    AmaMadde 1 - Bu Ynetmeliin amac, ticari hava tamacl yapan iletmecilerin, bnyelerinde bulunan hava

    aralarnn uua elverililiini korumak iin kurmalar gereken bakm sistemi konusunda usul ve esaslarbelirlemektir.

    KapsamMadde 2 - Bu Ynetmelik, 2920 sayl Trk Sivil Havaclk Kanunu ve ilgili Ynetmelikler kapsamnda

    ticari hava tamacl yapmak zere yetkilendirilmi gerek ve tzel kiiler ile bu amala kullanlacak hava aralarnkapsar.

    KNC BLMGenel Esaslar

    GenelMadde 5 - letmeci, uu ncesi kontrollerin JAR-145 onayl bir kurulu tarafndan yaplmas gerekmedii

    durumlar haricinde, bir hava aracn JAR-145 onayl bir kurulu tarafndan bakma alnmadka ve serviseverilmedike iletemez.

    BavuruMadde 6 - letmeci, bakm sisteminin onaylanmas amacyla veya iletilen hava arac tipinde deiiklik

    olmas durumunda, operasyona balama tarihinden en az 15 gn nce SHGM'ye yazl olarak bavuruda bulunmakzorundadr. Bu bavurunun ekinde bulunmas gereken dokmanlar unlardr:

    a) letmecinin Bakm Ynetimi El Kitab,b) letmecinin filosunda bulunan her bir hava arac iin hazrlanan bakm program(lar),c) Hava arac teknik defteri,

    d) Bakmlarn szleme ile yaplaca durumlarda, iletmecinin JAR-145 kuruluuyla JAA TGL 15euygun olarak yapt bakm szlemesi,e) letmecinin bnyesindeki hava aralarnn says, marka ve modeli, seri numaras,f) Ek-1de bir rnei bulunan Bakm Sistemi Bavuru Formu (Form-2M).

    OnayMadde 7 -letmecinin bu Ynetmeliin 6nc maddesinde belirtilen dokmanlarla SHGMye bavurusunun

    ardndan SHGM, sz konusu dokmanlar zerinde ve iletmeci bnyesinde incelemeler yapar. ncelemelerin sonucuen ge 30 gn iinde iletmeciye bildirilir. Bakm sistemi SHGM tarafndan onaylanmad srece iletmecioperasyona balayamaz.

    Bakm SorumluluuMadde 8 - letmeci, bir hava aracnn uua elverililii ile operasyonel ve acil durum ekipmannn

    kullanlabilirliini salamak iin aadaki hususlar yerine getirmek zorundadr:

    a) Uu ncesi kontrollerin yaplmas,b) MEL ve eer varsa hava arac tipi iin CDL gz nne alnarak operasyon emniyetini etkileyen herhangi

    bir arza veya hasarn onayl standartlarda giderilmesi,c) letmecinin onayl hava arac bakm programna uygun olarak tm bakmlarn zamannda yaplmas,d) letmecinin onayl hava arac bakm programnn etkisinin analizi,e) Srekli uua elverililii salamak amacyla yaymlanan her trl operasyonel direktifin, uua

    elverililik direktifinin ve SHGM tarafndan zorunlu klnan direktifin uygulanmas,f) Onaylanm bir standarda bal olarak zorunlu olmayan modifikasyonlar iin hazrlanan politikann

    oluturulmas ve bu politikaya uygun olarak modifikasyonlarn uygulanmas.

    Bir iletmeci, iletilen her bir hava aracna ait uua elverililik sertifikasnn geerliliini, sertifikadabelirtilen geerlilik sresi ile her trl bakm koulunu gz nne alarak ve Bakanln yaymlad ilgili mevzuata

    uygun olarak salamak zorundad

    letmeci, bakm ynetimi konusunda hava aralarnn uua elverililiinden ve uu emniyetinin gereklerinisalamaktan sorumlu olup, bu sorumluluu bir baka kii veya kurulua devredemez.

    letmeci, yukarda belirtilen hususlar, Bakm Ynetimi El Kitabndaki prosedrlere uygun olarak yapmakzorundadr.

    Bakm YnetimiMadde 9 - letmeci, uygun bir JAR-145 onayl kurulu ile SHGM tarafndan kabul edilmi bakm

    szlemesi yapt durumlar haricinde, bu Ynetmeliin 8inci maddesinin (b), (c), (e) ve (f) bentlerindeki hususlar yerine getirmek iin JAR-145 bakm yetkisi almak zorundadr.

