AN 11th hour deal savedSouth African mining tycoonMzi Khumalo’s two multi-
million rand properties in the luxu-ry Zimbali Golf Estate outsideBallito from going under auction, yesterday morning.
The plots were expected to beauctioned at the instruction of FirstRand Bank at the office of theSheriff in Stanger, KwaDukuza Mu-nicipality at 10am.
But with less than an hour be-
fore the properties with a com-bined value of R15.9-million wentunder the hammer, the auctionwas called off.
Acting for FRB, Alan Jacobs ofMendelow-Jacobs Attorneys saidan arrangement was made withinan hour before the auction tookplace adding that this “is not unu-sual”.
He said Khumalo owed the bankapproximately R14-million and notthe R17-million as has been sug-gested in media reports.
Deeds Office records show thetwo properties are owned by Khu-
malo’s Trust, the Mzi KhumaloFamily Trust.
“My client is happy.Mr Khumalohas accepted a payment arrange-ment,” said Jacobs.
He said the details of the agree-ment are “confidential” but addedthat all parties accepted the terms.
According to the Stanger sher-iff’s office, there were over 300calls of interest made concerningKhumalo’ s properties, with anumber of potential buyers havingalready arrived before 9am.
Khumalo’slawyer, SikanderTay-ob, confirmed the matter had been
finalised with all parties satisfied.“It has been amicably resolved,”
said Tayob.Property valuation tool used
widely by South African estateagents, Lightstone, said the proper-ties on Camwood Street are valuedatR7.6-millionandR8.3-million re-spectively.
Records show that between thetwo plots, Khumalo borrowed ap-proximately R16-million from thebank.
He bought the first vacant lot in1996 for R475 000 and borroweda combined R10.5-million from
FRB which included a loan of R500000 from the controversial bankAnsbacher South Africa, a formersubsidiary of FRB registered in thetax-haven Cayman Islands.
It has been implicated in Irelandasavehicle involved inmoney laun-dering.
The second lot was bought in2003 for R510 000 for which heborrowed R8.5-million from FRB.
Attempts to reach Khumaloproved unsuccessful. His Johan-nesburg home was contacted butstaff told the Weekly he would onlybe home later this month.

“PRESIDENT Jacob Zuma's leadershiphas led to improved service delivery.”This is according to ANC provincial executive committee member and KwaZuluNatal MEC for human settlement, Ravi Pillay, who was the guestof honour at an ANC gala dinner onThursday night.
The event, held at the Sibusiso Hallin Sundumbili, was aimed at unitingmembers of the ANC and supportersfrom the community and to raise fundsfor the organisation.
The dinner, which was attended byprominent ANC members and businesspeople, raised in excess of R200 000which will go towards building the party’s presence in the area preceding the2014 general elections.
Speaking at the dinner, Pillay saidpresident Zuma had bettered the government's delivery successes since1994.
He said this had been donethrough improved access to educationand formal housing, and the expan
sion of primary health care, electricityprovision and access to water services.
“The economy has grown and ismore diverse today than in 1993, andpublic revenues have increased,” saidPillay.
“Though divisions of race, genderand class remain, reflected in inequality across these lines, the ANC government’s policies are ensuring that westeadfastly work to remove such inequalities,” he said.
The building of a South Africabased on strong and positive principles and value featured strongly in Pillay's speech.
“The social ills, such as drug andalcohol abuse, the murder and rape ofthe elderly and teenagers, and teenage pregnancies are a manifestationof the wounds on the psyche of blackpeople in particular that still needs tobe healed,” said Pillay.
Early in his address, he called onthe community to take a moment tosend their thoughts and prayers to ailing former president Nelson Mandeladuring this difficult time.

A DISPUTE between a local secondaryschool and security service provider wasdismissed with costs in favour of theschool at the Durban High Court lastweek.
This came after Eagle Eye ProtectionServices filed an interdict to stop StangerManor Secondary School from terminating its services in June this year.
The school filed responding legaldocuments through Narrine Perumal andCompany and defended the case.
The school claimed that Eagle Eye didnot fulfil the requirements of the contractand therefore its services were terminated.
The school also claimed that EagleEye did not have specific equipment oncertain occasions and they did not have aproper monitoring system in place.
Eagle Eye believed their three year
contract was terminated without validreasoning, claiming the company did havea monitoring system in place as well as acontrol room and that they were beingtreated unfairly.
Eagle Eye took the school to court inthe hope that they would either be reinstated as the security service provider orpaid out the value of the three year contract , which amounted to more thanR500 000 in addition to legal fees.
However, the case was dismissed withcosts after the court found that EagleEye misrepresented itself in tender
documents.Speaking to the Weekly, the schools
attorney, Narrine Perumal said serviceproviders must realise that schools arenot there to make money off.
“Service providers need to take this into consideration before dragging a schoolto court over matters which could havebeen solved amicably internally.”
School governing body chairperson,Balan Naidoo said they were confidentfrom the beginning.
“When the tender was issued, basedon what the security company presented
to us, we had no option but to award thetender.
“However, other security companieswho also tendered came back to us andtold us that we flouted tender procedures.
“Investigations revealed what theywere saying was true, so we had to act,”said Naidoo.

