“ ”版权工作 十三五 规划

“ ” “ ”十三五 时期是全面建成小康社会的决胜阶段，是落实 四个全面 战略布局，实

“ ”现 两个一百年 宏伟目标的关键时期。为全面提高版权创作、运用、保护、管理和服务

能力，有效实施创新驱动发展战略，加快版权强国建设，服务全面建成小康社会，根据

《国家知识产权战略纲要》、《国务院关于新形势下加快知识产权强国建设的若干意

“ ” “ ”见》、《 十三五 国家知识产权保护和运用规划》及《新闻出版广播影视 十三五 发展

规划》，编制本规划。

一、版权工作发展环境

“ ”（一） 十二五 时期版权工作主要成就

“ ”十二五 时期，版权工作深入贯彻落实党的十八大精神，积极推进实施《国家知识

产权战略纲要》，各项工作取得显著成绩。

1.版权法律制度体系不断完善

我国批准世界知识产权组织《视听表演北京条约》，《著作权法》第三次修订工作深

入推进，完成《著作权法实施条例》、《信息网络传播权保护条例》等行政法规的修订工

作，制定《使用文字作品支付报酬办法》、《关于规范网络转载版权秩序的通知》等部门

规章和规范性文件，版权地方性立法工作有序开展。既符合中国国情又与国际规则相衔接

的版权法律制度体系不断完善，版权工作法治化水平显著提升。

2.版权执法监管力度不断加大

各级版权行政管理部门坚持日常监管与专项行动相结合，严厉打击各类侵权盗版行

“ ”为。 十二五 期间，全国版权行政处罚案件 35280件。国家版权局联合相关部门持续开

“ ”展打击网络侵权盗版 剑网行动 ，共查处网络案件 2765件，依法关闭侵权盗版网站

1193个，有效打击和震慑了网络侵权盗版行为。建设国家版权监管平台，利用技术手段

强化版权执法监管初见成效。

3.使用正版软件工作不断推进

软件正版化工作取得重大进展，政府机关于 2013年底全部实现软件正版化，全国累

计 27001家企业实现软件正版化。其中中央企业、大中型金融机构、新闻出版行业企业

集团基本实现软件正版化，75.35%的金融机构实现软件正版化，软件正版化长效工作机

制不断健全。

4.版权社会服务水平不断提升

著作权登记工作规范化、标准化、信息化水平不断提升，登记数量持续增长。2011

年至 2015年登记总量为 5260972件，2013年登记量首次突破百万，提前 2年完

“ ”成 十二五 规划目标。加强对著作权集体管理组织及涉外著作权认证机构的管理与服

务，版权社会服务体系日趋完善。

5.版权产业持续推进不断发展

国家版权局授予 8个城市为全国版权示范城市、56个单位为全国版权示范单位、18个园区（基地）为全国版权示范园区（基地），成立了全国版权示范城市联盟，各省级版权示范工作也逐步开展。全国设立 12家版权交易中心（贸易基地)，成立了国家版权交易中心联盟。我国版权产业对国民经济贡献的比重持续增长，2014年已占全国GDP的

7.28%。

6.版权宣传培训工作不断加强

“宣传培训工作形成了以 4·26 ”知识产权宣传周 为重要平台，配合版权重点工作有计

划开展的常态机制。国家版权局发挥官方网站信息主渠道作用，开通官方微博、微信及新

闻客户端，持续组织举办版权执法培训班、软件正版化培训班、版权相关热点问题媒体研

修班，各地开展了形式多样、丰富多彩的宣传培训活动，社会各界不断增进对版权工作的

认识和理解。

7.版权国际交流合作不断深入

我国于 2012年 6月在北京承办世界知识产权组织保护音像表演外交会议，推动成功

缔结《视听表演北京条约》，2014年批准该条约，积极推动世界知识产权组织在中国设

立了办事处，增强了我国在国际版权领域的话语权和影响力。积极落实与美、欧、英、

日、韩等国家和地区的版权合作战略备忘录，完成世界贸易组织对华贸易政策审议及相关

自贸区谈判、双边磋商等，为我国经济社会发展创造良好国际版权环境。

“ ”（二） 十三五 时期版权工作形势

“十三五”时期，我国经济发展进入“新常态”,坚持创新、协调、绿色、开放、共享五大发展理念，实施创新驱动发展战略，加快知识产权强国建设。版权创作、运用、保护、管理和服务的任务更重、作用更大、要求更高，版权工作进入一个新阶段。

