Drejtori Gjeneral i Doganes se Republikes se Kosoves Ne pajtim me nenin 243, paragrafi 4 te Kodit Doganor dhe te Akcizave ne Kosove nr. 03lL- 109 te dates 1 1 nentor 2008,

Me qellim te percaktimit te formulareve, te cilet duhet te perdoren nga Depoisti i Autorizuar i Mallrave me Akcize, per ta paguar akcizen dhe regjistrat tjere, te cilet duhet te mbahen, si dhe kushtet tjera te cilat mund te zbatohen ndaj Depoistit te Autorizuar te Mallrave me Akcize, dhe pas keshillimit me Ministrine e Ekonomise dhe Financave, nxjerr me kete rast Udhezimin Administrativ ne vijim:

Neni 1 QEllimi

1.1 Ky Udhezim Administrativ rregullon dhe siguron bazen ligjore dhe percakton formularet, te cilet duhet te perdoren nga Depoisti i Autorizuar i Mallrave me Akcize, per ta paguar akcizen dhe regjistrat tjere te cilet duhet te mbahen;

The General Director of Customs of Republic of Kosovo, In accordance with the article 243, paragraph 4 of Customs and Excise Code no. 03lL-109 date of 1 1 th of November 2008,

With the purpose to defining the forms, which have to be used by the Authorized Warehouse Employee for the Goods with Excise, to pay the excise and other registers, that have to be kept, and other conditions which can be applied toward the Authorized Warehouse Employee for the Goods with Excise, and after counseling the Ministry of Economy and Finance, in this case it issues this Administrative Direction pursuant to:

Article 1 Purpose

1.1 This Administrative Direction arranges and secures the legal base and assigns the forms, which have to be used by the Authorized Warehouse Employee for the Goods with Excise, to pay the excise and other registers that have to be maintained;

Generalni Direktor Carine Republike Kosovo U skladu sa Clanom 243, stav 4 Zakonika o Carini i akcize na Kosovu br. 03lL-109 od 1 1 Novembra 2008. godine

Kako bi se odredio obrasce, koji treba biti koriSCeni od strane ovlaSCenog driaoca akciznim proizvodima, radi plaCanje akcize i druge poslovne knjige, koje treba voditi, kao i druge uslove koji se primenjuju za ovlaSCenog driaoca akciznim proizvodima. i nakon konsultacije sa Ministarstvom privrede i finansija, izdaje sledeCe Administrativno Uputstvo:

Clan 1 Svrha

1.1 Ovo Adminstrativno Uputstvo reguliSe i daje pravni osnov i definSe obrasce, koje moraju biti koriStene od strane ovlaSCenog driaoca akciznim proizvodima za plaCanje akcize i druge poslovne knjige koje treba voditi. 2

1.2 Me kete Udhezim Administrativ percaktohen edhe kushtet tjera te cilat mund te zbatohen ndaj Depoistit te Autorizuar te Mallrave me Akcize.

Neni 2 PErkufizimet dhe Interpretimet BazE

Cdo perkufizim ose rregull per interpretim qe gjendet ne Kodin Doganor dhe te Akcizave nr. 03/L-109 te dates 11 nentor 2009, vlen edhe per kete Udhezim Administrativ; Per qellime te ketij Udhezimi Administrativ do te zbatohen edhe pkkufizimet plotesuese, si ne vijim:

"KerkesE pEr DMA" (Depo e Mallrave me AkcizE) - nenkupton formularin qe eshte dhene ne Aneksin 1 te ketij Udhezimi Administrativ, i cili plotesohet me te gjitha informatat e duhura qe jane te parapara ne kete formular, i cili duhet te nenshkruhet nga aplikuesi.

"Autorizim pEr DMA" (Depo e Mallrave me AkcizE) - nenkupton objektin e autorizuar nga Dogana ne baze te nenit 245, ne te cilin ne baze te marreveshjes per pezullim mund te prodhohen, te perpunohen, te ruhen, te pranohen ose te dergohen mallrat me akcize nga ana e ndonje Depoisti te Autorizuar te Mallrave me Akcize, ne perputhje me kushtet te cilat mund t'i percaktoje Dogana (shih aneksin 2).

1.2 With this Administrative Direction are assigned also other conditions which can be applied toward the Authorized Warehouse Employee for the Goods with Excise.

Article 2 Basic definitions and expositions

2.1 Any definition or rule for the expositions that is in the Custom and Excise Code no. 03/L-109 date of 1 lth of November 2009, serves also for this Administrative Direction.

