    SUPPLEMENT INVESTIGATIVE ACTION REPORT

    NARRATIVE SECTION:

    On Wednesday, 09/28/2011, at approximately 1:49 a.m., Detective Williams and I were called outto assist with a criminal investigation that occurred in front of 100 NW 30th Avenue, PompanoBeach, Florida. I arrived on scene at approximately 2:41 am. The crime scene was secured withyellow crime scene tape. Deputy S. Dirocco was standing guard at the crime scene and was alsothe Deputy responsible for logging everyone who entered or exited the crime scene location on aBSO crime scene entry/exit log.I looked at the crime scene area and observed a marked BSO patrol car stopped several feetbehind a tan colored Saturn. Detective Kessling, Sgt. Irvin, Sgt. Molamphy and Crime SceneDetective Vila were already on scene. Detective Vila was already conducting his portion of theinvestigation of the crime scene. Detective Williams, lead investigator, also responded to thescene moments later. Sgt. Irvin debriefed us all about the incident. It was learned that Rozier hadthreatened Deputy Huerta by pointing an unknown type firearm at Deputy Huerta prior to himfleeing the scene on foot. Deputy Huerta in fear for her life; fired her service weapon towardRozier's direction in attempt to element the threat against her life. We were also informed thatMarcus Rozier was classified as a sexual predator. This incident wasdocumented and recordedunder case PB11-09-7764.     I learned the vehicle located in the crime scene of Case PB 11-09-07764 was a 1999 Saturn,bearing an unassigned Florida tag of 654TXP. This was the vehicle stopped by Deputy Huerta fora traffic violation. Sgt. Irvin also advised a deputy had already responded to the registered vehicleowner's address of this Saturn, and the vehicle owner indicated that the car was sold. A deputyalso responded to the .registered Florida tag (654TXP) owner's address, and no contact wasmade. Sgt. Irvin did not have the vehicle owner's name immediately available. Sgt. Irvin alsoindicated that the vehicle was already searched by deputies on scene when the two additionaloccupants were detained and no firearm was found.Crime scene Detective Vila was done taking photos of the scene and the vehicle. The towcompany was on scene and the vehicle was ready to be towed to the impound lot. However, aninventory tow sheet was not yet completed. At approximately 3:25am, I assisted Deputy Diroccoand Deputy Huerta with performing a complete inventory of the vehicle contents prior to tow.During this inventory, I noticed that there were visible miscellaneous papers on the floor board ofthe front passenger vehicle of the Saturn.I attempted to locate a vehicle registration card. No registration card was located, but I did locatea Florida State vehicle certificate of title for the vehicle (Tit le# 75108852). Marcus Rozier's namewas signed and hand printed on the vehicle certificate of title. Rozier's name was located next tothe co-purchaser location (See Title) on this title. The signature for the purchaser location on thiscertificate was blank. Rozier's last FDLE Sexual Predator/Offender registration form, whichincluded Rozier's original thumb print with a date of 07/12/2011, was also located inside Rozier'svehicle. I took the certificate of title and the FDLE registration form as evidence. I also located aclosed camouflage pocket knife directly underneath the driver's seat of the vehicle where MarcusRozier was sitting. I pulled the seat forward and took a photo (3:27 am) of the knife prior toimpounding it as evidence. No other weapons or evidence was located by this investigator. Thevehicle tow sheet was completed and the vehicle was towed to the tow lot.Detective Kessling interviewed and obtained a sworn statement from Marcus Rozier's girlfriendZakia Newson. I was informed that Zakia Newson stated that Marcus and Zakia Newson movedinto the residence of 3036 NW 2nd Street, Apartment# 2, Pompano Beach, over a week ago.Detective Williams then directed us to respond to Rozier's residence along with two marked units.At approximately 4:55 am, Detective Kessling and I responded to Rozier's home address of 3036NW 2nd Street Apt 2, Pompano Beach, Florida 33069. I met with the residents (WillieNewson, Mary Terry, Tonya Terry, Deon Terry and Curtis Terry) and they all advised they movedinto the house on Tuesday, 09/20/2011 along with Marcus Rozier.Everyone was explained the current situation involving Marcus Rozier. They were advised thatRozier fled from a BSO Deputy Sheriff and he may have concealed a firearm he had in hispossession inside the house. Everyone was cooperative and indicated they had no problemscooperating with the investigation. Everyone also verbally consented to a search of the residence.All the residents of this home exited the home. The home was secured and no one was allowed toenter the home until Detective Williams obtained a search warrant for the home.Detective Kessling and I also interviewed each resident of this home on scene. During theinterviews of the residents I learned the following information:Willie Newson (Witness) and Mary Terry (Witness) have resided together as a family for overtwenty years and they both consider themselves as husband and wife. Zakia Newson (Witness)is Willie Newson and Mary Terry biological child. Deon Terry and Tonya Terry are Mary Terry'sbiological children and Willie Newson's step-children. Curtis Terry is Willie Newson and MaryTerry's nephew. Marcus Rozier is the boyfriend of Zakia Newson.I learned that everyone moved into the residence on Tuesday, September 20, 2011. WillieNewson and Mary Terry moved into the Southwest bedroom of the residence. Marcus Rozier andZakia Newson moved into the Northeast bedroom of the residence. Tonya Terry, Curtis Terry andDeon Terry all utilize the livingroom of the residence as their living space of the home. HoweverDeon Terry at times sleeps in Willie Newson and Mary Terry's bedroom.Willie Newson and Mary Terry both advised that they have known Rozier for about a month. Theyboth met Rozier when he began dating their daughter Zakia Newson. They were both shown aphoto of Rozier that was displayed on my computer. They both positively identified Marcus Rozieras the person who moved into the house with them on Tuesday 09/20/2011. Willie Newson andMary Terry both stated they went to bed Tuesday evening (09/27/2011). They both observedZakia Newson and Marcus Rozier in the house before they fell asleep for the evening.

