Poštovani čitatelji,
Pred vama je rujanski broj biltena EUROPA info koji u bibliografskom pregledu obuhvaća reference dokumenata, članaka, studija, izvještaja, sudskih presuda i priopćenja i ostalih publikacija objavljenih u razdoblju od 1. srpnja do 30. rujna 2010. Tekstovima svih službenih dokumenata, te ograničenom broju stručnih članaka možete izravno prsitupiti putem priloženih linkova. Nadamo se da ćete pronaći nešto za sebe. Sljedeći broj najavljujemo za prosinac ove godine.
Još dva zatvorena poglavlja
Na sastanku Pristupne konferencije održanom 27. srpnja 2010., Europska unija i Hrvatska postigle su dogovor oko privremenog zatvaranja poglavlja Financijska kontrola i Sigurnost hrane. Od početka pregovora 2005. godine, otvoreno je 32, od čega je 22 poglavlja privremeno zatvoreno. Sastankom je predsjedao veleposlanik De Ruyt, stalni predstavnik Belgije, koji je predvodio delegaciju Europske unije, uz Michaela Leigha, direktora Opće uprave za Proširenje koji je predstavljao Europsku komisiju. G. Leigh istaknuo je kako će u nadolazećem razdoblju biti riječi o nekoliko teških poglavlja – poput onih što imaju financijske implikacije, uključujući Tržišno natjecanje te Pravosuđe i temeljna prava, pri čemu je jasno kako će dinamiku pregovora u tom smislu određivati sama Hrvatska od koje se očekuje pravovremeno ispunjavanje zadanih mjerila. Barroso o stanju Unije
Predsjednik Europske komisije José Manuel Barroso održao je 7. rujna govor pred Europskim parlamentom u Strasbourgu, simbolično nazvan “State of the Union”, po uzoru na godišnja obraćanja Predsjednika SAD‐a Kongresu Sjedinjenih Američkih Država. Iako sam govor nije bio medijski popraćen poput onog u SAD‐u, što ga uvijek nestrpljivo očekuju milijuni gledatelja, već je bio koncipiran kao jutarnje obraćanje Parlamentu nakon kojeg slijedi rasprava, ipak zbog svog sadržaja zaslužuje pozornost. Pretežno optimističnog tona, govor je bio ponajviše fokusiran na ekonomske prilike, točnije na (ne)zaposlenost, istraživanja i inovacije te na budućnost kakvu zaslužuje Europska unija kao jedinstveni entitet. Stopa nezaposlenosti je, kako navodi Barroso, i dalje previsoka, ali je barem prestala rasti.
Barroso je iskazao optimizam što se tiče gospodarskog oporavka Unije, ali i zabrinutost zbog različitog stupnja napretka u oporavku, što stoga donosi nove rizike i nesigurnost. Iako EU ima 27 članica koje djeluju različito i na nacionalnom i na regionalnom i na lokalnom planu, Barroso je naglasio kako je iznimno važno da na svjetskoj pozornici one nastupe jedinstveno, europski, kao velika gospodarska sila koja, kao i do sada, mora imati značajnu ulogu svjetskom gospodarstvu. Sastanak Europskog vijeća
Jednodnevni izvanredni summit Europskog vijeća održan je 16. rujna 2010. u Bruxellesu. Iako mu je svrha prvenstveno bila rasprava o vanjskoj politici Europske unije, a posebno o odnosima s azijskim zemljama, tu je raspravu ipak donekle uspjelo zasjeniti verbalno sukobljavanje Nicolasa Sarkozyja i José Manuela Barrosoa oko pitanja romske populacije u Francuskoj. U konačnici je na sastanku ipak donesen zaključak u obliku poziva Europskoj komisiji da sastavi zajedničku strategiju o pitanju Roma. Glavna tema summita došla je do izražaja kada je predsjednik Europskog vijeća Herman Van Rompuy naglasio kako se zauzima za jedinstvenu i snažniju zajedničku vanjsku politiku, jer smatra da Europska unija u tom području “boksa u kategoriji ispod svoje težine” te kako je potrebno više koherentnosti i kontinuiteta u vanjskopolitičkom djelovanju.
