Biên bản tường trình diễn biến sự việc của bác sỹ Lộc về bệnh nhân Quốc

Căn cứ chính là dựa trên lời khai của anh Quốc vào khám bệnh lúc 9h30 có triệu chứng : nhức đầu, nhói tim, chóng mặt.

Tôi khám thấy tim bình thường nhưng trường hợp này, tôi thấy anh Quốc cần phải chuyển đến viện, gọi SOS, bác sý Trực lãnh đạo CD.

Kể lại tình trạng lúc đó của Quốc vào khoảng 9h45, khi trao đổi với bác sỹ Trực lãnh đạo, bác sỹ Lộc đề nghị chuyển bệnh nhân đi bệnh viện Việt-Pháp và bác sỹ Trực lãnh đạo đồng ý chuyển bệnh nhân đi bệnh viện Việt Pháp bằng xe cấp cứu của SOS Vũng Tàu.

Tôi gọi điện cho anh Hùng vào lúc 10h báo với anh Hùng tình trạng của anh Quốc và nói SOS sẽ gọi cho anh Hùng bàn về giá cả, sau đó tôi gọi lại cho anh Hùng nhưng không liên lạc được. Alarm Center gọi trực tiếp cho anh Hùng để nói chuyện trực tiếp về giá cả nhưng cũng không liên lạc được.

Sau đó tôi gọi điện cho Mr. Francis thuật lại tình hình như trên. Ông Quốc cũng nói chuyện với Francis, Francis đồng ý chuyển đi và tôi đề nghị cho Francis nói chuyện với SOS vè giá cả. sau đó Alarm Center gọi lại báo cho tôi là họ đồng ý chuyển bệnh viện.

Nói chuyện với cô Thúy Alarm center khoảng 10h30 ngày 28-11-2010 với giá cả và phương thức chuyển như trên và Alarm Center sắp xếp xe cấp cứu của SOS Vũng tàu xuống PM2.2 chuyển bệnh nhân đi bệnh viện Việt Pháp TP Hồ Chí Minh.

Xe vận chuyển tới PM2.2 lúc 13h30 và đưa bệnh nhân đi bệnh viện Việt – Pháp TP Hồ Chí Minh.

Tôi xin cam kết lời khai của tôi đúng sự thật và chịu trách nhiệm về lời khai của mình.

General term and conditions

1. Abbreviation

Buyer means Mekong Energy Co., Ltd.

Buyer’s Site means Phu My 2-2 Power Plant.

Seller means Service Provider and/or Supplier of Materials, Goods and/or Equipment

Purchase order and contracts to seller are hereinafter called as “P/O” which includes the purchase and procurement of Materials, Goods, Equipment, Man-power and/or Services.

Materials, Goods and Equipment are collectively called hereinafter as “Goods”.

Provision of Man Power and Services are collectively called hereinafter as “Services”

Delivery means the delivery of Goods, the Starting of Service, and When so stipulated, the Mobilization of Man-Power and related equipment, to and at Buyer’s Site.

2. Shipment of delivery

For all P/O within Vietnam territory, delivery term is DDP unless otherwise stated in the P/O.

For P/O to overseas, delivery terms can be Ex-works (EXW), FOB, CFR, CIF as interpreted in accordance with Incoterms 2000.

It is essential that seller is obliged to ship or deliver Goods and/or Services specified in P/O punctually by the time or within the period specified in P/O

3. Price

The price specified in P/O shall be firm and final and shall not be subject to any adjustment for any reason whatsoever. Notwithstanding the above, if the P/O specifies only the unit price for services, the total price is calculated by actual quantity rendered by Seller subject to the confirmation and approval by buyer.

4. Force majeure

If the performance by Buyer of its obligations hereunder is directly or indirectly affected or prevented by force majeure, including but not limited to Acts of God, fire, war declared or not or serious threat of the same, civil commotion, strike or other labor dispute, governmental order or regulation or any other causes beyond the reasonable control of buyer. Buyer shall not be liable for loss or damage or failure or delay in performing its obligations hereunder and may, at its sole discretion, terminate P/O or any portion thereof.

5. Default

In case of (i) seller’s failure to perform any provision of P/O or breach of any express or implied terms, conditions or warranties contained herein; (ii) seller’s inability to pay its debts generally as they become due; (iii) seller’s bankruptcy or insolvency; or (iv) appointment of a trustee, receiver or liquidator of seller or of any material part of seller’s assets or properties (“Events of Defaults”), buyer

may, at its sole discretion: (i) terminate the P/O or any part of thereof; (ii) reject Goods and/or Services; (iii) dispose of Goods and/or Services for the account of Seller at a time and price which buyer deems reasonable; and (iv) purchase elsewhere and charge seller with any resulting loss or damage, and seller shall reimburse Buyer for all loss or damage arising directly or indirectly from such Events of Default, including but not limited to any costs and expenses such as dead freight, loss of profit obtainable from resale by Buyer of Goods and/or Services.

The rights and remedies of Buyer hereunder are cumulative and in addition to buyer’s rights, powers and remedies existing at law or in equity or otherwise.

6. Warranty

Seller shall convey to buyer good and merchantable title to Goods free of any encumbrance, lien or security interest. Seller warrants that Goods shall fully conform to any and all specifications, descriptions, drawings and data or samples or models furnished to or by buyer, and Goods shall be merchantable, of good material and workmanship and free from defects, and shall be fit or suitable for the use(s) or purpose(s) intended by Buyer.

Buyer shall make all claims, except for latent defects, regarding Goods against seller in writing as soon as reasonably practicable after arrival of Goods at their final destination and unpacking and inspection thereof.

Seller shall be responsible for latent defects of at any time after delivery, notwithstanding inspection and acceptance of Goods by Buyer, Buyer reserves that right to reject and refuse acceptance of all or part of any shipment of goods which are not in accordance with specifications, descriptions, drawings, data, samples or models furnished to or by Buyer or with seller’s express or implied warranties.

Certificates of Origin, Quality, Quantity and Warranty, and when applicable, MSDF (Material Safety Data Sheet) to be provided with Goods, unless otherwise stated in the P/O.

With respect to Services, this clause shall be applied mutatis mutandis.

Warranty for goods and services shall be extended up to 1 year after the delivery of Goods or Services, unless otherwise specified in the body of the Purchase Order.

7. Indemnity

Seller shall defend, indemnify and hold Buyer, Buyer’s customer(s), users of Goods and/or Services, and its or their officers and directors harmless from and against any liability, loss, damage, penalty, cost, expense and disbursement (including attorneys’ fees) or personal injury, death or property damages as a result of any claim or dispute caused by, due to or relating, in any way, to Goods and/or Services or any defect property rights thereof or any infringement of any patent, trademark, utility model, design, copyright, mask work or any other intellectual property rights in Vietnam or in any other country, which indemnity shall survive the termination of P/O.

8. General

(1) All disputes, controversies or differences arising out of or in relation to this P/O or the breach thereof which cannot be settled amicably and mutually agreed, without undue delay shall be settled by arbitration in Ho Chi Minh City, Vietnam, in accordance with the rules of procedure of the Vietnam Chamber of Commerce and Industry. The award of arbitration shall be final and binding upon both parties, and judgment on such award may be entered in any court or tribunal having jurisdiction thereof.