2.2 For the purposes of this Administrative Direction there will be applied also additional definitions, pursuant to:

"Request for WGE (Warehouse for Goods with Excise)- intends the form that is given in the Annex 1 of this Administrative Direction, the one that should be filled out with all necessary information that are foreseen in this form, that has to be signed by the applicant.

"Authorization for WGE" (Warehouse for Goods with Excise)- intends the authorized object by the Customs according to the article 245, for which according to the agreement for cancellation can be produced, processed, saved, accepted or delivered the goods with excise by the side of any Authorized Warehouse Employee for the Goods with Excise, in accordance with the conditions that can be assigned by Customs (see annex 2).

1.2 Sa ovim Administrativnom uputstvo definisana su i drugi uslovi koji se mogu biti primenjeni za ovalSEenog driaoca akciznim proizvodima.

elan 2 Definicije i osnovne tumaEenja

2.1 Bilo koja definicija i l i pravilo za tumaEenje dostupna na Zakonika o Carini i akcize br. 03/L-109 od 1 1 Novembra 2009, takode se primenjuje na ovo Administrativno uputstvo;

2.2 U svrhe ovog Administrativnog uputstva takode primenjuju se i sledeEe dodatne definicje:

"Zahtev za AS" (Akcizno skladigte) - znaEi obrasac koji je u Prilog I ovog Administrativnog uputstva, koji se popunjava sa svim relevantnim informacijama koje su u ovom obrascu, i koji mora biti potpisan od strane podnosilaca zahteva.

"OvlaSEenje za AS" (Akcizno skladigte) - znaCi zgrada odobrena od strane Carine na osnovu Elana 245, gde na osnovu dogovora za odlaganje mogu biti proizvedena, obradena, saEuvana, primljena i l i da bude poslata akcizni proizvodi od strane bilo koje ovlaSEenog driaoca akciznim proizvodima, u skladu sa uslovima koje moie odrediti Carina (vidi Prilog 2).

"Kerkest ptr DAMA" (Depoist i Autorizuar ptr Mallra me Akcizt) - nenkupton formularin qe eshte dhene ne Aneksin 3 te ketij udhezimi, i cili plotesohet me t& gjitha informatat e duhura, qe jane te parapara ne kete formular dhe i cili duhet te nenshkruhet nga aplikuesi.

"Autorizim ptr DAMA" (Depoist i Autorizuar per Mallra me Akcizz) - eshte ndonje person fizik a juridik i autorizuar nga Dogana sipas nenit 246 per te prodhuar, perpunuar, ruajtur, pranuar ose derguar produktet me akcize ne ndonje depo te autorizuar te mallrave me akcize, nese akciza eshte pezulluar ne baze te marreveshjes per pezullim ne perputhje me kushtet te cilat mund t'i percaktoje Dogana (shih aneksin 4).

"Ktrkesa ptr TMA" (Tregtar i Mallrave me Akcizt) - nhkupton formularin qe eshte dhene ne Aneksin 5 te ketij udhezimi, i cili plotesohet me te gjitha informatat e duhura, qe jane t& parapara ne kete formular dhe i cili duhet te nenshkruhet nga aplikuesi.

"Autorizimi ptr TMA" (Tregtar i Mallrave me Akcizt) - nenkupton ndonje person fizik a juridik i autorizuar nga Dogana sipas nenit 248, per te pranuar produkte me akcize, nese akciza eshte pezulluar ne baze te marreveshjes per pezullim, ne menyre qe ai te mund t'i shfiytezoje keto produkte me akcize gjate veprimtarise se tij afariste.

"Request for WEGE" (Warehouse Employee for Goods with Excise)- intends the form that is given in the Annex 3 of this direction, that should filled out with all the necessary information, that are foreseen in this form and which should be signed by the applicant.

"Authorization for WEGE" (Warehouse Employee for Goods and Excise)- is any natural or legal person authorized by the Customs according to the article 246 to produce, process, save, accept or deliver products with excise in any authorized warehouse for goods with excise, if excise is cancelled according to the agreement of cancellation in accordance with the conditions that can be assigned by the Customs (see annex 4).

"Request for TGE" (Trader of Goods with Excise)- intends the form that is given in the Annex 5 of this direction, which should be filled out with all the necessary information, that are foreseen in this form and which should be signed by the applicant.

"Authorization for TGE" (Trader of Goods with Excise)- intends any natural or legal person authorized by the Customs according to the article 248, to accept products with excise, if the excise is cancelled according to the agreement for cancellation, in the way that he can use these products with excise during his business activity.