    Later the next morning (Wednesday, 09/28/2011 ), soon after the traffic stop was conducted byDeputy Huerta, Mary Terry was awakened when Rozier entered her bedroom. Rozier opened therear door looked out, closed the door and walked out of the bedroom. Mary Terry stated she wasunsure at first if the man was Rozier. Mary Terry later confirmed the man who entered herbedroom was in fact Rozier, because she learned BSO took Rozier into custody moments later.Willie Newson did not observe Rozier enter the house after he went to sleep for the evening. MaryTerry further advised she did not know if Rozier was holding anything when she observed himinside her bedroom.Tonya Terry advised the following information: Tonya Terry is the step-daughter of Willie Newson,and the biological daughter of Mary Terry. Tonya Terry has known Marcus Rozier forapproximately three to four weeks. During that time period, Marcus Rozier has owned andoperated the above listed 1999 Saturn. Tonya Terry has also witnessed Marcus Rozier drivingand operating this vehicle. Tonya Terry was also shown a photo of Marcus Rozier and shepositively identified Rozier as the person who moved into the resident with her family on Tuesday09/20/2011. Tonya Terry confirmed that she sleeps in the living-room and Rozier and ZakiaNewson sleep in the East bedroom of the home.On Tuesday, 09/27/2011, around 10:00 pm, Tonya Terry observed both Marcus Rozier and hersister Zakia Newson leave the residence together. Tonya Terry indicated they drove off in Rozier'svehicle. A few hours later, the next day, Wednesday, 09/28/2011, Curtis Terry told her to walkdown the street with him, because Zakia called and advised she was afraid. Tonya Terry alsoclaimed she left the house with Curtis and did not observe Marcus Rozier at anytime during thisprocess as she walked with Curtis Terry to the scene (1 00 NW 30th Avenue).Tonya Terry advised she walked back home with Curtis Terry after learning that Zakia was notgoing to be arrested. Deputy Sheriffs' then greeted her at her residence. Tonya Terry advisedshe allowed the deputies to enter her residence and directed them to Marcus Rozier's bedroom.Tonya Terry stated she then witnessed Rozier acting like he was asleep on the bed he shares withher cousin Zakia Newson. Tonya Terry also witnessed Rozier being taken into custody by BSODeputies. Tonya Terry again claimed she did not see Rozier enter the house prior to him leavingyesterday (09/27/11) with her sister Zakia Newson. Tonya Terry also claimed she has notwitnessed Rozier in possession of a firearm during the time frame she has k n o w ~ him.