Public Protector to probe
fraud claimsMandeni Municipality to come under scrutiny
MERVYN KRISHNA
PUBLIC Protector Thuli Madon-sela has been asked to probeclaims of mismanagement in
some KwaZulu-Natal municipalities,including Mandeni.
Other municipalities includeeThekwini,UmkhanyakudeandZulu-land.
According to information suppliedto the Public Protector's office in2009, Mandeni Municipality did notrenew the contract of Globe Tech Se-curity Company and instead brought
in Enforce Security Company.According to a reliable source,
whatmade thatmove suspicious wasthat, whereas Globe Tech SecurityCompany was paid R60 000 permonth, Enforce Security Company’spayment was about four times more, approximately R260 000 permonth.
This despite the allegations thatthe new company does not haveenough necessary resources to exe-cute its mandate.
This security company is alleged tobe the same company which was
awarded a contract by eThekwiniMunicipality.
In a statement, the Public Protec-tor'sofficesaid these are serious alle-gations.
“We do not know if they are trueor not, andwe do not in anywaywishto apportion blame to anyone.
“But if they are true, they are aserious indictment, not only againstthe political leadership of all the citedmunicipalities, but also against therelevant MEC.”
Inkatha Freedom Party deputy na-tional spokesperson, Joshua Mazibu-
ko said that his party believed that itis imperative that they are thoroughlyprobed so that the truth will comeout.
“It is the IFP’s view that, regardlessof any other investigation thatmay begoing on, if any, the office of the PublicProtector must come in urgentlyto investigate these allegations sothat the people will know thetruth.”
Attempts to obtain comment fromMandeni mayor, Siphesihle Zulu, were unsuccessful at the time of go-ing to press.

BEING on dif-ferent socialnetworks canbe excitingwhen you'remeeting newpeople andmaking newfriends, butwhat happenswhen a socialnetworkinghacker comesalong?
Facebookhacking is themost commonI believe, however recently I've noticed thatTwitter has its ownshareof hackinggoingon.
Themost common type of hacking I've no-ticed on Twitter is when a “hacked” accountsends you a private message that containsa link. When you click the link, it opens a fakeTwitter log in,whichrequiresausernameandpassword.
Once your details are entered, the hackerhas all the information they need to basicallysteal your account. I
I haven't ever seen a hacker actuallytweet anything, however the irritation factoris high when all of your followers get emailsdirecting them to some random site forweight loss and such.
The most well-known hacking messagethat I have seen is aDirectMessage (DM), thatsays “See what this person is saying aboutyou”, followed by a link.
Having any social network accounthacked can be very dangerous for you, be-cause all your personal information can beseen and your location can be found in statusupdates and location tagging.
So how do we as teenagers protect our-selves fromthesepredatorswhoare justwait-ing for us to make the first move?
We should try not to add locations onsocial networks which state our home ad-dresses. Also, try tokeepyourpersonal infor-mationonsocialnetworkslimited.Asmuchaswe would like to share information freely, itmay save us later on.
It's very unfortunate that we have to limitour freedom to saywhat wewould like on so-cial networks and let people know thatweareenjoying our lives.
However, to protect ourselves from boredpeople, there is a line we need to draw. Makesure you are always social network wise!

