CONCILIO DE LA CIUDAD DE CORPUS CHRISTI, TEXAS, QUE:

SECCIÓN 1. Una elección especial de la ciudad (“la elección”, de aquí en adelante) para llenar el cargo de alcalde que aún no se vence se llevará a cabo en la ciudad de Corpus Christi, Texas el sábado, 6 de mayo de 2017. Una elección de desempate se llevará a cabo el sábado, 24 de junio de 2017, si es necesario.

SECCIÓN 2. La elección se llevará a cabo de acuerdo con las Leyes Electorales del Estado de Texas. Durante la elección, todos los votantes habilitados y registrados en la ciudad de Corpus Christi tendrán el derecho de votar.

SECCIÓN 3. Los nombres de los candidatos para el puesto de alcalde aparecerán en la balota de manera prescrita por la ley.

SECCIÓN 4. El sistema de votación electrónica aprobado por el Secretario del Estado para el condado de Nueces se adoptó para la elección: eSlate equipo de grabación directa (DRE). (Sec. 123.001).

SECCIÓN 5. La elección se llevará a cabo en los lugares de votación y en los precintos regularmente prescritos por la ciudad de Corpus Christi, como se documenta en el Anexo A, adjunto e incorporado para referencia y parte de esta ordenanza. El condado de Nueces participa en el Programa de Votación Municipal del Condado de acuerdo con la Sección 43.007, a como fue enmendada o sea que cualquier votante habilitado y registrado de la ciudad de Corpus Christi puede votar en la elección en cualquier lugar de votación identificado en el Anexo A. Cada lugar de votación, incluyendo el lugar de votación principal, servirán a todos los precintos de la elección. Los lugares de votación abrirán de las 7:00 a.m. a 7:00 p. m. el día de la elección.

SECCIÓN 6. Los jueces que presidan incluyendo los jueces alternos serán nombrados para la elección de acuerdo al Anexo B adjunto, incorporado aquí mismo, (Sec. 32.005). Si ninguno, ni el juez que preside, ni el juez alterno puede servir en la elección y si se dan cuenta de su incapacidad de servir después del 15avo día antes de la elección, el alcalde provisional, como funcionario del concilio de la ciudad, nombrará a un juez sustituto (Sec.32.007). Cada juez que presida nombrará no menos de dos y no más de cuatro empleados, uno de ellos será nombrado Juez Principal Alterno estipulado en (Sec. 32.031 a 32.033).

SECCIÓN 7. El Secretario del Condado de Nueces servirá como el secretario de votación tempranera, de acuerdo con los servicios de elección de los dos partidos (Sec. 31. 092). La dirección física del secretario de votación tempranera es la Corte del Condado de Nueces, calle Leopardo 901, Corpus Christi, TX 78401 (Sec. 83.010). La votación tempranera en persona en cada lugar temporario de votación se conducirá de la manera siguiente:

Dicha votación tempranera en persona se podrá llevar a cabo en el lugar principal para votar localizado en el lobby del primer piso de la Corte del Condado de Nueces, calle Leopardo 901, y en los lugares de votación temporarios indicados en el Anexo C, adjunto e incorporado para referencia y parte de esta ordenanza. Además, el Anexo C estipula las fechas para la votación tempranera y las direcciones para la votación tempranera por correo.

SECCIÓN 8. es nombrado Juez Principal del Consejo de las Balotas de Votación Tempranera (Sec. 87.002). El Consejo de Votación Tempranera consistirá de un juez principal y por lo menos dos miembros. Los otros miembros se identifican como (Sec. 87.002 y Sec. 87.004).

SECCIÓN 9. La Corte del Condado de Nueces permanece como la única Estación Central de Conteo. (Sec. 127.001). es nombrado como juez principal de la Estación Central de Conteo. (Sec. 127. 005). La secretaria del condado de Nueces, Kara Sands, es nombrada supervisora de la Estación Central de Conteo. (Sec. 127.002). El secretario auxiliar, Paul Pierce, es nombrado asistente de la supervisora de la Estación Central de Conteo.

SECCIÓN 10. El director de las elecciones del condado de Nueces, Johnny D. Martínez, es nombrado supervisor de la Estación Central de Conteo (Sec. 127.003). Eric Gutiérrez de la Oficina del Secretario del Condado de Nueces es nombrado asistente al Supervisor de Tabulación (Sec. 127.004).

SECCIÓN 11. La compensación para las personas nombradas o empleadas de acuerdo a esta ordenanza será la siguiente:

A. Los jueces principales y jueces alternos recibirán $9.60 de compensación por cada hora de servicio cumplido. El tiempo extra será compensado de acuerdo al Fair Standards Act.

