Subject: Report of Exploration atNuh on 12*^ May 2018

History of Nuh - According to Mahabharata, the area was granted by the

eldest Pandava king Yudhishthira to their teacher Dronacharya. Later is passed in the hands

ofMaurya empire to invaders like Parthian and Kushan, and Yaudheya after they expelledKushanas from the area between Yamuna and Satluj. Yodheyas was sujugated by

king Rudradaman I of Indo-Scythians and later by Gupta Empire and then byHunas, who

were overthrown by Yashodharman of Mandsaur and then by Yashovarman of Kannauj.Area was also ruled by Harsha (590 - 467 CE), Gurjara-Pratihara (mid 7th century CE to11th century). Tomara dynasty, who founded Dhillika in 736 CE, were earlier tributaries of

Partiharas, overthrew Partiharas. Tomaras were defeated by [[ who were in turn were

overthrown in 1156 CE by king Visaladeva Chauhan of Chauhan Dynasty. After the defeat

ofPrithviraj Chauhan conquered the area of Gurugram, Nuh, Bhiwani and Rewari in 1182

CE. After the defeat of Prithviraj Chauhan in 1192 CE, the area came under Qutb al-Din

Aibak (1206 CE) of Delhi Sultanate who defeated and killed Prithviraj's son Hemraj who hadinvaded Mewat are from Alwar. Meo who were all Hindus during those times, killed SayyidWajih-ud-din who was sent to subjugate Meos, biit they were later suppressed by nephew ofAibak called Miran Hussain Jang and those Meo who remained Hindus were forced to payIslamic religious taxJizyaand others were forced to convert to Islam. In 1249

CE, Balban killed 2000 rebellious Meos. Meo rebels took away large number of camels of

Balban's army in 1257-58 CE. In 1260 CE, Balban retaliated by overrunning the area andkilling 250 Meo prisoners and slaughtered 12,000 women, children and surviving men.

We have visited following monuments and few of them may be taken under state

protection.

Ghasera Fort 28°08'10.5"N 77°04'35.7"E is a ruined fort in Ghasera village in Nuh district.Currently the villages is dominated by Muslims Meos, though Hindus also live there.

The ruined Ghasera Fort lies at Ghasera village 14 kilometres (8.7 mi) from Nuh city onNun-Sohna road that was ruled by Bahadur Singh Bargujar , a Rajput chief of 11 villages, hewas killed in 1753 by the famous Jat king Surajmal of Bharatpur State after Jats besieged andran over the Ghasera fort, after which Jats turned to Delhi by defeating Mughal king AhmadShah Bahadur and occupied the Red Fort there in 1754 CE.

Ruined walls and a grand entrance show that Ghasera was a historical village. It was build byStones and lakhouri bricks with lime surkhi mortar. Condition of wall is not very good. Itmay be taken for further conservation. A guard room still alive which is in good condition.

During the reign of Aurangzeb there was a Rajput freebooter named Hathi Singh Bargujar atDahana (now called Badshahpur village). He sought the helpof Jat King Churaman of Bharatpur State to seek his help to obtain pardon from Aurangzeb,which was granted to him on the condition that he will kill the famed bandit Sanwali. Forachieving this task, he was granted pardon and given a jagir of 11 villages by Aurangzeb thatincluded Ghasera, Indor, Kotla and Sohna, he built his fort at Ghasera.

Hathi Singh Bargujar was succeeded by his son Bhadur Singh Bargujar v^ho entered inallaiance withMalhar Rao Holkar of Indorewho was the Maratha Subhedar ofMalwato

attack the Rajput King Maharaja Sawai Madho Singh I of Jaipur. Maharaja Sawai MadhoSingh I sought the help of Jat king Maharaja Surajmal of Bharatpur State.

In 1753, Maharaja Surajmal besieged Ghasera fort of Bhadur Singh Bargujar. In the battle,Bahadur Singh lost and his wives committed suicide.

In 1754, after Ghasera Jats turned to Delhi, defeated the Mughal king Ahmad Shah Bahadur,occupied the Red Fort there, took away the bounty and gates of Red fort with them tohumiliate the Mughals

Nalhar Pandava Shiva Reservoir and Nalhar Shiva Temple are located and there is also anatural reservoir 2 kilometres (1.2 mi) from Nuh city in the foothills of Aravalli Hills whichcan be reached by climbing 250 stairsteps from .the Nalhar Shiva Temple. Shaheed HasanKhan Mewati Government Medical Cpllege is located nearby.