    8inci maddede belirtilen tm ilemlerin onayl standartlarda ve zamannda yaplmasn salamak iin

    iletmecinin yeterli personel istihdam etmesi zorunludur. Bu personel iletmecinin bakm ynetimi birimini(mhendislik birimi) oluturur. Bu personeli ynetmek ve 8inci maddedeki ilemleri yrtmek SHGM tarafndanonaylanmas gereken bakmdan sorumlu ynetici personelin (teknik mdr) sorumluluundadr. Bu personel ayn

    zamanda bakm sistemi konusunda kalite blmnn belirledii her trl dzeltici ilemin yaplmasndan dasorumludur.

    Bakmdan sorumlu ynetici personelin, havaclk, uak, elektrik, elektronik veya makine mhendisi ya dailetilen hava aralarndan en az birini kapsayan geerli bir teknisyen lisansna sahip olan bir teknisyen olmas, iletmeBYEKi, iletilen hava arac tipleri ve bakm yntemleri, JAR-145 ve JAR-OPS ile kalite sistemi hakknda bilgi veeitime sahip olmas zorunludur. Ayrca bu personelin, havaclk, uak, elektrik, elektronik veya makine mhendisi ise2 (iki) yl sivil havaclk sektrnde olmak zere en az 5 (be) yllk i tecrbesine sahip olmas, teknisyen ise en az 15(onbe) yllk sivil havaclk sektrnde i tecrbesine sahip olmas zorunludur.

    letmeci JAR-145 bakm yetkisi almam ise, bu Ynetmeliin 8inci maddesinin (b), (c), (e) ve (f)bentlerindeki hususlarn yerine getirilmesi iin bir veya birden fazla JAR-145 onayl kurulu ile ana bakm, hat bakm,motor bakm ile kalite unsurlarn ieren ve SHGM tarafndan kabul edilmi olan szleme veya szlemeler yapmakzorundadr.

    Bir iletmeci, personeli iin alma koullar elverili olan ve kabul edilebilir olanaklara sahip ofislersalamak zorundadr.

    Kalite SistemiMadde 10 -letmecinin kalite sistemi, aadaki hususlar kapsamak zorundadr:

    a) 8inci maddede belirtilen faaliyetlerin iletme BKEKinde yer alan prosedrlere uygun olarak yaplpyaplmadnn,

    b) Szleme kapsamnda yaplan bakm faaliyetlerinin szlemeye uygun olarak srdrlpsrdrlmediinin,

    c) Tm prosedrlerin ve szlemelerin bu Ynetmeliin gereklerini salayp salamadnn,izlenmesi.

    letmecinin JAR-145 kapsamnda yetkilendirilmesi durumunda kalite sistemi, JAR-145in gerektirdii kalitesistemiyle birletirilebilir.

    letmeci Bakm Ynetimi El KitabMadde 11 -letmeci, kurulu yapsn ve aadaki hususlar ieren bir BYEK hazrlamak zorundadr.

    Bu Ynetmeliin;a) 9uncu maddesinde geen bakm sisteminden sorumlu ynetici personel ile mhendislik biriminde grevli

    dier personel,b) 8inci ve 10uncu maddesinde anlan gerekleri yerine getirmek iin izlenecek prosedrler. letmeci JAR-

    145 onayl bir bakm kuruluu ise, bu prosedrler iletmecinin BKEKine dahil edilebilir. Bu durumdailetmecinin talebine bal olarak BYKEK kullanlmas da mmkndr.

    letmecinin BYEKi veya BYKEKi ile yaplacak her trl deiikliin SHGM tarafndan onaylanmasgereklidir.

    Hava Arac Bakm ProgramMadde 12 - letmeci, iletilen hava aralarnn bakmlarnn SHGM tarafndan onayl bakm programna

    gre yaplmasn salamak zorundadr. Bakm program, yaplacak tm bakmlarn ayrntlarn ve sklklarn iermek

    zorundad

    sahibi olan iletmelerin gvenilirlik program

    oluturmalar zorunlu olduundan, iletmeci Bakanln yaymlad ilgili mevzuata uygun olarak bir gvenilirlikprogram oluturmak zorundadr. Gvenilirlik program, bakm programnn iinde yer alabilecei gibi ayr birdokman olarak da hazrlanabilir.

    letmecinin bakm programnn ve sonrasnda yaplacak her trl deiikliin SHGM tarafndanonaylanmas gereklidir.

