A RARE AND VERY LARGE PAIR OF CANTON “FAMILLE ROSE” PORCELAIN BALUSTER VASES, CHINA, QING DYNASTY, 19 TH CENTURYEach of baluster shape, the shoulder slightly protruding lobed rising to a neck that ends into a trumpet with an evertedlobed rim. Enameled with two large rectangular panels enclosing scenes depicting soldiers riding in battle, with twoother smaller panels with related scenes of dignitary in pavilion at the neck. Two pair of Chilongs applied in high reliefon the shoulder divided by two confronted Buddhist lion and cub. On one rim a small piece missing and a hairline onthe shoulder of a vase: overall in good condition, surface slightly wear and firing imperfections.

A PAIR OF LARGE CHINESE "DRAGON" BALUSTER VASES, CHINA, QING DYNASTY, HALF OF 19TH CENTURY (2)Each with two confronted Buddhist lion cubs handles and chilong relief on the shoulder, decorated, on a turquoiseground, with a big dragon facing a tiger between rocks, pines and flowers. Below lappets and on the end of the necka continuous ruyi band. On the lobed rim a decoration of four bats and Buddhist Emblems. On both vases a metalplaque inserted with a relief decoration and an inscription. One vase in good conditions, the other broken in part ofthe body but with its own pieces re-stuck.

An accomplished collector with an excellent eye, prodigious, great knowledge and a truly outstanding memory, Nik-
ki Constable Maxwell and her late husband Andrew, a decorated WW2 (second world war) soldier and successful
businessman built up an important collection of valuable items. Between the 1950’s-1970’s they accumulated a large
number of pieces that they found interesting to them personally, not such that were necessarily in vogue at the time. In-
ternationally, they were best known for their outstanding collection of ancient glass, which was mostly sold in 1979 at
Sotheby’s for then record prices, both for the collection as a whole and also for an individual piece, a glass “diatre-
tum” or cage cup which bears their name. They also had a sale of rare books also at Sotheby’s in the late 1980’s.
Following a house move to a smaller home, they then concentrated on reducing their possessions. Those pieces now
offered for sale are the last remaining items, particular because they appealed to Nikki for various personal reasons.
Andrew died in 1991, age 83 and Nikki his widow in 2016, at the age of 95.

In overall good conditions, two minor flakes and minor firingimperfections.

A RARE AND LARGE CIZHOU STONEWARE FIGURE OF ASEATED GUANYIN, CHINA, EARLY MING DYNASTY (1368-1644)Representing an 'Avalokitesvara', the compassionate hearerof prayer, modeled seated on a rocky elevation guarded bya dragon. The divinity is clad in ancient form, wear anecklace and a tiara, and is shown with halo or nimbus.The right hand rests upon the raised knee, close to whichappears a parrot, the left arm rests on the rock with her handholding a rosary. Coated with a deep ivory-white glazewhich in part is relieved by pale russet-red and dark browntones. In very good conditions, just a very small hole closeto the her left knee, possibly could have been anaccompanied figure of a small boy, characteristic minorfiring imperfections, very minor wear.

A RARE “DOUCAI” STEM CUP, CHINA, CHENGHUA MARK, POSSIBLY OF THE PERIOD OF KANGXI (1665-1722)With a deep U-shaped form the cup, supported on a tall splayed foot bordered, with a raised fillet, the exteriordecorated in under-glaze blue, red, yellow and green enamels with four medallions of roses wreathed by foliage, twoblooms in red and the other two in yellow, all between stylized floral and pearls motifs at the rim and an undulatingborder supporting ruyi-heads below, the underside of the stem inscribed in under-glaze blue with a six characters markwritten in a semi-circle. in quite good condition, the cup in the high section broken and re-stuck, as visible from thecatalogue illustration, the stem cup would need a professional restoration.

A PAIR OF FINE SGRAFFIATO RUBY-GROUND “FAMILLE-ROSE” MEDALLION PORCELAIN BOWLS, CHINA, QING DYNASTY,SEAL MARK AND OF THE PERIOD OF DAOGUANG (1821-1850)Each finely potted with the rounded sides rising from a short straight foot to a slightly everted rim, the exterior delicatelypainted with four circular medallions decorated with spray of peach, pomegranate, chrysanthemum, lychee, rose, twoof the medallion accompanied with aster design, interspersed with pair of lotus spray, all reserved on a ruby groundexquisitely incised with feathery, scrolling tendrils, the interior painted in shadow of under glaze-blue with a medallionof a basket containing peaches, chrysanthemums and rose, beneath spray of aster, pomegranate and lingzhi in thecavetto, underneath the base a seal mark in underglaze blue. In good condition, one with a minor flake of 0,6 by 0,3cm and the other with a hairline of 4 cm from the mouth rim, both with light scratches inside on the centre.