At the foothills of Aravalli range at Nalhar village, there is also a Lord Shiva temple within aU-shaped Nalhar valley which is reached by the nalhar road from Nuh city through a largeceremonial Hindu religious gate small distance from the temple. Water keeps flowing out ofthis reservoir and it is located behind the temple up in Aravalli Hills. Popular folklore claimsthat Pandavas stayed here, prayed to the lord Shiva and drank water from this reservoirduring a visit in their 14 years long exile.

Kotla Mosque

Kotla Mosque are 6.5 kilometres (4.0 mi) from Nuh city in the Kotla village. The redsandstone and Grey quartzite tomb has inscription on the ruined gateway, dating it to 1392-1400 CE. The mosque is a square structure on raised platform. The surface of the exterior issimple. The interior is curved with red sandstone and the openings with jaalis. Remain of anold well also visible near the mosque. Condition is good.

A medieval grave yard also found which is at the entrance of Kotla village. One of them is verynice and decorated with paintings. Probably this area was used for elite class.

Chhatris and kuan at Meoli

There are two chhatris and a kuan (well) has.been found during the field survey. Meoli village islocated in Nuh Tehsil of Mewat district in Haryana, India. It is situated 7km away from sub-district headquarter Nuh and 7km away from district headquarter Mewat at Nuh. The ancestralvillages of the Deharwal Meos were at Meoli which was colonised by Mewa Singh. Jaggarecords inform that Mewa Singh was the head of fifty-two Khorei (settlements) in the KalaPahad. The term Dehrawal was derived from Dehar which comprised the low lying area near theKotla lake in the Nuh region.

Fairly old and small village had these remains which were built in an architectural style of themedieval era. The construction material, depth and diameter of the well cylinder, its location andthe style adopted for its superstructure obviously depended on the nature of the soil and terrain,the amount of average rainfall, purpose of location and availability of masonry expertise. Mainpurpose was required water to be lifted. Condition of chhatris is good but Kuan needs immediateconservation.

Brayne Meo High School

Chaudhary Mohammad Yasin Khan, one of the famous social activists of Mewat, wasdetermined to spread modem education among the Mewatis by establishing modem

educational institutions I He believed that only modem education could reform the society of

the Meos which suffered from backwardness and negligence 1 In this process he started a

school at Rehna which he later on shiffed to Nuh I He summoned a Meo Panchayat and it was

decided to upgrade the school into a High School. The scheme was put before the DeputyCommissioner of Gurgaon Mr. F.L.Brayne. The DC approved the plan and decided to levytwo anna per bigha with the revenue. The Meo community also started subscription for thepurpose. Sir Fazal-e-Husain, Education Minister of Panjab, laid the foundation stone of the

school by merging the Middle School Nuh and the Middle School of Zila Parishad, on 28thMarch 1923 and the school was named as Brayne Meo High School. At present the schoolhas been transferred as Yasin Meo Degree College. It is well maintained and will be gotHeritage status after five years.

Old Tehsil Building

It is located in main road of Nuh. In 1861, the District pf Gurgaon was re-arranged into 5

tehsils viz Gurgaon, Firozpur Jhirkha, Nuh, Palwal and Rewari vide Gurgaon District

Gazetter, 1910 p. 26 and thereafter 1872 -73 the building of the Tehsil Nuh was constructed

by the then British Government over the land comprising with the Khewat/Khata No.

1222/1337 Khasra No. 172 (14-08) total measuring 14 Kanal 8 Maria situated within the

revenue estate of Nuh, Tehsil Nuh, District Mewat and this building is a rich part of the

Heritage of Mewat. It is the witness of the then history. This is single storied brick built

building comprises 30 rooms. It may be protected by State Archaeology & Museums

Department. After proper scientific conservation this building may be use as district library

or as a primary school for girls. Heritage ambience may develop their interest, illustrate a

particular historical narrative, or engage pupils in historical enquiry.

