ေနာကတင ပဒမ ၃ - က အဖြ စ ေအာကပါအတငး

ဖြ ညစကရမည -

‘’Sec.3-A.(1)Stamp duties charged by

Articles 23, 33 and 40 (a)

respectively of Schedule I

annexed to this Act shall, in the

case of instruments affecting

immovable property situated

wheresoever in the whole of

the Republic of the Union of

Myanmar, other than the

Naypyitaw Development territory,

the City of Yangon Development

territory and theCity of Mandalay

Development territory, be

increased by an additional stamp

duty of 2 percentum for a

consideration equal to the

market -value of the property so

situated.

(2) The Ministry of Finance of the Union Government shall in accord with Law deposit the increased stamp duties to the Union Fund. The Ministry of Finance of the Union Government shall there after pay the increased stamp duties to the Township Development Funds in a prescribed manner in

accordance with Law.’’

ေအာကပါ အတငးအစားထးရမည -

‘’Sec.20.(1)Where an instrument is

chargeable with a d v a l o r e m duty in respect of any money

expressed in any currency other

than that of theRepublic of the

Union of Myanmar, such duty

shall be calculated onthe value

of such money in thecurrency of

the Republic of thethe Union

of Myanmar according to the

current rate of exchange on

the day of the date of the

instrument.

(2)The Current rate of exchange

mentioned in the foregoing sub -

section shall be the Daily Reference

Rate announced by the Central

Bank of Myanmar at the day of

the date of the instrument.’’

Description of instrument Proper Stamp-duty

1.ACKNOWLEDGMENT of a debtexceeding kyat 2,000 in amount or value, written or signed by, or on behalf of, a debtor in order to supply evidence of such debt in any book (other than a banker's pass - book)or on a separate piece of paper when such book or paper is left in the creditor's possession; provided that such acknowledgment does not contain any promise to pay the debt or any stipulation to pay interest or to deliver any goods or other property.

2. ADMINISTRATION BOND, given under the section 291 , section 375 or section 376 of the Succession Act:- (a)where the amount does not exceed kyat 100,000; (b)in any other case.

3. ADOPTION-DEED, that is to

say, any instrument (other than a will)recording an adoption or conferring or purporting to confer an authority to adopt.

ADVOCATE. See ENTRY AS AN ADVOCATE (No.30) 4. AFFIDAVIT, including an affirmation or declaration in the case of persons by law allowed to affirm or declare instead of swearing.

၁။ ေကးမြ ဝနခချက။ ထခဝနချက မာေငပမာဏ သမဟတ တနဖး ေငကျပ ၂၀၀၀ထက ပေသာ ေကးမြ ေပးဆပ ရန ရေကြ ာငးသကေသခ ဖြ စေစရန မြ စားကေသာလညးေကာငး မြ စား အတကေသာလညးေကာငး (ဘဏ လပငနးရင၏ ေငမတစာအပမအပ) အခြ ားစာအပတစခခတင ဖြ စေစ၊ သးခြ ားစာရကတစခ ေပါတငဖြ စေစ ေရးသားပြ းလျင သမဟတ လကမတ ေရးထးပြ းလျင ထစာအပက သမဟတ ထစာရကက မြ ရင၏လကတင ေပးအပ ထားသညကစစတင အဆပါ ေကးမြ အတက ဝနခချကဖြ စရမည။ သရာတင ထ ဝနခချကတင ေကး မြ ေပးဆပရန ကတပြ ချကတစခခ ေသာလညး ေကာငး အတးေပးရန သမဟတ ကနစညကဖြ စေစ၊ အခြ ားပစစညး တစခခကဖြ စေစ၊ ေပးအပရန စညး ကမးချက တစခခေသာလညးေကာငး မပါရေစရ။

၂။ အေမထနးခဝနချပ။ ၎ငးတင အေမဆကခေရး အကဥပေဒ ပဒမ ၂၉၁၊ ပဒမ ၃၇၅ သမဟတ ၃၇၆ အရ ေပးေသာ ခဝနချပလညး ပါဝငသည။