"Zahtev za ODAP" (OvlaiEeni driaoc akciznim prizvodima) - znaCi obrasac koji je u Prilog 3 ovog Uputstva, koji popunjava sa svim relevantnim infonnamcijama koje su u ovom obrascu, i koji mora biti potpisan od strane podnosioca zahteva.

"OvlaSEenje za ODAP" (OvlaSEeni driaoc akciznim proizvodima) - je fiziCko lice i l i pravno lice ovlaSEeno od strane Carine prema Clanu 246 da proizvode, obradi, sacuva, primiti ili poslati akciznim proizvodima na neku ovlaSCeno akcizno skladiSte, ako je akciza bila ukinuta na osnovu dogovora za odlaganje u skladu sa uslovima koje moie odrediti Carina (vidi Prilog 4).

"Zahtev za PAP" (Poslovanje sa akciznim proizvodima) - zanCi obrasac koji je u Prilog 5 ovog Uputstva, koji popunjava sa svim relevantnim informacijama koje su u ovom obrascu, i koji mora biti potpisan od strane podnosioca zahteva.

"OvlaSEenje za PAP" (Poslovanje sa akciznim proizvodima) - znaCi bilo koje fiziCko lice ili pravno lice ovlaSCeno od strane Carine prema Clanu 248, da primi akcizne proizvode, uoliko akciza je ukinuta na osnovu dogovora za ukidanje, tako da je on moie koristiti ove akcizne proizvode tokom njegovog poslovanja.

DEPOT E AUTORIZUARA PER MALLRAT ME AKCIZE

Neni 3 Autorizimi

3.1 Kerkesa per autorizim te objekteve si Depo te Mallrave me Akcize, behet ne formularin qe eshte dhene ne Aneksin I te ketij Udhezimi Administrativ, kopjen e te ciles e siguron Sektori i Akcizave. Formulari plotesohet ashtu qe i permbledh tC gjitha informatat e duhura dhe deklarata nenshkruhet nga aplikuesi. Formulari i plotesuar i kthehet Sektorit te Akcizave;

3.2 Kerkesa p k autorizimin e objekteve si Depo te Mallrave me Akcize, duhet te shoqerohet me nje liste te 'nenshkrimeve te autorizuara' te personave te autorizuar per te nenshkruar dokumentet DUD dhe DPA ne emer te Depoistit te Autorizuar te Depos se Mallrave me Akcize. Lista behet ne formen e dhene ne Aneksin 13 te ketij Udhezimi Administrativ. Cfaredo ndryshimi qe peson kjo list& obligon dorezimin e nje liste te re ne Sektorin e Akcizave;

3.3 Aplikuesi do te njoftohet per vendimin ne lidhje me aprovimin e autorizimit, ose per arsyet e refuzimit

AUTHORIZED WAREHOUSES FOR GOODS WITH EXCISE

Article 3 Authorization

3.1 The request to authorize the premises like Warehouses for Goods with Excise, it should be done in the form that is given in the Annex 1 of this Administrative Direction, a copy of which can be acquired by the Excise Sector. The form is filled in the way that it collects all the necessary information and the statement is signed by the applicant. The filled up form should be returned to the Excise Sector.

3.2 The request to authorize the premises like Warehouses for Goods with Excise should be accompanied with a list of 'authorized signatures' of authorized persons to sign documents like DUD and DPA in name of the Warehouse Employee for the Goods with Excise. The list should be done in the way the form is given in Annex 13 of this Administrative Direction. Any change that this list meets with it obliges to submit a new list to the Excise Sector.

3.3 The applicant will be notified for the decision about the approval of the authorization, or the reasons of request

" " " OVLASCENO AKCIZNO SKLADISTE

Clan 3 OvlagEenje

3.1 Zahtev za ovlaSCenje prostora (prostorija) kao akcizno skladiSte, se podnesi na obrascu iz priloga I ovog Administrativnog uputstva, Cija se kopija moie dobiti od Akcizne jedinice. Obrazac se popunjava tako da sadrii sve relevantne informacije i deklaraciju potpisuje podnosi lac zahteva. Popunjeni obrazac vraCa se Akciznoj jedinici.

3.2 Zahtev za ovlaSCenje prostora (prostorija) kao akcizno skladiSte obuhvata i prateCu listu "ovlaSEenih potpisa", lica koja su ovlaSCena da potpisuju JCI (DUD) i DPA dokumente, u ime ovlaSEenog drialaca akciznog skladiSta. Ta lista treba biti na formatu iz Priloga 2 ovog Administrativnog uputstva. Bilo kakva izmena na listi zahteva podnoSenje nove liste Akciznoj jedinici.

