În temeiul art.7 alin.(3) pct.1) lit.b) din Codul aerian al Republicii Moldova nr.301/2017
şi pct.10 subpct.1) lit.b) din Regulamentul cu privire la organizarea şi funcţionarea Autorităţii
Aeronautice Civile, aprobat prin Hotărârea Guvernului Republicii Moldova nr.133/2019, întru
executarea atribuţiilor ce îi revin Autorităţii Aeronautice Civile în calitate de autoritate
administrativă de certificare, supraveghere şi control în domeniul aviaţiei civile, în scopul
facilitării trecerii la noile norme prevăzute în Regulamentul de stabilire a cerinţelor tehnice şi
a procedurilor administrative referitoare la personalul navigant din aviaţia civilă, aprobat prin
Hotărârea Guvernului nr.204/2020, pentru a implementa amendamentul 174 şi amendamentul
176 la Anexa 1 Licenţierea personalului la Convenţia privind aviaţia civilă internaţională,
ORDON:
1. Se aprobă Procedurile şi Instrucţiunile Aeronautice Civile ”PIAC – Cerinţele şi
procedurile provizorii privind conversia certificatelor naţionale de pilot şi recunoaşterea
licenţelor de pilot eliberate de statele-membre ale Organizaţiei Aviaţiei Civile Internaţionale”,
conform anexei la prezentul Ordin.
2. Autoritatea Aeronautică Civilă va pune la dispoziţia tuturor persoanelor interesate
anexa la prezentul ordin prin publicarea pe pagina web oficială www.caa.md, la
compartimentul „Cadrul normativ/PIAC”.
3. Prezentul ordin intră în vigoare din data publicării în Monitorul Oficial al Republicii
Moldova.

CAPITOLUL I. DISPOZIŢII GENERALE
În temeiul art. 7 alin. (3) pct. 1) lit. c) și art. 22 alin. (4) din Codul aerian al Republicii
Moldova nr. 301/2017,
Având în vedere că Regulamentul de stabilire a cerințelor tehnice și a procedurilor
administrative referitoare la personalul navigant din aviația civilă, aprobat prin Hotărârea
Guvernului nr. 204/2020, ce cuprinde norme de aplicare a prevederilor corespunzătoare ale
Codului aerian nr. 301/2017, va intra în vigoare la data de 11 iulie 2021,
Luând în considerație faptul că actul normativ, opozabil la moment, Reglementările
aeronautice civile RAC-APL – Autorizarea personalului aeronautic al aviaţiei civile (piloţi,
navigatori aerieni, ingineri naviganţi, însoţitori de bord, operatori de bord, controlori trafic aerian,
dispeceri operaţiuni de zbor), Ediția 02, aprobate prin Ordinul nr. 27/GEN din 20 decembrie
2013 (publicat în Monitorul Oficial al Republicii Moldova, nr. 9-13, 2014, art. 58) nu include
dispoziții care ar putea fi aplicate pentru trecerea la noile norme ale Regulamentului de stabilire
a cerințelor tehnice și a procedurilor administrative referitoare la personalul navigant din aviația
civilă, aprobat prin Hotărârea Guvernului nr. 204/2020,
Constatând că RAC-APL în Secțiunea B Capitolele 10-11 nu detalizează (precizează)
unele aspecte ale validării de către AAC a certificatelor, calificărilor și autorizațiilor acordate de
către autoritățile aeronautice civile ale altor state, precum și eliberarea certificatelor de pilot
naționale la solicitarea titularilor certificatelor emise de autoritățile aeronautice civile ale altor
state, în cazul absenței unui acord privind recunoaşterea reciprocă a certificatelor între
autorităţile aeronautice civile ale statului-emitent a certificatului şi AAC,
Reieșind din sarcina pregătirii pentru auditul OACI la compartimentul licențierea
personalului navigant, în cadrul Programului universal de audit al supravegherii siguranței
(USOAP – Universal Safety Oversight Audit Programme), ce urmează să aibă loc în luna
septembrie 2021,
În vederea alocării unui timp suficient pentru a lua toate măsurile necesare
implementării dispozițiilor Regulamentului de stabilire a cerințelor tehnice și a procedurilor
administrative referitoare la personalul navigant din aviația civilă, aprobat prin Hotărârea
Guvernului nr. 204/2020,
Acționând în interesul siguranței zborurilor,
Aplicabilitate
1.1 Prezentul document ”Cerințe și proceduri prvizorii privind conversia certificatelor naționale
de pilot și recunoașterea licenților de pilot eliberate de statele-membre ale Organizației
Aviației Civile Internaționale” (în continuare document) reglementează:
a) conversia certificatelor de pilot naționale,
b) validarea certificatelor de pilot acordate de autoritățile aeronautice civile ale altor state,
c) eliberarea certificatelor de pilot naționale la solicitarea titularilor certificatelor emise de
autoritățile aeronautice civile ale altor state.

