l. Bids shall be submitted Manually in the Box provided in the Office of the Director,

Urban Bio-Diversity, Indira Park, Lower Tank Bund Road, Hyderabad.

The Bid processing fee and GST are non refundable in any circumstances. The

bid security deposit shall be refunded to the unsuccessful bidders except Hl and

H2, soon after finalizing the tenders, after receipt of requisition from the bidder.

Tenders submitted without EMD shall be summarily rejected.

The Bidder should handover the Bid processing fee, EMD, Bid Security and

GST by way of DD',s to the Director (Urban Bio-Diversity), GHMC on or before

opening of technical bid on proper acknowledgement.

The bidder is advised to submit their Hard copies of tender document.

Bidder shoutd give a Declaration that the bidder it's sister concerns if any,

GHMC reserves their right in not considering a bid of the bidder, if such

bidder/consortium member was a previous supplier and had a past bad track

record or their earlier performance was unsatisfactory on any count.

The bidder must keep the bid validity for a period of 120 days with effect from

the date of opening of financial bid. If the bidder withdraws his offer within 120

days the security deposit will be forfeited.

Any wrong declaration in this regard if comes to the notice at a later date' will

disqualif, him from tendering.

The Commissioner, GHMC reserves the right to accept / reject any or all the

tenders without assigning any reasons thereof'

should do so in writing.

Amendment of bidding documents:

i. At any time prior to the deadline for submission of bids, GHMC, for any

reason, whether at its own initiative or in response to a clarification

requested by a prospective bidder, may modify the bidding documents by

amendment.

ii. All prospective bidders those have received the bidding documents will

be notified of the amendment and such modification will be binding on

all bidders.

iii. In order to allow prospective bidders reasonable time in which to take the

amendmentintoaccountinpreparingtheirbids,theGHMC,atits

discretion, may extend the deadline for the submission of bids.

t 8. The GHMC will deal with the bidder directly and no

middlemen/agents/ commission agents etc. should be asked by the bidders to

represent their cause and they will not be entertained by the GHMC'

The tenderers should quote the prices both in words & figures in Indian

currency. No sort of representations will be considered in this matter.

The GHMC, in its discretion, reserves the right to reject or accept any or

all the tenders, wholly or partly, without assigning any reasons. The decision of

the Director (urban Bio-Diversity), GHMC with regard to the Technical Bids

will be final and no correspondence or representations will be entertained in this

regard.

Even after awarding the said contract, the GHMC reserves the right to terminate

the same at any time, without assigning any reason'

22. The quantity of requirement is approximately mentioned in tender shall be liableto increase/decrease depending upon the necessity. Statutory Deductions will be

effected at the time of payment as per rules and vogue.

Successful bidder shall have to execute an agreement within (7) days from the

date of issue of Intimation letter/Work Order with GHMC on a non-judicial

stamp paper worth Rs.l00/- (should be submitted by the agency) expressing

acceptance of the terms and conditions at his / their own cost.

The Commissioner, GHMC reserves the right to accept or reject any tender

either partly or wholly without assigning any reason thereof.

The bidder shall appoint one liaison officer to attend arbitration if any at his own

cost for immediate settlement.

Termination of the Contract

GHMC, Hyderabad is the sole arbitrator in case of failure by the vendor to

perform any of its obligation under or arising out of the agreement. All disputes,

differences and questions what so ever which may arise between the parties here

to during the continuance of the agreement the GHMC, Hyderabad will have

option to terminate the agreement or impose penalty' Order can be terminated by

GHMC, Hyderabad without assigning any reasons forthwith.

Special Conditions :

Tender Schedule should be submitted in sealed cover with the superscription, as

catching" should contain the technical qualifications as follows.

Central Government with a total turnover of Rs.l lakh or more in any one

２′ The Particulars of the applicant like Name, Address, Phone numbers, Bank

Account Number, the nature of account, and the name of the Bank, email ID etc.,

to be furnished on the form supplied along with the tender schedule.