党中央、国务院高度重视包括版权在内的知识产权工作，对版权工作的要求越来越

“ ”高。版权工作必须牢固树立 四个意识 ，特别是核心意识、看齐意识，始终同以习近平

同志为核心的党中央保持高度一致，始终坚持为党和国家工作大局服务的宗旨。在新的形

势下，做好版权工作必须具备更好政治素质和业务素质。版权工作属于社会化管理工作，

从事版权工作要树立面向全社会的新思路、新方法，充分运用市场力量，积极整合社会资

源，建立完善的版权社会化服务体系和治理体系。版权涉外事务繁多，双边、多边和区域

问题复杂。随着我国地位提升和国际竞争加剧，版权涉外应对形势愈加复杂、任务更加繁

重。版权工作要从被动适应国际规则转变到主动参与、引导国际规则制定，不断提升版权

国际话语权和影响力。

“ ”十二五 时期版权工作取得很大成绩，但当前还存在不少问题和挑战。一是版权保

护环境有待进一步优化。我国版权保护目前仍处于矛盾和纠纷高发期，总体特征仍然是保

“ ”护不足，这就决定了 十三五 时期仍然要将版权保护放在版权工作的突出位置，实行版

权严格保护，维护良好的版权保护环境和秩序。二是全社会的版权意识有待进一步提

“ ”高。 尊重创作、尊重版权 的氛围还没有在全社会普遍形成，需要持续加大版权宣传、

培训力度。三是版权法律制度、体制机制、人才队伍等方面还不能适应建设创新型国家和

版权强国的要求，还需要不断完善法律制度体系，健全体制机制，加强人才队伍建设。

二、指导思想、基本原则和发展目标

（一）指导思想

“ ”坚持以马克思列宁主义、毛泽东思想、邓小平理论、 三个代表 重要思想、科学发

展观为指导，全面贯彻党的十八大和十八届三中、四中、五中、六中全会精神，以习近平

总书记系列重要讲话精神为主线，全面落实党中央、国务院各项决策部署，紧紧围绕服务

经济发展新常态，大力实施创新驱动发展战略，认真贯彻《国家知识产权战略纲要》及

“《国务院关于新形势下加快知识产权强国建设的若干意见》，按照 创新、协调、绿色、

”开放、共享 的发展理念，推进版权工作理念创新、内容创新、方法创新，不断提高工作

水平，加快版权强国建设，为建设创新型国家和全面建成小康社会提供有力支撑。

（二）基本原则

实施版权严格保护。在版权保护方面，针对当前我国仍处于版权矛盾和纠纷高发期，

侵权盗版行为还比较普遍、版权环境还有待进一步优化的现实，继续加大版权执法监管力

度，实行严格的版权保护。同时要与我国仍处于社会主义初级阶段和属于发展中国家的基

本国情相适应，避免过度保护、滥用保护，突出版权保护实际效果，构建版权严格保护格

局。

推动版权产业发展。 “ ”根据中央 发展仍是解决我国所有问题的关键 这个重大战略判

断，综合运用法律、政策、经济、行政和技术等手段，促进版权创造和运用，加强版权交

易中心建设，做好版权示范工作，研究建立互联网版权确权、授权和交易机制，强化版权

资产管理，完善版权产业发展的制度研究，发挥版权在文化发展中的基础性、战略性作

用，构建版权产业又好又快发展格局。

健全版权工作体系。 “版权工作要注重体系建设，统筹兼顾，整体推进，坚持 五个并

”重 。坚持立法与执法并重,　既重视版权立法，也要强化版权执法；坚持监管与服务并重,

既要加大版权监管力度，也要提高版权服务水平；坚持网下与网上并重,既要重点打击互

联网侵权盗版行为，也不忽视传统形式的版权问题；坚持国内与国际并重,　既要加强国内

版权工作，也要提升国际应对能力；坚持保护与发展并重，既要强调加强版权保护，也要

注重版权产业发展。

（三）发展目标

1.总体目标

加快版权强国建设，为建成中国特色、世界水平的版权强国奠定坚实基础。按照《国务院关于新形势下加快知识产权强国建设的若干意见》规划，努力推进版权强国建设。到2020年,版权法律制度体系更加完备，版权工作法治水平进一步提高；版权执法监管力度不断加大，版权保护环境明显改善；版权社会服务体系更加完善，版权产业又好又快发展；版权创作、运用、保护、管理和服务能力显著增强，全社会版权意识大幅提升；版权国际交流合作不断拓展，我国在国际版权体系中的话语权和影响力进一步提高。

