U .S .C i t i ze n s h i p an d Im m i g r atio n S e r vi ce s Office of the Director ( M S 2000) Wash i n g t o n , D C20529 - 2 0 0 0 June 17, 2014 PA-2014-006 Policy Alert SUBJECT: Changes to Dates of Birth and Names on Certificates of Citizenship Purpose U.S. Citizenship and Immigration Services (USCIS) is issuing policy guidance in the USCIS Policy Manual relating to changes of dates of birth and names per court orders. Background USCIS recognizes that the dates of birth of children born abroad are not always accurately recorded in the countries in which they were born. In some adoption cases, for example, the child’s adoptive parents may obtain evidence of a mistake in the name or date of birth (DOB) reported by the foreign jurisdiction. In such cases, adoptive parents have sought to have the corrections recognized by their state court with jurisdiction in the United States. USCIS will issue a Certificate of Citizenship with the corrected name or DOB in accordance with the Accuracy for Adoptees Act (Pub. L. 113-74, January 16, 2014). Policy Highlights: USCIS will issue an initial, or replacement, Certificate of Citizenship with a new DOB if a U.S. state court order recognizes the new DOB. USCIS will issue an initial, or replacement, Certificate of Citizenship with a name other than that on a foreign record of birth if a U.S. state court orders the legal name change.