(က) ေငေပါငး ကျပ ၁၀၀,၀၀၀ (၁သနး)ထက မပလျင (ခ) အ ခြ ားကစစရပတစခခဖြ စလျင။ ၃။ ေမးစားစာချပ။ ဆလရငးမာ ေမးစားခြ ငးက မတတမးတငသည သမဟတ ေမးစားရန အာဏာအပနငး သည သမဟတ အပနငးေသာ သေဘာ သကေရာကသည (ေသတမးစာမအပ) အခြ ားစာချပစာတမးတစခခ။ တရား လတေတာေရ ေန။ တရား လတေတာ ေရ ေနအဖြ စ ေရးသငးချကစာတမး (အမတစဉ၃၀)က ကြ ညပါ။ ၄။ ကျမးကျနလာ။ ၎ငးတင ကျမးကျန မညအစား ကတသစစာပြ ရန သမဟတ ေကြ ညာရန တရားဥပေဒအရ ခငပြ ထားသများအတက ကတသစစာပြ ချက သမဟတ ေကြ ညာချက ပါဝင သည။

Exemptions.Affidavit or declaration in writing when made:- (a) as a condition of enrol ment under the Defence Services Act, 1959 ; (b) for the immediate purpose of being filed or used in any Court or before the officer of any Court; or (c) for the sale purpose of enabling any person to receive any pension or charitable allowance.

5.AGREEMENT OR MEMORANDUM

OF AGREEMENT – (a) if relating to the sale of a bill

of exchange; (b) if relating to the sale of a

Government security or share in an incorporated company or other body corporate;

(c) if relating to joint venture

agreement, production or profit sharing contract, construction agreement or other similar agreement or contract;

(d) if not otherwise provided for ... ...

- Kyat 50. - Subject to a

maximum of kyat 10,000 kyat 25 for every kyat 100,000 or part thereof of the value of the security or share.

- One per centum

on the amount or value of the subject -matters.

Provided that the maximum duty shall be Kyat 150,000.

-ေငေချး သကေသခ လကမတ သမဟတ အစရယယာ တနဖး ကျပ ၁၀၀,၀၀၀ (၁သနး)အတက ဖြ စ ေစ၊ ၎ငး၏အစတ အ ပငးအတက ဖြ စေစ ကျပ ၂၅ ။ သရာတင အများဆး ထကသငသည တဆပ ေခါငးခနမာ ကျပ ၁၀,၀၀၀ထကမပေစရ။ - ထေငပမာဏ သမ ဟတ တနဖးအေပါ ၁ % ။ သရာတင အများဆး ထကသငသည တဆပ ေခါငးခန ၁ သနးခဖြ စ ေစရမည။ ကျပ ၃၀၀

Exemptions.Agreement or memorandum of agreement:- (a)for or relating to the sale of goods or merchandise exclusively, not being a NOTE OR M EMORANDUM chargeable under No. 43; (b) made in the form of tenders to the Republic of the Union of Myanmar for or relating to any loan;

(c) made under the Land Acquisition Act. AGREEMENT TO LEASE See LEASE ( NO .35).

6. AGREEMENT RELATING TO

DEPOSIT OF TITLE – DEEDS , PAWN OR PLEDGE, that is to say, any instrument evidencing an agreement relating to –

(1)the deposit of title- deeds or instruments constituting or being

evidence of the title to any property whatever (other than a marketable security), or

(2)the pawn or pledge of moveable

property. Where such deposit, pawn or pledge ,has been made by way of security for the repayment of money advanced or to be advanced by way of loan or an existing or future debt –

၆။ ပငဆငေကြ ာငးပြ သညစာချပ စာတမးများတငသငးခြ ငးနင ေပါငန ခြ ငးဆငရာသေဘာတစာချပ။ ဆလရငးမာ ေအာကပါတနငစပလျဉး သည သေဘာတညချကသကေသခ စာ ချပစာတမးတစခခ - (၁)ေရာငးတနးဝငေငေချးသကေသခ လကမတမအပအခြ ား) မညသညပစစညး ကမဆ ပငဆငေကြ ာငး သကေသခ အဖြ စ ချပဆသည သမဟတ ပငဆင ေကြ ာငး သကေသခဖြ စသည စာချပ စာတမး များတငသငးခြ ငး (သမဟတ )

(a) if such loan or debt is repayable on demand or more than three months from the date of the instrument evidencing the agreement; (b)if such loan or debt is repayable not more than three months from the date of such instrument.

