So ’n besluit behoort jou nie as gyselaar te hou nie, sê dr. Salomé van Coller-Peter, bestuursafrigter en programhoof van MPhil in be- stuursafrigting aan die Universi- teit Stellenbosch se Bestuurskool (USB). Sy sê daar is verskeie fak- tore wat ons besluite beïnvloed wat die proses soms na ’n byna onmoontlike taak laat voel. “Vorige ervarings, die vrees vir mislukking, jou ouderdom en fi- nansiële posisie, persoonlike waardestelsel en dié wat deur jou besluit geraak gaan word, is almal belangrike faktore.” Dit is die rede hoekom ’n mens baie geestelike energie en tyd daaraan bestee om die verskeie opsies, scenario’s en gevolge teen mekaar op te weeg, verduidelik Van Coller-Peter. “Dit kan jou uitgeput en ver- ward laat voel, en dit vir jou selfs onmoontlik maak om die aller- belangrike besluit te neem.” Deur sekere strategieë ten op- sigte van logiese denke te volg en dit te kombineer met jou intuïsie, wat baie sterker is as wat ’n mens besef, kan jy die oorgang tot op- trede aansienlik vergemaklik. Van Coller-Peter raai aan dat ’n mens die volgende stappe volg wanneer jy ’n groot besluit moet neem. ) Sien die hele prentjie Sy stel voor dat jy die besluit be- skou as deel van jou lewe as ge- heel. “Dit is belangrik om nie jou besluit in afsondering te beskou en in die oomblik vasgevang te word nie. Neem ’n tree terug en kyk hoe die besluit jou of jou or- ganisasie se huidige situasie en langtermyndoelwitte gaan raak sodat jy ’n basiese begrip kan ontwikkel van hoe die besluit ook die toekoms kan raak.” ) Neem jou waardes in ag Waardes is daardie dinge wat jy belangrik ag in die wyse waarop jy leef en werk. Die lewe sal een- voudiger wees as ’n mens jou waardes in ag neem wanneer jy planne maak en besluite neem. Hulle bepaal jou prioriteite, bied jou vrede, versterk wie jy is en dien as maatstaf om te bepaal of jou lewe uitdraai soos jy dit wil hê. Dit is belangrik dat jy nie pro- beer om iemand anders se lewe te lei en hul denkwyse te volg nie. “Sorg dat jy jou intuïsie of ge- wete insluit in jou besluitnemings- proses en jy sal veel gelukkiger wees met die uitslag as wanneer jy net op logiese denke staat- maak, wat dikwels beïnvloed word deur die wêreld om jou.” ) Identifiseer en ontleed Die derde stap is wat Van Coller- Peter “besluitnemingsmatriks-ont- leding” noem. Dit sluit die identi- fisering in van al die belangrike aspekte van die besluit en dan die ontleding van elkeen op meriete. Jy wil byvoorbeeld ’n nuwe huis koop wat al die behoeftes van jou gesin wat ruimte en lig- ging betref sal bevredig, terwyl dit ook bekostigbaar is. Met ver- skeie sulke huise beskikbaar, is die vraag watter een om te kies. Die benadering dan is om ’n dokument te skep met die eerste kolom ’n lys van huise beskikbaar en dan ’n lys van die kriteria waaraan hulle moet voldoen. Neem ’n telling van een tot drie, met een die minste geskik vir jul behoeftes en drie die meeste ge- skik. Vermenigvuldig dan die tel- ling met die relatiewe belang van elke faktor en bereik sodoende ’n totale punt vir elke opsie. “Die huis wat die hoogste tel- ling kry, sal in alle waarskynlik- heid die beste keuse wees vir jul behoeftes.” ) Hoe hanteer ander dit? Van Coller-Peter sê die vierde stap in die besluitnemingsproses is die verkryging van kennis deur navorsing te doen oor hoe ander mense ’n soortgelyke situasie hanteer het en daardeur geraak is. “Dit is soms gerusstellend om te weet dat iemand anders ook by dieselfde kruispad gekom het en om te sien hoe hulle gereageer het op die situasie. “Daar moet egter in gedagte ge- hou word hoewel dit lyk asof die probleem soortgelyk is, verskil omstandighede grootliks van per- soon tot persoon. Dit wat vir die een gewerk het, werk nie nood- wendig vir die volgende een nie. Sien dit dus eerder as ’n proses van inligting versamel waar jy kennis, begrip en insig verkry wat jy kan interpreteer om by jou unieke situasie, waardes en om- standighede te pas.” ) Lys jou opsies In die voorlaaste stap stel jy ’n lys op van jou opsies en bespreek dit dan met jou vennoot, gesin of or- ganisasie wat deur die besluit ge- raak gaan word. “Hul voorstelle bied dalk duidelike insig, asook alternatiewe wat jy moontlik nie oorweeg het nie,” sê sy. ) Finale stap: evalueer Sodra jy die terugvoering en voorstelle ingesluit het, evalueer elke opsie en doen dan die finale stap: Besluit – en hou daarby! Van Coller-Peter waarsku dat baie mense ’n verskeidenheid re- aksies ervaar ná so ’n besluit. “Dit kan wissel van verligting en opwinding tot spyt en teleur- stelling. So ’n besluit behoort jou nie asgyselaar te hou nie, sê dr. Salomé van Coller-Peter, bestuursafrigter en programhoof van MPhil in be-stuursafrigting aan die Universi-teit Stellenbosch se Bestuurskool (USB). Sy sê daar is verskeie fak-tore wat ons besluite beïnvloed wat die proses soms na ’n byna onmoontlike taak laat voel.