2.具体指标

“ ”十三五 时期，各级版权行政管理部门要加大版权重点工作力度。国家版权局每年

组织开展 2次全国性的版权执法专项行动，5次全国性的版权执法培训及 7次全国性的软

件正版化工作培训。每年新授予 1至 2家全国版权示范城市、15至 20家全国版权示范

单位、3至 5家全国版权示范园区（基地）。著作权登记工作持续推进。其中作品登记年

均增长 15%，2020年全国登记数量达到 278万件；计算机软件著作权登记数量年均增

长 10%，2020年全国登记数量达到 60万件（详见下表）。

三、重点任务

（一）完善版权法律制度体系

根据《中共中央国务院关于完善产权保护制度依法保护产权的意见》等有关规定和要

求，立足版权实际和中心工作，推进版权法律制度精细化、时代化和特色化，着力解决版

权领域法律修订相对滞后等问题，加强版权重点立法，加快完善版权法律制度体系。

1.推进《著作权法》第三次修改

修改完善《著作权法》，健全侵权法定赔偿、著作权集体管理制度、著作权登记制

度、网络环境下确权、授权和交易规则等顶层设计，加强《著作权法》与我国加入国际条

约的衔接。

2.制定、修订有关著作权行政法规

根据《著作权法》修订情况，研究制定《民间文学艺术作品著作权保护条例》，修订

《著作权法实施条例》、《信息网络传播权保护条例》、《著作权集体管理条例》等配套

行政法规，完善著作权法律法规体系。

3.制定、修订有关著作权部门规章

研究制定规范网络版权秩序的系列办法，完善版权行政执法依据；研究制定国有著作

权管理办法，填补国内版权管理空白；适时修订有关著作权登记的部门规章，进一步规范

作品登记、合同登记与备案等工作。

4.指导地方著作权立法工作

加强工作指导和业务支持，鼓励各地在立法权限和范围内因地制宜制定地方性法规和

规章，保障各项著作权法律法规的有效实施。

（二）完善版权行政管理体系

1.加大版权执法监管力度

健全版权侵权查处机制，加强版权执法监管，做好行政执法与刑事司法衔接，强化事

中事后监管，重点突出大案要案查处和重点行业专项治理，加大侵权行为惩治力度，营造

和维护合法有序的版权环境。

(1)加强版权行政执法力度。把行政执法作为版权工作的首要任务来抓，通过专项整治与日常监管相结合，强化事中事后监管，重点查处侵犯版权的大案要案，加大对反复侵

权、恶意侵权、规模侵权等行为的处罚力度。

(2)突出网络领域版权监管。将网络作为履行版权监管职责的重要阵地，不断净化网“ ”络版权环境。持续开展打击网络侵权盗版 剑网行动 ，强化分类管理，加强对网络文

学、音乐、影视、游戏、动漫、软件等重点领域的监测监管，及时发现和查处侵权盗版行

为。依托国家版权监管平台，完善版权重点监管，扩大监管范围，把智能移动终端第三方

应用程序（APP）、网络云存储空间、网络销售平台等新型传播方式纳入版权有效监

管。

(3)强化版权执法协作。进一步强化版权执法协作机制，推动完善各级文化综合执法

机构落实版权执法任务的工作机制，有效发挥文化市场行政综合执法中的版权执法职能，

“ ”充分运用 扫黄打非 工作组织协调机制，加强与公安、工商、工信、网信等部门的配

合、协作，形成版权执法合力。加强版权行政执法与刑事司法的衔接，积极参与建设和使

用全国打击侵权假冒工作行政执法与刑事司法衔接工作信息共享平台，进一步推进版权执

法案件的信息公开。更好发挥地方执法监管和社会维权监督作用，建立地方版权执法协作

机制及版权执法部门与企业、协会合作机制。

(4)建立完善长效机制。完善打击网络侵权盗版的快速反应机制，健全与基础电信企