No alterations, amendments or modifications shall be made by the tenderer in the

tender documents like declaration & undertaking, Terms & conditions,

Specifications and if any such alterations are made or any special conditions

attached, the tender is liable to be rejected without reference to the tenderer'

lf the tender is made by an individual it shall be signed by him and his full name

and complete address shall be given. If it is made by partnership firm it shall be

signed in the name of the hrm by a partner of the firm who shall sign his own

name and give the name and address of each partner of the firm' In case the

Once a sealed tender is received with the application it will not be retumed under

any circumstances and the rate tendered therein by the tenderer shall be binding

GHMC shall have the right and power to change, modify, alter, extend, and

opening of tenders to any other day for reasons recorded in writing.

The tenderer should remit the Tender Processing Fee, GST, EMD & Security

Deposit through Demand Drafts drawn on any nationalized bank as mentioned

above and should enclose the same along with the tender (in cover "A")'

EMD & Security Deposit of unqualified tenderers will be returned on the same

day ofopening ofthe tenders on request.

The issue of license shall be to the highest quoted tenderer by way of tender and

the selected bidder / tenderer on fulfilling terms and conditions will be accorded

the license for running of pedal boats / Motor Boats / Fish breeding and Catching

at Indira Park for a period of (l) year. The bidding of licensing fee is for one

year. However the minimum bid amount for one year is fixed as Rs' l.tl5'900/-

(RupeesoneLakhEightyfiveThousanclandNineHundredonly).

16. The tender quoted by the tenderers shall be higher than the highest tendered

amount and shall be in multiples of Rs'100/-'

18. In case the day and the date fixed for the receipt of tenders is declared by the

Govemment as public holiday, the same will be held on the immediate next

working day and accordingly the date of receipt of tenders will get extended,

except as otherwise informed to the tenderers at the place of tender or through a

newspaper notification or by affixing a notice to that effect on the notice board in

Urban Biodiversity, GHMC.

The acceptance of the Tender Amount during tenders shall be subject to

confirmation by the Commissioner, GHMC. lntimation of confirmation of

License or otherwise as the case may be, will be communicated by Registered

Post or mail etc., within (7) days of such confirmation. In case of non-receipt of

such intimation, it shall be the responsibility of the applicant to personally obtain

a duplicate copy of the notice from the Office of the Director, Urban

Biodiversity, GHMC. Non-receipt of the notice by the applicant shall not be a

ground for non-payment of tendered amount / bid amount.

All correspondence will be made to the address given in the application form. It

shall be the responsibility of the applicant / tenderer to effect any changes in the

address recorded in the records of GHMC.

The tenderer is solely responsible to receive any sort of communication from

GHMC of Hyderabad.

The tenderer"s quote must be firm and shall include all taxes such as sales tax,

ESI / pF and any other statutory levy etc. The rates quoted by the Tenderer shall

remain firm throughout the contract for any reason whatsoever. It should be

clearly understood that any claims for extra sales tax, and any other statutory

levy taxes etc. shall not be entertained in any case whatsoever'

SITP INSBECTION BY THE TENDERFRS:

24. Before tendering, every tenderer is expected to inspect the site of the proposedwork and acquaint & satisfy himself for logistics and provisions & extent therein,

as well as permission from authorities for this purpose. He must go through all

the specifications and other tender documents. Any further clarifications in the

drawings and documents can be had from the Director, Urban Biodiversity,

GHMC. Submission of the tender shall be deemed to be due compliance with

this clause. Any extra claims made in consequence of any misunderstanding,

incorrect information on any of these points or on the grounds of insufficient

description or information shall not be entertained or allowed at any stage'

SCOPE. EXTENT & INTENT:

25. The general character and the scope of the work shall be as defined in the

specifications and other tender documents'