1.2 Aplicabilitatea prezentului document are caracter temporar, până la intrarea în vigoare a
Regulamentului de stabilire a cerințelor tehnice și a procedurilor administrative referitoare la
personalul navigant din aviația civilă, aprobat prin Hotărârea Guvernului nr. 204/2020, ce
cuprinde norme de aplicare a prevederilor corespunzătoare ale Codului aerian nr.
301/2017.
Definiții și abrevieri
1.3 În sensul prezentului document, se definesc următoarele noțiuni:
Anexa 1 OACI – Anexa 1 Licențierea personalului (Personnel Licensing) la Convenția
privind aviația civilă internațională;
certificat conform cu Partea FCL – certificat emis în conformitate cu anexa nr. 1 - Partea
FCL a Regulamentului de stabilire a cerințelor tehnice și a procedurilor administrative
referitoare la personalul navigant din aviația civilă, aprobat prin Hotărârea Guvernului nr.
204/2020;
certificat OACI - certificat emis de un stat contractant în conformitate cu standardele
Anexei 1 la Convenția privind Aviația Civilă Intemațională;
certificat național - certificat emis de Autoritatea Aeronautică Civilă în conformitate cu
cerințele Reglement[rilor Aeronautice Civile RAC-APL – Autorizarea personalului
aeronautic al aviaţiei civile (piloţi, navigatori aerieni, ingineri naviganţi, însoţitori de bord,
operatori de bord, controlori trafic aerian, dispeceri operaţiuni de zbor), Ediția 02, aprobate
prin Ordinul nr. 27/GEN din 20 decembrie 2013;
conversie unui certificat - eliberarea unui certificat național conform cu Partea FCL pe
baza unui certificat național emis conform cu JAR-FCL1/JAR-FCL2/RAC-APL;
credit – recunoaşterea experienţei sau a calificărilor anterioare;
JAR (Joint Aviation Requirements) – cerinţele aeronautice comune adoptate de
autorităţile aeronautice comune;
JAR-FCL1 – Reglementări aeronautice comune JAR-FCL1 Flight Crew Licensing
(Aeroplane), puse în aplicare în aviația civila a Republicii Moldova prin Ordinul
Administrației de Stat a Aviației Civile nr. 7/GEN din 19.01.2000 (publicat în Monitorul
Oficial nr. 47-48 din 26.04.2001);
JAR-FCL2 - Reglementări aeronautice comune JAR-FCL2 Flight Crew Licensing
(Helicopter), puse în aplicare în aviația civila a Republicii Moldova prin Ordinul
Administrației de Stat a Aviației Civile nr. 7/GEN din 19.01.2000 (publicat în Monitorul
Oficial nr. 47-48 din 26.04.2001);
Organizaţie de pregătire aprobată (Approval Training Organisation - ATO) – o
organisație de pregătire, în care, în temeiul aprobării de către Autoritatea Aeronautică
Civilă, se desfăşoară un curs de pregătire pentru o calificare de clasă sau de tip sau
examinatorul care efectuează evaluarea competenţei, testul de îndemânare ori verificarea
competenţei în scopul evaluării, al testării sau al verificării;
RAC-APL - Reglementările aeronautice civile RAC-APL – Autorizarea personalului
aeronautic al aviaţiei civile (piloţi, navigatori aerieni, ingineri naviganţi, însoţitori de bord,
operatori de bord, controlori trafic aerian, dispeceri operaţiuni de zbor), Ediția 02, aprobate

RAC-APL 3 - Reglementările aeronautice civile RAC-APL 3 – Autorizarea personalului
aeronautic din aviația civilă (cerințe medicale), Ediția 02, aprobată prin Ordinul
Administrației de Stat a Aviației Civile nr. 56/GEN din 7 iulie 2008 (publicat în Monitorul
Oficial al Republicii Moldova, nr. 125-126, 2008, art. 368);
raport de conversie – raport pe baza căruia un certificat național, eliberat de Autoritatea
Aeronautiă Civilă în conformitate cu cerințele relevante ale RAC-APL se poate converti într-
un certificat conform cu Anexa nr.1 (Partea FCL) la Regulamentul de stabilire a cerințelor
tehnice și a procedurilor administrative referitoare la personalul navigant din aviația civilă,
aprobat prin Hotărârea Guvernului nr. 204/2020;
raport de creditare – raport pe baza căruia se pot recunoaşte experienţa sau calificările
anterioare.

CAPITOLUL II. CONVERSIA CERTIFICATELOR DE PILOT NAȚIONALE
Secțiunea 1. Dispoziții generale privind conversia
2.1 Din data intrării în vigoare a Hotărârii Guvenului nr.204 din 25.03.2020, AAC înlocuiește
certificatele de pilot de avioane/elicoptere eliberate de AAC în conformitate cu cerințele
JAR-FCL 1/JAR-FCL 2, după RAC-APL Secțiunea B Capitolul 1 Certificate și calificări de
piloți de avioane/Capitolul 2 Certificate și calificări de piloți de helicoptere, cu certificatele
care respectă formatul prevăzut în Apendicele nr.1 la Partea ARA.
2.2 Certificatele de pilot, inclusiv toate calificările şi/sau autorizaţiile asociate, eliberate de AAC,
nu în conformitate cu JAR-FCL 1/JAR-FCL 2, dar după normele corespunzătoare din
RAC-APL, se convertesc de AAC în certificate conforme cu Partea FCL în corespundere
cu:
a) dispoziţiile prezentului Capitol;
b) elementele prevăzute în raportul de conversie.
2.3 Obiectivul conversiei este de a permite piloţilor - titularilor certificatelor/autorizațiilor
naționale, emise în conformitate cu cerințele Anexei 1 OACI și după RAC-APL, să-și
menţină sfera curentă de activitate, prin alinierea cerințelor din Partea FCL și eliberarea
certificatelor corespunzătoare.
2.4 Procedura de conversie începe din data intrării în vigoare a prezentului document și se
finalizează cu eliberarea certificatelor care respectă formatul prevăzut în Apendicele nr.1 la
Partea ARA. Eliberarea certificatelor după formatul din Apendicele nr.1 la Partea ARA va
avea loc după intrarea în vigoare a Hotărârii Guvenului nr.204 din 25.03.2020.
Raportul de conversie
2.5 Raportul de conversie este întocmit de AAC și conține următoarele elemente:
a) cerinţe naţionale pe baza cărora s-au emis certificatele de pilot;
b) sfera privilegiilor acordate piloţilor;
c) precizări pentru care dintre cerinţele din Partea FCL se acordă credite;
d) toate limitările care trebuie incluse în certificatele conforme cu Partea FCL şi toate
cerinţele care trebuie îndeplinite de către pilot pentru înlăturarea respectivelor
limitări.
2.6 Raportul de conversie include copii ale tuturor documentelor necesare pentru dovedirea
elementelor de la punctul 2.5, inclusiv copii ale cerinţelor şi procedurilor naţionale relevante.
Secțiunea 2. Conversia certificatului de pilot de avioane
2.7 Un certificat de pilot, emis de AAC în conformitate cu cerințele Anexei 1 OACI și după
RAC-APL, se converteşte într-un certificat conform cu Partea FCL cu condiţia ca solicitantul
îndeplinește următoarele cerinţe:

a) pentru ATPL(A) şi CPL(A), respectă, în urma unei verificări a competenței, cerinţele
de revalidare din Partea FCL pentru calificarea de clasă, de tip şi instrumentală,
aferente privilegiilor certificatului deținut;
b) face dovada cunoașterii părților relevante ale CT-OPS şi Părţii FCL;
c) face dovada competențelor lingvistice, în conformitate cu cerințele Părții FCL punctul
FCL.055;
d) respectă cerințele din tabelul de mai jos:

2.8 Titularii CPL care deţin deja o calificare de tip pentru un avion multipilot nu sunt obligaţi să

2.12 Un certificat de pilot eliberat de AAC în conformitate cu RAC-APL se converteşte într-un

CAPITOLUL III. VALIDAREA CERTIFICATELOR DE PILOT ACORDATE DE AUTORITĂȚILE
AERONAUTICE CIVILE ALE ALTOR STATE
Secțiunea 1. Dispoziții generale privind validarea
3.1 În temeiul punctului RAC-APL 0615 (4), termenul de valabilitate a Certificatului de validare
(perioada de validare a unui certificat), emis de către AAC în conformitate cu cerințele
RAC-APL Secțiunea B Capitolul 10, va fi pînă la data intrări în vigoare a Regulamentului de
stabilire a cerințelor tehnice și a procedurilor administrative referitoare la personalul
navigant din aviația civilă, aprobat prin Hotărârea Guvernului nr. 204/2020.
3.2 La cererea titularului Certificatului, un certificat de pilot eliberat în conformitate cu cerinţele
din Anexa 1 OACI de către un stat-membru OACI poate fi validat de AAC după dispozițiile
prezentului Capitol. La data intrării în vigoare a Regulamentului de stabilire a cerințelor
tehnice și a procedurilor administrative referitoare la personalul navigant din aviația civilă,
aprobat prin Hotărârea Guvernului nr. 204/2020, validările emise de AAC după prevederile
prezentului Capitol se consideră ca fiind eliberate în conformitate cu acest Regulament.
AAC va înlocui aceste certificate cu unele care corespund formatului prevăzut în Anexa nr.7
Partea ARA.
3.3 Perioada de validare a unui certificat efectuată conform prezentului Capitol nu depăşeşte
un an, cu condiţia ca certificatul de bază să rămână valabil. Această perioadă poate fi
extinsă doar o singură dată de către AAC, dacă, în timpul perioadei de validare, pilotul a
depus cerere sau se află în pregătire pentru eliberarea unui certificat în conformitate cu
Partea FCL. Această extindere acoperă perioada necesară pentru eliberarea certificatului
în conformitate cu Partea FCL.
3.4 Titularii unui certificat validat de către AAC după dispozițiile prezentului Capitol îşi exercită
privilegiile în conformitate cu cerinţele stabilite în Partea FCL.
Secțiunea 2. Validarea certificatelor de pilot pentru transportul aerian comercial
şi alte activităţi comerciale
3.5 În cazul certificatelor de pilot pentru transportul aerian comercial şi alte activităţi comerciale,
titularul trebuie să respecte următoarele cerinţe:
a) îndeplineşte, în urma unui test de îndemânare, cerinţele de revalidare din Partea
FCL pentru calificarea de tip sau clasă, aferente privilegiilor certificatului deţinut;
b) face dovada cunoaşterii părţilor relevante ale cerinţelor operaţionale şi ale Părţii
FCL.
c) face dovada competenţei lingvistice în conformitate cu Partea FCL punctul FCL.055;
d) este titularul unui certificat medical clasa 1 valabil, eliberat în conformitate cu
RAC-APL3;
e) în cazul avioanelor, îndeplineşte cerinţele privind experienţa în conformitate cu
următorul tabel:

Secțiunea 3. Validarea Certificatului de pilot pentru activităţi necomerciale
3.6 În cazul certificatelor PPL cu o calificare de zbor instrumental sau al certificatelor CPL şi
ATPL cu o calificare de zbor instrumental, dacă pilotul are în vedere doar exercitarea
privilegiilor de pilot particular, titularul trebuie să îndeplinească următoarele cerinţe:
a) promovează testul de îndemânare pentru calificarea de zbor instrumental şi
calificările de tip sau de clasă aferente privilegiilor certificatului deţinut, în

b) face dovada cunoaşterii legislaţiei aeronautice, a codurilor meteo aeronautice, a
planificării zborului şi performanţelor de zbor (IR), şi a performanţelor umane;
c) face dovada competenţei lingvistice în conformitate cu Partea FCL punctul FCL.055;
d) este titularul cel puţin al unui certificat medical clasa 2 valabil, eliberat în conformitate
cu Anexa 1 OACI;
e) are o experienţă minimă de cel puţin 100 de ore de zbor instrumental ca PIC pe
categoria de aeronave relevantă.