B. Los empleados para las elecciones que no sean empleados de la Ciudad recibirán $9.60 de compensación por cada hora de servicio cumplido, sujeto a la Sec.32.091. El tiempo extra será compensado de acuerdo al Fair Standards Act.

C. Además, se pagarán $25 dólares al juez de la elección o al empleado que entregue los records de la elección del precinto, las llaves de las cajas de las balotas, u otro equipo de la elección, incluyendo los recursos sobrantes de la elección. (Sec. 32.002)

D. No habrá compensación adicional para cualquier empleado de la ciudad.

E. No habrá compensación directa para los empleados del condado. En su lugar, los servicios de los empleados del condado contarán como parte de los servicios estipulados bajo el acuerdo de los servicios de elección del condado de Nueces.

SECCIÓN 12. La Secretaria de la Ciudad llevará a cabo la elección de acuerdo con la ordenanza del concilio de la ciudad y apegada a la ley de acuerdo con el convenio colectivo de elección acordado con el condado de Nueces. Se le pide a la Secretaria de la Ciudad entregar datos e información demográfica como lo exige la ley. La Secretaria de la Ciudad es responsable de postear y hacer público los avisos de elección como lo exige la Ley Electoral de Texas. Además, la Secretaria de la Ciudad es nombrada como la autoridad y oficial responsable por conducir dicha elección y por medio de la presente se le autoriza y se le exige que lleve a cabo todos los trámites necesarios para efectuar dicha elección de acuerdo con y apegada a las leyes de este estado, incluyendo pero sin limitarse a la coordinación del proceso de elección, el uso del equipo de tabulación, recursos e impresión de boletas, de acuerdo con el convenio de elección colectiva que se efectuará con el condado de Nueces. La Secretaria de la Ciudad queda autorizada de identificar lugares sustitutos adecuados para votar en caso que los lugares de votación designados no estén disponibles para dicho uso por circunstancias imprevistas.

SECCÓIN 13. Se espera que la elección se lleve a cabo de acuerdo con el Convenio de Servicios de Elección (Sec. 31.091 al 31.100) entre el Condado de Nueces y la Ciudad de Corpus Christi para llevar a cabo una elección especial el 6 de mayo de 2017, será aprobada, incorporada y anexada aquí mismo como Anexo D. La Secretaria de la Ciudad queda autorizada en aprobar todos los cambios legales y aditamentos a los trámites incluidos aquí para implementar dicho convenio.

SECCIÓN 14. Con aprobar y firmar esta ordenanza, el Alcalde Provisional confirma y exige oficialmente como gestión propia de Alcalde Provisional todos los asuntos presentes en esta ordenanza que por ley quedan bajo su jurisdicción como Alcalde Provisional.

SECCIÓN 15. Si por cualquier razón alguna sección, párrafo, subdivisión, cláusula, frase, palabra, o provisión de esta ordenanza o la boleta incluida aquí se considerara inválida o inconstitucional

por fallo final o por una corte de jurisdicción competente, no afectará a ninguna otra sección, párrafo, subdivisión, cláusula, frase, palabra, o provisión de esta ordenanza, debido a que la intención del concilio de la ciudad de cada sección, párrafo, subdivisión, cláusula, frase, palabra o provisión de este documento entre de lleno y en efecto de su propósito.

SECCIÓN 16. La fecha de vencimiento para presentarse a la elección especial establecida por esta ordenanza es el 27 de marzo de 2017. El periodo para entregar su solicitud y agregar su nombre a la balota es del 28 de febrero de 2017 al 27 de marzo de 2017. Las solicitudes de los candidatos deben entregarse durante este periodo. (Sec. 201.054)

JOINT ELECTION AGREEMENT

This Agreement ('`A reement") is made and entered into on thej) Up "" dayay of bCt l _, 2017

between the City of Corpus Christi and Nueces County for the purposes and considerations of holdinga special election for Mayor.

WITNESSETH

WHEREAS, the City of Driscoll, the City of Bishop, Emergency Services District 43. and BishopIndependent School District will hold elections on 6th day of May, 2017;

WHEREAS, the City of Corpus Christi will hold a Joint Election within the boundaries of NuecesCounty on the 6th day of May, 2017, and

WHEREAS, the Corpus Christi City Council finds that it would be mutually beneficial for City ofCorpus Christi to enter into an Election Services Contract to hold elections and for the provision ofcertain election services by the County Election Officer of Nueces County, Texas.