“Vorige ervarings, die vrees virmislukking, jou ouderdom en fi-nansiële posisie, persoonlike waardestelsel en dié wat deur jou besluit geraak gaan word, is almal belangrike faktore.”

Dit is die rede hoekom ’n mensbaie geestelike energie en tyd daaraan bestee om die verskeie opsies, scenario’s en gevolge teen mekaar op te weeg, verduidelik Van Coller-Peter.

AntwoordJy sal inderdaad kan eis van die Vergoe-dingskommissaris terwyl jy ’n ongeskikt-heidspensioen ontvang. Die uitsluiting vir ’n ongeskiktheidspensioen is baie duidelik: Iemand kan nie ’n ongeskikt- heidspensioen ontvang as hy of sy in die sorg van ’n staatsinstelling is of eni-ge ander maatskaplike toelaag ontvang nie. Die eis teen die Vergoedingskom-missaris is nié ’n maatskaplike toelaag nie.

Die Vergoedingskommissaris sal egternie uitbetaal as jou eis meer as 12 maan-de ná die diagnose van siekte ingedien word nie. Jou siekte is meer as drie jaar gelede gediagnoseer. As daar nog nooit ’n eis daarvoor ingedien is nie, sal jy nienou ’n eis teen die fonds kan indien nie. Ek stel voor dat jy die fonds dadelik kontak om uit te vind of daar wel be-tyds ’n eis namens jou ingedien is.

Dit geld in die geval van ’n besering of siekte wat ’n permanente liggaamlike verlies tot gevolg het, verlies van funk-sies en gebruik van ’n liggaamsdeel, ver-lies van gehoor of sig, beperkte long-funksie en verlies van ’n orgaan.

Enige ander permanente ongeskikt-heid wat nie in die Wet op die Vergoe-ding vir Beroepsbeserings en Siektes se Bylae 2 gelys is nie, sal deur die kom-missaris ondersoek word om te kyk of dit wel onder die bylae kan val.

Werkgewer  betaal  nie  volle  salaris,  be­taal  nie  bydraes  aan  WVF  oor  nie  –  wat nou?My seun het vir ’n private maatskappy gewerk. Daar is mondelings met hom ooreengekom om hom as ketelmaker op te lei. My seun het sedert Januarie 2015 nie sy volle salaris ontvang nie.

Die werkgewer het gesê die onderne-ming sukkel en wanneer dit beter gaan, sou hy die agterstallige salarisse betaal.