Najvažniji zaključci rujanskog sastanka na vrhu odnose se ponajprije na vanjsku politiku Europske unije. Zajednička vanjska i sigurnosna politika Unije zbog svoje je naravi kroz povijest vrlo rijetko i sporo mijenjana, budući da države članice ljubomorno čuvaju suverenitet u tom području. Stupanjem na snagu Lisabonskog ugovora došlo je do važnih promjena, ali je vanjskopolitička komponenta Unije i dalje ostala disperzirana, pa stoga još uvijek nema jednoznačnog odgovora na poznato Kissingerovo

pitanje: “Who do I call if I want to call Europe?” (Koga trebam nazvati želim li razgovarati s Europom?).
Zaključci summita podijeljeni su u dvije skupine od kojih se prva bavi odnosima sa strateškim partnerima. Zbog nepovoljne ekonomske situacije svijet prolazi kroz proces promjena u kojem Europu očekuju novi izazovi. Postavljen je cilj po kojem Europa mora postati učinkovit globalni čimbenik, spreman preuzeti odgovornost za svjetsku sigurnost. Europa će moći utjecati na svijet i odgovoriti zajedničkim svjetskim izazovima jedino pod uvjetom da pokaže gospodarsku snagu i osigura koheziju na unutarnjem političkom planu.
U drugoj skupini zaključaka pod naslovom Task Force for Economic Governance, Europsko se vijeće osvrće na izvještaj predsjednika Operativne skupine za ekonomsko upravljanje, te pozdravlja napredak postignut u provedbi Europskog semestra (European Semester) usmjerenog na razvoj makro‐financijskog nadzora i koordinaciju fiskalnih okvira država članica. Financijski nadzor
Europski je parlament 22. rujna 2010. usvojio niz reformskih mjera što u korijenu mijenjaju sustav nadzora banaka, burzi i osiguravajućih kuća. Europska nadzorna tijela (European Supervisory Authorities – ESA) sada imaju ovlast sankcionirati, ali i rješavati sporove među nacionalnim vlastima pojedinih država. Ovlašteni su privremeno zabraniti financijske proizvode koje procijene suviše opasnima. Također, pokrenut je postupak osnivanja Europskog odbora za sistemski rizik (European Systemic Risk Board) kojemu će glavna zadaća biti sprječavanje pojave financijskog rizika. Europski će parlament temeljem svojih demokratskih ovlasti zadržati kontrolu nad nadzornim sustavom u cjelini. Više: Europski parlament, 22.9.2010. i EK: MEMO/10/436, 22.9.2010.
Elektronička trgovina
Europski je parlament 21. rujna 2010. odobrio novi pravni akt kojemu je cilj ukloniti prepreke online trgovini. Uspostavom oznake povjerenja za e‐trgovinu temeljem europskog prava i pod nadzorom Europske komisije nastoji se potaknuti prekograničnu elektroničku trgovinu, te vratiti povjerenje potrošača zahvaljujući pouzdanosti odobrenih proizvoda.
Novim će se aktom stati na kraj zemljopisnoj diskriminaciji i jamčiti veća transparentnost između dobavljača i potrošača, a u dužem razdoblju ove će mjere pozitivno utjecati na konkurentnost europskog gospodarstva i unutarnjeg tržišta. Više: Europski parlament, 21.9.2010.
Imunitet pravne profesije
U odluci što ju je donio 14. rujna 2010. u predmetu Akzo Nobel Chemicals, Europski sud ističe kako pravnici u privredi ne mogu imati jednaku razinu neovisnosti u odnosu na svojeg poslodavca kao što to mogu odvjetnici koji vode neovisnu odvjetničku praksu. Drugim riječima, pravnik kao zaposlenik kompanije ne može primijeniti imunitet pravne profesije na svoju komunikaciju s kompanijom za koju

radi. Imunitet pravne profesije primjenjiv je samo na neovisne odvjetnike koji nemaju sklopljen ugovor o radu sa svojim klijentom. Ovaj zaključak odbacuje priziv grupe Chemicals koja je nastojala osporiti korištenje određenih dokumenata u protutrustovskoj istrazi. Više: Priopćenje Suda EU‐a, br. 90/10, 14.9.2010.