A FINE AND RARE YELLOW-GROUND “FAMILLE ROSE” PORCELAIN TEAPOT AND COVER, CHI-NA, QING DYNASTY, SIX IRON RED CHARACTER XIANFENG MARK AND OF THE PERIOD(1851-1861)The finely potted globular body with a short slightly tapering mouth with a geometric continuousband, on one side has a curved upright spout and opposed an elegant ear-shaped loop handle. The body of the teapotdecorated with two lobed panels surrounded by colorful scrolling lotus, flowers and foliate sprays, all reserved on abright imperial yellow ground, with a petal lappet decoration rising above the base and a band of ruyi head belowthe rim. AN ARCHAIC BRONZE RITUAL TRIPOD WINEVESSEL, JUE, CHINA, LATE SHANG DYNASTY,12TH - 11TH CENTURY B.C.Supported on three long triangular-sectionblade-like legs, the U-shaped body terminatesin a curved spout flanked by two posts withdomed caps, decorated with whorl patterns,and triangular tail. The C form handle is set onone side of the body over a two-characterinscription. The body is cast with a frieze of twolarge taotie masks with protruding eyes andleiwen scroll and quills, one mask is bisected bya vertical flange, and the other by theinscription. The soft greyish-green surface hassome malachite encrustation. The jue in goodcondition, X-ray shows the vessel in goodcondition with no break on the body, only avisible shaped short Y-crack and a chip re-stuckon top of the body where the handle joint thecaps of the body of the vessel and two crackson the handle, where the handle joint to thebody and re-stuck, some patch of malachiteencrustation to the decorated sides and someminor blistering to the flat surface, inside somevisible mud with traces of path of malachiteencrustation.

This is a private collection of objectscoming mainly from continental China.This collection reflects the taste forbeauty and craftsmanship excellence ofan Italian patrician and his spouse, aFrench lady, who lived at the highestlevel of life quality ot their times.The collectionist was a highest rankdiplomat who spent in China andneighbouring kingdoms more than twodecades from 1907 to 1931.Stemming from a patrician familyestablished in a NorthernTuscanyCommune since the tenth century, hestarted his diplomatic career inCostantinople (now Istambul) then inSao Paulo do Brasil followed by Bona(Algeria), with ever increasingresponsibilities.In 1907 he was moved for his first time toChina in Mongtze, where new raiwayconstruction was in course. Hankowfollowed where revolutionary eventsduring 1912 requested him to protectespecially the missions established in theregion.In 1916 he was moved to Shanghai asresponsible of the Italian Legation. In
1925 he was appointed Chargé d’Affaires of the then Kingdom of Italy in Beijing by the ImperialCourt.His last mission in Asia was as highest rank diplomat by the Kingdom of Siam (Thailand) until 1931.Other missions followed in Europe (Luxembourg and Bruxelles) but his very last mission regardingChina was his participation as highest representative of the Kingdom of Italy at the Society ofNations Conference in Geneve in 1932 for the solution of the Sino-Japanese controversy overManchuria.The collection build over the years of his stay in China, grew especially after his marriage in 1915with a French lady. She was living with her family in the French Legation in Shanghai. They fullyshared the taste for highest quality local craftsmanship valuing the manufacturing art more thanthe intrinsic value. Their aim was adorning their residences with attractive, significant objects tocreate a warm, exotic atmosphere fot them and their hosts.Being the highest rank diplomat and his wife, their social life was very active. Their residences werefrequently hosting official and private events. Their social life included sports, with special electionfor horse riding (both) and hunting. He owned his private hunting elephant while in Siam but bothhave especially loved dogs for hunting and as pets.He passed away in his estate in Tuscany in the early fifties while his beloved wife survived him untilthe mid seventies of last century.The collection was inheriteted by their only daughter who continued its preservation and finallytransmitted it to her heirs.

A Major in the Royal Italian Army, was born in Liguria in 1863 (?). He died in Africa in fighting in Africa in 1913. He came froma family of venetian shipowners and great travellers. At 17 years of age he went to the military school in Modena and be-gan his military career. Lieutenant first and then colonel, he was sent to China as a Major to assume the command at Tien-Tsin: he stayed there till 1903. Thanks to his good work in China, he was awarded the cross of a Knight of the Ordine dellaCorona d’Italia and of the Ordine dei SS. Maurizio e Lazzaro.In 1906 he left for Eritrea where he stayed until 1910 and he was promoted to Lieutenant Colonel. Two years later, he wasin Cirenaica (Libya) where he fought heroically and died in 1913. He was awarded the gold medal for Military Excellence.The collection here illustrated is comprised of objects he collected and received in China (he held a high military positionand frequented embassy parties and high society milieux): the collection have since remained with his descendants.