    Hava Arac Teknik DefteriMadde 13 - Bir iletmeci her bir hava arac iin aada belirtilen bilgileri ieren bir hava arac teknik defteri

    hazrlamak zorundadr:

    a) Srekli uu emniyetini temin etmek iin her bir uu hakknda bilgi,b) Gncel bakm k sertifikas,

    c) Bir sonraki planl ve plansz bakmlarn yaplmas gereken tarihleri ieren bilgi. Bu bilgi, SHGMninonayyla baka bir yerde tutulabilir,

    d) Hava aracnn operasyonunu etkileyen tm ertelenmi arzalar,

    e) Bakm destek anlamalaryla ilgili rehber talimatlar,f) letmenin veya bakm yapan kuruluun JAR-145 yetki numaras.

    letmecinin teknik el kitab sisteminin ve sonrasnda yaplacak her trl deiikliin SHGM tarafndanonaylanmas gereklidir.

    Bakm KaytlarMadde 14 - Bir iletmeci, son kayt tarihinden sonra hava arac teknik defterini 24 ay saklamak zorundadr.

    letmeci aadaki bilgileri, belirtilen sreler iin SHGM tarafndan kabul edilebilir bir formda saklamakzorundadr:

    a) Hizmete verildikten sonra 24 ay boyunca, hava arac ve hava aracna taklm olan paralara ait ayrntlbakm kaytlar,

    b) Hava aracnn daimi olarak hizmetten geri ekilmesinden sonra 12 ay boyunca, hava arac nn ve tmmrl paralarn toplam uu sreleri ve inileri,

    c) Yeniletirmeye tabi hava arac ve hava arac paralarnn son yeniletirmeden itibaren uu sreleri veinileri,

    d) Son yaplan planl bakmlarn tarihlerini/uu srelerini/inilerini gsteren gncel durumu,e) Hava aracnn daimi olarak hizmetten geri ekilmesinden sonra 12 ay boyunca, hava arac ve hava arac

    paralarna uygulanabilir uua elverililik direktiflerinin gncel durumu,f) Hava aracnn daimi olarak hizmetten geri ekilmesinden sonra 12 ay boyunca, hava arac na ve havaaracna taklm olan motorlara, pervanelere ve uu emniyetine etki edebilecek tm paralara uygulananmodifikasyonlarn gncel ayrntlar.

    Bir hava arac daimi olarak baka bir iletmeciye devredilirse; hava aracn devreden iletmeci, yukardabelirtilen tm kaytlarn yeni iletmeciye aktarlmasn temin eder ve yukarda belirtilen sreler yeni iletmeci iin degeerli olur.

    NC BLMSorumluluk, Gzetim ve Denetim

    SorumlulukMadde 15 - Bu Ynetmelikte belirtilen hkmlerin uygulanmasndan srasyla iletmeci genel mdr,

    bakmdan sorumlu ynetici personel (teknik mdr) ve bakm ynetimi biriminde (mhendislik birimi) alan tmpersonel sorumludur.

    Gzetim ve DenetimMadde 16 - SHGM, her iletmeciyi bu Ynetmelik hkmlerinin uygulanmasna ynelik ylda en az bir kez

    denetler. Bu denetlemeler iletmeciye nceden bilgi verilmeden de yaplabilir. Denetlemelerde referans olarak buYnetmelik ve JAR-OPS Altblm M, kontrol listesi olarak Ek-2de bir rnei bulunan JAA Form 13 kullanlr.Denetlemeler sonrasnda bu Ynetmelie uygunluu tespit edilen iletmelere yetki belgesi olarak Ek-3te bir rneibulunan JAA Form 14 dzenlenir.

    Note A: To focus the survey on JAR-OPS 1 Subpart M, this form has been formatted against JAR-OPS 1 Subpart M, but as

    some paragraphs cover subject matter not relevant to an organisation trying to demonstrate compliance, these havebeen omitted.

