b. PROPOSED USE: For the Manhattan District, Corps of Engineers.

c. ACREAGE INVOLVED: Approximately 430,780 acres of land, includ­ing 79,400 acres of Government owned land (approximately 3,270 tracts).

d. IMPROVEMENTS: Power plants, telephone systems, water supply systems, railroads, water power facilities, highways, homes, business structures, cemeteries and farms.

On the 22nd of April I was designated by the office of the Attorney General to take charge of the Hanford Project in lastern Washington for the Separtaeat of Justice. I find that the federal Land Bank appraisers hare teen assigned to the task of appraising the eoae three thousand ownerships within the project, and it has also been brought to ay attention that the federal Land Bank appraisers are under fire by certain agencies of the State of Washington and by ■any Individuals within the boundaries of the project on the ground that their values as placed upon the properties within the project are below the true aarket value of the lands.

In riew of the fact that X will be in charge of all the litigation Incidental to the acquisition of these lands and that in all such litigation the Government's case east rest upon the testimony of theee federal Land Bank appraisers,' I feel that I should leave no doubt in your alnd or in the alnd of any of the officials of the federal Land as to ay personal attitude toward the word that your appraleal staff is doing In the Hanford Project. I have had the privilege of working with the greater auaber of your appraisers la connection with the acquisition ef Camp Whits and Camp Adair la the State of Oregon by the War Department, and In all eases tried la these two projects, the Geveraaent relied exclusively upon the testimony of those appraisers, fhe results obtained were highly satisfactory and X assure you that X am personally convinced that no nore competent and reliable appraisers can be found than thoee on the staff of the federal Land Bank of Spokane, further, X have found that they Bake exceptionally satlafactory witnesses in that they are sot only able to properly appraise properties but are also able v to deaonstrats that fact to the trial juries. Beth their ability and their abeolute fairness as between the acquiring agencies and the Individual land owners has been demonstrated to ay absolute satisfaction.It Is a great personal satisfaction to ae that X will be able to rely upon the assistance of this able group of aen in ell future litigation arising froa the acquisition program in the Hanford Project.

(H) The foregoing covenants shall be binding upon the undersigned Owner and the heirs,, executors„ administrators, successors and assigns of said Owner,

The terms of this option are as followsg

(*0 The Vendor agrees that all taxeB, assessments and encumbrances which are a lien against the land at the time of the conveyance to the United States shall he satisfied of record by the Vendor at or before the transfer of title andB if the Vendor falls to do so0 the United States may pay any taxes9 assessments and encumbrances which are a lien against the land; that the amount of such payments shall be deducted from the purchase price of the lands at the request of the United states by its authorized representative and without prior payment or tender of the purchase price, he will execute and deliver the general warranty deed hereinabove provided for conveying to the United Stater, the land herein described; that he will pay the documentary revenue stamp t*uc and obtain and record such other evidence of title as may be required by the United Spates; it being understood that the Government will pay the fee for recordation of the deed to the United Spates.

(*>) The Vendor agrees that loss or damage to the property by fire or acts of God shall be at the risk of the Vendor until the title to the land and deed to the United States have been accepted by the United Spates through its duly authorized representative0 or until the right of occupancy and use of the land;, as hereinbelow provided for, has been exercised by the United States; and in the event that such less or damage occurs, the United States may„ without liability,, refuse to accept conveyance of title, or it may elect to accept conveyance of title to such property, in which case there shall be an equitable adjustment of the purchase price.

(6) The Vendor agrees that the United Spates may„ at its election, and notwithstanding the prior acceptance of this option, acquire title to said land or any portion thereof or any interest therein, by condemnation or other judicial proceedings0 in which event the Vendor agrees to cooperate with the United States in the prosecution of such proceedings and also agrees thatthe consideration hereinabove stated shall be the full amount of the award of Just compensation inclusive of interest for the taking of said land and that any and all awards of just compensation that may be made in the proceeds ing to any defendant shall be payable and deductible from the said amount and that said consideration shall also be in full satisfaction of any and all claims of the Vendor for the payment of the right of occupancy and use hereinafter provided for in Paragraph (7)0

(7) *s additional consideration for the payment of the purchase price hereinabove set forth0 the Vendor hereby grants to the United Spates the right of immediate occupancy and use of the land hereinabove described for any purpose whatsoever from and after the acceptance by the United States of this option until such time as said land is conveyed to the United Statesby the Vendor as hereinabove provided, and upon demand the Vendor will immediately vacate the property and deliver possession to the United States0

(8) It is agreed that the spouse, if any, of the Vendor by signing below agrees to join in any deed to the United States and to execute any instrument deemed necessary to convey to the United States any separate or community estate or interest in the contracted property or to relinquish and release any dower* courtesy, homestead or other rights or interest of such spouse thereino

MEMORANDUM TO RESIDENTS AND LANDOWNERS WITHIN AREA "A* AND «D*

ALL QUESTIONS REGARDING LANDS BEING ACQUIRED SHOULD BE DIRECTED TO THE PROSSER LAND OFFICE — NOT TO THE ARMY ENGINEER9S OFFICE IK PASCO. The Pasco Office is solely concerned with construction- The Prosser Office w ill confer with the Pasco Office on any questions requiring joint action. As necessity indicates, further memoranda to owners and occupants w ill be issued by the Prosser Office with concurrence of the Pasco Office.

It is suggested that as many inquiries as possible be handled by Bail.I f copies of th is memorandum are desired by land owners or residents, copies w i l l be mailed upon request by the P rosser Office.

SCHEDULE OF VACATION:'

"Hot" Areas must be vacated not later than April 28, I 9U3, due to military necessity. The "hot" area6 were described in the public meetings held at Richland and White B lu ffs , March 26, I 9U3 , and no changes in boundaries of these areas have since been made.

Business houses w i l l remain in operation un til further notice. Business men and their fam ilies, school teachers and their families may remain in their homes until further noticeo

ALL OTHER OWNERS AND OCCUPANTS IN THE "HOT" ARIAS MUST VACATE NOT LATER THAN APRIL 28, 19U3 , UNLESS OTHERWISE NOTIFIED IN WRITING BT THIS OFFICE.

Owners and Occupants in Area "A" Outside of the *Hot" Area Must Yacate Not Later Than May 31, 19^3 as previously announced. Merchants and business men may remain in operation until further notification, and are advised not to liquidate their stocks at a sacrifice , as they w ill be given opportunity for sale of their complete stock without sacrifice.