THEREFORE, pursuant to Chapter 31 and 271 of the Texas Election Code, the Cite of CorpusChristi and Nueces County agrees as follows:

THIS CONTRACT is entered into for and in consideration of the mutual covenants andpromises hereinafter set out, and for the purpose of ensuring that the Contracting Officer and theCity of Corpus Christi understand the tasks each is to perform in connection with the City ofCorpus Christi Mayoral election and the runoff election:

NUECES COUN'T' Y ELECTIONS RESPONSIBILITIESThe Contracting Officer (also referred to as NUECES COUTY ELECTIONS) shall be responsiblefor performing the following duties and furnishing the following services and equipment inconnection with the election and the runoff election:

1. 1 In accordance with Chapter 271. 002 of the Texas Election Code, the County ElectionOfficer of Nueces County, Texas agrees to oversee and coordinate the conduct of said election forthe City of Corpus Christi of services to prepare for and facilitate the Joint Election to be held on 6thday of May 2017. City of Corpus Christi agrees that early voting and regular Election Day votingshall be conducted.

1. 2 In accordance with Chapter 31. Subchapter D of the Texas Election Code„ City ofCorpus Christi agrees to enter into an Election Services Contract with the County Election Officer ofNueces County, Texas, for the provision of those certain election services described in this agreement. The County Election Officer, Kara Sands. is hereby designated the Election Officer responsible forconduct and provision of the election services identified in this agreement. Said County ElectionOfficer will serve as the Early Voting Clerk. and her designee will serve as the Counting StationManager of the Central Counting Station for the Joint Election. In addition, Kara Sands as the Early

Voting Clerk will perform or cause to be performed the following services: a. NUECES COUNTY ELECTIONS will contract 3rd Party ( HART Intercivic) vendor

to program and create the ballots per the City of Corpus Christi specifications the cost ofprogramming and shipping shall be invoiced to and paid by the City of Corpus Christi directly.

b. NUECES COUNTY ELECTIONS will conduct one or more election schools.

C. NTUECES COUNTY ELECTIONS will manage, lend technical support and electionlaw assistance to poll workers during Early Voting and Election Day time period.

d. NUECES COUNTY ELECTIONS will supply all voting equipment and supplies to allEarly Voting and Election Day locations.

e. NUECES COUNTY ELECTIONS will manage the hours worked for the Early VotingBallot Board. The compensation sheets will then be turned over to City of Corpus Christi forcompensation.

f. NUECES COUNTY ELECTIONS will coordinate the handling and disposition ofCityof Corpus Christi election returns, voter ballots, and tabulation of unofficial returns, and preparationof the tabulation for the official canvass by governmental entities.

g. NUECES COUNTY ELECTIONS will take custody of the City of Corpus Christireturns for a period as required by the Texas Election Code.

h. i' I?ECES COUNTY ELECTIONS will prepare ballots for City of Corpus ChristiMayoral race.

i. Arrange to have published the legal notice of the first test of the electronic tabulatingequipment as provided in Section 127. 096, Texas Election Code, and/ or the legal notice of thelogic and accuracy test of the direct recording electronic (' DRE") voting machines as provided inSection 129. 023( b), Texas Election Code, as applicable, and conduct all required tests of theelectronic tabulating equipment under Sections 127. 096- 127. 098, Texas Election Code, the votingsystem that uses DRE voting machines under 129. 021- 129. 023, Texas Election Code, or the

voting system that uses other electronic voting systems in accordance with advisories issued bythe Texas Secretary of State ( hereinafter referred to as " SOS"), respectively.

j. Procure all necessary voting machines and equipment, prepare them for use at theearly voting locations and at the election day polling places, and transport them ( or arrange tohave them transported) to and from the early voting locations and at the election day pollingplaces.

k. Arrange for the use of a central counting/ central accumulation station and tabulatingpersonnel and equipment needed at the counting/accumulation station and assist in thepreparation of programs and the test materials for the tabulation of ballots to be used withelectronic voting equipment.

1. Submit Election Night Returns (" ENR") electronically to the Texas Secretary of StateSOS") in the form requested by the SOS in accordance with Chapter 68, Texas Election Code.

II

CITY OF CORPUS CHRISTI ELECTIONS RESPONSIBILITIESThe City of Corpus Christi shall be responsible for performing the following duties inconnection with the election and the runoff election:

2. 1 Coordinate ( l) selection of early voting workers, and ( 2) designation of Election Dayworkers.