Poboljšanje postupka procjene učinka mjera
Europski revizorski sud u svojem izvješću o Komisijinim postupcima procjene učinaka pojedinih mjera objavljenom krajem rujna 2010. tvrdi kako procjene Europske komisije sadrže dobar pregled bitnih pitanja u prostupku odlučlivanja, no ističe i činjenicu da izvješća ponekad nisu dovoljno jasna. Zbog toga Revizorski sud poziva Komisiju da poboljša svoj sustav procjene učinaka provedenih mjera. EurActiv.com: Komisija planira komunikacijsku revoluciju
Iz izvora unutar Europske komisije, EurActiv doznaje kako Komisija priprema unijeti temeljite promjene u komunikacijsku strategiju što će uključiti i rebrandiranje usredotočeno na predsjednika Barrosoa, povećanu centralizaciju komunikacije s javnostima, te nov organizacijski ustroj i promjenu ključnih dužnosnika. Povjerenica Europske komisije, Viviane Reding, zadužena među ostalim i za komunikacijsku politiku, želi uvesti 'kulturni šok' i pravu 'revoluciju' u postojeće metode što ih Komisija primjenjuje u području komuniciranja, koristeći pritom i iskustva što ih je stekla kao povjerenica Europske komisije za informacijsko društvo. Spomenuta strategija mogla bi ugledati svjetlo dana do kraja ove godine, no iz same Komisije stižu predviđanja kako bi nov sustav mogao zaživjeti i početi funkcionirati tek 2012. godine. Europa u propadanju
Francuski časopis Filozofija (Philosophie), čiji je prvi broj objavljen 2006. godine, uspio je u tom razdoblju filozofiju učiniti dostupnom široj publici držeći se načela koje tu disciplinu ne smatra nužno rezerviranom za profesionalne filozofe.
Upravo u jednom od najnovijih članaka objavljenih u spomenutom časopisu u rujnu 2010., autor Alexandre Lacroix vraća se pomalo pomodarskoj raspravi o ideji Europe u propadanju (Declining Europe) što je potkrijepljena otužnim demorafskim i ekonomskim pokazateljima. Autor članka pokušava postaviti neke nove teze i ponuditi drugačiji pogled na ideju Europe u propadanju, pa tako ističe kako bismo današnju Europu lako mogli usporediti s dekadencijom starog Rima, iako je takva usporedba možda tek pojednostavljivanje cijele stvari. Mit zvan declining Europe star je koliko i sam europski kontinent. Drugo zapažanje autora odnosi se na tvrdnju kako je najvažnija inovacija našeg vremena činjenica da se više ne oslanjamo na darovite pisce i mislioce kako bismo lakše razumjeli slabosti svojeg okruženja, već proučavamo suhoparna izvješća statističkih zavoda poput Eurostata ili Svjetske banke. Treća njegova teza tvrdi kako je svođenje mita o propasti Europe na opis gospodarskih problema samo po sebi zabrinjavajući simptom propasti. Alexandre Lacroix ustraje na stajalištu da se vitalnost civilizacije može mjeriti i snagom njezine kreativne inicijative. Više: Whither the European mind?, PressEurop, 10.9.2010.

Novi izvori, publikacije i dokumenti
European e‐justice portal
Europska komisija pokrenula je u srpnju 2010., u suradnji s državama članicama, projekt pod nazivom European e‐Justice portal kako bi olakšala pronalaženje i razmjenu pravnih informacija, osobito imajući na umu činjenicu da oko deset milijuna građana Europske unije svake godine sudjeluje u nekoj vrsti prekograničnog pravnog postupka. Portal e‐Justice, zamišljen kao jedinstveni online izvor informacija, pojednostavit će i ubrzati put do odgovora na pravna pitanja i to na 22 službena jezika EU‐a. Portal u početnoj fazi obuhvaća 12.000 stranica što upućuju na pravne izvore i praksu svih država članica, nudeći i mogućnost pretraživanja pravnih baza podataka uključujući primjerice pretraživanje zemljišnih knjiga i registara oporuka.
Kao sljedeći korak u razvoju portala predviđeno je objavljivanje sažetih pregleda prava branjenika kao i prava žrtava, vjerojatno početkom 2011. Također je u planu omogućiti sudovima da prekogranične zahtjeve rješavaju putem portala (online), kao i da s potražiteljima, branjenicima i sudovima u drugim državama članicama komuniciraju koristeći ovaj novi internetski alat.