3.7 În cazul certificatelor PPL sau al certificatelor CPL şi ATPL fără o calificare de zbor
instrumental, dacă pilotul are în vedere doar exercitarea privilegiilor de pilot particular,
titularul trebuie să îndeplinească următoarele cerinţe:
a) face dovada cunoaşterii legislaţiei aeronautice şi a performanţelor umane;
b) promovează testul de îndemânare PPL conform Părţii FCL;
c) îndeplineşte cerinţele relevante din Partea FCL pentru eliberarea unei calificări de
clasă sau de tip relevante pentru privilegiile certificatului deţinut;
d) este titularul cel puţin al unui certificat medical clasa 2, eliberat în conformitate cu
Anexa 1 OACI;
e) face dovada competenţei lingvistice în conformitate cu Partea FCL punctul FCL.055;
f) are o experienţă minimă de cel puţin 100 de ore de zbor ca pilot pe categoria de
aeronave relevantă.
Secțiunea 4. Validarea certificatelor de pilot pentru sarcini specifice de durată limitată
3.8 Fără a aduce atingere punctelor de mai sus din prezentul Capitol, în cazul zborurilor
producătorului, AAC poate accepta un certificat eliberat în conformitate cu Anexa 1
OACI de către un stat-membru OACI pentru o perioadă de maximum 12 luni pentru
sarcini specifice de durată limitată, precum zboruri de instruire pentru punerea în
serviciu, zboruri demonstrative, de transbordare sau de încercare, cu condiţia ca
solicitantul să respecte următoarele cerinţe:
a) este titularul unui certificat corespunzător, al unui certificat medical şi al calificărilor
asociate, în conformitate cu Anexa 1 OACI;
b) este angajat, direct sau indirect, de un producător de aeronave sau de o autoritate
aviatică.
3.9 În cazurile menționate la punctul 3.8 privilegiile titularului se limitează la efectuarea
instruirii practice şi a probelor pentru obţinerea calificărilor de tip, supravegherea primului
zbor de linie de către piloţii operatorilor, asigurarea de zboruri de livrare sau de
transbordare, primele zboruri de linie, demonstraţii de zbor sau zboruri de încercare.
3.10 Fără a se aduce atingere dispoziţiilor punctelor de mai sus din prezentul Capitol, AAC
poate, în cazul zborurilor de competiţie sau al zborurilor demonstrative de scurtă durată,
accepta un certificat eliberat de un stat-membru OACI care permite titularului să exercite
privilegiile unui PPL, SPL sau BPL, cu următoarele condiţii:
a) înaintea evenimentului, organizatorul zborurilor de competiţie sau demonstrative
furnizează AAC dovezi adecvate privind modul în care acesta se va asigura că
pilotul va fi familiarizat cu informaţiile de siguranţă relevante şi va gestiona
eventualele riscuri asociate zborurilor; şi
b) titularul deţine un certificat de pilot corespunzător, un certificat medical şi calificările
asociate, în conformitate cu Anexa 1 OACI.
3.11 Fără a se aduce atingere dispoziţiilor de la punctele de mai sus din prezentul Capitol,
AAC poate accepta un PPL, SPL sau BPL, eliberat de un stat-membru OACI în
conformitate cu cerinţele din Anexa 1 OACI, pentru un număr maxim de 28 de zile într-

un an calendaristic, în vederea unor sarcini specifice necomerciale, cu condiţia ca
solicitantul să îndeplinească următoarele condiţii:
a) este titularul unui certificat de pilot corespunzător, al unui certificat medical şi al
calificărilor asociate, în conformitate cu Anexa 1 OACI; şi
b) a efectuat cel puţin un zbor de aclimatizare cu un instructor calificat înainte de
îndeplinirea sarcinilor specifice cu durată limitată.
CAPITOLUL IV. ELIBERAREA CERTIFICATELOR DE PILOT NAȚIONALE LA
SOLICITAREA TITULARILOR CERTIFICATELOR EMISE DE AUTORITĂȚILE
AERONAUTICE CIVILE ALE ALTOR STATE
Secțiunea 1. Dispoziții generale privind eliberarea certificatelor de pilot naționale
4.1 Persoanele care solicită certificate conforme cu Partea FCL şi care sînt deja titulare a unui
certificat, calificări sau certificat echivalent eliberat de un stat-membru OACI în conformitate
cu Anexa 1 OACI, îndeplinesc toate cerinţele din Partea FCL, cu excepţia faptului că
cerinţele privind durata cursurilor, numărul de lecţii şi numărul de ore de pregătire specifică
pot fi reduse.
4.2 Creditele acordate solicitantului se stabilesc de către AAC.
4.3 În ceea ce privește eliberarea certificatelor conforme cu Partea FCL, se creditează integral
pregătirea începută înainte de aplicarea prezentului document, în conformitate cu cerințele
și procedurile autorităților aeronautice comune (JAA), sub supravegherea reglementară a
unui stat recomandat pentru recunoaștere mutuală în cadrul sistemului autorităților
aeronautice comune în privința JAR relevante.
4.4 Pregătirea începută înainte de aplicarea prezentului document în corespundere cu Anexa 1
OACI se creditează în vederea eliberării de certificate conforme cu Partea FCL, pe baza
unui raport de creditare întocmit de AAC.
4.5 Raportul de creditare descrie domeniul de pregătire, precizează pentru care dintre cerințele
pentru certificate conforme cu Partea FCL se acordă credit și, dacă este cazul, care sunt
cerințele pe care solicitanții trebuie să le îndeplinească pentru a li se elibera certificate
conforme cu Partea FCL. Raportul cuprinde copii ale tuturor documentelor necesare pentru
a dovedi domeniul de pregătire și ale reglementărilor și procedurilor naționale în
conformitate cu care s-a început pregătirea.
Secțiunea 2. Eliberarea ATPL, CPL, PPL/BPL/SPL la solicitarea titularilor certificatelor
emise de autoritățile competente ale altor state
4.6 Titularii unui ATPL eliberat de un stat-membru OACI sau în numele acestuia în conformitate
cu Anexa 1 OACI, care îndeplinesc cerinţele privind experienţa pentru eliberarea unui ATPL
pentru categoria de aeronave relevantă stabilite în subpartea F din Partea FCL pot fi
creditaţi integral în ceea ce priveşte cerinţele de a urma un curs de pregătire înainte de
participarea la examenele teoretice şi la testul de îndemânare, cu condiţia ca respectivul