I LIVE in Sandra Road, Ballito and for thelast four months the street lights have notbeen working.
I called the KwaDukuza Call Centre onnumerous occasions reporting this matterbut nothing has been done.
I go home well after dark. We are livingin dangerous times where it is imperativeto have adequate lighting for some sem-blance of safety.I cannot understand why as ratepayers wehave a mammoth task of begging for ourvoice to be heard by our municipality, yetBallito is the highest rate paying area inthe KwaDukuza Municipality.
We need the street lights fixed ASAP.
Mr K Naidoo
Light up my life,please
LAST week I heard one of themost preposterous storieson 5fm. On my way to work
the SABC run station ran a leadstory about transportminister Di-pou Peters saying that only a“few” people are against the im-plementationofe-tolls inGauteng, with themajority in favour of hav-ing “world class roads”.
President Jacob Zuma recentlysigned into law the TransportLaws and Related MattersAmendment Bill, which paves the
way for the implementation of e-tolling.
Now this is not the first time agovernment official has saidsomething so outrageously non-factual and blatantly ignorant.
This happens all the time withpoliticians. The spin. That's whatits called in the ever back stab-bing world of politics. Take some-thing super ridiculous and makeit seem a little bit okay. A run ofthe mill event if you will.
But the reality of howwe live asSouthAfricans on a day to day ba-sis paints quite a despondent pic-ture.
Despite what we are told byeconomists, there is a lot of mon-ey in this country. We are oftenreferred to as the United States ofAfrica. And this is a fairly accu-rate comparison.
Our country has billions ofrands at its disposal that is beingsquandered by local, provincialand national politicians.
Many of the comments youread in this very paper as well asthe broadsheets is merely whatreporters can tell you.
We have to give you factual in-formation. But the truth is, thereare many shoddy deals both herein the iLembe District as well asthe rest of the country, which arealways benefitting politicians.
The E-tolling matter for exam-ple. This comes despite the factthat there is a fuel levy that hasbeen implemented by govern-ment.
Where are the civic associa-tions? Where are the councillorswho are meant to be implement-ing or “working together” to helpthese small communities?
This is where it all starts. Nowof course I'm not saying that allyour local politicians are involvedin shoddy dealings.
But my friends, trust me,someof them are.
Andwow,theymake a lotmore
money than you or I. I like to callit the comfort marker. Over R25000 per month.
How has KwaDukuza, for ex-ample, improved since 2011?
To me it looks shockingly thesame, andI visit all townships andsuburbs on a daily basis.
You, the so-called community, are letting yourselves down.
You are never at public meet-ings.
There are ahandful of familiarfaces that are making key deci-sions and leaving “the general”comments with the newspaper.
Is this the society you wantyour children and great grand-children to live in? Live up to thelegacy of stalwarts like Billy Nair.Don't just name drop or enjoyyour armchair critic status.
Go out to these meetings andmake a difference.
Hold your public officials toaccount. If you don't, stop com-plaining.
Where do politicians get off?

Meet KwaDukuza’stalented SaiyanNaidoo
CHILD prodigies are definedas children who possess unusual talents showing great
mastery of a certain subject, art orskill.
They are usually children noolder than 11 who show extremeproficiency in certain adultrelated fields. Today, scientists are stillstudying this mystery and tryingto determine whether prodigiesare a product of genetics or upbringing.
With KwaDukuza born SaiyanNaidoo its definitely a combination of both. Saiyan is a nineyearold who plays lead guitar for thepopular Tyles band.
Saiyan blew the audienceaway when he performed at theBattle of the Bands contest atSibaya in August this year.
Saiyan was seen strummingthe tunes of Dire Straits, Deep Purple, Santana and the Eagles, likea seasoned professional.
His rendition of Jonathan Butler’s 7th Avenue, led one seasonedmusician to comment that thenext best thing to what he heard, was indeed the original.
Saiyan has been playing guitarfrom the tender age of four. Hismentor is his grandfather SydneyNaidoo, who was the drummer forthe original Tyles band, and theband leader for the band as it is today. Sydney was quick to realiseSaiyans keen ear for music. Despite no formal music training andbeing unable to read or write music, Saiyan was able to pick up intricate pieces merely by listening.
At age five Saiyan performedbefore legendary American jazzmusician, and three time Grammynominee Ronny Jordan. In the same year, Saiyan releaseshis first CD, making him one of SA’syoungest recorded artists. In 2011,Saiyan outdid 800 other hopefulsto win a talent contest at UshakaMarine World.
However, his performance atthe Battle of the Bands Show inSibaya, is what propelled Saiyanfirmly into the limelight.Sagren Moodley of BoxOfficePromotions, who now manageSaiyan's career, believes that he isan immense talent and is destinedfor greatness on the world stage.Moodley says that Saiyan is onlynow learning to read music andplay the piano.
“It is all part of developingSaiyan as a musician and the upcoming Battle of the Bands tour ofKZN is all part of the strategy toexpose Saiyan to the world.”
Catch Saiyan and his band theTyles performing with the Chatsworth based band the Magnets, atSibaya on Friday, 18 October at7.30pm and Sunday, 20 Octoberat 3pm.
Tickets can be purchased atComputicket and Shoprite/Checkers.