Sadržaj portala e‐Justice trenutačno obuhvaća četiri glavne rubrike dostupne s naslovnice, a namijenjene specifičnim ciljnim korisnicima:
1. Građani: uključuje odjeljke ‘Odlazak na sud’, ‘Obiteljska pitanja’, ‘Pravna pomoć’, ‘Troškovi postupka’
2. Poslovna zajednica: uključuje registre poslovnih subjekata, stečajnih postupaka i registar zemljišnih knjiga, ‘Odlazak na sud’ i ‘Postupak mirenja’
3. Pravni stručnjaci: uključuje odjeljke ‘Pravo’, ‘Sudska praksa’, ‘Pravni sustavi’, ‘Videokonferencije’
4. Pravosuđe: obuhvaća odjeljke ‘Alati za sudove i pravne praktičare’, ‘Pravosudna obuka’, ‘Financiranje’, ‘Pravna zanimanja i pravosudne mreže’
Portal nudi mješavinu informacija o zakonodavstvu i inicijativama na razini Europske unije te informacija o pravnom pravilima i uslugama u pojedinim državama članicama. Primjerice, odjeljak posvećen mirenju obuhvaća dva segmenta – sažetak Direktive Europske unije o mirenju iz 2008. godine s vezama na cjelovit tekst, kao i pregled uređenja tog područja u pojedinim državama članicama. Iako je teško pregledati cjelokupan sadržaj portala, tj. svih trenutačno dostupnih 12.000 stranica, prvi je dojam da se radi o svakako iznimno vrijednom izvoru, osobito korisnom svima onima koji u svojem radu trebaju informacije iz područja prava. Nove web stranice za pravosuđe i unutarnje poslove
Umjesto Opće uprave za područje slobode, sigurnosti i pravde, od 1. srpnja 2010. uspostavljene su dvije nove uprave Europske komisije ‐ Opća uprava za unutarnje poslove (DG Home Affairs) i Opća uprava za Pravosuđe (DG Justice), te su slijedom toga pokrenute i njihove zasebne web stranice. ABC prava Europske unije
Vodič ‘ABC prava Zajednice’ najprije objavljen u seriji 'Europska dokumentacija’, doživio je novo izdanje u izmjenjenom obliku i pod novim naslovom 'ABC prava Europske unije’ što odražava promjene nastale stupanjem na snagu Ugovora iz Lisabona. Dostupna u dvije verzije – tiskanoj i elektroničkoj (pdf) – ova je knjiga namijenjena čitateljima bez stručnog pravnog znanja koji žele razumjeti utjecaj i posljedice europskog prava za njihov svakodnevni život. Najvažnija poglavlja su: ‘Od Pariza do Lisabona, preko Rima, Maastrichta, Amsterdama i Nice’, Temeljne vrijednosti Europske unije’, ‘Ustav Europske unije’, ‘Pravni poredak Europske unije’ i ‘Položaj prava Unije u odnosu na pravni poredak u cjelini’. Zelena knjiga o Europskom ugovornom pravu
Europska komisija usvojila je u srpnju 2010. strateški dokument – Zelenu knjigu o daljnjim koracima usmjerenim ka uspostavi Europskog ugovornog prava za potrošače i poduzeća. Tim dokumentom Komisija nastoji doprinijeti pojednostavljenju pravila poslovanja u prekograničnim okvirima, te povećati povjerenje potrošača što je sada ugroženo postojanjem različitih pravnih pravila unutar nacionalnih sustava. Koegzistencija takvih različitih pravila često uzrokuje povećanje troškova transakcija, pravne nesigurnosti u poslovanju te ugrožava povjerenje potrošača. Trenutačno, kompanije se moraju prilagođavati lokalnim pravnim odredbama ukoliko svoje proizvode žele prodavati u drugoj državi članici Europske unije. Takva pravna nesigurnost i dodatni troškovi usklađivanja s različitim pravnim sustavima često sprječava i obeshrabruje prekograničnu trgovinu.