The Old Tehsil Building Nuh

The case is related to the protection and preservation of the Old TehsilBnilding Nuh. Department of Archaeology 86 Museums Haryana has issued .preUminary notification on 15.102018. Before going in details of the issue itis important to discuss some important preliminary legal and policy relatedissues hereunder.

Directive Principles of State Policy as mentioned in the Constitution ofIndia

The Part IV of the Constitution of India from Article 36 to 51 provides for theDirective Principles of State Policy. This part provides for fundamentalprinciples for the guidance of the State in the governance of the country. TheState is duty bound to follow these fundamental principles in drafting itspolicies, for making laws, by laws or general administration.

Article 49 under this part of the Constitution provides that it shall be theobligation of the State to protect every monument or place or object ofartistic or historic interest, declared by or under law made by Parliament tobe of national importance, from spoliation, disfigurement, destruction,removal, disposal or export, as the case may be.

Central and State Acts:-

The Punjab ancient and Historical Monuments and Archaeological Sites andRemains Act-1964 was enacted to provide for the preservation ofancient and historical monuments and archaeological sites andremains other than those of national importance, for the regulation ofArchaeological excavations and for the protection of sculptures,carvings and other like object as envisaged by the Article 49 of theConstitution of India. The other Acts are The Antiquities and Art TreasuresAct 1972, The Indian Treasures Trove Act, 1878 which also deal with similarsubject.

Conservation of Heritage buildings:-

As per the criteria of CPWD guide on Conservation of Heritage buildings(2013), there are three key concepts need to be taken into consideration todetermine whether a property is worthy of listing:

• Historic significance

• Historic integrity

• Historic context

Historic significance is the importance of a property in context of history,architecture, archaeology, engineering or culture of a community, region ornation. Those who do not remember the past are condemned to repeat it.

Further, in selecting a building, particular attention should be paid to thefollowing:

1. Association with events, activities or patterns2. Association with important persons !

3. Distinctive physical characteristics of design, construction or form,representing work of a master

4. Potential to yield important information such as illustrating social,economical history such as railway stations, town halls, clubs,markets, water works etc.

5. Technological innovations such as dams, bridges etc.6. Distinct town planning features like squares, streets, avenues e.g.

Rajpath in Lutyen's New Delhi.

Historic integrity is the authenticity of a property's historic identity,evidenced by the survival of physical characteristics that existed during theproperty's historic period.Historic context is information about historic trends and propertiesgrouped by an important theme in the history of a community, region ornation during a particular period of time. Knowledge of hmtoric contextenables understanding a historic property as a product of its time.

Monuments:-

As per National Policy for Conservation (2014)

• "Monuments" comprise a vast array of human-built edifices, eitherstanding or underground or still buried, and these reflect tangiblemanifestation of India's rich past. Monuments include archaeologicalsites and mounds, cave shelters, rock-cut temples, monoliths,sculptures and bas-relief panels, underground structures andarchitectural heritage representing various categories, e.g., reli^ous,palatial, residential, defensive, funerary, civic, institutional,landscapes, etc. The monuments may be 'functional' or 'nonfunctional' depending upon whether or not these are functioning asper their original intended use.

• "Monuments" were often built as part of a wider urban or naturalcontext / setting and not built in isolation. Thus, monuments shouldbe conceived as inseparable part of their immediate context or setting.

• Monuments reflect myriad applications of building materials, such as,mud, wood, stone, brick, lime, metal, glass, etc., or composite materialapplication, used under different construction techniques, oftenrepresenting different architectural styles and styles of ornamentation(structural and appHed), reflecting influences from other regions anddiverse cultures due to cultural interactions in the past millennia.

There are considerable regional and local variations in monuments interms of materials, styles and techniques also due to influence ofvernacular (indigenous) architecture.

At present, Monuments and archaeological sites, which are a finite and non-renewable cultural resource of our country, unlike ever before, are nowsubject to an ever-increasing pressure from development and the increase intourist visitation, which has put an unprecedented adverse impact on them.

Preservation:-

Preservation means and includes maintaining the fabric of a place in itsexisting state and retarding deterioration.Section 4 of The Punjab ancient and Historical Monuments andArchaeological Sites and Remains Act-1964 provides that where theGovernment is of opinion that any ancient and historical monument orarchaeological site and remains, which has not been declared by or underthe law made by Parliament to be of national importance and which is notincluded in section 3 requires protection under this Act, it may bynotification declare such ancient and historical monument or archaeologicalsite and remains to be a protected monument or a protected area.