“ — ”业、互联网信息服务企业快速有效的 通知 移除侵权 工作机制。完善版权快速维权与

维权援助机制，缩短侵权处理周期。探索建立版权行政调解机制，通过非诉讼纠纷解决途

“径积极化解版权纠纷。探索建立侵权盗版信用评价机制，发布失信单位和个人 黑名

”单 。

(5)提升执法监管信息化水平。充分利用云计算、物联网、大数据、移动互联网等新一代信息技术，创新版权监管手段，提高执法有效性和精准度。完善国家版权监管平台，

建设权利人及侵权盗版等信息库，实现对互联网侵权盗版行为的及时发现、源头追溯、有

效监控、准确取证、属地查处，提高对侵权盗版行为的监管、查处效能。

2.持续推进软件正版化工作

建立健全软件正版化工作制度和长效机制，充分利用互联网和大数据等信息技术，创

新工作模式和方法，制度与技术手段并重，构建软件正版化工作新体系，巩固和扩大软件

正版化工作成果。

(1)紧密把握两个结合。推进软件正版化与信息化建设、信息安全保护有机结合，推

进软件正版化与自主创新有机结合，推广应用优秀软件产品，提升国家软件核心竞争力。

(2)突出重点工作任务。充分发挥推进使用正版软件工作机制优势，加强正版软件管

理，巩固中央和省级政府机关、中央企业和大中型金融机构软件正版化成果，推进市县级

政府机关软件正版化工作规范化、常态化，推进地方国有企业和中小金融机构全部实现软

件正版化，推进事业单位和民营企业软件正版化工作。

(3)建立健全责任体系。推进政府机关和相关企业明确软件正版化工作责任部门，建

立较为完善的软件正版化责任体系，把推进软件正版化工作的领导责任、部门责任和员工

责任落到实处。

(4)加强技术标准手段。在完善软件正版化工作涉及的软件采购、使用管理、督促检

查等制度的基础上，充分利用技术手段，建立软件正版化工作信息化平台，统一软件正版

化工作相关数据标准和统计标准，提高软件正版化工作效率。加强管理模式创新，科学利

用第三方专业机构资源。

（三）完善版权社会服务体系

1.优化版权社会管理工作

全面完善版权社会服务体系，创新工作方式方法，加强版权公共信息服务平台建设，

充分发挥版权社会服务机构的作用，进一步提升版权服务与管理能力。

(1)搭建版权社会服务平台。积极争取国家有关部门批准，搭建全国著作权登记工作的服务平台，探索建立全国统一的著作权登记、统计和查询系统，完善版权社会服务。

(2)推进著作权登记工作。进一步规范作品登记、计算机软件著作权登记、著作权质

权登记、涉外著作权合同登记、著作权专有许可使用合同及转让合同备案等工作，提高著

作权登记数量，提升著作权登记质量。

(3)加强对著作权集体管理组织的监管与服务。支持著作权集体管理组织依法开展业务活动和维权工作，妥善解决其与相关利益方之间的矛盾与纠纷。鼓励著作权集体管理组

织建立与相关产业、行业的合作平台。适时研究建立表演、美术等领域的著作权集体管理

组织。

(4)依法加强对涉外著作权认证机构、国际著作权组织在华常驻代表机构的监管。健全监管通气会制度，依法规范上述机构在我国境内开展的各项涉及版权的活动，充分发挥

其在国内外版权交流与合作中的桥梁纽带作用。

2.推动版权产业健康发展

完善推动版权产业发展的制度与政策，加强机制和平台建设，抓好项目带动，综合运

用各种措施，促进版权创造与运用，推动版权产业又好又快发展。

(1)积极推进版权交易。加强对国家版权交易中心、国家版权贸易基地的培育和管

“ ”理，重点培育东北地区、 一带一路 沿线、国家综合改革试验区、自由贸易区等既符合