3.3 Podnosilac zahteva se mora biti obaveSten o odluci u vezi prostora (prostorija) kao akciznog

te kerkeses, brenda 30 diteve nga data kur eshte dorezuar kerkesa, ose nga data kur Drejtori Gjeneral te kete pranuar informatat komplete te kerkuara nga ai;

3.4 Autorizimi per Depo te Mallrave me Akcize do te hyje ne fuqi duke filluar nga data e leshimit te autorizimit ose ne nje date te mevonshme te paraqitur ne autorizim, perveg nese Drejtori Gjeneral bie dakord ne forme te shkruar per te shfrytezuar proceduren para se te leshohet autorizimi;

3.5 Autorizirni p k depo te mallrave me akcize nuk do te kete kufizim te periudhes se vlefshmerise.

DEPOISTI I AUTORIZUAR I MALLRAVE ME AKCIZE

Neni 4 Autorizimi

4.1 Kerkesa per autorizimin e nje personi fizik qe te veproje si Depoist i Autorizuar i Mallrave me Akcize, behet nga ai person fizik ne formularin qe eshte dhene ne Aneksin 3 te ketij Udhezimi Administrativ, kopjen e tC ciles e siguron Sektori i Akcizave.

refusal, within 30 days from the date when the request is submitted, or from the date when the General Director will accept the complete information required by him;

3.4 The authorization for the Warehouse for Goods with Excise will be enforced starting from the date of issuance of the authorization or any other after date showed in the authorization, except if the General Director will agree in a written form to use the procedure before the authorization is issued.

3.5 The authorization for the Warehouse of goods with excise will not have validity period of limitation.

AUTHORIZED WAREHHOUSE EMPLOYEE FOR THE GOODS WITH

EXCISE Article 4

Authorization

4.1 The request to authorize a natural person to proceed as an Authorized Warehouse Employee for the Goods with Excise is done by the natural person in the form that is given in Annex 3 of this Administrative Direction, copy of which one is ensured by the Excise Sector. The

3.4 OvlaSCenje za akcizno skladiSte stupa na snagu na dan izdavanja ovlaSEenja i l i nekog kasnijeg datuma koji je naznaCen na tom ovlaSCenju, osim ako Generalni direktor ne dostavi pismeni dogovor za koriSCenje postupka pre stvarnog izdavanja ovlaSCenja.

3.5 Rok vainosti ovlaSCenja ne odreduje se za ovlaSCenje akciznog skladiSta..

4.1 Zahtev za ovlaSCenje fizickog lica da bude drialac akciznog skladigta saCinjava fiziCko lice na obrascu iz Prilog 4 ovog Administrativnog uputstva, Cija je kopija moie dobiti kod Akcizne jedinice. Obrasac se popunjava tako

permbledh te gjitha informatat e duhura dhe deklarata nenshkruhet nga aplikuesi. Formulari i plotesuar i kthehet Sektorit te Akcizave;

4.2 Aplikuesi do te njoftohet per vendimin ne lidhje me aprovimin e autorizimit te tij si Depoist i Autorizuar i Mallrave me Akcize ose per arsyet e refuzimit te kerkeses, brenda 30 diteve nga data kur eshte dorezuar kerkesa, ose nga data kur Drejtori Gjeneral te kete pranuar informatat komplete te kerkuara nga ai;

4.3 Autorizimi i personit fizik si Depoist i Autorizuar i Mallrave me Akcize hyn ne fuqi, duke filluar nga data e Ieshimit te autorizimit ose ne nje date te mevonshme te paraqitur ne autorizim, perveq nese Drejtori Gjeneral bie dakord ne forme te shkruar per te shfrytezuar proceduren para se te Ieshohet autorizimi;

4.4 Autorizimi i personit fizik si Depoist i Autorizuar i Mallrave me Akcize nuk do te kete kufizim te periudhes se vlefshmerise.

Neni 5

Librat dhe Evidenca qe mbahet nga nje

4.2 The applicant will be notified for the decision about the approval of the authorization as a Authorized Warehouse Employee for the Goods with Excise or for reasons of request refusal, within 30 days from the date when this request is submitted, or from the date when the General Director will accept the complete information required by him;

4.3 Authorization of the natural person as Authorized Warehouse Employee for the Goods with Excise will be enforced, starting from the date of authorization issuance or any other after date showed in the authorization, except if the General Director agrees in a written form to use the procedure before the authorization is issued.

4.4 Authorization of the natural person as an Authorized Warehouse Employee for the Goods with Excise period limitation for validity.

