Die struikelblokke is nie net fisiek nie, maar ook in die hou- ding van werkgewers, sê Julia Wood, ontwikkelingsbestuurder van Progression, ’n maatskappy wat werkgewers help om toe- ganklike werkplekke te skep. Op ’n konferensie in Pretoria oor die billike akkommodasie van gestremdes in die werkplek is die belangrikheid van ’n inklusiewe en diverse arbeidsmag beklem- toon. “Indien mense met gestremd- hede op ’n billike wyse in die werkplek tegemoetgekom word, ontsluit ons nie net mense-poten- siaal nie, maar ook die waarde- volle bydrae wat hierdie individue tot ’n diverse werkplek kan le- wer,” sê Wood, wat as bedryfsiel- kundige reeds 15 jaar met ge- stremdheid werk. “Ek het ’n suster met ’n ge- stremdheid en daarom beleef ek die uitdagings vanuit ’n persoonli- ke perspektief, asook vanuit die korporatiewe wêreld se perspek- tief.” Diskriminasie teen gestremdes in die werkplek is ’n werklikheid, en indien toeganklikheid nie van meet af ’n integrerende deel van die maatskappy se sakefilosofie is nie, is dit moeilik om later enige vooroordeel uit die weg te ruim. “Die akkommodering van ge- stremdes in die werkplek moet volhoubaar wees en daarom moet die organisasie die hantering van kwessies soos vertroulikheid en openbaarmaking in sy beleid en prosedures vaslê.” Dit is die vierde jaar dat die konferensie gehou word, en Wood sê elke jaar kom nuwe op- lossings na vore om die impak van gestremdheid in die werkplek te hanteer. “Een van die wanopvattings oor die billike akkommodering van gestremdheid in die werkplek is dat dit duur veranderinge noodsaak, maar daar is deesdae so baie oplossings vir integrasie beskikbaar. Werkgewers moet net die kwessie oopkop benader.” Sy sê indien werkgewers ’n in- klusiewe benadering volg, dink hulle in breër terme oor die voor- dele wat gestremde werknemers na die werkplek bring. “Net soos elke individu sy of haar gestremdheid anders beleef, sal billike akkommodasie afhang van die individu. ’n Mens moet jou nie blind staar teen die beper- kings wat ’n algemene diagnose van die toestand skep nie, maar eerder saam met die individu werk om in behoeftes te voor- sien.” Volgens Wood is die doel van billike akkommodasie in die werkplek om die impak te versag wat die gestremdheid het op die individu se vermoë om die werk suksesvol te doen. “Nuwe tegnologiese ontwikke- lings het die suksesvolle integra- sie van gestremdes in die werk- plek aansienlik vergemaklik. Maatskappye soos Apple en Microsoft het oplossings vir ge- stremdes ingebou in hul stan- daard-sagteware.” Heelwat aanpassings kan ook sonder enige bykomende koste aan ’n standaard-kantoorrekenaar aangebring word. Talle nuwe hulpmiddels is beskikbaar wat toeganklikheid vir mense met ge- stremdhede kan verbeter. Nuwe tegnologie help ook om geboue toegankliker te maak, met die gebruik van bewegingsensors, deure wat outomaties toemaak, aanpasbare beligting en meubels wat vir verskillende hoogtes ver- stel kan word. “Gestremdheid in die werkplek behoort benader te word vanuit die perspektief dat dit ’n normale deel van die daaglikse bedrywig- hede in ’n organisasie is sodat die vooroordele en stigma mettertyd kan verdwyn.” Aanpassings kan sonder bykomende koste aan ’n rekenaar aangebring word om toeganklikheid in die werkplek vir mense met gestremdhede te verbeter. Foto: DEAN VIVIERS Wanneer gestremdheid ter spra- ke is, verwys ‘billike akkommo- dasie’ na enige verandering in die werkplek wat ’n gekwalifi- seerde individu met ’n gestremd- heid in staat stel om gelyke ge- leenthede vir indiensneming te kry. Dit sluit in: ) Veranderinge aan die proses waarop werkaansoeke ingedien word. ) Veranderinge wat ’n werkne- mer met ’n gestremdheid in staat stel om gelyke voordele en voorregte van indiensneming te geniet. ) Verstellings aan die werkom- gewing, soos om geriewe toe- ganklik te maak, poste op ’n an- der wyse te struktureer, werkreë- lings aan te pas, nuwe of aangepaste toerusting vir die ge- stremde aan te skaf, toetse en leermateriaal aan te pas of om gekwalifiseerde tolke aan te stel. Ondanks verskeie pogingsdeur werkgewers om ’n in-klusiewe en diverse ar-

beidsmag te skep, is baie werk-plekke steeds nie toeganklik vir mense met gestremdhede nie.

Op ’n konferensie in Pretoria oor die billike akkommodasie van gestremdes in die werkplek is die belangrikheid van ’n inklusiewe en diverse arbeidsmag beklem-toon.