Exemption. Instrument of pawn or pledge of goods if unattested. 7. APPOINTMENT IN EXECUTION OF A POWER, where made by any writing not being a will -

8. APPRAISEMENT OR VALUATION made otherwise than under an order

of the Court in the course of a suit –

(a) where the amount does not exceed kyat 100,000;

(b) in any other case… … …

Exemptions. (a) Appraisement or valuation made for the information of one party only, and not being in any manner obligatory between parties either by agreement or operation of law.

- The same duty as a Bill of Exchange [No. 13(a)] for the amount secured

- Half the duty

payable on a Bill of Exchange [No. 13(a)] for the amount secured.

. - Kyat 1,500. - Kyat 3,000.

-The same duty as a Bond(No.15) for such amount

- Kyat 2,000.


(က) အဆပါေချးေင သမဟတ ေကးမြ ကေတာငးဆေသာအခါ ဖြ စေစ၊ သေဘာတညချကသက ေသခ စာချ ပစာတမးချ ပဆ သညေနမသးလေကျာလနသညအခါဖြ စေစ ပြ နဆပရမညဖြ စ လျင။ (ခ) အဆပါ ေချးေင သမဟတ ေကးမြ က အဆပါ စာချပ စာတမးချ ပဆသညေနမ သးလ မေကျာလနမ ပြ နဆပရမညဖြ စ လျင။

ကငးလတခင အသသကေသလကမတမေရးထးဘ ချပဆသည ကနစည ေပါငနခြ ငးစာချပစာတမး။

၇။ အခငအာဏာလအပချကအရ ေဆာငရကရနခနအပသညစာ တမး။ ၎ငးကေသတမးစာမဟတ ေသာေရးသားချကတစခခဖြ င - (က) ယမတအပနခရသများက ခနအပရနပြ လပလျင၊ (ခ) ေရ ေပြ ာငးနငေသာပစစညး သမဟတ မေရေပြ ာငးနငေသာ ပစစညးအတက ေဆာငရကရန ခနအပသညစာတမးပြ လပလျင။

၈။ ရာဖြ တစာတမး သမဟတ တနဖးဖြ တ ချကစာတမး။ တရားမမစစေဆးေနစဉအေတာ အတငးတရားရး၏အမနအရပြ လပခြ ငးမအပအခြ ားနညးဖြ င ပြ လပသညထစာတမးမာ -

(က) ေငေပါငး ကျပ ၁ သနး ထကမပလျင (ခ)အခြ ားကစစရပတစခခဖြ စလျင

9.APPRENTICESHIP-DEED - including every writing relating to the service or tuition of any apprentice, clerk or trainee, placed with any master to learn any profession, trade or employment, not being ARTICLES OF CLERKSHIP (No.11).

Exemption. Instruments of apprenticeship executed by which a person is apprenticed by or at the charge of any public charity. 10. ARTICLES OF ASSOCIATION OF A COMPANY -

(a)Where the company has no share capital or the nominal share capital does not exceed kyat 100,000,000.

(b)Where the nominal share

capital exceed skyat 100,000,000.

Exemption.

Articles of any association not formed for profit and registered under section 26 of the Myanmar Companies Act. See also MEMORANDUM OF ASSOCIATION OF A COMPANY (No.39).

Exemptions. (a) Lease executed in the case

of a cultivator and for the purposes of cultivation (including a lease of trees for the production of food or drink), without the payment or delivery of any fine or premium, when a definite term is expressed and such term does not exceed one year, or when the average annual rent reserved does not exceed kyat 10,000.

(b) Leases of Fisheries

granted under the existing Laws.

Exemption. Policies of life-insurance granted in accordance with the rules for Postal Life Insurance.

E.-RE-INSURANCE BY AN INSURANCE COMPANY, which has granted a policy of the nature specified in Division A or Division B of this Article with another company by way of indemnity or guarantee against the payment on the original insurance of a certain part of the sum insured thereby.

General Exemption. Letter of cover or engagement to issue a policy of insurance: Provided that, unless such letter or engagement bears the stamp prescribed by this Act for such policy, nothing shall be claimable thereunder, nor shall it be available for any purpose except to compel the delivery of the policy therein mentioned.
