The main legislation providing for the health and safety of people in the workplace are the Safety,
Health and Welfare at Work Acts 2005 and 2010 They apply to all employers, employees !incl"ding
fi#ed$term and temporary employees% and self$employed people in their workplaces The Acts set o"t
the rights and o&ligations of &oth employers and employees and provides for s"&stantial fines andpenalties for &reaches of the health and safety legislation
(General Application) Regulations 2007:Almost all of the specific health and safety laws which
apply generally to all employments are contained in theSafety, Health and Welfare at Work !'eneral

3revent risks from "se of any article or s"&stance and from e#pos"re to physical agents,
noise and vi&ration
3revent any improper cond"ct or &ehavio"r likely to p"t the safety, health and welfare of
employees at risk
3rovide instr"ction and training to employees on health and safety
3rovide protective clothing and e"ipment to employees
Appointing a competent person as the organisations Safety 4fficer

The d"ties of employees while at work are set o"t inSection 1of the Act These incl"de the following
To take reasona&le care to protect the health and safety of themselves and of other people in
the workplace
6ot to engage in improper &ehavio"r that will endanger themselves or others
6ot to &e "nder the infl"ence of drink or dr"gs in the workplace
To "ndergo any reasona&le medical or other assessment if re"ested to do so &y the
employer
To report any defects in the place of work or e"ipment which might &e a danger to health and
safety