A BARDO MANDALA THANGKA, TIBET, 17TH CENURYGouache on cotton with silk mount and the reverse withTibetan inscriptions and the stupa. The so called Bardothangka is about the between-state depiction showing thevarious forms of Deities who manifest themselves duringthe between (bard-do) state after death and beforerebirth, in circular realms related to the transmigratoryvision. In the concentric external circles an array ofvision of deities produced by the psyche of the deceasedimmediately after the death; a Lama (in the upper rightside of the painting) usually assists in instructing theperson before the death to prepare to face the vision . Inthe central circle the Six Buddhas of the Six Realms: demi-god, animal, infernal hungry ghost, human, God’s realm,who will try to seduce the deceased and bring him totheir Realm. On the sixth day the five Buddhas appeartogether to prevent the deceased to have bad visions andconsequently bad karma and the carmic energy of theindividual is transmigrated to a new beginning. In theupper register of the painting on the left the ShakyamuniBuddha (the founder of Buddhism). Wear on the surfaceand some losses in color.

A LARGE AND RARE GILD REPOUSSÉ COPPER ALLOY SEATED FIGURE OF A RATNASAMBHAVA BUDDHA, TIBET, 17TH CENTURYRatnasambhava is one of the Five Dhyani Buddhas (or "Five Meditation Buddhas")Tantric Buddhism and he isassociated with the attempt to destroy greed and pride, can be represented with or without ornaments. The Buddhais finely cast seated with legs crossed in dhyanasana on double-lotus pedestals, one with his left hand inbhumisparsa mudra, his right hand varada mudra. He has a serene expression with downcast eyes below archedeyebrows and the urna on his forehead, flanked by pendulous earlobes, his "snailshell" hair are highlighted withblue pigments. The robe covers the left shoulder. The head is removable and inside there is a prayer roll.A knock in the back, some losses in gild and re-touches.

ESPORTAZIONE DEI LOTTI ACQUISTATIIl Dlgs n. 42 del 22 gennaio 2004 regola l’esportazione di Beni Culturali al di fuoridel territorio della Repubblica Italiana. Il Regolamento CEE n. 3911/92 del 9dicembre 1992, come modificato dal Regolamento CEE n. 2469/96 del 16 dicem-bre 1996 e dal Regolamento CEE n. 974/01 del 14 maggio 2001, regola invecel’esportazione dei Beni Culturali al di fuori dell’Unione europea.Per esportare fuori dall’Italia i Beni Culturali aventi più di 50 anni è necessaria la Li-cenza di Esportazione che l’acquirente è tenuto a procurarsi personalmente.WANNENES ART AUCTIONS non risponde per quanto riguarda tali permessi, népuò garantire il rilascio dei medesimi. WANNENES ART AUCTIONS, su richiestadell’acquirente, può provvedere all'espletamento delle pratiche relative alla con-cessione delle licenze di esportazione secondo il seguente tariffario:- euro 250,00 + IVA per singolo lotto o per il primo di una pratica- euro 100,00 + IVA per gli altri lotti facenti parte della medesima pratica

DIRITTO DI SEGUITOCon Dlgs n. 118 del 13/2/2006 è in vigore dal 9 Aprile 2006 in Italia il “Diritto di Se-guito” (Droit de Suite), ossia il diritto dell’autore (vivente o deceduto da meno di70 anni) di opere di arti figurative e di manoscritti a percepire una percentuale sul
prezzo di vendita degli originali delle proprie opere in occasione delle vendite suc-cessive alla prima. Tale diritto sarà a carico del Venditore e sarà calcolato sul prez-zo di aggiudicazione uguale o superiore ai 3.000,00 euro.Tale diritto non potrà comunque essere superiore ai 12.500,00 euro per ciascun lot-to. OFFERTE SCRITTE E OFFERTE TELEFONICHEPer la partecipazione attraverso offerte scritte e telefoniche i potenziali acquirentidevono compilare l’apposito Modulo di Offerta pubblicato in questo catalogoed inviarlo via fax al numero +39 010 2517767 almeno 7 ore prima dell’inizio del-l’asta. COLLECTION OF LOTSPurchasers must collect the Lot/s by 15 working days from the date of the Auction.At the end of this span of time, WANNENES ART AUCTIONS will not be responsibleeither for the custody of the Lot/s or for any damage that may occur to the Lot/supon their removal to an appropriate warehouse. EXPORT OF THE LOTS PURCHASEDThe Law Decree no. 42 of January 22nd 2004 regulates the export of cultural heri-tage and goods outside the Republic of Italy. The EU Regulation no. 3911/92 of De-cember 9th 1992, as modified by EU Regulation no. 2469/96 of December 16th1996 and by EU Regulation no. 974/01 of May 14th 2001, regulates the export ofcultural heritage and goods outside the european Union. In order to export outsi-de Italy cultural heritage and goods that are over 50 years old need an Export Li-cence that the Purchaser has to procure for him/herself personally. WANNENES ARTAUCTIONS is not involved in the procurement of such permits and cannot therefo-re guarantee the relative issue of such permits. THE ARTIST’S RESALE RIGHTThe Artist’s Resale Right has been in force in Italy since April 9th 2006 with the LawDecree no. 118 (13/02/2006). This represents the right of the Author/Artist (living ordeceased within the previous seventy years) of figurative art works and manuscriptsto perceive a percentage of the sale price of his/her original works upon those sa-les taking place following the initial sale of the work/s in question. Resale Royaltieswill be charged to the seller where the hammer prise is 3.000,00 euro or more andwill not be superior to 12,500 euro per lot. The amount to be paid may thus be cal-culated:4% for the sale price up to 50,000 euro.3% for the sale price between 50,000,01 and 200,00 euro.