    Curtis Terry advised the following additional information: Curtis Terry advised that he is thenephew of Willie Newson and Mary Terry. Curtis Terry has known Marcus Rozier for about amonth. During this time frame, C ~ . : ~ r t i s Terry has not witnessed Marcus Rozier to be in possessionof a firearm. Curtis Terry indicated that Rozier has owned and operated the above 1999 Saturnsince he has known Rozier. Curtis Terry confirmed that Marcus Rozier moved into the residenceas a permanent resident on Tuesday, 09/20/2011. Curtis Terry also indicated that Marcus Rozierlives in a bedroom of the residence with his cousin Zakia Newson. Curtis Terry positivelyidentified Marcus Rozier by viewing a photograph of Rozier.On Tuesday, 09/27/2011, sometime during the late evening hours, Curtis Terry witnessed bothZakia Newson and Rozier leave the residence together. On Wednesday, 09/28/2011, while CurtisTerry was talking on his cell phone, he witnessed Rozier enter the house without Zakia Newson.Curtis Terry stated that Rozier was out of breath when he entered the home. Curtis Terry heardRozier say "They stopped us again!" Curtis Terry advised that Tonya Terry and Deon Terry werealso present and witnessed the same during this time period. Curtis Terry could not confirm if heobserved Rozier carrying a gun or a weapon when Rozier entered the residence. Soon afterRozier entered the house, Zakia Newson had called him and informed him that they were stoppedby the police and told him that she was afraid. Curtis Terry left Rozier in the house and walkeddown the street with Tonya Terry to check on Zakia Newson.Curtis Terry and Tonya Terry walked over to the scene located at 100 NW 30th Avenue, PompanoBeach. They learned that Zakia Newson was okay, so they both walked back home. At theirresidence, a BSO Deputy approached Curtis Terry and ask him if Marcus Rozier was inside thehouse. He informed the deputy that Marcus Rozier was inside the home. A few moments later,Curtis Terry observed Rozier being taken into custody.Willie Newson and Mary Terry also allowed us to speak with Deon Terry. Detective Kesslinginterviewed Deon Terry. I was informed that Deon Terry also confirmed that Marcus Rozierestablished permanent residency at the home on Tuesday, September 20, 2011. DetectiveKessling obtained a sworn statement from Deon Terry.Each resident witness of this home provided sworn statements. Everyone confirmed that MarcusRozier moved into the home with them on Tuesday, September 20, 2011. Each witness alsoadvised they did not know much about Rozier's criminal or personal past other than Rozier knewhow to cut hair.

    Deputy K. Bukata, Deputy Freiberger and Detective Kessling remained on scene with the housesecured. No one was allowed to enter the residence. Detective Kessling cleared the scene a fewhours later leaving Deputy Freiberger and Deputy K Bukata on each side of the residence.I responded back to the Broward Sheriff's Office Pompano Beach Station and debriefed DetectiveWilliams on the information provided by the witnesses. I also performed a records check ofRozier. I learned that Rozier was a convicted felon and he was also designated as a registeredSex Offender with FDLE. I also confirmed that Rozier had last registered with DHSM and theSheriff's Office as a transient with no current, temporary or permanent address on file.Rozier failed to update his information within the time period required by law and report his newaddress as required. It was also unknown if Rozier had concealed the firearm used to threatenDeputy Huerta inside his home residence when he fled the scene on foot.Detective Williams interviewed Rozier post Miranda. Rozier made some admissions about theincident and his sex offender status. Detective Williams documented his investigation under casePB11-09-07764.Rozier knows his obligation to register and update his information as a Sex Offender within fortyeight hours of any change. Rozier failed to update the Broward Sheriff's Office and DHSMV of hisstatus change within forty eight hours as per Florida State Statue. During this investigation, Iestablished probable cause to believe Rozier had violated the State of Florida Sex Offender laws.Rozier was add-charged with these additional crimes and this information was documented undercase PB 11-09-7798.My investigation revealed the following additional information:Marcus Joel Rozier was convicted for Lewd, Lascivious act on a child who was under sixteenyears of age on 09/19/2000, a violation of Florida State Statue 800.04. Rozier was incarceratedfrom 09/25/2000 to 03/01/2004.This conviction required Marcus Rozier to register as a sex offender. On 01/06/2006, MarcusRozier violated the Sex Offender Registration law (943.0435-9), and was found guilty underBroward County Court case 10117AF10. Rozier was state sentenced on 10/05/2007 for thisviolation and sentenced to two years and six months. Rozier received another copy of his notice ofresponsibilities to register this date. Rozier established a permanent residence in Broward Countyon Tuesday, 09/20/2011, and moved into 3026 NW 2nd Street Apt 2, Pompano Beach, Florida.Rozier moved into this residence with his girlfriend Zakia Newson (Witness) and Zakia Newson'sfamily members. Willie Newson (Witness), Tonya Terry (Witness), Deon Terry (Witness), CurtisTerry (Witness) all moved into the house the same date and reside in the house with MarcusRozier (Arrestee) and Zakia Newson (Witness). All the resident witnesses provided swornstatements indicating the same. Rozier's Florida Identification card indicated he was a transientresident of the City of Pompano Beach, and he has not updated his address since 11/01/2010 withDHSMV.Detective Williams later obtained a search warrant for the residence at 3036 NW 2"d Street, Apt 2,Pompano Beach. Sgt. Rubin, Detective Williams and I responded back to this location to searchthe residence for Rozier's weapon. Detective Williams executed the search warrant, read thewarrant to Willie Newson and handed him a copy of said search warrant prior to our entry. Iassisted with the search of the home. No firearm was located inside the residence. Whilesearching the East bedroom, several bags and document items with Marcus Rozier's name writtenon them along with Rozier's clothing were found inside this bedroom. This would confirm thatRozier established this home as his permanent residence. Detective Williams photographed theresidence, and took several items from the residence as evidence. The house was then cleared .Sgt. Rubin, Detective Williams and I then completed an additional search and canvass of the area(1 00 NW 30h Ave) where Deputy Huerta fired her duty weapon. No bullet holes were foundinside any vehicles. No one reported any shots fired and no body was located shot by a bullet inthe area. However, at 3:35 pm, Sgt. Rubin and I located a small round mark on a concrete wall.This mark was consistent with past patterns left on walls by bullets.This mark was located on the side of a yellow vacant home. This home is located at 2928 NW 2"dStreet, Pompano Beach, Florida. This residence was three houses away from where DeputyHuerta fired her duty weapon . The bullet pattern was located on the lower portion of theresidence, and it is believed that this is the ending location of the bullet fired by Deputy Huerta.     The yard was covered with bushy uncut grass and the actual lead from the bullet was not located.The house was also posted with a for sale sign. Detective Williams was also shown this location.Sgt. Rubin, Detective Williams and I also spoke to a few residents of the community. We did notlocate anyone who advised that they witnessed the actual incident early that morning.I down loaded the digital photos and digital media on a CD and provided a copy to DetectiveWilliams. All other evidence was placed into BSO property as evidence. I also requested from theFlorida Department of Corrections a certified copy of Marcus Rozier's Department of Correctionsrecords.On Thursday, 10/13/2011, I conducted an FDLE Sex Offender records checked and learned thatMarcus Rozier registered as a Sex Offender on the following dates : April 8, 2009, May 18, 2009,05/19/2009, July 13, 2009 as a Transient, July 16, 2009 as a Transient, January 11, 2010,October 01, 2010, 01/10/2011 as a Transient and July 12, 2011 as a Transient.Rozier signed the FDLE Sexual Predator/Offender registration forms. All These forms signed byMarcus Rozier included the information containing his responsibility to register. Rozier knew hewas to register twice a year with the jurisdiction he resides and his obligation to update hisinformation within forty eight hours of change with his permanent or temporary address. Rozier'slast registration form dated July 12, 2011 did not include any vehicle information or addressinformation, and he did not update his address after September 20, 2011. Failure to register isvehicle would also be a third felony violation .A DHSMV records check revealed that Rozier current Florida Driver's License is revoked. Rozierlast updated his Florida Identification card November 01, 2010 with DHSMV as a transientPompano Beach person. Rozier also provided a certification of address verification form with atransient address of ih Street and 3rd Avenue, Pompano Beach, Florida. Rozier's Certified Florida Department of Corrections documents also contained a Sexual Predator/Offender Registrationform signed by Rozier on 03/11/2009.The above information and Rozier last prison sentence proves that Rozier had knowledge that itwas a felony if he did not update his information with the local Sheriff's Office or DHSMV. The original certified Department of Correction documents were impounded into BSO property asevidence.

