Despite having broken no laws, the agency to include its officers, agents and civilian employees continue to violate my Federally Protected Civil Rights and rights under the United Nations Universal Declaration of Human Rights. I have been subjected to repeated terroristic threats, deprivation of property, due process, deprivation of rights and deprivation of life. In recent months agency officials have made several alarming statements indicating that they have full intentions on taking my life due to my lawful disclosures.

                                                                                                                                    July 28, 2013                                                                                                                                    OIG                                                                                                                                    OBM/DLP                                                                                                                                   DEPARTMENT OF VETERANS AFFAIRSOffice of Inspector General (50)810 Vermont Avenue, NWWashington, DC 20420  Subj:  US SENATE COMMITTEE VETERANS AFFAIRS Iam writing you today in response to my previous communications to the Deputy Under Secretary Human Resources, Department of Veterans Affairs and the US Senate Committee Veterans Affairs. On April 22, 2013 Ranking Member, Richard Burr informed me that this matter had been forwarded to your office for investigation.  However, to date I have yet to receive any official notice, status or disposition of this case. However damaging these allegations may be, the deliberate, willful and intentional acts by agency counsel, employees and civilians are perceived as a conspired retaliatory event.  As a result of my damaging disclosure’s the agency has engaged in a conspiratorial tactic devised to destroy me by controlling my information, so that, by frame up or “disinformation to include terror” the agency gets me to engage in the discriminatory EEO process against the agency.

The actions taken by the agency were taken but for no other reason than to “chill speech” and to intimidate me from further lawful disclosures on egregious acts taken by agency officials.  The details surrounding my initial disclosures were based on facts and firsthand accounts, daily routines and operating procedures.  Even so, my disclosures don’t warrant the stepped up retaliation and reprisal, to include illegal medical experimentation, harassment and further subjection to disparate treatment by the agency. Despite having broken no laws, the agency to include its officers, agents and civilian employees continue to violate my Federally Protected Civil Rights and rights under the United Nations Universal Declaration of Human Rights.  I have been subjected to repeated terroristic threats, deprivation of property, due process, deprivation of rights and deprivation of life.  In recent months agency officials have made several alarming statements indicating that they have full intentions on taking my life due to my lawful disclosures.  In an effort to highlight and showcase some of the recent comments I have listed them below: 1.      On March 4, 2013 a VA employee confirmed my suspicions and allegations that the U.S. Department of Veterans Affairs “willfully and intentionally gave me a virus with the intent to inflict pain and suffering and cause end of life.” 2.      On March 4, 2013 a VA employee confirmed my suspicions and allegations that Lisa K. Holliday, Esq. of General Counsel is responsible for the continued harassment, discrimination and retaliation against my partner and I. 3.      On April 4, 2013 a VA employee stated “you know what I don’t know, I don’t see how it could because they keep dragging it out, they keep pulling you in, I mean they’re not letting you go. We’ve talked about it before, they want to get rid of those other people that did it but they got to use you to be the one that can justify, that can give them the evidence they need to get rid of those people I guess, why pull you in unless they want to pull you in to get rid of you because you knew it but then if it’s all put out in public so what, why hurt you, why get rid of you, it’s going to be known anyway.”  4.      On April 4, 2013 a VA employee stated “I don’t know, I don’t know why you were picked.  I sit in amazement I wish I could, actually I don’t want to know, I don’t want to be there when I’m going to hear them tell me, here’s this person let me tell you what we’re doing to him, but then I wish I could hear it so I could go hey, hold up we got to stop this.” 5.   On April 4, 2013 a VA employee stated “if I changed my name and ssn I would die as that person, she then continued, asking so is that even something you would, um.” 6.   On April 4, 2013 a VA employee stated “the Department of Veterans Affairs West Los Angeles VA Medical Center was making me a target.  She continued, stating “you’re a target, just go ahead and paint a sign on your head.”

7.   On April 4, 2013 a VA employee confirmed my suspicions and allegations stating “agency officials were getting away with murder.”

Again, when the record is viewed as whole, this equates to “racial” profiling based on racial hatred, bigotry, purgatory and terroristic acts against a African American male. 

In recent months there have been several VA employees turned whistleblowers that have gained some national media attention.  To my knowledge, none of them have reported any severe retaliation, reprisal or terroristic acts against them in connection to their complaints.  Is it because they are white, considered professionals and I’am black that they receive different treatment than I? In response to this matter I have sought the opinions of several prominent lawyers who all agree; since the employee/employer relationship terminated on March 18, 2011 there should be no further discrimination, yet alone any new or current EEO complaints.  For agency officials to pursue me over 6 state lines from where my initial disclosures took place is absurd.  To create an atmosphere by conspiratorial tactics to get me to engage with them is a clear and convincing violation of my civil rights. The actions of agency officials to include the Office of Policy and Compliance and Office of Resolution Management are in keeping with allegation #3 as noted above.  The agency should not be engaging a former employee for any reason at all.  Again, the employee/employer relationship was terminated on March 18, 2011 and all matters were considered closed. At this time I request that your office provide me with a status update to the matter at hand.   Oliver B. Mitchell III