The tenderer shall take up and carry out the work under the tender in every

respect and the work shall include everything else necessary for the proper

execution and successful completion of the work in accordance with the contract

documents and to the discretion and satisfaction of the GHMC' The tenderer

shall be fully responsible and liable for every'thing and all matters in connection

with or arising out of or being a result or consequence of his carrying out or

omitting to carry out any part of the work'

The tender documents are complementary and what is called for by any one shall

be binding as if called for by all. wherever it is mentioned in the tender

documents that the contractor shall perform certain work or provide certain

facilities, it is understood that the contractor shall do so at his own cost'

Materials or work described in words, which so applied have a well known

technical or trade meaning shall be held to refer to such recognised standards as

are applicable'

other recreation activity and GHMC has the right to collect additional fee for

satisfactionoftheGHMC.Also,allmachines,toolsimplements,cleaning

materials,manpowerandeverythingelsenecessaryfortheproperand

satisfactoryexecutionoftheworkinaccordancewiththecontractconditions

shall be provided by the tenderer at his own cost'

Thetenderer..srepresentativeshallbeonthesiteatalltimesandshallbe

responsibleforcarryingouttheworktothetruemeaningof,Specifications,

Conditionsofcontract,anddirectionsoftheGHMC.Theinstructionsand

directionsgiveninwritingtotheTenderer..sRepresentativeortoanyofhis

assistantsatthesitebytheGHMCshallbedeemedtohavebeengiventothe

41. The tenderer shall, in addition to other personnel, engage expert swimmers, life

jackets, safety equipment during the entire duration of boating hours to save the

visitors, workers, children etc. from accidental or willful falling into the water

bodies.

The tenderer is wholly /solely responsible for damages to public caused due to

boating activity. All the compensation and claims shalt have to be borne by the

successful tenderer.

Fish Breedins 4 catchine:

43. Breeding of cat fish is prohibited. Before dropping the seed fish in the pond the

tenderer should inform the in-charge officer of GHMC duly obtaining varietal

certificate from Fisheries Department'

If cat fish is caught in the lake it should be handed over to veterinary

Department, GHMC and destroy them immediately as per rules'

The fishing should be done during 10'00 am to 3'00 pm only when morning &

evening walkers not present in the park'

catching of fish should be done with trained personnel only who can perfectly

swim.

The successful tenderer shall use proper fishing equipment' fish net etc'' and

fi sherman safetY equiPment'

The successful tenderer shall not drop any polluted material in the pond as fish

food. The fish should be grown naturally'

Reduction and increasing of water level in the pond may effect fish breeding for

which GHMC is not resPonsible'

50. The fish caught should be transported outside the park and should be sold outside

Indira Park only.

The dead fish should be removed regularly from the pond and disposed properly

to the nearest bin outside the park.

The fish litter around the pond should be removed regularly.

All the personnel engaged by the successful tenderer like supervisors, boat

operators, swtmmers, fishermen etc. shall be trained & experienced, in the work

canied out bY them.

54. Sub-leasing or transfer of this license by the tenderer in whatever manner ls

prohibited and unlawful and liable for cancellation of license I contract I

agreement and eviction of the tenderer from the above said premises besides

forfeiture of the caution Money Deposit and other amounts paid by the agency

DISCRE,TIONARY POWERS OF THE CQMMISSIgIIER' GHMC:

55.TheCommissioner,GHMCreservestherighttoacceptorrejectanytenders

withoutassigninganyreasons.ThedecisionoftheCommissioner,GHMCwill

be final and binding'

contract,the decision ofthe CommiSSiOner,GHMC WiH be flnal and binding.

58. The Commissioner, GHMC will have right to issue directions from time to time

for the proper running of boating activity and such directions are binding on the

part ofthe Tenderer.

The Commissioner, GHMC reserves the right to withdraw or cancel the license /

agreement / contract with seven days notice without assigning any reason'

For violation of any terms and conditions by the licensee, the Commissioner'

GHMC shall have the right to cancel the license / agreement / contract with

seven days advance notice.