“Indien mense met gestremd-hede op ’n billike wyse in die werkplek tegemoetgekom word, ontsluit ons nie net mense-poten-siaal nie, maar ook die waarde-volle bydrae wat hierdie individue tot ’n diverse werkplek kan le-wer,” sê Wood, wat as bedryfsiel-kundige reeds 15 jaar met ge-stremdheid werk.

“Ek het ’n suster met ’n ge-stremdheid en daarom beleef ek die uitdagings vanuit ’n persoonli-

ke perspektief, asook vanuit die korporatiewe wêreld se perspek-tief.”

Wanneer  gestremdheid  ter  spra­ke  is,  verwys  ‘billike  akkommo­dasie’  na  enige  verandering  in die  werkplek  wat  ’n  gekwalifi­seerde  individu  met  ’n  gestremd­heid  in  staat  stel  om  gelyke  ge­leenthede  vir  indiensneming  te kry.  Dit  sluit  in:)  Veranderinge  aan  die  proses waarop  werkaansoeke  ingedien word.) Veranderinge  wat  ’n  werkne­mer  met  ’n  gestremdheid  in staat  stel  om  gelyke  voordele  en voorregte  van  indiensneming  te geniet.

) Verstellings  aan  die  werkom­gewing,  soos  om  geriewe  toe­ganklik  te  maak,  poste  op  ’n  an­der  wyse  te  struktureer,  werkreë­lings  aan  te  pas,  nuwe  of aangepaste  toerusting  vir  die  ge­stremde  aan  te  skaf,  toetse  en leermateriaal  aan  te  pas  of  om gekwalifiseerde  tolke  aan  te  stel.

Om een van die sleutelbronne van generatiewenavorsingsaktiwiteit en -produksie in die gesondheidswetenskappe te wees, is ʼn belangrike aspekvan die Fakulteit se identiteit.

Die Universiteit wil ʼn dinamiese Dekaan aanstel, ʼn visionêre leier met die vermoë om strategieste dink en doeltreffende uitvoering aan die Universiteit en Fakulteit se strategiese planne tegee. Maatskappy  teken  nie  dogter  se  klerk­skap  af  nie  –  wat  staan  ons  te  doen?My dogter het ’n BCom-graad in finan-siële rekeningkunde verwerf en is sedertFebruarie 2012 besig met haar klerkskap by ’n maatskappy. Sy het haar sedert-dien ingeskryf vir ’n oorbruggingskursus en gekwalifiseer om haar klerkskap reeds aan die einde van Januarie 2014 te voltooi. Haar assessor het egter be-sluit om haar eers aan die einde van Ju-lie 2015 af te teken.

Teen einde Desember 2014 was daarnet een vaardigheid uitstaande vir die voltooiing van haar klerkskap. Sy het die nuwe kontrak vir einde Julie 2015 se aftekening onderteken, maar dit het nie ’n werklikheid geword nie. Dit is reeds Augustus 2015 en steeds is sy nie afgete-ken nie. Graag wil ek weet wat haar te doen staan?

As sy ’n ander werk-aanbod kry, sal sy haar werkgewer een maand kennis moet gee? Ons as ouers voel sy word mis-bruik. Sy het baie pligte bygekry maar haar salaris weer-spieël dit nie.

AntwoordJou dogter sal die maatskap-py se interne grieweprosedure moet volg. Sy moet skriftelik redes van die assessor en die maatskappy aanvra oor hoekom haar klerkskap nie afgete-ken word nie.

Ek twyfel of hulle net sonder rede salweier om haar af te teken omdat dit tog tot nadeel van albei partye is.

Daar moet altyd eers probeer word om griewe en dispute intern op te los en sodoende ook die werkverhouding gesond te hou. As sy nie tevrede is met hul antwoord nie, kan sy die aange-leentheid na die Suid-Afrikaanse insti-tuut van geoktrooieerde rekenmeesters (Saica) verwys om die saak te onder-soek.

Is daar ’n bepaling in jou dogter se dienskontrak wat spesifiseer hoe lank sy

vir die maatskappy moet werk en hoe lank die kennisgewingtydperk is? Indien wel, sal sy daardie ooreenkoms moet eerbiedig, anders sal dit op kontrak-breuk neerkom en kan hulle haar siviel-regtelik aanspreeklik hou vir skade.

As daar niks in haar kontrak is wat die kennisgewingstydperk re-

guleer nie, sal sy kragtensart. 38 van die Wet op

Basiese Diensvoor-waardes vier wekekennis moet geeomdat sy langer as’n jaar in dienswas.

Al voel jy as ou-er dat jou kind

baie hard werk enekstra insit, moet jy

onthou dat geen werk-nemer ’n reg het op ’n

verhoging nie. Werknemers hetslegs ’n reg op ’n regverdige arbeids-praktyk. Die Wet op Basiese Diensvoor-waardes het geen bepalings en voor-skrifte oor salarisverhogings nie. Jou dogter het slegs die reg op ’n jaarlikse verhoging as haar werkgewer in haar dienskontrak daarop ooreengekom het.