    Note B: The right hand part of each box must be completed with one of the three indicator:

    1. a tick () which means in compliance;2. NR which means the requirement is Not Relevant to the operator's activity (the reason for NR should be stated in

    Part Four of the report unless the reason is obvious);

    JAR-OPS 1.890 Maintenance responsibility

    (a) An operator shall ensure the airworthinessof the aeroplane and the serviceability of both

    operational and emergency equipment by:

    (1) The accomplishment of preflight inspections

    (2) The rectification to an approved standard ofany defect and damage affecting safeoperation, taking into account the minimumequipment list and configuration deviation list if

    available for the aeroplane type.

    (3) The accomplishment of all maintenance inaccordance with the approved operator'saeroplane maintenance programme specified inJAR-OPS 1.910.

    (4) The analysis of the effectiveness of the

    operator's approved aeroplane maintenanceprogramme.

    (5) The accomplishment of any operationaldirective, airworthiness directive and any othercontinued airworthiness requirement made

    mandatory by the Turkish DGCA. Until formaladoption of JAR-39, the operator must complywith the current national aviation regulations.

    (6) The accomplishment of modifications inaccordance with an approved standard and fornon-mandatory modifications the establishmentof an embodiment policy.

    (b) An operator shall insure that the Certificateof Airworthiness for each operated aeroplaneremains valid in respect of:

    (1) The requirements in sub-paragraph (a)above;

    (2) Any calendar expiry date specified in theCertificate; and

    (3) Any other maintenance condition specifiedin the Certificate.

    (c) The requirements specified in paragraph (a)above must be performed in accordance with

    procedures acceptable to the Turkish DGCA.

    JAR-OPS 1.895 Maintenance Management

    (a) An operator must be appropriately approvedin accordance with JAR-145 to carry out therequirements specified in JAR-OPS 1.890(a)(2),(3), (5) and (6), except when the Turkish DGCAis satisfied that the maintenance can becontracted to an appropriate JAR-145

    approved/accepted organisation.

    (b) An operator must employ a person orgroup of persons acceptable to the Authority toensure that all maintenance is carried out ontime to an approved standard such that themaintenance responsibility requirementsprescribed in JAROPS 1.890 are satisfied[ ].The person, or senior person as appropriate,is the nominated postholder [referred to inJAR-OPS 1.175(i)(2). The NominatedPostholder for Maintenance is also responsiblefor any corrective action resulting from thequality monitoring of JAR-OPS 1.900(a).

    (c) The Nominated Postholder for Maintenanceshould not be employed by a JAR 145approved/accepted Organisation undercontract to the Operator, unless specificallyagreed by the Authority.

    (d) When an operator is not appropriatelyapproved in accordance with JAR-145,arrangements must be made with such anorganisation to carry out the requirementsspecified in JAR-OPS 1.890(a)(2), (3), (5) and(6). [Except as otherwise specified inparagraphs (e), (f) and (g) below, thearrangement must be in the form of a writtenmaintenance contract between] the operatorand the JAR-145 approved/accepted

    maintenance organisation detailing thefunctions specified in JAR-OPS 1.890(a)(2),(3), (5) and (6) and defining the support of thequality functions [of JAR-OPS 1.900.Aeroplane base and scheduled line

    maintenance and engine maintenancecontracts, together with all] amendments, mustbe acceptable to the Authority. The Authoritydoes not require the commercial elements of amaintenance contract.

    (e) Notwithstanding paragraph (d) above, theoperator may have a contract with anorganisation that is not JAR 145approved/accepted, provided that :

    (1) for aeroplane or engine maintenancecontracts, the contracted organisation is aJAROPS Operator of the same type ofaeroplane,

    (2) all maintenance is ultimately performed byJAR 145 approved/accepted organisations,

    (3) such a contract details the functionsspecified in JAR-OPS 1.890(a)(2), (3), (5) and(6) and defines the support of the qualityfunctions of JAR-OPS 1.900,

    (4) the contract, together with all amendments,is acceptable to the Authority. The Authoritydoes not require the commercial elements of amaintenance contract.

    (f) Notwithstanding paragraph (d) above, in thecase of an aeroplane needing occasional linemaintenance, the contract may be in the form

    of individual work orders to the MaintenanceOrganisation.

    (g) Notwithstanding paragraph (d) above, inthe case of aeroplane componentmaintenance, including engine maintenance,the contract may be in the form of individualwork orders to the Maintenance Organisation.

    (h) An operator must provide suitable officeaccommodation at appropriate locations forthe personnel specified in sub-paragraph (b)above.