The acceptance of tender shall rest with the commissioner, GHMC who does not

bind to accept the highest tender and reserves to the right to reject any or all the

tenders received without assigning any reason(s) whatsoever. Non-acceptance of

any tender shall not make the tenderer(s) liable for compensation or damages'

In case of drying up of the water body or if sufficient water is not present in the

waterbodyforrunningofthesaidactivityduringanyparticularmonthofthe

contractperiod,ontherequestofthetenderer,thecommissioner,GHMCwill

compensate that particular period duly giving time extension for such period

even after contract period. In any case the total months during which the tenderer

runs the boats shall not exceed 12. However, such cases will be considered only

whenthetenderedactivitycouldnotbetakenupforthereasonsmentioned

above and such period shall not be less than (30) days and it shall be in multiples

of 30 days. The decision of GHMC is final for deciding whether the water level

is sufficient or not for running the boating'

The boating / fishing should not cause any damage to the Jet fountains working

in the lake. The damages if any should be paid to the GHMC'

GHMC is final with regard to proper running of boating'

The consequences or claims of bad service or no service provided by the

tenderer, ifany, shall have to be borne by the tenderer'

68. After expiry of the contract period, the Tenderer shall have to vacate the park

69. In case of cancellation or withdrawal of the license / contract / agreement or

onexpiryofthelicense/contract/agreementperiod,thelicenseeshallbe

deemedtohavevacatedthepremisesandpossessionrevertedtotheGHMC

andGHMCshallhavetherighttoevictthetendererandalsototreatthe

tendererastrespasserorencroacherliableforcriminalactionunderlaw'

70. GHMC shall not be responsible for any loss to the tenderer due to termination

ofthelicensebytheGHMCaspertermsandconditionsorvacationof

premises by tenderer for whatever reason

71. TheTenderershallcomplywithallapplicablelawsandgovernmentacts

73. The tenderer shall comply with all applicable environmental laws and

regulations and shall ensure that the site is and remains free from pollutants

throughout the contract period. Notwithstanding the above' the tenderer shall

comply with all the directions and decisions of the GHMC in this regard'

74. All licenses and permits for the materials under Government control, and

those required to be obtained by the tenderer for the execution of the work'

totreatthelicenseeastrespasserorencroacherandisliableforcriminalaction

107. The licensor shall have the right to grant similar license for any other

109. Sub-leasing of canteen or transfer of this license by the licensee in whatsoever

the manner is prohibited and unlawful and liable for cancellation of license and

eviction from the above said premises'

110. It shall be the responsibility of the licensee to strictly follow all other laws' rules

andregulationsandotherconditionspertainingtotheactivitylaiddownbythe

authorities concerned from time to time'

lll.Incaseofanydispute,thedecisionoftheCommissioner,GHMCshallbefinal

llz. GHMC shall have the right and power to change/modify' alter' extend' and

reduce the time of tender and also to postpone the date of receipt of tenders

The licensee is solely responsible to receive any sort of communication from

Greater Hyderabad Municipal Corporation'

The licensee shall not put-up any activity, which will cause inconvenience to the

visitors (like equipments of sound systems, erection of publicity material of

products being sold etc.,) in the park'

ll8. The licensee shall not indulge in unlawful activities in the licensed area and

other areas ofthe Park'

The GHMC reserves the right to impose/ enforce any special term/condition/s in

the service level agreement arising aS per the Government orders, if any, from

time to time in the interest of security of general public/visitors of the park' etc'

The GHMC will have right to issue directions from time to time for the proper

PAYMENT TERMS:

121, The successful bidder / tenderer shall have to pay

including but not limited to non-compliance with the applicable laws and

licenses and permits, infringing any patents rights and specifically regarding use'

storage and disposal of hazardous materials'