Sonder ’n kontraktuele waarborg vir’n verhoging is dit die prerogatief van haar werkgewer.

Ek stel voor dat jou dogter met haarwerkgewer oor ’n verhoging onderhan-del nadat sy haar klerkskap suksesvol voltooi het.

As jou dogter meen daar word onbil-lik teenoor haar opgetree deurdat haar salaris nie aangepas is nie, kan sy ’n saak van onbillike arbeidspraktyk teen

haar werkgewer aanhangig maak. Die bewyslas is op haar om die onbillike ar-beidspraktyk te bewys. Sy sal moet be-wys dat sy geregtig was op ’n verhoging omdat dit ’n gevestigde praktyk in die maatskappy is deurdat al die ander werknemers in soortgelyke poste ver-hogings ontvang het behalwe sy.

Is  my  werkgewer  onredelik  oor  my  dog­ter  se  siekte?My skoolgaande dogter is onlangs met ’n erge vorm van epilepsie gediagno-seer. Sy is as gevolg daarvan ook baie depressief en is die laaste twee maande verskeie kere in die hospitaal opgeneem vir diagnose en behandeling.

Dit het alles veroorsaak dat ek baie van die werk afwesig was omdat ek be-raders en dokters saam met my dogter moes sien. Dit was gebeure buite my beheer.

My werkgewer het my ingeroep en ge-sê die situasie is nie vir hom aanvaar-baar nie en dat my werk daaronder ly. Is dit nie onredelik en onmenslik van hom nie?

Ons is ook in dispuut oor die toestaanvan gesinsverantwoordelikheids- en siekteverlof. Die laaste twee maande se gebeure het my baie uitgeput en ek woutwee dae se siekteverlof neem maar dit is geweier omdat my werkgewer meen ek is nie siek nie. Is dit reg?

AntwoordOnthou dat gesinsverantwoordelikheids-verlof en siekteverlof nie vir die ver-keerde redes toegestaan kan word nie. Daar is werknemers wat hierdie voorde-le misbruik. Dit kos die werkgewer baie geld deurdat die produktiwiteit van die onderneming negatief geraak word. Al-bei dié soorte verlof word dus streng deur wetgewing gereguleer sodat billik-heid teenoor werkgewer en werknemer geskied.

Art. 27 van die Wet op Basiese Diens-voorwaardes bepaal dat werknemers wel gesinsverantwoordelikheidsverlof mag neem as hul kind siek is. Onthou egter dat jou werkgewer mag vra vir be-wyse van die kind se siekte en dat jy

haar op die betrokke dae moes versorg. Gesinsverantwoordelikheidsverlof sal

ook nie toegestaan word as jou kinder-oppasser of kind se versorger afwesig is en jy tyd wil afkry om na jou kind om te sien nie.

In jou geval, waar jy baie verlof moesneem, moet jy onthou jy is net op drie gesinsverantwoordelikheidsverlofdae per jaar geregtig. Jy is nie daarop gereg-tig om elke keer as jou kind siek is drie dae gesinsverantwoordelikheidsverlof te kry nie.

Siekteverlof is spesiale verlof wat deurart. 22 van die Wet op Basiese Diens-voorwaardes gereguleer word. Die wet is baie duidelik dat jy slegs betaalde siekteverlof kry as jy siek of beseer is. Dit is nie beskikbaar vir werknemers wat uitgeput en moeg is en tyd nodig het om te rus nie.

Dit is waarom daar 15 werkdae se jaarlikse verlof tot jou beskikking is.

Jy noem uitdruklik dat jy net baie moeg was en nie siek was of deur ’n dokter afgeboek is nie. Ek stel voor dat jy van jou jaarlikse verlof neem om ’n bietjie te gaan rus en sake by jou huis te reël.

As jy geen jaarlikse verlof meer tot jou beskikking het nie, kan jy jou werk-gewer versoek om onbetaalde verlof aan jou toe te staan.

Jy moet onthou dat jou werkgewer jou vergoed vir jou dienste en daarom daarop geregtig is dat jy jou volle aan-dag, tyd en beste werk sal gee wanneer jy by die werk is.

DISCIPLINARY COMMITTEE (RE-ADVERTISED)The NHBRC is a statutory body established in terms of the Housing Consumers ProtectionMeasures Act, Act 95 of 1998, (“the Act”). The primary mandate of the NHBRC under the Actis to protect the interests of housing consumers and to regulate the home building industry.

In terms of section 5 (b) of the Act, Council is required to establish a Disciplinary Committee(“the Committee”) which is ad hoc in nature, to assist in the presiding of disciplinary hearingswhere registered home builders have contravened the provisions of the Act.

It is on this basis that Council intends to establish a panel fromwhich successful members shallbe selected from time to time to preside over disciplinary hearings of home builders.