The criteria for selecting Nuh tehshil building come under the point no 1.Because the entire official records/works of the then British raj were done inthis building. Basically this building was witness of different administrativereforms and events.

Old Tehsil Building at Nuh;-

In the light of the here stated discussion on various laws, policies and otherconsiderations, the case of Old Tehsil Building it worthy of consideration.

Location:-

It is located on main road of Nuh town. In 1861. According to the revenuerecord it is build over land comprised of Khewat/Khata No. 1222/1337 ,Khasra No. 172 (14-08) measuring total 14 Knal 8 Marias. This building isrich part of the Heritage of Mewat.

History of the building:-

The building is historic evidence of the evolution of British civiladministration in the State of Haryana.

The Old Tehsil Building at Nuh was built by British Government in 1872 theyear of the first population census in India. It was the headquarter of tehsilNuh, which was one of the five tehsils constituting the Gurgaon District. Thegeneral administration of the Nuh tehsil was being conducted from this

building in the past vide Chapter V titled as 'Administration and Finance' inthe handbook of Haryana District Gazetteers reprint of Gurgaon DistrictGazetteer, 1883-84 reprinted by Gazetteers Organisation RevenueDepartment Haryana Chandigarh, India, 1998.

Vide District & State Gazetteers of Unidivided Punjab (Prior toIndependence) Volume III reprinted in 1993, the Old Tehsil Building of Nuhtown was recorded as significant place of interest in Gurgaon District evenbefore Independence of India. It was the headquarter of tehsil Nuh, whichwas one of the five tehsils constituting the Gurgaon District.

Heritage:-

Vide chapter IV of District 86 State Gazetteers of the Undivided Punjab (Priorto Independence) Volume III , the tehsil, school, rest-house, dispensary andpost-office were the only public building of interest at Nuh.

This building is a rich part of the Heritage of Mewat. It witnessed the thenhistory of British Administration. It was built in 1872 by^BnhshJnJj;^,built in imposing scale and is a significant repository of architectural stylesof that era. it were the tehsUs'^ich. extensively worked for recording eachand every' activity in the Gurgaon District, whether it was law & order orgeneral administration related to the general statistics on each and everyactivity in that area. This building passed phases of transition -witnessingthe organisation of the old Gurgaon District, then a long period of generalinformation and even after that the historic event of Independence.

As per literature survey, we got the references of this monument in DistrictGazetteers. '

Chapter V titled as 'Administration and Finance' of Haryana DistrictGazetteers reprint of Gorgaon District Gazetteer, 1883-84 reprinted byGazetteers Organisation Revenue Department Haryana Chandigarh (INDIA)1998, the Gurgaon District was under the control of the Commissioner ofDelhi. The ordinary head-quarters staff of the district consisted of a DeputyCommissioner and to Extra Assistant Commissioners. There were five tehsilsin Gurgaon District. These five tehsils were Gurgaon, Rewari, Palwal, Nuh,Firozpur. Each tehsil was in charge of a tehsildar assisted by Naib. Therewas one munsiff in the district, had jurisdiction throughout the five tehsilsand he sits for two months at Rewari and Nuh alternatively. This building ise-vidence of the then administrative reforms done by British Government inHaryana when the district of Gurgaon was reconstituted in five tehsils.

Architectural Value:- ^

This building is part of the rich built heritage of Mewat ofA.D. It was constructed in 1872 A.D. by the then British Government. It wasbuHTaJter the district of Gurgaon was re-arranged into 5 Tehsils,

It is a single storied building comprising 30 rooms. The roof of the structureis built of lakhauri bricks. The building has unique vault roof structure withcornice on the exterior fagade which creates an architectural interest.Conclusively, this building showcases the Colonial Architecture of that era.The walls of this structure are made of locally available sandstone and insome places quartz stone is also used. The binding material used for itsconstruction is lime surkhi prevalent at that time.

Current Condition of the building:-

The Old Tehsil Building of Nuh lies unattended and in state of neglectdespite of its rich history, cultural and architectural identity. Condition ofthe building is poor especially some of the portion but not beyondarchaeological conservation.