    Later this same date at approximately 3:45 pm, Detective Williams and I responded to 324 NW461h Street, Pompano Beach, and met with Barbara Harden (Witness). Barbara Harden is theregistered owner of the 1999 Saturn that was driven and operated by Rozier on Wednesday09/28/2011. Harden advised she has known Marcus Rozier for over fifteen years. Harden wasshown a photo of Rozier and she positively identified Rozier as the person she has known for overfifteen years. Harden further indicated that she sold Rozier the Saturn during the m_onth of March2011 for approximately $500.00 cash. Harden obtained the cash and then gave Rozier the vehicleand title. Rozier then left with the vehicle and title this same month (March 2011 ). All informationforwarded to the State Attorney's Office for final case review.

    On 09/28/11, at approximately 12:22am, Deputy Huerta was patrolling near the intersection ofAtlantic Boulevard and Powerline Road, in Pompano Beach, Florida, when she ran a license plate(654-TXP) that was attached to a four (4) door Saturn. The tag information revealed the tag wasunassigned to the Saturn. Deputy Huerta followed the Saturn and eventually conducted a trafficstop at 100 NW 30th Avenue. During the traffic stop, the driver, who was a black male, refused tocomply with Deputy Huerta's commands, which were to remain inside the vehicle and place hishands outside the window. As such, Deputy Huerta requested additional patrol units to respondwhile she remained by her vehicle. While Deputy Huerta was waiting for backup units to respond,the driver suddenly exited the Saturn and pointed at her an object she believed was a firearm.According to Deputy Huerta, at that moment, she feared for her life and fired a single round fromher service handgun, in an attempt to eliminate the threat. The round missed the driver whocontinued running northbound on NW 30th Avenue. Responding deputies established a perimeter;BSO K-9 and Aviation units subsequently responded to the area to assist with the search for thedriver. The K-9 unit tracked the driver a few blocks away from the traffic stop to a residence,3036 NW 2nd Street, Apartment 2. Afterwards, the driver was identified as Marcus Joel Rozier(07/16n7). Incidentally, at the time of the traffic stop, the Saturn was also occupied by Mr.Rozier's recent girlfriend, Zakia Mashon Newson (10/04/90), and his long time friend, Melvin LeeMitchell (09/18/88) . Ms. Newson occupied the front passenger seat and Mr. Mitchell the right sideof the backseat. Mr. Mitchell and Ms. Newson adhered to the same commands that were alsogiven to Mr. Rozier, during the initial traffic stop, according to Deputy Huerta's event report.