ESTIMATESBeside each Lot description in the Catalogue there is an indication of the Estimatefor potential Purchasers. In each case, all the Lots, in light of market interest, mayachieve prices that are either superior to or inferior to the indicated Estimates. TheEstimates published in the Auction Catalogue may be subject to revision and donot include the purchase commission (buyer’s premium) and VAT.
RESERVEThe reserve price corresponds to the minimum price agreed upon between WAN-NENES ART AUCTIONS and the SELLER, beneath which the Lot will not be sold. Lotsoffered with no reserve are indicated in the Catalogue with the Estimate in RED andwith the description O.1. These Lots are sold to the highest Bidder independently ofthe published Estimates.

TAKING PART IN AN AUCTIONTaking part in an Auction may occur by means of the Bidder being present in theAuction Room, or by means of written or telephone Bids that WANNENES ARTAUCTIONS will gladly carry out for potential Purchasers. This service is free of char-ge and, therefore, WANNENES ART AUCTIONS bears no form of responsibility forthis service. WANNENES ART AUCTIONS will, therefore, not be responsible for anyBids inadvertently mislaid or for mistakes in relation to the latter. BIDDING IN PERSONIn order to bid in person, potential Purchasers have to register and collect a biddingnumber by filling out the Bidding Form and providing a valid document of identi-fication and tax code number. WRITTEN AND TELEPHONE BIDSIn order to bid by means of written or telephone Bids potential purchasers have tofill out the Bidding Form in this Catalogue and send it by fax to the number +39 0102517767 at least SEVEN hours before the beginning of the Auction. Bids must be ineuro and do not include Auction commissions and charges and taxation as laiddown by the Law. Written Bids are carried out on behalf of the Bidder at the lowestprice possible in consideration of the reserve price and the other Bids offered. CONDIZIONI GENERALI DI VENDITA
Art. 1 I beni possono essere venduti in lotti o singolarmente ad insindacabile giudizio della WANNENES ART AUCTIONS (di segui-to ART AUCTIONS o Casa d’Aste). Le aste saranno tenute in locali aperti al pubblico da ART AUCTIONS che agisce unicamentecome mandataria nel nome e nell’interesse di ciascun venditore (il nome del quale è trascritto in tutti i registri previsti dallevigenti leggi). Gli effetti della vendita influiscono direttamente sul compratore e sul venditore. ART AUCTIONS non assumenessuna responsabilità nei confronti dell’aggiudicatario, del venditore, o di qualsiasi altro terzo in genere.
Art. 2 Gli oggetti sono venduti/aggiudicati al miglior offerente, e per contanti. Nel caso in cui sorgessero delle contestazionitra più aggiudicatari, il Banditore, a suo insindacabile giudizio, rimetterà in vendita il bene che potrà essere nuovamen-te aggiudicato nella medesima asta; in ogni caso gli aggiudicatari che avessero sollevato delle contestazioni restano vin-colati all’offerta fatta in precedenza che ha dato luogo alla nuova aggiudicazione. In caso di mancata nuovaaggiudicazione il Banditore, a suo insindacabile giudizio, comunicherà chi deve intendersi aggiudicatario del bene. Art. 3 ART AUCTIONS si riserva il diritto di ritirare dall’asta qualsiasi lotto. Il banditore conduce l’asta iniziando dall’offerta che ritienepiù opportuna, in funzione sia del valore del lotto presentato sia delle offerte concorrenti. Il banditore può fare offerte con-secutive o in risposta ad altre offerte, fino al raggiungimento del prezzo di riserva. Il Banditore, durante l’asta, ha facoltà di ac-corpare e/o separare i lotti e di variare l’ordine di vendita. Il banditore può, a suo insindacabile giudizio, ritirare i lotti che nonraggiungano il prezzo di riserva concordato tra ART AUCTIONS ed il venditore.
Art. 4 L’aggiudicatario corrisponderà ad ART AUCTIONS un corrispettivo pari al 24% sul prezzo di aggiudicazione comprensivo diI.V.A. Per i lotti che fossero in temporanea importazione, provenendo da paesi non UE oltre ai corrispettivi d’asta di cui sopral’aggiudicatario, se residente in un Paese UE, dovrà corrispondere ogni altra tassa conseguente, oltre a rimborsare tutte le spe-se necessarie a trasformare da temporanea a definitiva l’importazione (i beni interessati saranno indicati con il segno**). Si ri-corda che qualora il venditore fosse un soggetto I.V.A. l’aggiudicatario dovrà corrispondere anche le imposte conseguenti (ibeni interessati saranno contrassegnati dal segno °°).