certificat eliberat de un stat-membru OACI să conţină o calificare de tip valabilă pentru
aeronava care urmează a fi folosită pentru testul de îndemânare ATPL.
4.7 Titularii unui CPL eliberat de un stat-membru OACI sau în numele acestuia în conformitate
cu Anexa 1 OACI, care îndeplinesc cerinţele privind experienţa pentru eliberarea unui CPL
pentru categoria de aeronave relevantă stabilite în subpartea F din Partea FCL, trebuie să
urmeze în cadrul ATO, aprobate de către AAC, un curs de pregătire ATP înainte de
participarea la examenele teoretice şi la testul de îndemânare, cu condiţia ca respectivul
certificat eliberat de un stat-membru OACI să conţină o calificare de tip valabilă pentru
aeronava care urmează a fi folosită pentru testul de îndemânare pentru eliberarea calificării
de tip sau de clasă relevante.
4.8 Titularul certificatului ATPL sau CPL trebuie să îndeplinească următoarele cerinţe minime,
pentru categoria de aeronave relevantă:
a) a demonstrat un nivel de cunoștințe adecvat privilegiilor acordate titularului unui ATPL
(A)/(H);
b) în cazul punctului 4.6, promovează testul de îndemânare ATPL, în conformitate cu
Partea FCL;
c) în cazul punctului 4.7, promovează testul de îndemânare pentru eliberarea calificării de
tip sau de clasă relevante, în conformitate cu subpartea H Părții FCL;
d) este titularul cel puţin al unui certificat medical clasa 1, eliberat în conformitate cu
RAC-APL 3;
e) face dovada competenţei lingvistice în conformitate cu Partea FCL punctul FCL.055;
f) în cazul avioanelor, îndeplineşte cerinţele privind experienţa în conformitate cu

4.9 Titularului unui certificat PPL/BPL/SPL, unui CPL sau unui ATPL eliberat cu respectarea
cerinţelor din Anexa 1 OACI de către un stat-membru OACI, AAC poate elibera un
certificat PPL/BPL/SPL cu o calificare de clasă sau de tip pentru un singur pilot conform
cu Partea FCL.
4.10 În cazurile stipulate la punctul 4.9 titularul certificatului trebuie să îndeplinească
următoarele cerinţe minime, pentru categoria de aeronave relevantă:
a) promovează un examen scris în domeniul legislaţiei aeronautice şi performanţelor
umane;
b) promovează testul de îndemânare PPL, BPL sau SPL, după caz, în conformitate cu
Partea FCL;
c) îndeplineşte cerinţele pentru eliberarea calificării de tip sau de clasă relevante, în
conformitate cu subpartea H Părții FCL;
d) este titularul cel puţin al unui certificat medical clasa 2, eliberat în conformitate cu
RAC-APL3;
e) face dovada competenţei lingvistice (unde este aplicabil) în conformitate cu Partea
FCL punctul FCL.055;
f) a efectuat cel puţin 100 de ore timp de zbor ca pilot.
CAPITOLUL V. PROCEDURI ADMINISTRATIVE
Secțiunea 1. Dispoziții generale
5.1 Prezentul Capitol stabilește procedurile adminitsrative pentru emiterea certificatelor,
calificărilor, autorizărilor și certificatelor de validare prevăzute de prezentul document,
precum și documentele necesare procesului de certificare solicitat.
5.2 Procedura de emitere a certificatelor, calificărilor, autorizărilor și certificatelor de validare
prevăzute de prezentul document cuprinde următoarele etape:
1) etapa depunerii cererii include:
a) solicitantul completează cererea corespunzătoare, conform specimenului anexat
la prezentul document și transmite aceasta către AAC;
b) solicitantul anexează la cerere documentele necesare în dependență de procesul
de certificare solicitat și anume originalele certificatelor de absolvire cursuri,
certificatelor medicale, carnetului de zbor, etc., descrise în punctele 5.3 – 5.9
(corespunzător) al prezentului docment.

2) etapa verificării cererii și documentelor anexate include:
a) inspectorii AAC responsabili pentru procesul de certificare a personalului
navigant verifică documentele depuse;
b) în situația în care documentele justificative nu sînt suficiente pentru procesul de
certificare solicitat inspectorul informează solicitantul privind necesitatea
completării documentației anexate la cerere;
c) inspectorul AAC responsabil pentru procesul de certificare a personalului
navigant, în dependență de procesul de certificare solicitat, verifică conformarea
solicitantului cerințelor aplicabile, fixează examinările teoretice și practice
specifice solicitării;
3) etapa examinării cererii și emiterii certificatului include:
a) examinarea teoretică și practică a solicitantului în dependență de procesul de
certificare solicitat;
b) perfectarea raportului de conversie sau de creditare, după caz;
c) adoptarea deciziei privind emiterea certificatului;
d) toate evidențele (rezultatele examinărilor, testelor etc.) obținute la această etapă,
raportul de conversie sau de creditare (după caz), copia certificatului emis, se
arhivează la dosarul individual al solicitantului.
Secțiunea 2. Documentele necesare pentru eliberarea certifiatelor
5.3 În scopul conversiei Certificatului de pilot național existent, care nu a fost emis în
conformitate cu cerințele JAR, solicitantul va prezenta către AAC următoarele documente:
a) cererea corespunzătoare (specimenul este prezentat în Anexa 1 la acest document);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile în
străinătate);
c) certificatul de pilot național existent;
d) carnetul de zbor;
e) certificatul medical valabil de clasa corespunzătoare, acordat în conformitate cu
cerinţele JAR-FCL 3/RAC-APL 3.
5.4 În scopul conversiei Certificatului de pilot național existent emis în conformitate cu
cerințele Anexei 1 OACI, solicitantul va prezenta către AAC următoarele documente:
1) la etapa depunerii cererii:
a) cererea corespunzătoare (specimenul este prezentat în Anexa 1 la acest
document);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile
în străinătate);
c) certificatul de pilot național existent;
d) carnetul de zbor;
e) certificatul medical valabil de clasa corespunzătoare, acordat în conformitate
cu cerinţele JAR-FCL 3/RAC-APL3.

5.5 În scopul validării certificatului de pilot pentru transportul aerian comercial şi alte
activităţi comerciale, prevăzut în Capitolul III al prezentului document, solicitantul va
prezenta către AAC următoarele documente:
1) la etapa depunerii cererii:
a) cererea corespunzătoare (specimenul este prezentat în Anexa 3 la acest
document);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile
în străinătate);
c) certificatului de pilot existent;
d) carnetul de zbor;
e) certificatul medical valabil de clasa corespunzătoare, acordat în conformitate
cu cerinţele JAR-FCL 3/RAC-APL 3:
2) la etapa examinării cererii:
a) rezultatele susţinerii examenelor teoretice (specimenul este prezentat în
Anexa 2 la acest document) (după caz);
b) rezultatele testelor de verificare a competenței (specimenul este prezentat în
Anexa 4 sau Anexa 5 la acest document);
c) certificatul competenţei lingvistice în conformitate cu Partea FCL punctul

5.6 În scopul validării certificatului de pilot pentru activităţi necomerciale, solicitantul va
prezenta către AAC următoarele documente:
1) la etapa depunerii cererii:
a) cererea corespunzătoare (specimenul este prezentat în Anexa 3 la acest
document);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile
în străinătate);
c) certificatul de pilot existent;
d) carnetul de zbor;
e) certificatul medical valabil de clasa corespunzătoare, acordat în conformitate
cu cerinţele JAR-FCL 3/RAC-APL 3;
2) la etapa examinării cererii:
a) rezultatele susţinerii examenelor teoretice (specimenul este prezentat în

5.7 În scopul validării certificatului de pilot pentru sarcini specifice de durată limitată,
solicitantul va prezenta către AAC următoarele documente:
a) cererea corespunzătoare (specimenul este prezentat în Anexa 3 la acest document);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile în
străinătate);
c) certificatul de pilot existent;
d) certificatul medical valabil de clasa corespunzătoare, acordat în conformitate cu
cerinţele naționale ale țării de eliberare a certificatului;
e) carnetul de zbor.
5.8 În scopul eliberării unui certificat național titularului unui ATPL sau CPL acordat de
către statele-membre OACI (Capitolul IV din prezentul document), solicitantul va prezenta
către AAC următoarele documente:
1) la etapa depunerii cererii:
a) cererea corespunzătoare (conform specimenului prezentat în Anexa 2 la RAC-
APL);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile
în străinătate);
c) certificatul care confirmă susţinerea cu succes a pregătirii corespunzătoare în
cadrul unei organizaţii de pregătire;
d) carnetul de zbor;
e) certificatul medical valabil de clasa corespunzătoare, acordat în conformitate
cu cerinţele din RAC-APL 3;
f) o poză 4x5 cm., cu capul descoperit;
2) la etapa examinării cererii:
a) rezultatele susţinerii examenelor teoretice (specimenul este prezentat în Anexa
2 la acest document) (după caz);
b) rezultatele testelor de îndemînare ATPL (în cazul p.4.6) (specimenul este
prezentat în Anexa 4 sau Anexa 5 la acest document);
c) rezultatele testelor de îndemînare pentru eliberarea calificării de tip sau de
clasă relevante (în cazul p.4.7) (specimenul este prezentat în Anexa 4 sau
Anexa 5 la acest document);
d) certificatul competenţei lingvistice în conformitate cu Partea FCL punctul
FCL.055 (specimenul este prezentat în Anexa 6 la acest document).
5.9 În scopul eliberării certificatelor de pilot PPL/BPL/SPL în baza certificatelor acordate
de către statele-membre OACI, solicitantul va prezenta către AAC următoarele
documente:
1) la etapa depunerii cererii:
a) cererea corespunzătoare (conform specimenului prezentat în Anexa 2 la
RAC-APL);
b) documentul care confirmă identitatea solicitantului (paşaport pentru călătoriile
în străinătate);

f) o poză 4x5 cm., cu capul descoperit;
2) la etapa examinării cererii:
a) rezultatele susţinerii examenelor teoretice în domeniul legislaţiei aeronautice şi
performanţelor umane (specimenul este prezentat în Anexa 2 la acest
document) (după caz);
b) rezultatele testelor de îndemînare (specimenul este prezentat în Anexa 4 sau
Anexa 5 la acest document);
c) certificatul competenţei lingvistice în conformitate cu Partea FCL punctul
FCL.055 (specimenul este prezentat în Anexa 6 la acest document).
Secțiunea 3. Examinarea teoretică și practică
5.10 Examinarea teoretică a solicitanților este atributul exclusiv al AAC.
5.11 AAC organizează sesiuni de examinare teoretică în funcție de cererile care sînt depuse în
acest scop de solicitanți.
5.12 Participarea la examinările teoretice se face după înregistrarea cererilor corespunzătoare