Article 5

Books and Evidences that are carried by

da sadrii sve potrebne infonnacije i deklaraciju potpisuje podnosilac zahteva. Popunjeni obrasac se vraCa Akciznoj jedinici.

4.2 Podnosilac zahteva mora biti obaveSten o odluci u vezi njegovog ovlaSCenja za driaoca akciznog skladiita, ili o razlozima zbog kojih je njegov zahtev odbijen, u roku od 30 dana od datuma podnoSenja zahteva, ili datuma kada je Generalni direktor primio kompletne infonnacije na njegov zahtev.

4.3 OvlaSCenje fiziCkog lica kao driaoca akciznog skladiSta stupa na snagu na datum izdavanja ovlaSCenja ili nekog kasnijeg datuma koji je naznaCen na tom ovlaSCenju, osim ako Generalni direktor ne dostavi pismenu saglasnost za koriSCenje postupka pre stvarnog izdavanja ovlaSCenja.

4.4 Rok vainosti ovlaSCenja se ne odreduje za ovlaSCenje fizi Ckog lica kao driaoca akciznog skladigta.

Poslovne knjige i evidencije koje vodi

Depoist i Autorizuar per Mallrat me Akcize

5.1 Ne lidhje me nje depo te mallrave me akcize, kur eshte nevoja, Depoisti i Autorizuar i Mallrave me Akcize duhet te mbaje:

(a) evidencen e Iendes se pare ne depo;

(b) evidencen per te gjitha produktet me akcize qe jane ne prodhirnlperpunim ne depo, dhe

(c) evidencen e produkteve te gatshme me akcize ne depo;

5.2 Evidenca e obligueshme per t'u mbajtur sipas Nenit 5.1 duhet te permbaje te gjitha informatat e pershkruara ne Anekset 10, 11 dhe 12 te ketij Udhezimi Administrativ. Nese shenimet mbahen ne forme elektronike, atehere ajo duhet te jete ne ate forme ose me nje procedure e cila garanton se shenimet nuk mund te ndryshohen apo te fshihen;

5.3 Evidenca e obligueshme sipas Nenit 5.1 vertetohet nga Dogana e Kosoves para se te perdoret. Kur perdoret evidenca, te gjitha hapesirat e zbrazeta duhet te anulohen me v i e dhe te gjitha ato anulime te tekstit dhelose shifrave kur kerkohet nga Dogana e Kosoves, duhet te vertetohen nga Depoisti i Autorizuar

one Authorized Warehouse Employee for the Goods with Excise 5.1 In connection with one warehouse for the

goods with excise, when needed, the Authorized Warehouse Employee for the Goods with Excise should retain:

(a) evidence for the raw material in the warehouse;

(b) evidence for all the products with excise that are under production I processing in the warehouse, and

(c) evidence for the available products with excise in the warehouse;

5.2 The mandatory evidence to be retained according to the article 5.1 should contain all the necessary information prescribed in the Annexes 10, 1 1 and 12 of this Administrative Direction. If the notes are retained electronically, then it should be in that form or with a procedure that guarantees that the notes cannot be changed or deleted;

The mandatory evidence according to the article 5.1 is certified by the Kosovo Customs before it's used. When the evidence is used, all the empty spaces should be cancelled with a line and all those cancellations of the text andlor digits when required by Kosovo Customs should be certified by the Authorized Warehouse Employee for the Goods with

ovlaSCeni drialac akciznog skladiSta

5.1 U vezi sa akciznim skladiStem, kada je potrebno, ovlaSCeni drialac akciznog skladiSta treba voditi:

(a) evidenciju zaliha svih sirovina u skladiStu;

(b) evidenciju zaliha svih akciznih proizvoda u proizvodnjilobradi u skladiStu, i

(c) evidenciju zalilia gotovih akciznih proizvoda u skladiStu;

5.2 Evidencija obavezna iz Clana 5.1 mora da sadrii sve informacije opisane u Prilog 8 ovog Administrativnog uputstva. Ako se evidencija vodi na elektronski naein, onda to mora biti naCim il i postupak koji garantuje da se evidencija ne moie menjati i l i izbrisati.

5.3 Evidenciju iz Clana 5.1 pre upotrebe overava Carina Kosovo. Pri upotrebi evidencije, svi neiskoriSCeni prostori u evidenciji se moraju precrtati, svi precrtani tekstovi ilili brojke potvrduje, kada to zahteva Carina Kosovo, drialac akciznog skladiSta.