    JAR-OPS 1.900 Quality System

    (a) For maintenance purpose, the operator'squality system , as required by JAR-OPS 1.035,must additionally include at least the followingfunctions:

    (1) Monitoring that the activities of JAR-OPS1.890 are being performed in accordance with

    the accepted procedures.

    (2) Monitoring that all contracted maintenanceis carried out in accordance with the contract.

    (3) Monitoring the continued compliance withthe requirements of this Subpart.

    (b) Where an operator is approved inaccordance with JAR-145, the quality Systemmay be combined with that required by JAR-145.

    JAR-OPS 1.905 Operator's MaintenanceManagement Exposition

    (a) An operator must provide an operator's

    Maintenance Management expositioncontaining details of the organisation structureincluding:

    (1) The nominated postholder responsible forthe maintenance system required by JAROPS 1.175(i)(2) and the person, or group ofpersons, referred to in JAROPS 1.895(b);

    (2) The procedures that must be followed tosatisfy the maintenance responsibility of JAROPS 1.890 and the quality functions of JAR

    OPS 1.900, except that where the operator isappropriately approved as a maintenanceorganisation in accordance with JAR145,such details may be included in the JAR145exposition.

    (b) An operator's maintenance managementexposition and any subsequent amendmentmust be approved by the Turkish DGCA.

    JAR-OPS 1.910 Operator's aeroplanemaintenance programme

    (a) An operator must ensure that the aeroplaneis maintained in accordance with the operator's

    aeroplane maintenance programme. Theprogramme must contain details, includingfrequency, of all maintenance required to becarried out. The programme will be required toinclude a reliability programme when theTurkish DGCA determines that such a reliabilityprogramme is necessary.

    (b) An operator's aeroplane maintenanceprogramme and any subsequent amendmentmust be approved by the Turkish DGCA.

    JAR-OPS 1.915 Operator's AeroplaneTechnical Log

    (a) An operator must use an aeroplanetechnical log system containing the followinginformation for each aeroplane:

    (1) Information about each flight necessary toensure continued flight safety.

    (2) The current aeroplane certificate of releaseto service.

    (3) The current maintenance statement givingthe aeroplane maintenance status of what

    scheduled and out of phase maintenance isnext due except that the Turkish DGCA mayagree to the maintenance statement being keptelsewhere.

    (4) All outstanding deferred defects that affectoperation of the aeroplane.

    (5) Any necessary guidance instructions onmaintenance support arrangements.

    (b) The aeroplane technical log and anysubsequent amendment must be approved bythe Turkish DGCA.

    JAR-OPS 1.920 Maintenance Records

    (a) An operator shall ensure that the aeroplanetechnical log is retained for 24 months after thedate of the last entry.

    (b) An operator shall ensure that a system hasbeen established to keep, in a form acceptableto the Turkish DGCA, the following records forthe periods specified:

    (1) All detailed maintenance records in respectof the aeroplane and any aeroplane componentfitted thereto - 24 months after the aeroplane oraeroplane component was released to service.

    (2) The total time and flight cycles asappropriate, of the aeroplane and all life limitedaeroplane components - 12 months after theaeroplane has been permanently withdrawnfrom service.

    (3) The time and flight cycles as appropriate,since last overhaul of the aeroplane oraeroplane component subjected to an overhaullife - until the aeroplane or aeroplanecomponent overhaul or inspection has beensuperseded by another overhaul or inspectionas appropriate of equivalent work scope and

    detail.

    (4) The current aeroplane inspection statussuch that compliance with the approvedoperator's aeroplane maintenance programmecan be established - until the aeroplane oraeroplane component overhaul or inspectionhas been superseded by another overhaul orinspection as appropriate of equivalent work

    scope and detail.

    (5) The current status of airworthinessdirectives applicable to the aeroplane andaeroplane components - 12 months after theaeroplane has been permanently withdrawnfrom service.

    (6) Details of current modifications and repairsto the aeroplane, engine(s), propeller(s) andany other aeroplane component vital to flightsafety - 12 months after the aeroplane has beenpermanently withdrawn from service.

    (c) An operator shall ensure that when anaeroplane is permanently transferred from oneoperator to another operator the recordsspecified in paragraphs (a) and (b) are alsotransferred and the time periods prescribed willcontinue to apply to the new operator.

    JAR-OPS 1.925 Intentionally blank
