PROCEDURE UNDER E-TENDERING INSTRUCTION TO BIDDERS

(Note: RFP stands modified to the extent required as per these instructions)

1. Accessing/ Purchasing of bid documents

i) It is mandatory for all the bidders to have class-III Digital Signature Certificate(in the name of person who will sign the Bid) from any of the licensedCertifying Agency (Bidders can see the list of licensed CNs from the link www.cca.gov.in) to participate in e-tendering of NHAI.

ii) To participate in the E-Bid submission, it is mandatory for the bidders to getregistered their 'firm/ Consortium (As qualified in RFQ stage for the Project)with e-tendering portal http://www.nhai.org/ / to have user ID &passwordwhich has to be obtained by submitting an annual registration charges of INR

2247/(Inclusive of all taxes to M/ s ITI Ltd.) through e-payment gateway of Punjab National Bank using Credit Card/Debit Card/Master Card and Visa only.Validity of online registration is 1 year. Henceforth there will be no need of physical submission of Demand Draft for the same.

iii) The complete Bid Document can be Viewed / downloaded from the NHAI e-tendering portal free of cost (www.nhai.org).

iv) Detailed tender document can be viewed from e-tender portal of NHAIwww.nhai.org from19.11.2012.

v) To participate for bidding, bidders have to pay Rs.40,000/-(Rs. Forty Thousandonly) towards fee for RFP document (non-refundable) in the form of DemandDraft issued from a scheduled Bank in India in favour of "National Highways

Authority of India" payable at New Delhi and Rs 13,483/-(Thirteen ThousandFour Hundred Eighty Three Only) inclusive of all Taxes towards TenderProcessing fee (Non-Refundable) in favour of "M/s ITI Limited", through e-payment gateway of Punjab National Bank using Credit Card/Debit Card/MasterCard and Visa only on e-tender portal www.tenderwizard.com/NHAI

vi) Detailed tender document can be downloaded from e-tender portal of NHAIwww.nhai.orgfrom19.11.2012.

Following may be noted

(a) Registration should be valid at least up to the date of submission of bid.

(b) Bids can be submitted only during the validity of their registration.

(c) The amendments / clarifications to the bid document, if any, will be hosted

on the NHAI website.(d) If the firm / Consortium (As qualified in RFQ stage for the Project) is

already registered with e-tendering portal of NHAI and validity of

registration is not expired the firm / consortium is not required for fresh

registration.



2. Preparation & Submission of bids:(i) Detailed tender documents may be downloaded from e-tender portal

of NHAI www.nhai.org from 19.11.2012 and tender may besubmitted online following the instruction appearing on the screen.A buyer manual containing the detailed guidelines for e-tenderingsystem is also available on e-tender portal ofNHAI.

(ii) The following documents shall be prepared and scanned in differentfiles (in PDP or JPEG format such that file size is not more than 5MB) and uploaded during the on-line submission of Bid. Thesedocuments shall also be submitted in 'ORIGINAL' to NHAI beforethe prescribed date &time for submission of Bids.

(a) Bid Security [Rs. 6.86 Crore (Rupees Six Crore and Eighty Sixonly)] in the format at Appendix-II;

(b) Cost of tender document of Rs 40,000/ - (Rupees Forty Thousandonly) in the form of DD in favour of NHAI, payable at NewDelhi

(c) Tender processing fee of Rs. 13,483/ -(Thirteen Thousand FourHundred Eighty Three Only) inclusive of all Taxes, through e-payment gateway of Punjab National Bank using CreditCard/Debit Card/Master Card and Visa only - on e-tender portalwww.tenderwizard.com/NHAI;

(d) Power of Attorney for signing of Bid in the format at Appendix-iii;

(e) If applicable, the Power of Attorney for Lead Member of Consortium in the format at Appendix-IV; and

(f) An Undertaking from the person having PoA referred to in Sub.Cl. (d) above that they agree and abide by the Bid documents

uploaded by NHAI and amendments uploaded if any(iii) The bid (Price bid) should be submitted online only in the

prescribed format given in the website. No other mode of submission is accepted.

(iv) Appendix-l of the Bid shall be digitally signed by the AuthorizedSignatory of the bidder & submitted "on-line" only. No hard copyof Appendix-l is required to be submitted.

(v) It may be noted that scan copies can be prepared in different fileformat (PDP, JPEG).

(vi) It may also be noted that bidders can upload a single file of size of 5MB only but you can upload multiple files.

(vii) The Documents as specified in para 2 (ii) above shall be placed in asealed envelop. The envelop should bear the followingidentifications: ~Enclosure to Bid for_ Operation andMaintenance of Muzaffarpur-Darbhanga-Ring Bunds-Simrahi-Forbesganj-Purnea section of NH-57 (Km. 0.0000 toKm. 148.550 and Km. 159.357 to Km. 310.000) Total Length274.197 Km) on OMT basis and Operation Toll Collection,Maintenance and Transfer of Toll Plaza at Km. 150.390 (for Toll collection of Annuity reach from Km. 148.550 to Km.159.357 of Koshi Bridge of NH-57 in the State of Bihar onOMT Basis (OMT Package No. -20 [Total Cost includingmajor maintenance Rs.156.80 crore]" and addressed to.

3. Modification / Substitution! Withdrawal of bids:

(i) The Bidder may modify, substitute or withdraw its e- bid after submission. Prior to the BidDue Date. No Bid shall be modified, substituted or withdrawn by the Bidder on or afterthe Bid Due Date.

(ii) Any alteration / modif ication in the Bid or additional information supplied subsequent tothe Bid Due Date, unless the same has been expressly sought f or by the Authority, shall be

disregarded;(iii) For modification of e-bid, bidder has to detach its old bid from e-tendering portal and

upload I resubmit digitally signed modified bid.

(iv) For withdrawal of bid, bidder has to click on withdrawal icon at e-tendering portal andcan withdraw its e-bid,

(v) Before withdrawal of a bid, it may specifically be noted that after withdrawal of a bid forany reason, bidder cannot re-submit e-bid again.

4. Opening&Evaluation of bids.

(i) Opening and evaluation of bids will be done through online process.

(ii) The Authority shall open on-line received Bids at 1600 hrs on the Bid Due Date, in thepresence of the Bidders who choose to attend. The Authority will subsequently examineand evaluate the Bids in accordance with the provisions set out.

(iii) Prior to evaluation of Bids, the Authority shall determine whether each Bid is responsiveto the requirements of this RFP.

(iv) 'Financial Bid' of non-responsive bidders shall not be opened.

(v) The bid shall be opened of those bidders only who submit originals as mentioned' in para2 (ii) of e-tendering procedure. The bid submitted online shall not be opened and shall bedeclared non-responsive, if original are not submitted as mentioned in para 2(ii) of e-tendering procedure. Further action will be initiated against such non-response bid as perclause 2.20.7.