Akcize do te dorezoje Doganes se Kosoves, listat kryesore e te gjitha produkteve me akcize qe kane p k t'u prodhuar ose perpunuar, ne te cilat pershkruhen komponentet e ndryshem te ketyre produkteve dhe perllogaritjet e rendimentit te prodhimit ose perpunimit;

5.6 Depoisti i Autorizuar i Mallrave me Akcize, duhet te mbaje tere evidencen, librat dhe dokumentet qe kerkohen sipas neneve 5.1 dhe 5.5 per nevoja te kontrollit nga Dogana e Kosoves, per se paku tri vite kalendarike, ose nese me gjate, per periudhen qe kerkohet me ndonje rregullore tjeter ne fuqi, pa marre parasysh metoden e mbajtjes se evidences. the Goods with Excise will submit to the Kosovo Customs, the main lists of all products with excise that have to be produced or processed, in which is prescribed the different components of these products and the casts of efficiency of the production or processing;

Except the required evidence by the article 5.1, the Authorized Warehouse Employee for the Goods with Excise, should retain all the notes, books and documents that are mandatory for a trader, like: a) annual account; b) bank accounts; c) cash register books and other notes; d) documents of import and export; e) transaction books; f) transaction bills, and g) total business correspondence;

5.6 The Authorized Warehouse Employee for the Goods with Excise, should retain all the evidence, books and documents that are required according to the articles 5.1 and 5.5 for control needs by the Kosovo Customs, for at least three calendar years, or if longer, for the period that is requested by any regulation in power, without considering that retaining methods of the evidence. 5.4 Drialac akciznog skladiSta dostavlja Carini Kosova osnovne liste svih akciznih proizvoda koji se proizvode i l i preraduju u akciznom skladiStu, koje opisuje razliCite komponente tih proizvoda i procenjuju normative proizvodnje i l i obrade.

5.5 Osim evidencije iz Clana 5.1, drialac akciznog skladigta treba da vodi i svu evidenciju, poslovne knjige i dokumenta koji se zahtevaju od jednog poslovnog subjketa ukluCuj uCi:

a) godignje obraCune; b) izvegtaje iz banke; c) knjige blagajne i ostalu evidenciju; d) dokumenta uvoza i izvoza; e) knjige nabavke i prodaje; f) raCune o nabavci i prodaji, i g) svu poslovnu korespondenciju.

5.6 OvlaEeni drialac akciznog skladiSta vodi svu evidenciju, poslovne knjige i dokumenta koja se zahtevaju Clanom 5.1 i 5.5 za potrebe kontrole od strane Carine Kosova, za najmanje tri kalendarske godine, i l i duie, za period koji zahteva bilo koji zakonski propis na snazi, bez obzira koje se sredstvo koristi. 5.7 Sva evidencija, poslovne knjige i dokumenta zahtevana Elanom 5.1 , 5.4 i 5.5 se vode u akciznom skladiitu Eija je adresa navedena na ovlaSEenju i moraju biti dostupne Carini Kosova za konrolu u svako vreme.

5.8 Sve promene u zalihama u akciznom skladiitu (unosi, razduienja, prenosi, itd.) unose se odmah u evidenciju kako se to zahteva Elanom 5.1.

6.1 The request for authorization of one person to work as a Authorized Trader for the Goods with Excise, is done by that person in the form that is given in the Annex 5 of this Administrative Direction, a copy of which is ensured to Excise Sector. 6.4 Autorizimi i personit si Tregtar i Mallrave me akcize nuk do te kete kufizim te periudhes se vlefshmerise.

Neni 7 Librat dhe Evidenca qe duhet t& mbahen

nga nje Tregtar i Autorizuar i Mallrave me Akcize

6.2 The applicant will be notified for the decision about the approval of his authorization as a trader for the goods with excise, or for the reasons of the request refusal, within 30 days from the date when this request is submitted, or from the date when the General Director will receive the complete information required by him;

6.3 The authorization of a person as a Trader of Goods with Excise enters into force starting from the date of issuance of the authorization or any other after date showed in the authorization, except if the General Director agrees in a written form to use the procedure before the authorization is issued;

6.4 The authorization of the person as a Trader for the Goods with Excise will not have a period limitation of the validity.

Article 7 Books and evidences that have to be retained by an Authorized Trader for the Goods with

Excise

6.2 Podnosilac zahteva mora biti obaveSten o odluci u vezi njegovog ovlaSCenja za driaoca akciznog skladiSta, ili o razlozima zbog kojih je njegov zahtev odbijen, u roku od 30 dana od datuma podnoienja zahteva, ili datuma kada je Generalni direktor primio kompletne informacije na njegov zahtev.