    On 09/28/11, at approximately 1:49am, a BSO Duty Officer called me and requested that Irespond to the 100 Block of NW 30th Avenue, in Pompano Beach, regarding a deputy-involvedshooting. I arrived at the scene at approximately 2:48am. The area was adequately illuminated bythe street lamps. I observed that the section near the beginning of NW 1st Street, on the southend, was cordoned off from west to east' with yellow crime scene tape.Just beyond the section of the crime scene tape, I observed a dark green and white patrol vehicleparked on the right side of the roadway, facing northbound. Beyond the patrol vehicle, I observeda faded tan color four (4) door Saturn parked on the right side of the roadway, also facingnorthbound. Yellow crime scene tape cordoned off the roadway, from west to east, on the northend of the roadway just beyond the Saturn.Shortly after arriving, I met with Sgt. T. Irvin/ CCN 7901 who provided me with the preceding factsregarding the shooting. Additionally, Sgt. Irvin advised me that a record's check for the suspect,Mr. Rozier, revealed he was a registered Sexual Offender. BSO Violent Crimes Unit assistingdetectives, J. Ramirez/ CCN11199 and J. Kessling/ CCN 10333, had also responded to the scene.BSO Internal Affairs Unit Detective Sgt. G. Molamphy/ CCN 9496 and Crime Scene Unit DetectiveI. Vila/6032 were at the scene.Deputy D. Dirocco/ CCN 12117 was standing next to her patrol vehicle just south of NW 1st Street, where the south end crime scene tape was suspended. She was maintaining a crime scene log.Deputy Dirocco advised me that Mr. Mitchell was being detained in back of her patrol vehicle. Shepointed to a patrol car located just east of our location and stated that Ms. Newson was beingdetained in back of it. Next, she pointed to another patrol vehicle, which was located just north ofthe crime scene and stated Mr. Rozier was being detained in back of it. At approximately 2:53am,I provided Deputy Dirocco my name and CCN number and entered the crime scene from its southend.At this time, I was approached by Crime Scene Detective Vila, who advised me that the crimescene consisted of Deputy Huerta's patrol vehicle, the Saturn, a spent shell casing, a hat, and apair of sandals. Detective Vila advised me that the shell casing was recovered near the left rearcorner of Deputy Huerta's vehicle; the hat was recovered west of the Saturn's driver door; and thepair of sandals were recovered on the west side of NW 30th Avenue, approximately one hundredeight (108) feet from the hat. Deputy Huerta stated she was okay. However,although she was calm, her overall demeanor appeared to be somewhat doleful.Moments after, I approached the Saturn and inspected its exterior for any indication of penetrationor strike marks caused by a projectile. I did not find anything of evidentiary value. At some point,Detective Ramirez approached and advised me that he was told earlier that the Saturn hadalready been search by deputies, prior to our arrival. Detective Ramirez, Deputy Dir9cco, andDeputy Huerta inventoried the Saturn for towing. Nevertheless, with Deputy Dirocco's assistance .I sealed the Saturn with red evidence tape (except for the passenger side front/rear windowswhich '+'ere broken); a tow truck was requested (Emerald Towing/ 4000 North Powerline Road,Deerfiela Beach, FL); and I placed a hold on it in the event a search warrant was required.Later that morning, we had discovered that the Saturn had been searched by Deputy C. Depelisi/CCN 15554, who checked underneath the front passenger seat and recovered a baggie thatcontained seven individually packaged smaller baggies of marijuana. Deputy Depelisi did notcharge anyone with the marijuana and he sent it to the Crime Laboratory marked for destruction.Please see Deputy Depelisi's Supplemental Event Reporl for details of this discovery.At approximately 3:50am, while on scene, the Saturn's front passenger, Ms. Newson, providedDetective Kessling with a sworn digitally recorded statement. Thereafter, Detective Kesslingconveyed the following information to me based on Ms. Newson's statement:

    Ms. Newson acknowledged riding earlier in the Saturn with Mr. Rozier, the driver, and Mr.Mitchell, the backseat passenger, when Deputy Huerta activated her lights and siren in anattempt to stop them. She stated that Mr. Rozier then told her that he did not want topullover, because he had warrants and did not want to go back to jail. When Mr. Rozierfinally stopped the Saturn, Ms . Newson advised they complied with Deputy Huerta'scommand to place their hands outside the w i n ~ o w s . However, at some point, Ms. Newson informed that Mr. Rozier refused to comply withDeputy Huerta's commands and opened the driver's door. Ms. Newson recalled Mr. Rozierholding his cell phone at which time she heard Deputy Huerta command him to put downthe object. She said Mr. Rozier did put down the cell phone, but then suddenly exited theSaturn, at which time she heard a gunshot. Ms. Newson advised Mr. Rozier rannorthbound from their location. She confirmed that Mr. Rozier and she were residing with

    At approximately 4:06am, the Saturn's backseat passenger, Mr. Mitchell, provided me with asworn digitally recorded statement, in which he stated the following:According to Mr. Mitchell, he had called Mr. Rozier around 12:04am, to pick him up anddrive him to his grandmother's residence, which is located at 2631 NW gth Street, inPompano Beach. Mr. Mitchell stated he was riding in the Saturn with the driver, Mr. Rozier,and front seat passenger, Ms. Newson. When they reached the 3000 Block of AtlanticBoulevard, Mr. Mitchell said Mr. Rozier advised them that Deputy Huerta was behind them.At that point, Mr. Mitchell said Mr. Rozier told them he was thinking about not stopping,because he did not want to go back to jail. Mr. Mitchell stated he pleaded with Mr. Rozier topullover and when he finally did, within the 100 Block of NW 30th Avenue, he said Mr.Rozier asked him to switch places with him, in an effort to confuse Deputy Huerta, as towhich male was actually driving the Saturn. Mr. Mitchell said he refused to switch placeswith Mr. Rozier and told him not to run. However, Mr. Mitchell stated Mr. Rozier refused tocomply with Deputy Huerta's commands to leave his hands outside the window. At onepoint, Mr. Mitchell saw Mr. Rozier in possession of his cell phone and recalled hearingDeputy Huerta telling him to drop it. He said Mr. Rozier complied, but exited the Saturnshortly after, at which time he heard a gunshot. Mr. Rozier ran northbound on NW 30 1hAvenue, according to Mr. Mitchell.

    At approximately 4:54am, Detectives Ramirez and Kessling responded to the 3036 residence,where Mr. Rozier had been residing and fled into earlier. Detectives Ramirez and Kessling hadgone there to assist with securing the residence, while I prepared to interview Mr. Rozier andobtained a search warrant. Detective Kessling informed me that prior to responding to the 3036residence, he had consulted with the K-9 unit and had retraced Mr. Rozier's path, in an effort torecover a firearm or any relevant evidence, but he did not recovery anything of evidentiary value.At approximately 5:15am, I entered the interviewing room and before I could seat myself, Mr.Rozier spontaneously asked, "Sex Offender questions ... sex offender questions", referring to thedirection of my anticipated questioning (video time: 12:47).     Mr. Rozier then stated that he was ready to return to prison, because at least in there he had abunk, but out here, he does not have anything. He added that he had been roaming all night andthat law enforGement would have caught him sooner or later. Mr. Rozier stated he did not careanymore about returning to prison because he was really tired. I asked him what he meant bybeing tired and he stated that he was tired of being out here, trying to survive; he said he had beenliving out of a locker in prison, but out here he had been living out of a bag. Therefore, if lawenforcement would have caught him, it would not have matter (video time: 4:40 thru 15:16).Moments after, Mr. Rozier asked what I had intended on asking .him and I told him I wanted todiscuss the incident that had occurred earlier. Rather than discussing the shooting incident, Mr.Rozier chose to mention the following regarding his Sex Offender status:

    He stated he was staying with a friend, David Role, down on Dixie Highway, but they toldhim he had to move, which he took very hard. Mr. Rozier said he found himself in parks,sometimes just to "wash off '. He mentioned added that he would make sure that kids werenot around. Mr. Rozier advised that he was grandfathered in on 16th Street (video time:19:24).Seconds after, Mr. Rozier spontaneously stated he does not live a life of robbing and never shot agun ... never shot a .22 (caliber) and only fistfight. At this point, I had not mentioned a gun or aspecific caliber. Mr. Rozier began weeping and said he loved cutting (hair), but did not makeenough money. He stated that "shit was crazy ... I feel better in jail. .. fuck that shit. .. I can't wait togo back to jail. .. I'm ready; give me a bunk" (video time: 24:52). Mr. Rozier said he rather beimprisoned and told me to go ahead and read them (Miranda) because he already knew them byheart (video time: 27:05 thru 27:06). After minutes of stalling, Mr. Rozier finally allowed me to readMiranda Warning, via BSO Form; he indicated he understood his rights and signed the form,agreeing to speak with me.Thereafter, I asked Mr. Rozier to tell me what occurred in reference to the shooting and herequested that I ask him specific questions about the incident, of which he would answer. I askedMr. Rozier if the Saturn was his and he stated, yes; his mother had purchased it for him. Hefurther explained that his mother was in the process of properly registering the Saturn. I asked Mr.Rozier for his mother's information and he told me she had moved to Georgia and was homeless(video time: 34:33 thru 35:00).