2. 2 Provide information services for voters and election officers relating to City of CorpusChristi elections.

2. 3 City of Corpus Christi will be responsible for posting or publication requirementsnecessitated by federal, state or local laws as they may pertain to implementation of the respectiveissues placed on the ballot.

2. 4 City of Corpus Christi will be responsible for receipt and processing filings offinancial report statements relating to the City of Corpus Christi' s respective elections.

2. 5 City of Corpus Christi will be responsible for designating Early Voting and ElectionDay polling locations.

2. 6 City of Corpus Christi will be responsible for appointing the Early Voting Ballot BoardAnd poll workers that will be working the Early Voting and Election Day polling locations

2. 7 City of Corpus Christi will be responsible for compensating all Early Voting andElection Day judges and clerks.

2. 8 City of Corpus Christi will be responsible for receipt and processing of applications ofcandidates for places ori the ballot for its own positions, handling of drawings for places on the ballotfor such positions, and the posting and issuance of ani, notices related thereto.

2. 9. Appoint a presiding and an alternate judge for each election day polling place, apresiding and an alternate judge for the central counting station, and a presiding judge for the earlyvoting ballot board and promptly provide the names and contact information to the ContractingOfficer. (It is the responsibility of the presiding judges to appoint the appropriate number ofelection clerks.)

III

PAYMENT, BILLING, AND COMPENSATION

3. 1. For the performance of duties and services and the providing of equipment andsupplies under Section 1 above, the City of Corpus Christi shall pay the Contracting Officer forthe actual expenses he/ she incurs in accordance with Section 31. 100, Texas Election Code includingthe costs and expenses of election supplies; newspaper publication of the testing notice only; use ofvoting machines and equipment;; logic and accuracy testing, and voting machines and equipmenttransportation. Provided, that nothing herein shad be construed as permitting the ContractingOfficer to be paid for costs or expenses for which reimbursement is not allowed under Section3 1. 100 or other sections of the Texas Election Code.

3. 2. The City of Corpus Christi will pay directly to the proper parties the wages andsalaries of the precinct election judges, alternate judges, and election clerks, members of the earlyvoting ballot board, and 3rd Party (HART Intercivic) vendor for programming the ballot.

3. 3. The City of Corpus Christi will pay directly to the precinct election and alternate judgesand election clerks, members of the early voting ballot board, and the presiding and alternate judgesand clerks of the central counting station the wages and salaries earned by them in connectionwith the election and runoff election.

3A. A cost estimate for the services, equipment. and supplies provided by theContracting Officer for the election and the runoff election is attached to and made a part of thisContract as Exhibit A. The cost estimate should express costs in the categories set forth in the Cityof Corpus Christi' s Cost Estimate and the City of Corpus Christi' s Runoff Cost Estimate.

3. 5. As soon as reasonably possible after the election or the runoff election, the

Contracting Officer will submit an itemized invoice to the City of Corpus Christi ( i) for the actualexpenses he/ she incurred as described above.

3. 6. The Contracting Officer' s invoice shall be due and payable by the City of CorpusChristi to the address set forth in the invoice within 30 days after its receipt by the City of CorpusChristi. If the City of Corpus Christi disputes any portion of the invoice, the City of Corpus Christishall notify the Contracting Officer within such 15 -day period or the invoice will be deemed to bea true and accurate rendering of the amount that is due.

IV

GENERAL PROVISIONS

4. 1. Acknowledgement of Shared Polling Places. The Cit) of Corpus Christiacknowledges that the Contracting Officer may enter into similar Election Services Contractswith the City of Driscoll, the City of Bishop, Emergency Services District #3, and BishopIndependent School District. In such event, the City of Corpus Christi agrees to share commonpolling places with the other political subdivisions.

4.2. Nothing contained in this Contract shall authorize or permit a change in the officerPage 4 of 6

with whom or the place at which any document or record relating to the election or to the runoffelection is to be filed, the place at which any function is to be carried out, the officers " vhoconduct the official canvass of the election returns, the officer to serve as custodian of the votedballots or other election records, or any other nontransferable functions specified by Section31. 096, Texas Election Code.

4. 3. Only the actual expenses directly attributable to the Contract may be charged to theCity of Corpus Christi by the Contracting Officer, Section 31. 100, Texas Election Code.

4.4. For purposes of implementing this Contract, the Contracting Officer and the City ofCorpus Christi designate the following individuals, and whenever the Contract requires submissionof information or notice to the Contracting Officer or the City of Corpus Christi, submission ornotice shall be made to these individuals:
