2. Upon approval of the Form I-526petition, either:

a. File a Form I-485, Applicationto Register Permanent Residenceor Adjust Status, with USCIS toadjust status to conditionalpermanent resident within theUnited States, orb. File a DS-230, Application forImmigrant Visa and AlienRegistration, with the Departmentof State to obtain an EB-5 visa foradmission to the United States.

What are Steps 3 and 4to obtain the EB-5 GreenCard?

3. The EB-5 investor (and his or herderivative family members) is grantedconditional permanent residence for atwo-year period upon the approval of theI-485 application or upon entry into theUnited States with an EB-5 immigrantvisa.

4. File Form I-829, Petition by Entrepreneurto Remove Conditions, 90 days prior tothe two-year anniversary of the grantingof the EB-5 investor’s conditionalresident status (Green Card). If USCISapproves this petition, the conditions areremoved from the EB-5 applicant’s statusand the EB-5 investor and derivativefamily members will be allowed topermanently live and work in the UnitedStates [and will be issued permanentGreen Cards.]

Travel Documents (Reentry Permits).Each Travel Document is valid for 2years. With proper planning and legaladvice you may use the TravelDocuments to stay in China for a totalof 4 additional years, provided thatyou can show that you have nointention of abandoning or have notabandoned your legal permanentresidence in the USA. You shouldconsult an attorney to review thespecific factors that will apply in yourcase that would allow you to reside inChina and in the United States. Eachfamily’s circumstances are different.
