TheHonbleSupremeCourtofIndiaintheabovereferredcaseshasappointedHonbleMr.JusticeSh.VikramajitSen,
FormerJudgeofSupremeCourt asArbitrator toresolvethedisputesbetweenthepartiesvideorderdated2701
2016. The Honble Arbitrator vide procedural order no. 7 dated 23072016 passed interalia orders and the
operativepartofthesaidproceduralorderinparano.2isreproducedasunder:
Aftermuch deliberation, ithasbeen further decided that toundertakeallotment, it is imperative thata listof
eligibleallotteesisfirstdrawnupasitappearsthatinalotofcases,multiplesaledeedsoragreementshavebeen
wrongfullyandillegallyexecutedonthebasisofasingleallotment.Insuchcircumstances,ithasbeenagreedthatthe
DirectorGeneralTownCountryPlanning(DGTCP)alongwitharepresentativefromtheBuilderandarepresentative

fromtheconcernedAssociationswill inviterepresentations/applicationsalongwith theallotment documentsfrom
all the claimants/ allottees andwill examine and scrutinize these applications, asper all the existing rules and
guidelines,toidentifygenuineallotteesandpruneoutthecasesofwrongful/multipleallotments.....

TheHonbleArbitratorintheorderno.5dated7052016hassetthefollowingconditionstodetermine
entitlementofeachplotholder.
Plotholdersshouldhavemadebookingsalongwithentirepaymenttowardscostoflandpriorto07.04.1997.
Further, such plot holders should have paid/deposited the entire development charges with the Haryana
Governmentupto31.12.1999,intermsofHonbleSupremeCourtorderdated02.12.1999.
The plot holder who have made bookings along with the entire payment towards cost of land prior to
07.04.1997,buthadnot madepaymentstowards theDevelopmentcharges interms ofSupremeCourtorder
dated02.12.1999,canbe consideredprovided theyarewilling topaytheDevelopment chargesaswouldbe
requiredonthedateofcarryingouttheactualdevelopment

Themultiplicity and duplicity of claims i.e.more than one claim from one family,will not be considered as
eligible.Further,ifanypersonisalreadyinoccupationofaplotillegallyorbyencroachment,hewillsimilarlynot
beconsideredforanyfurtherallotment.
Intheproceduralorderdated23072016itwasdirectedthatthesaidexercisefordecidingeligibleallotteewill
bestartedwiththeNPNLcategory. DirectorGeneral,Town&CountryPlanning,Haryana incomplianceofthe
orders issuedpublic noticeon 18082016 innewspaperdated18082016 invitingapplications to file the
claimsaccompanyingwithsupportingdocumentsregardingallotment/bookingofplotinNoProfitNo
Losscategory(hereafterreferredasNPNL)intheofficeofSeniorTownPlanner,Sector12,Faridabadupto16
092016.Afterreceivingapplications firstmeetingofthecommittee washeldon27102016 alongwith Dr.
Monika Gusain, Standing Council on behalf of Government of Haryana, District Town Planner, Faridabad,
advocate of the concerned associations, representativeofplotholders associations. In themeeting itwas
decided that allassociationwill prepare draft format covering maximum informationrelatedtobooking

/allotmentofplots.Thecommitteedecidedthattheformatshouldbesimplewithmoredetailssothatrecord
ofclaimantscanbemaintainedregardingpaymentsmadeforbookingofplot,developmentcharge,date/year
wisepaymentsmadetothedeveloper/department,detailsofplotsize/changesintheplotno./sizeifany,land
costpersqyd.,bifurcationoflandcost/developmentchargepaidtimetotimeorinonego,detailsofallotment
ofplot,detailof BuilderBuyerAgreement,detailsof saledeed,approvalofbuildingplansandany specific
detailsproducedbyclaimants.Thescrutinyofdocumentswasinitiatedon21102016,buttherepresentativeon
behalfof thebuilderobjected thatuntiland unless copyof record received fromclaimants isprovided to
them,theverificationshouldnotbecommenced.Itwaspointedouttothemthatexceptdetailsofclaimants
received from associations, thedocuments of individuals were collectedby their staffonly in theofficeof
STP/DTP and theywere also asked to submit the original record in STP officewithin two days aftermaking
necessarycopiesaspertheirrequirementandatleastthesecasescanbeputupforverificationbynextdate
ofhearing.
Theformatwasfinalizedbythecommitteeon6112016andthescrutinyofdocumentswasinitiatedon7112016.
Duringthefirstdayof scrutinyrepresentativeofdeveloperhadpointedout that asperthedirectionof Honble

Arbitrator,copiesofdocumentsreceivedfromclaimantbeprovidedfirstsothatitcanbeexaminedbythem.Since
itwasgoingtotakelotoftime,thereforetherepresentativeofthebuilderwasadvisedthesameintheofficeSTPso
thatprocessofscrutinyofapplicationsreceivedbyhisstaffintheofficeofSeniorTownPlanner/DistrictTown
Planner Faridabad can be initiated to avoid delay and subsequently the representative of coloniser can take
photocopy of the applications/ documents received from claimants. For the above said reason scrutiny process
actualycommencedon21112016. Initially average30cases were takenup for scrutiny per sittingwhichwas
increased toaverage40 perdaykeeping inview theno.ofclaims tobeheardandalso themeetingdays were
increasedfromthriceaweektofivedaysaweekkeepinginviewthevolumeofwork.
Although the claimantappearingbefore the committeewereadvised thatwhat sortofdocuments they
shouldproduceandwhatshouldnotbeproducedbeforethecommitteefortheverification/scrutinyofdocuments.
But itwasobservedthatmostoftheclaimantscamewithallthecorrespondencesmadewiththecoloniser and it
tookmoretimetoscrutinizetheclaimsinspiteofallnecessaryhelpbythememberofthecommitteetoindividual
claimant.Duringthescrutinyitwasobservedthatinmostofthecasesplotsweretransferredfromoneallotteeto
anotheraftertakingtransferchargesbythedeveloperandtherewaspossibility/chancethatreceiptsintwonames

foroneplotcanbereproducedbytheotherclaimantstherefore,afterthirddayofscrutinyitwasdecidedthatthe
originalpaymentreceiptsshouldbestampedsothatitcannotbereproducedbyanyotherclaimants.
ThecommitteealsoobservedthatinmanycasesGPAorSPAholderhaveapplieddirectlyforallotmentofplot
under their namewithout executing saledeed in their favour by the original allottee therefore the name of the
originalallotteewastakenuponlywhilereferringnameofGPAorSPAholdertoknowthathowmanyapplication
havebeenreceivedthroughGPA/SPA.Itisalsoobservedinsomecasesthattheownerofplothaveexecutedwillor
agreement to sale in their favour. The application submittedbyGPA/ SPAholder in theirownname havebeen
consideredbythecommitteesincetheyhadauthoritytorepresenttheircase.
Beforestartingtheprocessofverificationoforiginaldocuments,thecommitteeobservedthatasper
departmentpolicy on NoProfitNoLoss(hereafter referredasNPNL)25%oftotalno.ofresidentialplotsof
sizes125 sqmts. to225 sqmts,orotherwise approved specifically in the layoutplan byDirector Town and
CountryPlanningare keptunderNPNLcategoryplots.But in thisparticularcase on thedirectionofHonble
PunjabandHaryanaHighcourt inCWPno.3311o