    Seconds after, Mr. Rozier stated "The cops came up saying I had a gun. I never had a gun inmy life .. never shot a gun" (video time: 36:14). I asked Mr. Rozier how he copes with life andhe said ,, can't cope with life now" (video time: 39:58 thru 40:00). Suddenly, Mr. Rozier stated"I had no money. I was being nice; my friend (Mr. Mitchell) called me to pick him up fo r aride to his grandma's house .. trying to help a bitch out and now I'm sitting . ./ was chillingwith my girl / just met .. I violated pretrial but tuck it". He started crying and stated he wasready to go to jail to get a bunk (video time: 40:41 ).Mr. Rozier also corroborated Mr. Mitchell's statement of them knowing each other for many years.He further corroborated Mr. Mitchell's statement that he received a call from Mr. Mitchellwho offered him ten dollars ($10.00) to pick him up. Mr. Rozier then advised that his sister,Toya (he later referred to as Tanika), gave him the tag which used to be attached to a ChevyLumina. He said he did not have any funds to register the Saturn (video time: 43:06 thru44:22).Seconds after, Mr. Rozier said he had only been staying with his girlfriend, Ms. Newson, fora couple of days and knew past seven (7) days he would have to check in with hisprobat ion officer. Mr. Rozier acknowledged that deputies had retrieved him from Ms.Newson's residence (video time: 45:02 thru 46:54).I asked Mr. Rozier to recount the route he had taken after he had retrieved Mr. Mitchell. Hestated that he had taken Atlantic Boulevard to return to home. Mr. Rozier reiterated that hewas only trying to help Mr. Mitchell. He stated that he was done talking because he had "noharmful" violations, just fear of going back to jail, due to pretrial status, which he wasscared would have violated/ revoked fo r a simple traffic ticket (video time: 50:36 thru 51 :28).He reiterated that he was only trying to get some money from Mitchell.At this point, I had ceased all questioning due to Mr. Rozier's statement of being "done talking";however, unsolicited he kept speaking and said the following:"I did not mean harm to anybody; she (Deputy Huerta) told me to stay still. I was trying tobe nice to Mel (Mr. Mitchell); now, my tucker-ass is in here .. aint got no gun .. where am Igoing to keep it. I was scared man because I didn't want a ticket to violate my pretrial(release)" (video time: 55:09 thru 55:56).

    Deputy Huerta subsequently charged Mr. Rozier with Aggravated Assault on a Police Officer,Elude Law Enforcement (Lights/ Siren Activated), Driving While License Suspended (Habitual),Fail To Register Vehicle, and Attached Registration License Plate Not Assigned; DetectiveRamirez charged him with Failure To Report Name or Residence Change By Sex Offender andFailure To Comply With Registration Law .BY Sex Offender. Please see Detective Ramirez'sInvestigative Action Report (PB11-09-098) and Deputy Huerta's Original Event Report for details.Also, please see the attached BSO Property Receipt which lists Deputy Huerta's handgunmake/model/serial number and three (3) magazines. Deputy Huerta had delivered her handgun tothe cri17Je lab for functionality testing and for matching the recovered casing to said handgun. Thehandgun was received at approximately 3:21pm and returned to Deputy Huerta at approximately3:50pm, on 09128111 (LAB #11-00021067).A complete records check revealed Mr. Rozier had an extensive criminal history which included atotal of twenty-six (26) felonies, eleven (11) of which were convictions, for Sex Offenses, Robbery,. Various Drug and Traffic Offenses.Based on the circumstance that the object Mr. Rozier pointed at Deputy Huerta may have been afirearm which had not been recovered at this time, coupled with Mr. Rozier fleeing into theresidence at 3036 NW 2"d Street, Apartment 2, there was reason to believe that he might havehidden the firearm inside the mentioned residence. As such, I drafted a search warrant for theresidence. The search warrant was faxed to and reviewed by Assistant State Attorney M. Horn.At approximately 2:25pm, I responded to the Broward County Central Courthouse, where theHonorable Judge Carlos Rebello signed the search warrant.At approximately 3:20pm, I responded to the 3036 residence and read the search warrant to Mr.Newson. I provided Mr. Newson with a copy of the search warrant and at approximately 3:28pm,Detective Ramirez, Detective Sgt. Rubin, and I entered Mr. Newson's apartment (2) to conduct asearch for any evidentiary material, relating to this shooting investigation and Detective Ramirez'scase (Sex Offender Charges). Mr. Newson's residence consisted of a small living room space,small kitchen, small bathroom and two (2) small bedrooms. Mr. Newson slept in the west bedroomand Mr. Rozier and Ms. Newson slept in the northeast bedroom. The search concluded atapproximately 4:05pm and the following items were recovered:

    Between 4:06pm and 4:29pm, I canvassed Northwest 30th Avenue, in an attempt to locate theprojectile that was fired by Deputy Huerta and any eyewitnesses to the shooting. Please see thefollowing:1. At 4:06pm-1 01 NW 30th Avenue-the property was enclosed by a large p e r i ~ e t e r wall andtwo (2) locked gates-later an adolescent black female returned home from school andstated that neither her family or she new anything about the shooting. I provided her withmy business card for her parents but no one called me back.2. At 4:14pm-2983 NW 19 Street-spoke with Renee Brown (B/F) 08/29/64; she resided inthe front unit and did not know anything. I also spoke with Rodney Wimble who resided inthe rear unit; he also heard/saw nothing.3. At 4:14pm-100 NW 3dh Avenue-spoke with Jeff Verde/us (15 YOA)-said he didnot hear/see anything. Later, his parents returned home and his father said heheard/saw Deputy Huerta commanding Mr. Rozier to show his hands and to stay inthe vehicle. Short ly after he said he saw Mr. Rozier exiting the vehicle and he heard a

    single shot, which proceeded by Mr. Rozier running northbound. I pleaded with themale to provide me with his name and a sworn statement, but he refused, citing fearof retaliation.4. At 4:25pm-180 NW 30th Avenue-no answer and I left my business card.5. At 4:31pm-2980 SW 1st Court-no answer and I left my business card. The next day, atapproximately 12:38pm, Yvonne Drayton called me back; she said she did not see anythingbut did hear a female cop's voice telling someone to get down and then she heard a singlegunshot. Ms. Drayton said she became afraid and hid underneath her bed.In the interim, Detective Ramirez and Sgt. Rubin were also canvassing Northwest 30th Avenue,just north of my location. Detective Ramirez had advised me that they did not observe anyvehicles with bullet holes or strike marks. However, Detective Ramirez directed me to a residenceat 2928 NW 2"d Street, where they had discovered what appeared to be a bullet strike mark on the

We never located a projectileand no one, to date, has reported a projectile penetrating or striking a house or vehicle.On 09/29/11, at approximately 7:25pm, I responded to Emerald TransportationfTowing at 4000North Powerline Road, in Deerfield Beach, Florida and removed the hold for the Saturn .Additionally, I removed the license plate from the Saturn.On 10/12111, at approximately 11 :45am, I verified that the tag (654-TXP) was assigned to a 1998Green four (4) door Oldsmobile that was registered to Delissia Tanikia Randell (8/F 05/09/83).Research for the Saturn verified that it was still registered to Barbara Burns Harden (W/F06/14/47). At 3:50pm, I responded to the Broward Clerk's office at the Central Courthouse and thesearch warrant and the return/inventory were recorded under court case #11-783SF10.On 10/13/11, at approximately 3:00pm, Detective Ramirez and I went to Ms. Randell's last knownaddress, 3931 NW 31st Avenue, Apartment 3, in Lauderdale Lakes. Our knocks wereunanswered; I left my business card and presented a neighbor (Apt. 4) with a photo of Ms.Randell. The neighbor stated she did not recognize Ms. Randell. Hours after, Stacy Burch calledmy office and left a message advising that she resided in Apartment 3. I called back Mrs. Burchand she stated she did not know Ms. Randell.At approximately 3:45pm, Detective Ramirez and I went to Ms. Harden's residence at 324 NW 46thStreet, in Pompano Beach. Ms. Harden told Detective Ramirez that she had known Mr. Rozier forover fifteen (15) years. Detective Ramirez presented her with a color photo of Mr. Rozier fromBSO PICS. Ms. Harden circled and signed the photo, identifying Mr. Rozier as the person she hadsold her Saturn to, in March of 2011, for five hundred dollars ($500.00). She added that once Mr.Rozier provided her with the last cash installment, she gave him the Saturn and its title. Ms.Harden provided Detective Ramirez with a sworn digitally recorded statement in which shereiterated her account.