6.3 OvlaSCenje lica kao lice koje Ce se baviti akciznim proizvodima stupa na snagu na datum izdavanja ovlaSCenja ili nekog kasnijeg datuma koji je naznaCen na tom ovlaSEenju, osim ako Generalni direktor ne dostavi pismenu saglasnost za koriSEenje pstupka pre stvarnog izdavanja ovlaSCenja.

6.4 Rok vainosti ovlaSCenja se ne odreduje za ovlaSEenje fiziCkog lica kao lice koje Ce se baviti akciznim proizvodima.

Clan 7 Poslovne knjige i evidencija koje vodi lice

(b) per daljen (shkarkimin) e produkteve te akcizes (per prodhimtari); - data e daljes, dhe - sasia e produkteve;

7.2 Regjistrat e obligueshem sipas Nenit 7.1 vertetohen nga Dogana e Kosoves para se te perdoren. Kur perdoret evidenca, te gjitha hapesirat e zbrazeta duhet te anulohen me vize dhe te gjitha ato anulime te tekstit dhelose shifrave kur kerkohet nga Dogana e Kosoves duhet te vertetohen nga Tregtari i Mallrave me Akcize;

Tregtari i Mallrave me Akcize do t'ia dorezoje Doganes se Kosoves listat kryesore e te gjitha produkteve me akcize qe kane per t'u prodhuar ose perpunuar nga ai, ne te cilat pershkruhen komponentet e ndryshem te ketyre produkteve dhe perllogaritjet e rendimentit te prodhimit ose

retain an evidence for all the products with excise accepted by him under the agreement of cancellation, along with a register for each type of the product with accepted excise, which contains information as it continues:

a) for the income of excise products; - date of entry, - entry document (DPA), and - product quantity;

b) for the outcome (unload) of excise products (for production); - date of outcome, and - products quantity;

7.2 The mandatory registers according to the articles 7.1 are certified by Kosovo Customs before they are used. When the evidence is used, all the empty spaces should be cancelled with a line and all those cancellations of a text andlor digits when required by Kosovo Customs should be certified by the Trader for Goods with Excise;

The Trader for Goods with Excise will submit to Kosovo Customs the main lists of all the products with excise that have to be produced or processed by him, in which is described the different components of these products and the casts efficiency for production of processing;

7.2 Evidenciju obavezna iz Elana 7.1 pre upotrebe overava Carina Kosovo. Pri upotrebi evidencije, svi neiskoriSEeni prostori u evidenciji se moraju precrtati, svi precrtani tekstovi ilil i brojke potvrduje, kada to zahteva Carina Kosovo, lice koji se bavi akciznim proizvodima.

7.3 Lice koji se bavi akciznim proizvodama dostavlja Carini Kosova osnovne liste svih akciznih proizvoda koje on proizvodi i l i preraduje, koje opisuju razliCite komponente tih proizvoda i procenjuju normative proizvodnje i l i

7.5 Tregtari i Mallrave me Akcize duhet te mbaje tere evidencen, librat dhe dokumentet qe kerkohen sipas neneve 7.1 dhe 7.5 per se paku tri vite kalendarike, ose nese me gjate, per periudhen qe kkkohet me ndonje rregullore tjeter ne fuqi, pa marre parasysh metoden e mbajtjes se evidences. Periudha prej 3 viteve fillon nga fundi i vitit ne te cilin jane krijuar evidenca, librat ose dokumentet;

7.6 Te gjitha shenimet, librat dhe dokumentet e kerkuara me nenet 7.1 dhe 7.4 duhet te mbahen ne objektet e Tregtarit te Mallrave me Akcize, adresa e te ciles eshte shenuar ne autorizim dhe duhet te jete ne

Neni 8 Kushtet Teknike ne Depo t& Autoruuar

8.1 Lenda e pare qe perdoret per prodhiminlperpunimin e produkteve te akcizes duhet te mbahet ne nje hapesire deponimi te veqante e cila eshte e sigurt dhe mund te mbyllet me qeles, ashtu qe lenda e pare nuk mund te largohet nga hapesira ku jane deponuar perveq nese regjistrohen dhe llogariten si duhet ne evidence te depos (shih Nenin 5 te ketij Udhezimi Administrativ);

8.2 Hapesira e deponimit duhet te kete hapesira te definuar qarte per mbajtjen e produkteve me detyrime te akcies te suspenduara ndaras nga produktet me detyrime te paguara te akcizes;

8.3 Depoisti i Autorizuar i Mallrave me Akcize duhet te kujdeset qe asnje produkt me detyrime te suspenduara te akcizes te mos largohet nga hapesira e

time;

7.7 All the differences in the products stocks with excise that are retained by the Trader for Goods with Excise (income, outcome, etc.) should be registered immediately in the evidence which is mandatory according to the article 7.1.