Art. 5 Al fine di garantire la trasparenza dell’asta tutti coloro che sono intenzionati a formulare offerte devono compilare una sche-da di partecipazione con i dati personali e le referenze bancarie. ART AUCTIONS si riserva il diritto di verificare le referenze for-nite e di rifiutare alle persone non gradite la partecipazione all’asta. All’atto della compilazione ART AUCTIONS consegneràun cartellino identificativo, numerato, che dovrà essere esibito al banditore per formulare le offerte.
Art. 6 ART AUCTIONS può accettare mandati per l’acquisto (tramite sia offerte scritte che telefoniche) effettuando rilanci tramite il Bandi-tore, in gara con le persone partecipanti in sala. In caso di offerte identiche l’offerta scritta preverrà su quella orale.
Art. 7 Nel caso di due offerte scritte identiche, che non siano superate da offerte in sala o telefoniche, ART AUCTIONS considere-rà aggiudicataria quella depositata per prima. ART AUCTIONS si riserva il diritto di rifiutare, a suo insindacabile giudizio, of-ferte di acquirenti non conosciuti e/o graditi. A parziale deroga di quanto sopra ART AUCTIONS potrà accettare dette offertenel caso sia depositata una somma a garanzia di importo pari al valore del lotto richiesto, oltre commissioni, tasse, e spese.In ogni caso all’atto dell’aggiudicazione l’aggiudicatario comunicherà, immediatamente, le proprie complete generalità e ipropri dati fiscali.
Art. 8 ART AUCTIONS agisce esclusivamente quale mandataria dei venditori declinando ogni responsabilità in ordine alla descri-zione degli oggetti contenuta nei cataloghi ed in ogni altra pubblicazione illustrativa. Tutte le descrizioni dei beni devono in-tendersi puramente illustrative ed indicative e non potranno generare nessun affidamento di alcun tipo negli aggiudicatari.L’asta sarà preceduta da un’esposizione dei beni al fine di permettere un congruo esame degli stessi da parte degli aspiran-ti acquirenti, affinché quest’ultimi, sotto la loro totale e completa responsabilità, possano verificarne tutte le qualità, quali adesempio, l’autenticità, lo stato di conservazione, il tipo, il materiale, la provenienza, dei beni posti in asta. Dopo l’aggiudica-zione nessuno potrà opporre ad ART AUCTIONS od ai venditori la mancanza di qualsiasi qualità dei beni oggetto di aggiu-dicazione. ART AUCTIONS ed i propri dipendenti e/o collaboratori non rilasceranno nessuna garanzia di autenticità e/oquant’altro. Tutte le indicazioni sulla caratura ed il peso di metalli o pietre preziose, come sui relativi marchi, sono puramen-te indicative. ART AUCTIONS non risponderà di eventuali errori o della falsificazione effettuata ad arte. Nonostante il possi-bile riferimento ad elaborati di esperti esterni alla Casa d’Aste, ART AUCTIONS non ne garantisce né l’esattezza né l’autenticità.
Art. 9 Le stime relative al prezzo base di vendita, riportate sotto la descrizione di ogni bene sul catalogo, sono da intendersi al netto di ognionere accessorio quale, ad esempio, diritti d’asta, tasse ecc. ecc. Poiché i tempi tipografici di stampa del catalogo richiedono la de-terminazione dei prezzi di stima con largo anticipo esse potranno essere oggetto di mutamento, così come la descrizione del bene.Ogni e qualsivoglia cambiamento sarà comunicato dal Banditore prima dell’inizio dell’asta sul singolo bene interessato; fermo restandoche il lotto sarà aggiudicato unicamente in caso di raggiungimento del prezzo di riserva.
Art. 10 Il completo pagamento del prezzo di aggiudicazione, dei diritti d’asta, e di ogni altra spesa accessoria dovrà essere effettua-to entro 10 giorni lavorativi dalla data dell’Asta, in valuta avente corso legale nella Nazione ove si è svolta l’asta. In caso di man-cato pagamento, fermo restando il risarcimento dei maggiori danni ART AUCTIONS potrà: a) restituire il bene al mancatovenditore ed esigere il pagamento dal mancato acquirente delle commissioni perdute; b) agire per ottenere l’esecuzionecoattiva dell’obbligo di acquisto; c) vendere il lotto a trattativa privata, od in aste successive, comunque in danno del man-cato compratore, trattenendo a titolo di penale gli eventuali acconti versati. Nel caso il lotto rimanesse custodito da ARTAUCTIONS ciò avverrà a rischio e spese dell’aggiudicatario e del mancato venditore in solido. In ogni caso fino alla data divendita o restituzione l’aggiudicatario dovrà corrispondere ad ART AUCTIONS una somma, a titolo di penale, calcolata, aven-do come base, l’importo di aggiudicazione maggiorato di tutte le tasse e commissioni, al tasso del 30%. Tale somma sarà do-vuta a partire dal sesto giorno successivo all’aggiudicazione.