5.13 Conținutul subiectelor de examinare se elaborează de către examinatorii pentru
disciplinele teoretice din cadrul AAC, cu excepția celor utilizate din banca de întrebări
existente la nivel european (ECQB-EASA) și banca de întrebări pentru ECQB-PPL
furnizor LPLUS Gmbh, pentru PPL(A) și PPL(H).
5.14 Examinarea practică se efectuează sub supravegherea unui examinator autorizat de

Section 1 – Basis of application: In accordance with the requirements of paragraph 3, Subpart A, Annex III of Regulation laying down technical requirements and administrative procedures for civil aviation flight crew Government Decision No.204/2020 Part FCL, the Civil Aviation Authority of the Republic of Moldova may accept a licence issued in accordance with Annex 1 to the Chicago Convention by a contracting state for a maximum of 12 months for use in Commercial Air Transport or other Commercial

Operations, provided the applicant complies with the following requirements:
(a) meets any of the qualifying criteria described in Sections 1.1 to 1.4 of this Application Form; or, (b) intends to fly aircraft, in compliance with Articles 32 and 33 of the Convention on International Civil
Aviation, outside the territory of the Republic of Moldova.
This period may be extended by the CAA RM only when, during the validation period, the pilot validated has applied for or is undergoing training for the issuance of a licence in accordance with Government Decision No.204/2020 Part-FCL (Refer Applicant’s Declaration at Section 10.3).
(Note: If employment is via an intermediate company or pilot procurement agency, copies of all contracts proving the pilot’s link with the aircraft operator will be required.)
Section 1.3 and 1.4 - Documentary evidence which is required to prove that aircraft which is flown or intended to be flown is a Moldavian registered
• Aircraft details must be filed at Section 9.2 of this Form.
Section 1.5. In accordance with the requirements of paragraph 6, Subpart A, Annex III of Regulation laying down technical requirements and administrative procedures for civil aviation flight crew Government Decision No.204/2020 Part FCL, the Civil Aviation Authority of the Republic of Moldova may accept a licence issued in accordance with Annex 1 to the Chicago Convention by a Contracting State for a maximum of 12 months for “specific tasks of limited duration”, such as instruction flights for initial entry into service, demonstration, ferry or test flights, provided the applicant-
(a) is employed, directly or indirectly, by an aircraft manufacturer, and,
(b) documentary proof is supplied by an employing aircraft manufacturer or aviation authority (see Section 12).
Any validation applied for which involves carriage of passengers (as opposed to technical staff necessary for the task) will require the applicant to meet the full requirements as if for Commercial Air Transport operations.

Section 6 - ATPL(A) Theoretical Knowledge (to be completed by CPL/IR-holders, if applicable) CPL(A)/IR holders requesting validation as co-pilot on multi-pilot aeroplanes / helicopters shall have demonstrated ICAO ATPL(A/H) level knowledge before acceptance (Government Decision No.204/2020, Annex III, paragraph 3 (e) note marked (*))
Section 7 – Details of Relevant Pilot Flight Experience (to be completed by applicant)
Minimum qualifying experience required (based on Part-FCL requirements) is shown at Sections 9.3 (Aeroplanes) and 9.4 (Helicopters). Proof of this experience must be demonstrated by paper or printed electronic log-book records and may be verified independently by the CAA RM from a source such as an NAA or Employer,
Note also re “90-day Rule” - (Extract from Government Decision No.204/2020, FCL.060 – “Recent experience”.
“(b) Aeroplanes, helicopters, powered-lift, airships and sailplanes.
A pilot shall not operate an aircraft in commercial air transport or carrying passengers:
(1) as PIC or co-pilot unless he/she has carried out, in the preceding 90 days, at least 3 take-offs, approaches and landings in an aircraft of the same type or class or an FFS representing that type or class. The 3 take-offs and landings shall be performed in either multi-pilot or single-pilot operations, depending on the privileges held by the pilot”;
Section 8 – English Language Proficiency (ELP)
The copy of your Pilot Licence must include an ELP endorsement of a minimum of ICAO Level 4. If no ICAO Level is specified, your application must be supported by documentary evidence from the Civil Aviation Authority which issued the Licence certifying that a minimum of ICAO Level 4 ELP is otherwise held. The CAA RM requires each applicant pilot to undergo an ELP assessment with an CAA RM-designated or accepted English Language Assessors [ELA]. The English Language Assessment Form must be attached to this application.
Section 10 – Applicant’s Declaration
This section must be completed by the applicant after reviewing all information entered on the application form. If you are unable to understand any of the questions in the Application Form, please contact the CAA RM Personnel Licensing Office for further advice before submitting it.
Section 11 - Applicant’s Certification Of Testing, Training & Medical Certification
This Section must be completed by the applicant after reviewing all test and training certificates / documentation required to be submitted with the application form and the information entered on the application form. If you are unable to understand any of the questions in the application form, please contact the Personnel Licensing Office for further advice before submitting it.

13.1 GUIDANCE NOTES
Section 2 – Personal Details
Please ensure that your Surname and First Name(s) are entered exactly as per the Passport document and pilot licence that you submit with your application. Your permanent address will be the address entered on your Pilot Licence, and will also be the address to which the Validation will be sent, unless you request that it be sent to the address for correspondence. If you want the validation sent to your Employer, please enter the Employer address in the details under ‘correspondence address’.