The authenticity of the Old Tehsil Building Nuh is evidenced by the survivalof its physical characteristics showcasing Colonial Architecture. Thestructure evidences the historic period of British rule of late 19^^ centuryA.D.

So this building is significant in context of history as well as culture of theregion. It is part of rich heritage of Mewat. It is evidence of importantadministrative events and activities conducted by the then BntishGovernment.

This heritage building may be used as district library or as a primaryschool for girls or as a Bal Bhavan with Museum. Heritage ambiencemay develop their interest, illustrate a particular historical narrative orengage pupils in historical enquiry.

It is a significant Monument that is to be preserved for future generationsand its preservation and revival in a harmonious form can be taught to thepeople around and shovm to younger generations, being part of their ownhistorical journeys.

It IS submitted that as per revenue records. Government of Haryana isthe owner in possession of the land ands the building has been used forfShsiloffice for several years and has been renovated at different points of time.Presently also. It is being used as the Tehsil Patwarkhana and the record room.The si^visit has also been done and It has been observed that due to therenovations at different points of time, the building has already lost its original

As discussed with worthy Director on 28.5.19 the matter is resubmitted -

Old Tehsil is located in main road of Nuh. In 1861, the District pf Gurgaon was re

arranged into 5 tehsils viz Gurgaon, Firozpur Jhirkna, Nuh, Palwal and Rewari vide Gurgaon

District Gazetter, 1910 p. 26 and thereafter 1872 -73 the building of the Tehsil Nuh was

constructed by the then British Government over the land comprising with the Khewat/Khata

No. 1222/1337 Khasra No. 172 (14-08) total measuring 14 Kanal 8 Maria situated within the

revenue estate of Nuh, Tehsil Nuh, District Mewat and this building is a rich part of the .

Heritage of Mewat. It is the witness of the .then history. This is single storied brick built

building comprises 30 rooms. Department has already issued preliminary notification on

15.10.2018 under the The Punjab Ancient Historical Monuments and Archaeological Sites

and Remains Act, 1964". As per proposal on NP 9 that after proper scientific conservation

this building may be use as district library or as a pirimary school for girls. Heritage ambience

may develop their interest, illustrate a particular! historical narrative, or engage pupils in

historical enquiry.

As per order of worthy ACS, the letter obtained from DC. Nuh. it has mentioned that

"the site visit also been done... (Photographs attached)". But it is not clear the site visited by

whom and when. Neither any photograph nor any site inspection report has been attaclied

with that letter.

It is true that the renovation has been done time to time by local administration but

still its original style exists and visible (See the NP 9-10). The condition of the building is not

beyond conservation.

So it is proposed to write a letter to D.C

photographs.

'•- It is submitted that the~Old Tehsil Building at Nuh comprising in

Khasra No., 172 admeasuring area 14 Kanal 8 Maria has been notified under

sub section (1) of section 4 of the Punjab Ancient &■ Monuments andArchaeological Sites and Remains Act, 1964, proposing to declare the OldTehsil Building at Nuh to be a protected monument and the area to beprotected area.

The notification has been issued by the Archaeology andMuseums Department,'Haryana Govt. on the following grounds:-'

"The Old Tehsil building g of Nuh was constructed in 1872-73 bythe then Birtish Govt. It was built after the district of Gurgaon was rearranged into 5 tehsils viz Gurgaon, Ferozpur; Jhirka, Nuh, Palwal and Rewari.

This Lakhauri brick built structure is a rich part of the heritage of Mewat. Thematerial used for its construction is Lime Surkhi. It is a single storied buildingcomprising 30 rooms".

It is submitted that as per revenue records, Govt. of Haryana isIthe owner in possession of the land and the building has been used for tehsiloffice for several years and has been renovated at different points of time.Presently also, it is being used as the Tehsil Parwarkhana and the recordroom. The site visit has also, been done and it has been observed that due to "the- renovations at different points of time, .the building has already lost itsoriginal character to a large extent (Photographs attached)!'

Moreover, the building is of little architectural value as Iticonsists of only rooms. Subtantial construction has been done inside theI I

building further diminishing heritage & architectural value of the building.