Art. 11 L’aggiudicatario, dopo aver pagato tutte le somme dovute, dovrà ritirare i lotti acquistati entro 15 giorni lavorativi dalla data dell’Astaa suo esclusivo rischio, cura e spese, rispettando l’orario a ciò destinato da ART AUCTIONS. Nel caso in cui l’aggiudicatario non do-vesse ritirare i lotti acquistati entro il termine sopraindicato ART AUCTIONS li conserverà, ad esclusivo rischio e spese dell’aggiudica-tario, nei locali oggetto dell’asta per altri cinque giorni lavorativi. Trascorso tale periodo ART AUCTIONS potrà far trasportare, semprea rischio e spese dell’aggiudicatario, i beni presso un qualsiasi depositario, od altro suo magazzino, liberandosi, nei confronti dell’ac-quirente, con la semplice comunicazione del luogo ove sono custoditi i beni. Resta fermo il fatto che per ritirare il lotto l’aggiudica-tario dovrà corrispondere, oltre al relativo prezzo con accessori, anche il rimborso di ogni altra spesa successiva.
Art. 12 In ogni caso ART AUCTIONS potrà concordare con gli aggiudicatari diverse forme di pagamento, di deposito, di vendita atrattativa privata, di assicurazione dei beni e/o la fornitura di qualsiasi altro servizio che fosse richiesto al fine del miglior an-damento possibile dell’affare.
Art. 13 Tutti sono ovviamente tenuti a rispettare le leggi vigenti all’interno dello Stato ove è stata svolta l’asta. In particolare ARTAUCTIONS non assume nessuna responsabilità in relazione ad eventuali restrizioni all’esportazione dei lotti aggiudicati, e/oin relazione a licenze e/o permessi che l’aggiudicatario potrà dover richiedere in base alla legge vigente. L’aggiudicatarionon potrà richiedere alcun rimborso ne al venditore ne ad ART AUCTIONS nel caso che lo Stato esercitasse il suo diritto diprelazione, od altro diritto a lui riservato. I diritti maturati in relazione ad una aggiudicazione poi annullata a causa della ne-gata autorizzazione all’esportazione del lotto per contrasto tra le diverse Soprintendenze, sono comunque dovuti dal man-dante ad ART AUCTIONS se tale mancato permesso deriva dalla non comunicazione del mandante ad ART AUCTIONSdell’esistenza di una autorizzazione all’esportazione rilasciata dall’Ente competente su richiesta del mandante stesso.
Art. 14 In caso di contestazioni rivelatesi fondate, ed accettate da ART AUCTIONS a seguito della vendita di oggetti falsificati ad ar-te la Casa d’Aste potrà, a sua discrezione, dichiarare la nullità della vendita e, ove sia fatta richiesta, rivelare all’aggiudicatarioil nome del venditore. L’acquirente potrà avvalersi di questo articolo solo ed esclusivamente nel caso in cui abbia notificatoad ART AUCTIONS, ai sensi degli articoli 137 e SS CPC la contestazione con le prove relative entro il termine di 15 giorni dal-l’aggiudicazione. In ogni caso, a seguito di un reclamo accettato l’aggiudicatario avrà diritto a ricevere esclusivamente quan-to pagato per l’aggiudicazione contestata, senza l’aggiunta di interessi o qualsiasi altra somma per qualunque altro motivo.
Art. 15 Le presenti condizioni di Vendita sono accettate automaticamente alla firma della scheda di cui all’art 5 e comunque da tut-ti quanti concorrono alla vendita e sono a disposizione di chiunque ne faccia richiesta. Per qualsiasi controversia è stabilitala competenza del foro di Genova
Art. 16 Legge sulla Privacy d. lgs. 196/03. Titolare del trattamento è ART AUCTIONS S.r.l. con sede in Genova Piazza Campetto, 2. Il clien-te potrà esercitare i diritti di cui al d. lgs. 196/03 (accesso, correzione, cancellazione, opposizione al trattamento ecc.ecc.), ri-volgendosi ad ART AUCTIONS S.r.l.. GARANZIA DI RISERVATEZZA ai sensi dell’art. 25 del d. lgs. 196/03 i dati sono trattati in formaautomatizzata al solo fine di prestare il servizio in oggetto, o di altro servizio inerente l’oggetto sociale della società, con lemodalità strettamente necessarie allo scopo. Il conferimento dei dati è facoltativo: in mancanza, tuttavia ART AUCTIONS nonpotrà dar corso al servizio. I dati non saranno divulgati. La partecipazione all’asta consente ad ART AUCTIONS di inviare suc-cessivi cataloghi di altre aste.