“ ”国家战略又具有产业特色的国家版权交易中心。支持 国家版权交易中心联盟 建设，充

“分发挥其在版权交易、评估、融资等方面的聚集、协同和服务作用。继续举办 中国国际

”版权博览会 ，扩大版权产业影响。

(2)继续开展版权示范创建。继续开展国家版权示范城市、示范单位、示范园区（基地）创建工作，加强对已授予称号的示范城市、单位和园区（基地）的后续管理，充分发

挥版权示范创建工作对版权产业发展的引导带动作用。

(3)深入开展版权产业相关研究。以出版行业国有版权资产管理为基础，开展广播电影电视等领域的版权资产管理调研，清理、拓展版权资产价值，探索版权资产管理的方法

流程和制度体系，带动全社会各领域加强版权资产管理。组织开展网络版权产业发展研

究，继续开展版权产业国民经济贡献调研，指导推动地方开展版权产业国民经济贡献调

研，更好发挥对版权产业发展的促进作用。

3.加强版权宣传培训工作

充分利用各种传播形式尤其是新型传播形式，全方位地进行版权宣传，广泛开展版权

培训，提升全社会版权认知度，扩大版权工作的社会影响，增进国际社会对中国版权工作

的理解和支持。

(1) “做好版权重点宣传。以 4·26 ”知识产权宣传周 为重要平台，以重大版权事件、版

权活动为契机，充分发挥国家版权局门户网站及官方微信、微博等主导作用，利用各种场

合、媒体，不断创新宣传方式，做好版权重点工作的国内国际宣传，营造良好版权舆论氛

围。

(2)建立版权舆情监测信息服务机制。积极运用各种媒体特别是网络媒体，注重对版权热点问题、重大事件、网络监测内容的舆情分析，建立舆情信息专报制度，为版权工作

大局提供舆情信息服务。

(3)强化版权教育培训。针对不同地区、不同部门、不同人群开展培训，将版权培训

“对象从版权执法人员向公众、媒体和版权相关从业人员扩展，继续办好 版权媒体热点问

”题研修班 ，引导正确的舆论导向，提高全社会的版权认知水平。

（四）完善版权涉外工作体系

正确研判国际形势，统筹国内国际两个大局，主动参与国际版权体系建设，积极推

“ ”动 一带一路 涉外版权工作，稳妥处理国际版权事务，拓展国际交流合作渠道，进一步

提高版权多、双边合作与应对水平，适时变被动应对为主动出击，不断提升版权国际话语

权和影响力。

1.深化与版权有关的国际组织合作

深化与世界知识产权组织、世界贸易组织、亚太经合组织等与版权有关的国际组织的

交流合作，争取增加我国在国际组织中的职员比重，推动《视听表演北京条约》早日生

效，做好《马拉喀什条约》批准的相关工作，积极参与相关国际版权条约的制定及版权议

题的对话与磋商，切实维护我国家利益，争取有利于我发展的国际版权环境。

2.推动建立合作共赢的新型双边版权关系

“进一步完善与美、欧、英、日、韩等重要版权双边关系的对话交流平台，本着 合作

”共赢 的原则，妥善处理版权保护问题，化解版权争端，适时推动与其他国家建立对话协

“ ”商机制，促进与 一带一路 沿线国家版权工作开展，继续推进两岸四地版权工作，形成

遍及重点国家和地区的新型双边版权关系网络。

3.建立健全版权国际应对联动机制

继续做好国际版权事务的分析研究，跟踪了解、掌握国际版权发展的新动向、新趋

势，特别是美欧发达国家版权新情况，及时制定实施相应工作措施。加强与立法机关、司

法机关及外交、商务、专利、商标等行政机关的版权国际应对联系沟通，实现多部门、多

行业的联动应对机制。

四、保障措施

（一）加强组织领导，强化督促检查，确保各项工作落到实处