Subject: Final Notification for Old Tehshil building, Nuh

The Old Tehshil building is located in main road of Nuh. In 1861, the District pfGurgaon was re-arranged into 5 tehsils viz Gurgaon, Firozpur Jhirkha, Nuh, Palwal andRewari vide Gurgaon District Gazetter, 1910 p. 26 and thereafter 1872 -73 the building ofthe Tehsil Nuh was constructed by the then British Government over the land comprisingwith the Khewat/Khata No. 1222/1337 Khasra No. 172 (14-08) total measuring 14Kanal 8 Maria situated within the revenue estate of Nuh, Tehsil Nuh, District Mewat andthis building is a rich part of the Heritage of Mewat. It is the witness of the thenhistory. This is single storied brick built building comprises 30 rooms. The monumentwas selected as per PUC received from Matloob Khan Bharti, Kulwant Singh BaghelDated 10.2.2018. Approval ofHon'ble C.M. has been obtained on 15.6.2018.

As per report submitted by Deputy Commissioner on 22.4.19, Govt of Haryana isthe owner in possession of the land and the building has been used for tehsil office forseveral years. At present it is being used as the Tehsil Parwarkhana and the record room.

Preliminary notification has been issued by the department on 15.10.18.

A petition has been received by the department from Matloob KhanBharti/Kuiwant Singh Baghel, City Nuh Distt. Nuh 8901236950 on 20 August, 2019regarding for issuing Notification on the Archaeological monument of Nuh old TehsilBuilding an its campus of British Designing of colonial period 1872 under protection andpreservation by state Government in accordance with the law article 51A of constitutionwhere it has written that

"'We, under signed petitioner humble request for the consideration on the abovecited Subject, for the gazette notification by your minister Law & justice as all theformalities relating to gazette notification has been completed by archaeological deptt.Haryana Sector 10, Chandigarh.

That as per the requirements of the Law for notification, no pendency of the casemay be ruled out, but archaeological deptt requires pending case must be withdrawn bythe petitioner gazette notification as per requirement of archaeology Law.

Its there for we pray humbly to your office for publishing the gazette notificationon above cited subject despite and pendency of our petition / case in the Court ofNuh,(for revenue record ) Distt Nuh, or a letter may be issued to the petitioners for thewithdrawn of the case out of the Court of Law either by Ministry of Law & JusticesHaryana Chandigarh or archaeological Deptt Haryana Chandigarh in the regards."

The criteria for selecting Nuh tehshil building come under the point no 1. Becausethe entire official records/works of the then British raj were done in this building.Basically this building was witness of different administrative reforms and events.

Condition of the budding is poor especially some of the portion but notbeyond archaeological conservation. Site visit at old Tehshil Buildingin Nuh has been done by under signed and Shri

Darbar Singh (Photographer) with worthy Principal Sectretary to Govt. (A&M) on 15"*December 2019.

Old Tehshil Building, Nuh is,located in main road of Nuh. In 1861, the District

of Gurgaon was re-arranged into 5 tehsils viz Gurgaon, Firozpur Jhirkha, Nuh, Palwal

and Rewari vide Gurgaon District Gazetter, 1910 p. 26 and thereafter 1872 -73 the

building of the Tehsil Nuh was constructed by the then British Government over the land

comprising with the Khewat/Khata No. 1222/1337 Khasra No. 172 (14-08) total

measuring 14 Kanal 8 Maria situated within the revenue estate of Nuh, Tehsil Nuh,District Mewat and this building is a rich part of the Heritage of Mewat. It is the witness

of the then history. This is single storied stone &brick built building comprises 30

rooms.

Worthy Pricipal Secretary (A&M)isdesiringthe building to be used as a district

library after proper scientific conservation by State Archaeology & Museums

Department. Heritage ambience may develop the interest, illustrate a historical narrative,or engage people in historical enquiry. In earlier, department also gave the proposal that

the building may be used as Library, Bal Bhavan or Primary School for girls.

Preliminary notification has been published by Haryana Government,

Archaeology and Museums Department by notification no 12/219-2018/ Pura-3986,

published on 15. 10. 2018. There is no stay from the side of the court.

to conserve the central building only and the CPWD guidelines for

Conservation of Heritage Building may be scrupulously obeyed in maintaining the

CELEBRATING That as the constitution of India part IV A WhichTHE MAHATMA

only one article 51-A was added to the constitution be the 42"amendment, 1976. This article for the first time specifies a code of