GENERAL CONDITIONS OF SALE
Art. 1 The objects may be sold in Lots or individually according to the final opinion of WANNENES ART AUCTIONS (here follows referred toas ART AUCTIONS or AUCTION HOUSE). The Auctions will be held in premises that are open to the public by ART AUCTIONS whichacts simply as AGENT in the name and interests of each Seller (the name of the said Seller is written in all the Registers required byLaw). The Sale directly concerns the Purchaser and the Seller. ART AUCTIONS does not assume any responsibility in relation to thePurchaser, the Seller or any Third Party concerned.
Art. 2 The objects are sold to the highest Bidder for cash. Should any disputes arise among more than one Purchaser, the Auctioneer(his/her decision is final) will put the object up for sale once more so it can be purchased again in the same Sale. In each case, thePurchasers who disputed the former Sale of the object in question are still bound by the initial Bid (which gave rise to the subsequentSale of the object). Should the subsequent purchase fall through once again the Auctioneer (his/her decision is final) will decide whichperson may successfully purchase the Lot/s. Each transfer to Third Parties of the Lot/s purchased does not become the responsibili-ty of ART AUCTIONS which considers the Purchaser as the sole person/s responsible for payment. Bidding at an Auction in the na-me of and for Third Parties may be accepted by ART AUCTIONS only after sufficient bank references as well as a power of attorneyhave been received by the AUCTION HOUSE at least three days before the Auction.
Art. 3 ART AUCTIONS reserves the right to withdraw any Lot/s from the Auction. The Auctioneer starts the Auction beginning with the Bidthat s/he believes to be the most opportune, based upon both the value of the Lot/s as well as the competing Bids. The Auctione-er may make further Bids or in response to other Bids, until the reserve price is reached. The Auctioneer, during the Auction, may grouptogether or separate Lot/s and vary the order of the Sale. The Auctioneer may – and his/her decision is final – withdraw Lot/s thatdo not reach the reserve price agreed upon between ART AUCTIONS and the Seller.
Art. 4 The Purchaser will pay ART AUCTIONS a sum equivalent to 24% of the hammer price including VAT. For those Lots being temporarilyimported and coming from non-EU States, apart from the above-mentioned detractions, the Purchaser – if resident in an EU member-State - will pay all other subsequent taxes, as well as refund all expenses required to transform the temporary import status of the ob-ject/s to a status that is permanent (the objects are indicated by the sign **). If the Seller is in possession of a VAT number the Purchaserwill also pay all subsequent taxes (the objects are indicated with a °°).
Art. 5 In order to guarantee the highest levels of transparency during the Auction for all those who intend to make Bids, prospective Bidders arerequired to fill out a participation form with personal information and bank details. ART AUCTIONS reserves the right to make checks on thedetails/references provided and to refuse those who might not be welcome. Upon completion of the form ART AUCTIONS will supply anumbered identification paddle which will have to be shown to the Auctioneer in order to proceed with Bidding.
Art. 6 ART AUCTIONS may accept absentee Bids (by means both of written as well as telephone Bids) that will be undertaken by the Auc-tioneer, in direct competition with those present in the Auction Room. Should there be a case of identical Bids, the written Bid willprevail upon the oral Bid.
Art. 7 Should there be two written Bids that are not beaten by Bids made in the Auction Room or telephone Bids, ART AUCTIONS will con-sider the Purchaser to be the one who made the Bid first. ART AUCTIONS reserves the right to refuse – its decision is final – Bids ma-de by Purchasers who are not known or welcome. ART AUCTIONS may, however, partially in reference to the above-mentioned,accept Bids if there is a guaranteed sum deposited equal to the value of the Lot that is requested, apart from commissions (buyer’spremium), taxes and expenses. In each case, at the moment of Purchase, the Purchaser will immediately inform the AUCTION HOU-SE of his/her personal information and taxation details.
Art. 8 ART AUCTIONS acts exclusively as the agent for the Sellers and bears no responsibility in terms of descriptions of the objectsin the Catalogues or in any other illustrated publication. All the descriptions of objects are intended purely as illustrative andindicative. They may not generate any form of reliance as far as the Purchaser is concerned. The Auction will be preceded bya public viewing of the objects in order to allow for a careful examination of the objects on behalf of aspiring Bidders. In thisway, potential Purchasers will have the opportunity to and be responsible for a complete examination of all the qualities ofthe object/s in question: for example, the authenticity, the state of preservation, the type, the material and the provenance ofthe objects being auctioned. Following the Purchase, no one will be able to dispute or criticise ART AUCTIONS or the Sellersfor the lack of any form of quality in reference to the object being auctioned. ART AUCTIONS and its employees/consultantswill issue no guarantee of authenticity. All those indications relative to the carats and the weight of metals or precious stones,as well as their relative marks, are merely indicative. ART AUCTIONS is not responsible for any potential errors or falsifications.Notwithstanding any potential reference to descriptions by experts external to the AUCTION HOUSE, ART AUCTIONS does not ei-ther guarantee the accuracy or the authenticity of such comments.