In Junie 2015 het die werkgewer my seun in kennis gestel dat hy moet gaan omdat die onderneming ’n finansiële krisis beleef. Daar is werkloosheidsver-sekering van sy salaris verhaal, maar toemy seun vra vir die besonderhede om van die Werkloosheidsversekeringsfonds (WVF) te eis, het die werkgewer gesê hy

en my seun kan in groot moeilikheid kom omdat dit nie oorbetaal is nie.

Ons soebat en smeek elke maand datdie werkgewer my seun se afleggings-brief aan hom gee asook die agterstalli-ge geld, maar daar is altyd verskonings. Wat staan ons te doen?

AntwoordJou seun moet dadelik die saak gaan aangee by die departement van arbeid in die gebied waar hy gewerk het. Hulle sal ’n saak open en die werkgewer kon-tak en kan indien nodig ’n bevel tot na-koming uitreik. As die werkgewer dan steeds nie sy verpligtinge nakom nie, kan hy kragtens wet tronkstraf of ’n boete opgelê word.

Dit is die werkgewer se plig om hom-self as werkgewer en sy werknemers by die WVF te registreer. Dit was nie jou seun se verantwoordelikheid nie en hy kan glad nie daarvoor verantwoordelik gehou word nie.

Hy moet dít ook met die departementvan arbeid opneem en die werkgewer sodoende dwing tot registrasie en om die geld wat van sy salaris verhaal is, te-rugwerkend aan die WVF oor te betaal. Die werkgewer het nie ’n keuse of hy dit wil doen of nie. Hy is wetlik daartoe verplig.

U seun se verlofgeld moet ook vir dieses maande wat hy gewerk het aan hom uitbetaal word. Dit beloop gewoonlik 1,25 dae verlof per maand vir ’n gewone vyfdag-werkweek of kan teen 1 dag vir elke 17 dae gewerk bereken word. Die departement van arbeid sal u seun ook daarmee kan help.

Die werkgewer is ook verplig om ’n dienssertifikaat aan jou seun te gee waarop die volgende verskyn:

) Die werknemer se volle name;) Die naam en adres van die werkge-

wer;) ’n Beskrywing van enige bedin-

gingsraad of sektorale diensstandaard wat op die onderneming van toepassing is;

) Die werknemer se aanstellings-datum en datum van diensbeëindiging;

) Die werknemer se werktitel of ’n

kort beskrywing van die werk wat die werknemer gedoen het ten tye van diensbeëindiging;

) Die vergoeding wat die werknemerontvang het ten tye van diensbeëindi-ging; en

) Indien die werknemer dit versoek,die rede vir diensbeëindiging.

Jou seun kan die sertifikaat aanheg ashy aansoek doen vir ’n ander werk om te bewys hy is afgelê en nie byvoor-beeld ontslaan weens wangedrag nie.

Dit kan ook as bewys dien vir hoe lank hy daar werksaam was, hoeveel hy verdien het en sy werkondervinding.

Die werkgewer kan nie net ’n werkne-mer aflê nie. Daar moet kennis van die afleggings gegee word en jou seun moes kans gehad het om op die kennisgewing van aflegging te reageer. Daar is ook voorgeskrewe bedrae wat dan aan werk-nemers uitbetaal moet word, soos geld vir die kennisgewingstydperke as die werknemer nie in dié tyd gewerk het nie. In jou seun se geval sal dit een week wees. Jou seun het egter te kort gewerk om enige ander geld te kan ont-vang.

Art. 191(12) van die Wet op Arbeidsver-houdinge bepaal dat wanneer ’n enkele werknemer afgelê word, soos in jou seun se geval, die werknemer die dis-puut na óf die Kommissie vir Versoe-ning, Bemiddeling en Arbitrasie (KVBA) óf die arbeidshof kan verwys.

Ek stel ook voor dat jou seun onmid-dellik die aangeleentheid na die KVBA verwys en ook die saak by die departe-ment van arbeid gaan aangee.