Article 8 Technical Conditions in the Authorized

Warehouse for Goods with Excise

The raw material that is used to produce1 process the products with excise should be kept in a special storage space which is secure and can be locked with a key, so the raw material cannot be moved from the space where its stored, except if are registered and recorded as required in the evidence of the warehouse (see Article 5 of this Administrative Direction);

8.2 The storage space should have clearly defined area to keep the products with excise obligation suspended separately from the products with paid excise obligation;

8.3 The Authorized Warehouse Employee for Goods with Excise should care about that none of the products with suspended excise obligation should not be removed

Clan 8 TehniZki uslovi u ovlaGi.enom akciznom

skladigtu

8.1 Sirovine koje se koriste u proizvodnj ilobradi akciznih proizvoda se moraju skladiStiti u odvojenim skladiStim prostorima ko-ji su obezbedeni i koji se mogu zakljucavati, tako da se iz skladiSnog prostora sirovine ne mogu iznositi, a da nisu pravilno proknjiiene i l i obraCunate (vidi Clan 5 ovog Administrativnog uputstva).

8.2 SkladiSni prostor mora imati jasno odreden prostor za skladiStenje akciznih proizvoda sa odleienim placanjem akcize od proizvoda za koje se plaCa akciza bez odlaganja.

8.3 OvlaSCeni drialac akciznog skladiSta treba da osigura da se akcizni proizvodi sa odloienim plaCanjem akcize ne mogu iznositi iz skladiSnog

deponimit per pa u regjistruar dhe llogaritur si duhet ne evidence te depos-(shih Nenin 5 te ketij Udhezimi Administrativ);

8.4 Te gjitha hapesirat ku jane deponuar produktet me akcize, qofie te paketuara ose ne ndonje forme tjeter, duhet te jene te siguruara dhe te mbahen te mbyllura ose te vezhgohen. Depoisti i Autorizuar i Mallrave me Akcize duhet te merr masat e duhura per te minimizuar rrezi kun nga vjedhja e produkteve me akcize;

8.5 Te gjitha produktet e akcizes ne depo duhet te identifikohen lehte me an& te nje numri identifikues te depos dhe me daten e prodhimit;

8.6 Te gjitha produktet me akcize qe ruhen ne depo duhet te jene ne dispozicion per inspektim. Te gjitha mjetet e deponimit (rezervare, fugi, etj.) duhet te jene te pajisura me pajisje per matje precize;

8.7 Depoisti i Autorizuar i Mallrave me Akcize duhet te siguroje per oficeret e Doganes se Kosoves pajisje profesionale te matjes, te nevojshme per te konstatuar sasine, fuqine, temperaturen etj, te produkteve me akcize qe mbahen ne Depo te Autorizuar per Mallra me Akcize;

All the products with excise that are saved in warehouse should be available to be inspected. All the means of storage (reservoirs, barrels, etc.) should be equipped with equipment for precise measures;

8.4

The Authorized Warehouse Employee for Goods with Excise should ensure for the Kosovo Customs Officers professional equipment for measurement, necessary to ascertain the quantity, power, temperature etc, of the products with excise in the Authorized Warehouse for Goods with Excise;

Svi prostori (prostorije) u kojima su akcizni proizvodi smeSteni, bilo da su pakovani i l i ne, obezbedeni su i drie se od prismotrom. Drialac akciznog skladiita treba preduzeti sve neophodne mere radi umanjenja rizika od krade akciznih proizvoda.

Svi uskladiiteni akcizni prizvodi trebaju biti lako prepoznatljivi prema referentnom broju zaliha i datuma proizvodnje.

Svi uskladiiteni akcizni proizvodi tebaju biti dostupni za pregled. Sva oprema u skladiitu (cisterne, burad, idr.) mora biti opremljena sa preciznim uredajima za merenje.

OvlaiCeni drialac skladiSta snabdeva carinike Carine Kosova sa profesionalnom opremom za merenje, neophodnom za utvrdivanje koliCine, jaEine, temperature i dr. svih akciznih proizvoda koji se drie u ovlaSCenom akciznom skladiStu.

Dogana e Kosoves te nevojshme per te siguruar mbrojtjen e detyrimeve te papaguara te akcizes, duhet te ndermerren nga Depoisti i Autorizuar i Mallrave me Akcize.

8.8 Cfaredo masa tjera qe kerkohen nga