Art. 9 The Estimates relative to the initial sale price, indicated beneath the description of each object in the Catalogue, are intended as NETand do not include, for example, the commissions (buyer’s premium), taxes etc. Since the printing time employed for the making ofthe Catalogue requires price Estimates in advance, these latter may be subject to change, as may also the description of the object.
Each and every change will be communicated to the Auctioneer before the beginning of the Auction in relation to each object con-cerned. The Lot/s will, however, only be sold upon reaching the reserve price.
Art. 10 The entire payment of the hammer price, the commissions applied (buyer’s premium) as well as all other expenses must be paid forwithin ten working days of the Auction date, in the legal currency of the State in which the Auction has taken place. In the case oflack of due payment, after full compensation of damages made to ART AUCTIONS, the AUCTION HOUSE may:return the object to the Seller and demand full payment from the Purchaser of the due commissions/premium;undertake action in order to forcefully obtain the obligations of purchase;sell the Lot/s privately or in subsequent Auctions, to the disadvantage of the original Purchaser, treating any sums paid by the latteras a form of sanction. If the Lot/s is kept by ART AUCTIONS this will be at the risk and expense of the Purchaser and the original Sel-ler. In each case, until the sale or return dates the Purchaser will pay ART AUCTIONS a sum – in the form of a sanction – to be calcu-lated on the basis of the hammer price plus all taxes and commissions at a rate of 30%. This sum must be paid from the sixth dayfollowing the Auction.
Art. 11 The Purchaser, after having paid all the sums due, must collect the Lot/s acquired within fifteen working days of the Auction date,at his/her own risk and expense, in full consideration of the opening hours of ART AUCTIONS. Should the Purchaser not collect theLot/s during the above-mentioned times ART AUCTIONS will keep them at the risk and expense of the Purchaser in the AUCTIONHOUSE for a further five working days. Once this period has passed, ART AUCTIONS will remove the object/s (at the Purchaser’s ownrisk and expense) to the storage space deemed most appropriate by the AUCTION HOUSE. The AUCTION HOUSE will inform thePurchaser of the place where the object/s are kept. Let it be clearly understood that in order to collect the object/s the Purchaserwill have to pay, apart from the price plus commissions (buyer’s premium) etc, any refund due to subsequent expenses incurred bythe AUCTION HOUSE.
Art. 12 In each case, ART AUCTIONS may agree with the Purchaser/s upon different forms of payment, storage, private sale, insurance of theobject/s and/or granting of any other service requested in order to achieve the most successful results possible.
Art. 13 Everybody has, obviously, to respect the current Laws within the State where the Auction is held. In particular, ART AUCTIONS assu-mes no responsibility in relation to potential restrictions concerning the export of purchased objects and/or in relation to licencesor permits that the Purchaser might have to request on the basis of current Laws. The Purchaser will not be able to request any re-fund either from the Seller or from ART AUCTIONS should the State exercise its right to pre-emption or any other right it may pos-sess. The rights that have matured in relation to the hammer price of a sale that has been annulled on account of it not receivingauthorisation for export due to the lack of agreement of the cultural authorities concerned are, nevertheless, to be paid by the ven-dor to ART AUCTIONS if permission was not given because the vendor did not previously inform ART AUCTIONS of the existence ofauthorisation (for export) given by the relevant authority upon the request of the vendor him/herself.
Art. 14 In the case of disputes that are revealed to be well-founded and accepted by ART AUCTIONS subsequent to the sale of false objects, theAUCTION HOUSE may, at its own discretion, declare the sale null and void and, if requested, reveal the name of the Seller to the Purcha-ser. The Purchaser may make use of this Article (Article 14) only and exclusively in the case that s/he has notified ART AUCTIONS – accor-ding to Articles 137 and following in the Code of Civil Procedure – of the dispute in question with the relative proof within fifteen days ofthe Auction date. In each case, subsequent to an accepted claim the Purchaser has the right to receive exclusively what was paid as thedisputed hammer price without the addition of interests or other sums for any other reason.
Art. 15 The current Sale Conditions are accepted automatically upon signing the form (see Article 5) and by all those individuals who takepart in the Sale. The above-mentioned Conditions are at the disposal of any individual who requests to see them. Any case of con-troversy is within the jurisdiction of the Genoa Law Courts.
Art. 16 Privacy Law (Legislative Decree 196/03). Data Controller: ART AUCTIONS S.r.l. with headquarters in GENOA, Piazza Campetto, 2. TheCustomer may exercise his/her rights according to Legislative Decree 196/03 (access, correction, cancellation, opposition etc), by con-tacting ART AUCTIONS S.r.l. GARANZIA DI RISERVATEZZA according to Article 25 of Legislative Decree 196/03. The information iscomputerised with the sole intention of providing the above-mentioned service or any further service relative to the Company, insuch a way that is strictly connected to the question at hand. The supply of data is optional: in default of which, ART AUCTIONS willnot be able to perform the service required. Data will not be divulged. Participation in an Auction allows ART AUCTIONS to send sub-sequent Catalogues of other Auctions.