建立完善版权工作领导负责制，从新闻出版广播影视（版权）系统做起，把版权工作

作为全局性的工作统筹谋划、切实抓好，引导全社会高度重视版权工作。加强对各级版权

行政管理部门的指导和协调，发挥中央和地方两个层面的积极性，将版权工作纳入从中央

到地方的重大规划当中。强化对各项工作任务的监督、指导与考核，建立目标责任考核体

系，积极争取把版权执法、软件正版化、著作权登记、版权示范等纳入地方政府的重点工

作及考核目标，确保各项工作任务的落实。

（二）加强队伍建设，提高业务能力，完善版权执法及管理体系

强化国家版权局与地方版权管理部门及文化市场综合执法部门的联系，发挥各地文化

“ ”市场综合执法优势，充分调动公安、工信、网信、 扫黄打非 等部门版权执法的积极

“ ”性，运用好 两法 衔接机制，定期召开版权执法工作会议，开展版权执法培训，运用国

家版权监管平台，增强版权行政管理和执法人员利用新技术进行监管的能力。建立媒体及

著作权登记等版权从业人员培训制度，定期组织业务培训，提高从业人员的版权业务水

平，进一步规范版权相关服务机构及中介组织的市场行为。

（三）争取财政支持和优惠政策，加大对版权工作的扶持力度

积极与财政、金融、税务、发展改革等部门沟通协调，努力将版权工作纳入各地重大

规划中实施，争取财政及其他相关政策支持。引导地方政府给予著作权登记工作专项资金

或优惠政策。对西部欠发达地区及少数民族地区版权重点工作加强指导、扶持。

（四）加强激励引导，调动社会力量，激发全民创新创造活力

“ ”继续举办并有效运用 中国版权金奖 ，对在版权创作、运用、保护、管理和服务过

程中作出突出贡献的单位和个人予以嘉奖，激发全社会的创新意识和创作热情。充分调动

各种社会资源和力量，发挥各类版权协会、中介组织、交易中心、研究机构、集体管理组

织及专家学者的作用，强化版权登记、评估、质押、融资、交易、调解、仲裁等功能，完

善版权社会服务体系，促进版权事业、版权产业全面健康发展。

（五）加强人才储备，整合社会资源，服务版权涉外应对工作

建立国际版权专家智库，重视版权国际应对人才的培养，有针对性地开展国际版权专

业人才培训，培养一批政治素质好、业务水平高、熟悉国内外版权事务的版权业务骨干。

充分利用社会资源，发挥专家学者的特长，整合由高校、科研院所等专业机构为主体的国

际版权应对工作咨询团队，系统研究版权热点难点问题，为做好版权国际应对、提升对外

版权工作水平提供人才保障和智力支持。

1.国家版权监管平台项目

完善国家版权监管平台，通过平台应用实现版权执法、著作权登记和软件

正版化等版权工作信息的及时报送、统计、公告和查询，对互联网及其他新媒

体的侵权盗版行为进行实时监管，加强对著作权集体管理组织及著作权涉外认

证机构的监管与服务，增进对地方版权管理及执法机构的联系和指导，全面提

升版权工作水平。

2.国家版权示范工作推进工程

“继续开展全国版权示范城市、示范单位、示范园区（基地）创建工作， 十

”三五 时期，争取创建 5-10个示范城市、75-100个示范单位、15-25个示范

园区（基地），充分发挥各示范主体在版权保护、版权产业发展中的引领和带

动作用。

3.全国版权交易体系建设推进工程

重点培育 5-10 “ ”个在 一带一路 沿线、国家综合改革试验区、自由贸易区

内既符合国家战略又带动区域经济发展的全国性或区域性版权交易中心（基

地），建立并完善全国性的版权贸易、版权交易协作联盟，集聚版权资源，降

低交易成本，促进版权交易的规范化运作，打造健康版权产业链，服务创新型

国家和版权强国建设。