ATPL(A) - CONVERSION Application for the conversion of an Airline Transport Pilot
Licence ATPL(A) according to Government Decision No.204/2020 Article 8
Section 6 – Details of Relevant Pilot Flight Experience (to be completed by applicant)
Minimum qualifying experience required (based on Part-FCL requirements) is shown at Sections 9.3 (Aeroplanes) and 9.4 (Helicopters). Proof of this experience must be demonstrated by paper or printed electronic log-book records and may be verified independently by the CAA RM from a source such as an NAA or Employer,
Note also re “90-day Rule” - (Extract from Government Decision No204/2020, FCL.060 – “Recent experience”.
“(b) Aeroplanes, helicopters, powered-lift, airships and sailplanes.
A pilot shall not operate an aircraft in commercial air transport or carrying passengers:
(1) as PIC or co-pilot unless he/she has carried out, in the preceding 90 days, at least 3 take-offs, approaches and landings in an aircraft of the same type or class or an FFS representing that type or class. The 3 take-offs and landings shall be performed in either multi-pilot or single-pilot operations, depending on the privileges held by the pilot”;
Section 7 – English Language Proficiency (ELP)
The copy of your Pilot Licence must include an ELP endorsement of a minimum of ICAO Level 4. If no ICAO Level is specified, your application must be supported by documentary evidence from the Civil Aviation Authority which issued the Licence certifying that a minimum of ICAO Level 4 ELP is otherwise held. The Moldavian Aviation Authority requires each applicant pilot to undergo an ELP assessment with an CAA RM-designated or accepted English Language Assessors [ELA]. The English Language Assessment Form must be attached to this application.
Section 9 – Applicant’s Declaration
This section must be completed by the applicant after reviewing all information entered on the application form. If you are unable to understand any of the questions in the Application Form, please contact the CAA RM Personnel Licensing Office for further advice before submitting it.
Section 10 - Applicant’s Certification Of Testing, Training & Medical Certification
This Section must be completed by the applicant after reviewing all test and training certificates / documentation required to be submitted with the application form and the information entered on the application form. If you are unable to understand any of the questions in the application form, please contact the Personnel Licensing Office for further advice before submitting it.
Section 12 – Sponsoring Employer’s Declaration (if application is sponsored by an Employer)
Section 12 is obligatory for applicants for “Short Duration Task” Validations under section 1.5 of this form.

Also, if an application is sent by Email, all scanned documents must be in Adobe Acrobat PDF file format. The original Application Form & supporting documents must be submitted by post as soon as possible thereafter. A Conversion will not be issued until the original Application Form & supporting documents are received in the CAA RM.

The requirements for the initial issue of a Part-FCL LAPL (A) / PPL(A) are set out in Subpart C, Sections 1 & 2 of the Regulation establishing the technical requirements and administrative procedures, and in Annex III, Part B for conversion of an ICAO Annex 1 compliant licence.
Credit for PIC flight time in an aircraft category other than Aeroplanes can only be claimed if a pilot licence, or equivalent privileges, is held for the appropriate category of aircraft. Any such credit shall be calculated in accordance with FCL.210.A (d).
Section 6 – Declaration of Further Training
This section must be completed by the ATO’s Head of Training (or nominated Deputy) where a previous attempt at the LAPL (A) / PPL(A) skill test resulted in a partial pass or fail and the examiner specified the need for further training before re-test / further attempt.

Additional authorisation on a type rating for instrument approaches down to a DH of less than 60 m (200 ft) (CAT II/III)
The following manoeuvres and procedures are the minimum training requirements to permit instrument approaches down to a DH of less than 60 m (200 ft.). During the following instrument approaches and missed approach procedures, all aeroplane equipment required for type certification of instrument approaches down to a DH of less than 60 m (200 ft.) shall be used.

9. GUIDANCE NOTES
Section 1: Applicant Details – to be completed by the applicant. Section 2: Purpose of the Skill Test / Proficiency Check – to be completed by the applicant.
Note: If a test/check is to be completed for both SP and MP privileges, a separate form must be completed for each test/check. A skill test may also serve as a revalidation or renewal Proficiency Check for the applicant’s IR.
Section 3: Application & Declaration - to be completed by the applicant. Section 4: Course Completion Certificate – to be completed, as applicable, by the ATO Head of
Training or authorised signatory for initial issue or renewal of a type rating. An ATO Course Completion Certificate will be accepted in lieu of this section provided it contains the same information.
Section 5: Examiner Declaration – to be completed by the Examiner(s) that conduct the Test/Check, and re-test if applicable.
Section 6: Skill Test / Proficiency Check Details (1-st Attempt only) – to be completed by the Examiner that conducts the 1-st attempt only. If the result of the test/check is a Partial Pass or Fail, the Examiner report must be completed – the report can be continued on a separate sheet of paper if necessary.
Section 7: Skill Test / Proficiency Check Details (2-nd Attempt only) – to be completed by the Examiner that conducts the 2-nd attempt (re-test following Partial Pass) only. If the result of the re-test is a Fail, the Examiner report must be completed – the report can be continued on a separate sheet of paper if necessary.
Section 8: Content of the Training, Skill Test / Proficiency Check – to be completed by the Instructor(s) and Examiner(s), as applicable. The Examiner(s) should annotate PASS or FAIL against each item tested in the ‘Attempt 1’ box as applicable’. If an item is passed, complete the ‘Examiner Initials and date completed’ box. If an item is failed, do not initial or date the box. On a retest annotate PASS or FAIL in ‘Attempt 2 box’ and sign and date in the ‘Examiners Initials and date completed’ box. A different Examiner may conduct Attempt 2. All items in Attempt 1 must be completed before starting Attempt 2. Full details on the conduct of the Test/Check, specific requirements for the Test/Check, pass marks, test tolerances and content of the Training, Skill Test/Proficiency Check are set out in Appendix 9 of the Regulations establishing technical requirements and administrative procedures relating to civil aviation personnel (Government Decision No.204/2020 (as amended).
Section 9: To establish or maintain PBN privileges one approach shall be an RNP APCH. Where an RNP APCH is not practicable, it shall be performed in an appropriately equipped FSTD. If Section 6 (Low Visibility Operations) of the Skill Test / Proficiency Check is completed, the additional ATO/Air Operator details must be given.
