(Recognition of Forest Rights) Act,2006

This Act recognizes forest dweller’s rights and makes conservation more accountable.

Three Categories

No one gets rights to any land that they

have not been cultivating or using the

land for other allied agricultural activities

prior to December 13, 2005 .

Those who are cultivating land or having a grazing land but don't have document can claim up to 4 hectares, as long as they are cultivating the land themselves for a livelihood and using the land for agriculture allied works.

Those who have a Patta or a government lease, but whose land has been illegally taken by the Forest Department or whose land is the subject of a dispute between Forest and Revenue Departments, can claim those lands.

Minor forest produce things like tendu leaf, herbs, medicinal plants, etc. “that has been traditionally collected .

1. Grazing grounds and water bodies . পূশুচা�রণ ধিভূধি?রে� এব� জ� স�স্থা�.

2.Traditional areas of use by nomadic or pastoralist communities i.e. communities that move with their herds, as opposed to practicing settled agriculture.

1.This law also gives the community the right to protect and manage the forest.

এইআইন এ-�ড়া�ও সম্প্রদা�রেয়র বন রক্ষ� ও পূধিরচা��ন� কাররে� অধি�কা�র তোদায়.

2.Section. 5 gives the community a general power to protect wildlife, forests.��র�. ৫ সম্প্রদা�রেয়র বন�প্রা�ণ�, বন রক্ষ� কার�র জন� একাটি

Right to protect and Conserve রক্ষ� ও স�রক্ষণ কার�র অধি�কা�র

Three step procedure :- ধি�ন ��পূ পূদ্ধধি�: -

1. The Gram Sabha makes a recommendation. গ্র�� সভূ�র একাটি স;পূ�ধিরশী কারের তো��রে�.

Recognition of Rights অধি�কা�রেরর স্বী�কা* ধি�

2. The Gram Sabha's recommendation goes through two stages of screening committees at the Taluk and District levels.

গ্র�� সভূ�র এর স;পূ�ধিরশী দা;টি স্তর পূযা$�রেয় ব�-�ই কাধি�টির ����রে� যা�য় ���;কা এব� তোজ��.

3.The District Level Committee makes the final decision land recognized under this Act cannot be sold or transferred.

তোজ�� স্তরের কাধি�টি চা�ড়া�ন্ত ধিসদ্ধ�ন্ত তোনন, এইআইরেনর অ��ন স্বী�কা* � জধি� ধিবধি+ ব� স্থা�ন�ন্তর কার� যা�রেব ন�.

1. Protect the wild life, forest and biodiversity.

বন� জ�বন, বন ও জ�ববৈবধিচাত্র্য� রক্ষ� কার�র জন�.

2. Ensure that adjoining catchments area, water

sources and other ecological sensitive areas

adequately protected.

Duties of Right Holders অধি�কা�র ��ররেকার কা�$ব�

3.Ensure that the habitat of forest dwelling Scheduled Tribes and other traditional forest dwellers is preserved from any form of destructive practices affecting their cultural and natural heritage.

4.Ensure that the decisions taken in the Gram Sabha to regulate access to community forest resources and stop any activity which adversely affects the wild animals, forest and the biodiversity are complied with.

কারের, বন ও জ�ববৈবধিচাত্র্য� �� তো�রেন হায়. 

1.Punished with fine which may extend to one thousand rupees.

একা হা�জ�র ট�কা� পূযা$ন্ত সম্প্রস�ধির� হারে� পূ�রের জধির��ন� শী�ধিস্ত.

Penalties & Offences জধির��ন� ও অপূর��

2.No suit, prosecution or other legal proceeding shall lie against any officer or other employee of the Central Government or the State Government for anything which is in good faith done or intended to be done under this Act.

1.Lay down a procedure for identification or hamlets or settlements and process of consolidation of their lists.

সন�S কার�র জন� একাটি পূদ্ধধি� পূধির���গ অথাব� হা���রে�টস ব� জনবসধি� এব� ��রেদার ��ধি�কা�য় একা�কারণ

প্রাধি+য়�.

2.Increase the mandatory tribal membership of Forest Rights Committees from the present one-thirds to two-thirds. বনআধি�কা�র কাধি�টির ব������#�কা উপূজ���য় সদাস�পূদা

ব�ড়া�ন ব�$��রেন একা �*��য়��শী তোথারেকা দা;ই �*��য়��শী.

Amendments Suggested স�রেশী��ন� প্রাস্ত�ধিব�

3.Reduce the present requirement of quorum of two-thirds in the Gram Sabha meetings to one-half.

গ্র�� সভূ�র বৈবঠারেকা ব�$��ন গণপূ#ধি�$ প্রারেয়�জনহ্রা�স কারুন দা;ই �*��য়��শী তোথারেকা একাঅরে�$কা.

4.Clarify that the term ‘sustenance’ includes fulfillment of livelihood needs of self and family, including the sale of any produce.

5.Allow transportation of minor forest produce within and outside forest area through ‘locally appropriate means of transport for use of such produce or sale by forest rights holders or their cooperatives/federations for livelihood.  পূধিরবহান �ঞ্জু;ধির ধিদান তো-�টখা�ট বন উ�9পূ�দান বন এ��কা�র

6.Lay down process for recognition of rights, including community rights.

সম্প্রদা�রেয়র অধি�কা�র সহা অধি�কা�রেরর স্বী�কা* ধি� প্রাধি+য়� ধিনরেদা$শী কাধিরয়� তোদাওয়�.

7.Insert new Claim Forms for Rights to Community Forest Resource and Title Form for Community Forest Resources. 

সম্প্রদা�য় বন সম্পদাঅধি�কা�র এব� সম্প্রদা�য় বন সম্পদা ধিশীরের�ন�� আকা�রেরর ন�]ন দা�ধিব তোj�কা�ন.
