En los últimos tiempos, nos estamos encontrando casi a dia-rio, lamentablemente, con situaciones en las que, en casos de venta de inmuebles por no residentes, no existe beneficio, o éste es ínfimo.

En estos casos el vendedor no residente tiene la posibilidad de solicitar a la Agencia Tributaria la devolución íntegra de la retención que por Ley se les practicó en su día cuando ven-dió su bien inmueble (3% sobre el precio de venta), o en su caso, el sobrante en exceso que resulte de la diferencia entre dicho 3% y el impuesto aplicable por la ganancia patrimonial derivada de la venta del bien inmueble.

In recent times, we are finding almost every day, unfortu-nately, that the sale of real estate by non-residents do not generate any profit, or where there is, it is insignificant.

However, it is often overlooked that the non-resident seller has the possibility of reclaiming from the tax authorities a full refund of the withholding tax that was applied on the date of the sale of the real estate (3% of the sale price), or in some cases, the excess arising from the difference between such withholding tax of 3% and the taxes applicable on the capital gains derived from the sale of the property.

In letzter Zeit passiert es leider immer wieder, dass bei einem Verkauf einer Immobilie durch einen Nicht Residenten, die-sem leider kein Steuervorteil, bzw. nur ein Winziger zusteht.

In diesen Fällen hat der nicht residente Verkäufer die Mögli-chkeit, bei dem Finanzamt (Agencia Tributaria) die Rückers-tattung des gesamten Vorsteuereinzugs zu beantragen, der ihm laut Gesetz bei dem Verkauf seiner Immobilie berechnet wurde (3% des Verkaufspreises), bzw. des Restbetrag, der aus der Differenz zwischen diesen 3% und den anfallenden Steuern für den Vermögensgewinn durch den Verkauf seiner Immobilie resultiert.

El comprador deberá entregar al vendedor el modelo 211, justificativo de que efectivamente esa retención del 3% se ha ingresado en la Agencia Tributaria. Este ingreso se debe efectuar dentro del mes siguiente a la fecha de la compraventa.

Transcurrido dicho mes, el vendedor tiene tres meses contados a partir del término del plazo que tiene la per-sona que adquirió el inmueble para ingresar la retención para solicitar la devolución integra -o parcial- del 3% re-tenido. El modelo a utilizar es el Modelo 210.

The buyer must give the seller the Form 211, which effec-tively confirms that the withholding tax of 3% has in-deed been remitted to the tax authorities. This payment must be made within one month of the date of the sale. After the end of this month, the seller has the three sub-sequent months to request the full - or partial - refund of the withholding 3%. The form to use is Form 210.

Der Käufer muss dem Verkäufer das Formular “Modelo 211”, als Nachweis dafür, dass der Vorsteuerabzug von 3% tatsä-chlich bei dem Finanzamt eingezahlt wurde aushändigen. Diese Einzahlung muss innerhalb des Monats nach dem no-tariellen Verkaufstermin vorgenommen worden sein.

Nach diesem Monat, also nach Ablauf der Frist, die der Käufer der Immobilie hat, um den Vorsteuerabzug einzuza-hlen, hat der Verkäufer drei Monate Zeit, um die vollstän-dige oder partielle Rückerstattung der vorgezahlten 3% zu beantragen. Zu diesem Zweck dient das Formular „Modelo 210“.

La Administración practicará, si procede, liquidación pro-visional dentro de los seis meses siguientes al término del plazo establecido para la presentación del modelo. Si la liquidación provisional no se practica en el referido plazo, la Administración Tributaria procederá a devolver de oficio el exceso sobre la cuota autoliquidada. Transcu-rridos los seis meses citados sin que se haya ordenado el pago de la devolución por causa no imputable al contri-buyente, se aplicará a la cantidad pendiente de devolu-ción el correspondiente interés de demora.

The tax administration may issue, if necessary, a pro-visional tax calculation within six months, following the period for the submission of the Form 210. If the provisional tax calculation is not issued within that period, the tax authorities shall return automatically the excess of the tax paid by the taxpayer. If after these six months, the refund has not been processed for any reason not attributable to the taxpayer, the tax authorities shall apply the relevant late payment interest to any outstanding amounts.

Das Amt wird dann, ggfs. den vorläufigen Ausgleich innerhalb von sechs Monaten nach dem Ablauf der gesetzlich festgelegten Frist für das Einreichen des Formulars vornehmen. Wenn der vorläufige Ausgleich in dieser Frist nicht gezahlt wurde, wird das Finan-zamt den Überschuss zur selbstgezahlten Quote von Amts wegen rückerstatten. Wenn nach diesen sechs Monaten keine Rückerstattung angewiesen wurde, aus Gründen, die nicht unter die Verantwortung des Steuerzahlers fallen, werden auf den zurückzuerstat-tenden Betrag die anfallenden Verzugszinsen erho-ben.