Problem je osobito važan za mala i srednje velika poduzeća koja najčešće nisu u stanju izdvojiti dodatna sredstva za pravnike u 27 različitih država. Isto tako, ono što je problem za poduzeća, problem je i za potrošače. Gotovo dvije trećine potrošača koji pokušaju kupiti nešto iz druge države članice EU‐a su odbijeni jer trgovci odbijaju poslovati s državom iz koje potrošač dolazi. Ipak, ideja je daleko od realizacije jer je ugovorno pravo trenutačno u nadležnosti država članica EU‐a koje nevoljko odustaju od svoje nacionalne suverenosti po tom pitanju. Inicijativa “Mladi u pokretu”
Komisija je sredinom rujna 2010. usvojila inicijativu pod nazivomm “Mladi u pokretu” (Youth on the Move) kao doprinos reformskoj strategiji Europa 2020. Inicijativa Komisije obuhvaća skup mjera usmjerenih na poboljšanje zapošljivosti mladih ljudi, prilagodbu obrazovnih sustava potrebama zapošljavanja mladih, povećanje svijesti o mogućnostima stipendiranja mobilnosti u cilju studiranja, obuke ili volontiranja u nekoj drugoj državi Europske unije. Studije pokazuju da poslodavci izuzetno cijene takva iskustva.

Androulla Vassiliou, povjerenica Europske komisije za Obrazovanje, kulturu, višejezičnost i mlade, naglašava kako će Europska unija, želi li prosperitet, u budućnosti trebati sve veći broj visokoobrazovanih i inovativnih mladih ljudi. Kako je nezaposlenost ipak jedan od najvećih problema milijuna mladih europljana, povjerenik Komisije za Zapošljavanje, socijalne poslove i jednakost László Andor smatra da će upravo ova inicijativa, i na nacionalnoj i na europskoj razini, pružiti potporu mladima u pronalaženju posla i lakšem ostvarenju životnih planova. Strategija Komisije o ravnopravnosti spolova (2010‐2015)
Europska je komisija 21. rujna 2010. usvojila novu, petogodišnju Strategiju o ravnopravnosti spolova. Kako ravnopravnost spolova spada u temeljna prava Unije, povjerenica Komisije za Pravosuđe, temeljna prava i državljanstvo Viviane Reding nije propustila naglasiti da je upravo Europa svojim primjerom, još od Rimskih ugovora predvodnica u politici jednakih prava za muškarce i žene. Strategija se temelji na pet najvažnijih točaka: ekonomija i tržište rada, jednake plaće, ravnopravnost na vodećim pozicijama, suzbijanje nasilja, te promicanje ravnopravnosti u EU. Komisija se također obvezala organizirati godišnji Dijaloga o ravnopravnosti spolova koji će uključiti predstavnike Europskog parlamenta, Vijeća ministara, socijalnih partnera i civinog društva, kako bi zajednički pratili napredak u proverbi Strategije. Obiteljsko nasilje nad ženama
Eurobarometer je u rujnu objavio novo izvješće s rezultatima istraživanja javnog mišljenja o nasilju nad ženama. Istraživanje je provedeno tijekom veljače i ožujka 2010. u svih 27 država članica, a obuhvatilo je ukupno 26.800 građana. Dobiveni podaci pokazuju da čak 87% europljana podupire mjere što ih Europska unija provodi na suzbijanju obiteljskog nasilja. Čak jedan od četiri ispitanika poznaje osobu koja je bila žrtva takvog nasilja, dok svaki peti ispitanik u svojem krugu poznanika, prijatelja i obitelji zna za obiteljskog nasilnika. Također, podaci ukazuju na veću svijest građana o obiteljskom nasilju i želju da se ono suzbije oštrijim mjerama. Više: Domestic Violence against Women, Special Eurobarometer 344, 09/2010.

Bibliografija obuhvaća odabrane službene dokumente institucija Europske unije, uključujući zakonodavstvo objavljeno u Službenom listu EU‐a, priopćenja i vijesti, zakonodavne prijedloge, izvještaje i studije, stručne i znanstvene članke i radove domaćih i stranih autora, te pregled novih izdanja knjiga u području prava i politika Europske unije. Reference službenih izvora razvrstane su obrnutim kronološkim redom, dok su članci, radovi i knjige razvrstani prema imenu autora. Kod službenih dokumenata i vijesti te kod onih radova i članaka koji su slobodno dostupni priložen je i link na cjelovit tekst. Obuhvaćeno je razdoblje od 1. srpnja do 30. rujna 2010.
