    Modificri ale legislaiei romne a muncii, n conformitatecu noul cod al muncii

    Actuala reform a Codului Muncii va duce la o pia a muncii mai flexibil n

    Romnia, ceea ce va mbunti competitivitatea rii i va genera astfel oportuniti

    pentru crearea de noi locuri de munc, esteconcluzia principal a conferinei NoulCod al Muncii, noi oportuniti, organizat de PwC Romania.

    Potrivit noii legi, prevederile din fia postului vor deveni fundamentale pentruevaluarea performanei profesionale a oricrui angajat, ceea ce va preveni eventualeabuzuri din partea angajatorilor. De asemenea, noul Cod al Muncii stipuleaz faptul cperformana profesional va fi criteriul principal avut n vedere n cazul unei eventualedisponibilizri colective efectuate de o companie ca urmare a conjuncturii economicenefavorabile, nlocuind astfel vechile prevederi care impuneau ca situaia social a unui

    angajat s fie luat n considerare n principal atunci cnd se efectuau disponibilizricolective.

    Angajrile pe perioad determinat au fost extinse pn la 36 de luni, ceea ce vastimula companiile s fac mai multe angajri pe baz de proiecte, fr teama cpersonalul adiional va deveni o povar financiar dup finalizarea proiectelor.

    O alt prevedere care vizeaz flexibilizarea pieei muncii, ine de perioada de lucru.Potrivit noului Cod al Muncii, n cazul n care o companie se confrunt cu o scdere acererii i cu o conjunctur economic dificil, aceasta poate decide n mod unilateralreducerea programului de lucru de la 5 zile pe sptmn la 4 zile, reducnd astfelcosturile de personal cu pn la 20%. Aceast prevedere va proteja locurile de munc din

    Romnia.Companiile vor beneficia de asemenea de o perioad de prob extins pentru noii

    angajai, de pn la 90 de zile pentru funciile de execuie i 120 de zile pentru poziiilede management. n plus, perioada n care companiile trebuie s compenseze orelesuplimentare efectuate de angajai a crescut de la 30 la 60 de zile, ceea ce corespunde cuciclurile de afaceri ale companiilor.

    Reforma Codului Muncii s-a aflat n mod constant pe agenda comunitii de afaceridin Romania. Recenta criz economic i msurile pe care companiile au fost nevoite s

    Changes of romanian employment laws as providedby the new labour code

    The current reform of the Labour Code will bring about a more flexible labour

    market in Romania, which will improve the countrys competitiveness, thus opening up

    new opportunities for job creation, this is the main conclusion of the conference

    New Labour Code, new opportunities, organized by PwC Romania.

    According to the new law, the provisions of the job description will becomeparamount in assessing the professional performance of any employee, which willprevent abuses from employers. Also, the new Labour Code stipulates that professionalperformance will prevail in case of disposals made due to the economic situation of acompany, thus replacing the old provisions that social criteria had to be taken intoconsideration first when undertaking disposals.

    The temporary labour agreements have been extended up to 36 months, which willstimulate companies to hire more employees project-based, without fear that theadditional personnel will become financially burdensome once the projects have beencompleted.

    Another provision that will make the labour market more flexible, concerns theworking time. According to the new Labour Code, in case a company is faced withreduced demand and harsh economic circumstances, it can unilaterally decide onreducing the work schedule from 5 to 4 days per week, thus reducing personnel costswith up to 20%. This will help protect the existing jobs in Romania.

    The companies will also benefit from an increase ofthe trial period for recently hiredemployees, of up to 90 days for executive positions and 120 days for managementpositions. In addition, the period in which companies have to compensate the overtime oftheir employees grew from 30 to 60 days, which is an interval better adapted to currentbusiness cycles.

    The reform of the Labour Code has been constantly on the agenda of the Romanianbusiness community. The recent economic downturn and the measures that local

    companies had to implement in order to safely navigate the crisis, sent a clear message

    to the authorities that the labour market needed more flexible provisions, stated CarmenMedar, Managing Associate, D&B David si Baias.

    According to the recent edition of PwCs Global CEO Survey, managing talent hasbecome the top priority of CEOs worldwide, 83% of the 1200 CEOs surveyed worldwideindicating that they plan to change their firms talent management strategy over the next12 months, while 31% stating that these changes will be major.
